John Austin, Supervisor Gentlemen; As is our normal policy for winter operation we will discontinue the installation of water taps effective December 15th, 1973 and re- , sume the installation of water taps on or About April lst, 1974. In the event of an emergency during tb&A9p 't4& we will make taps with an additional charge to tbbb tapping fee to cover thhs1 additional cost due to frost and winter conditions. in recent weeks we have been advised of price increases and availabilty shortages in materials for 1974. .- . The price of cast iron pipe has been increased 10%. Ttw, price of copper tubing has increased 507, over our 1973 cost, and., the price of brass fittings has increased 25%. In addition we have been advised that any prices bid on materials for 1974 will not be fixed prices but prices at time of delivery. ond that the available allotment of copper and brass for 1974 has been reduced. The last revision of our t ping fees was ma0* in May ©f 1968. Since that time in addition to the above increased cost there has> been a yearly increase in labor cost. The meeting was called to order by Supervisor Austin, and upon roll being called, the following were PRESENT: John Austin, Supervisor Daniel Olson, Councilman Robert Barber, Councilman Harold Robillard, Councilman Gordon Streeter, Councilman ABSENT: None . The following resolution was offered by Mr. Streeter, who moved its adoption, seconded by Mr . Robillard, to wit: BOND RESOLUTION DATED NOVEMBER 29, 1973. A RESOLUTION AUTHORIZING THE CONSTRUCTION OF A WATER DISTRIBUTION SYSTEM TO SERVE THE SOUTH QUEENSBURY WATER DISTRICT NO. 2 IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $437 ,000.00 AND AUTHORIZING THE ISSUANCE OF $437,000.00 SERIAL BONDS OF SAID TOWN TO PAY THE COST THEREOF. WHEREAS , the Town Board of the Town of Queensbury, Warren County , New York, has duly established theSouth Queensbury Water District No. 2 in said Town pursuant to Article 12-A of the Town Law; and WHEREAS , it is now desired to provide for the financing of the cost of the construction of a water distribution system to serve said Water District, NOW, THEREFORE, BE IT RESOLVED by theTown Board of the Town of Queensbury, Warren County, New York, as follows : Section 1. The construction cF a water distribution system to serve the South Queensbury Water District No. 2 in the Town of Queensbury, Warren County, New York, including buildings , land or rights in land, original furnishings , equipment , machinery or ,apparatus required in connection therewith or incidental thereto , is hereby authorized at a maximum estimated cost of $437,000.00. Section 2. . The plan for the financing of such maximum estimated cost is by the issuance of $437,000.00 serial bonds of said Town hereby authorized to be issued therefor pursuant to the Local Finance Law. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years , pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further ,.� determined that the maximum maturity of the serial bonds herein authorized will exceed five years . Section 4. The faith and credit of said Town of Queens- bury, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such bonds as the same become du and payable . There shall annually be assessed upon all the taxable real property in said South Queensbury Water District No. 2 at the same time and in the same manner as other town charges , an amount sufficient to pay said principal and interest as the same become due and payable , but if not paid from such source , all the taxable real property within said Town shall be subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds . Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes , is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms , form and contents , and shall be sold in such manner, as may be prescribed by said Supervisor consistent with the provisions of the Local Finance Law. Section 6. The validity of such bonds or bond antici- pation notes authorized pursuant to this bond resolution, and the validity of any bond anticipation notes issued pursuant to the bond resolution adopted by the Town Board on December 14, 19722 may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is com- menced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 7. This resolution, which takes effect immedi- ately, shall be published :in full in the Glens Falls. Post Star aid Times and the Tri-County News , the official newspapers hereby designated for this purpose, together with a notice of the Town Clerk in 1. yC_ substantially the form provided .in Section 81.00 of the Local Finance Law. LlSection 8. The bond resolution adopted by the Town Board on December 14, 1972 entitled: "BOND RESOLUTION DATED DECEMBER 14, 1972. A RESOLUTION AUTHORIZING THE CONSTRUCTION OF IMPROVEMENTS TO SERVE THE SOUTH QUEENSBURY WATER DISTRICT NO. 2 IN THE TOWN OF QUEENSBURY, WARREN COUNTY , NEW YORK, AT A MAXIMUM ESTIMATED COST OF $380 ,000 AND AUTHORIZING THE ISSUAM E OF SERIAL BONDS NOT EXCEEDING $380 ,000 TO PAY THE COST THEREOF. ", is hereby superseded by the adoption of this bond resolution. The question of the adoption of the foregoing resolutio was duly put to a vote on roll call, which resulted as follows : Mr. Olson voting Aye I Mr. Barber voting Aye Mr. Robillard voting Aye Mr. Streeter voting Aye Mr. Austin voting Aye The resolution was thereupon declared duly adopted.
