1971-05-27 149 Regular Meeting May 27, 1971 Present: Gerald B. Solomon Supervisor Lloyd Demboski Councilman John D. Austin, Jr. Councilman Harold Robillard Councilman Hammond Robertson Councilman Harold Katz, Town Attorney, was not present. The meeting was called to order at 8:06 with a salute to the flag. Proof of publication was shown by the Clerk. The Ordinace was read by the Clerk. Councilman Austin explained that the ordinance would limit speeds to five miles an hour within 100 feet of shore, except in the case of boats towing water skiers on take-off or landing and would prohibit unauthorized anchorage within 100 feet of private _ property. John E. Sinnott, President of Kattskill Bay Association, who said he represented its 141 members urged the Town Board to do all in its powers to eliminate a hazardous situation. W. Joseph McPhillips of Glen Lake, who said that while problems there were not acute, the Glen Lake Association was in full accord with Lake George property owners. Severt other members of the audience voiced their approval of the ordinance, stating that the boat situa- tion is unbelievable and at times it is impossible to swim. No one opposed the ordinance. Councilman Austin explained that the ordin- ance requires prior written approval of the New York State Conserva- tion Department or an appropriate successor agency before it could be adopted. It was agreed that the new ordinance be sent to the Conservation Commission for its approval. The hearing was closed at 8:32 P.M. RESOLTUION No. 113, introduced by Mr. Austin, who moved- its adoption, seconded by Mr. Robertson. WHEREAS, the Town Board of the Town of Queensbury deems it necessary to revise their Ordinance No. 2 entitled ORDINANCE REGULATING THE OPERATION OF MOTOR BOATS IN. THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, and WHEREAS, this Ordinance should have the approval of the Conservation Commission, therefore be it, RESOLVED, that a copy of the proposed Ordinance be sent to the Con- servation Commission for its approval before final adoption by the Town Board, Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes: None 150 RESOLUTION TO AUTHORIZE TEMPORARY PERMIT FOR MOBILE HOME RESOLUTION ado. 114, introduced by Mr. Austin, seconded by Mr. Robertson. WHEREAS, Erwin R. Bardin of R.D. 1, Glens Falls, New York has made application in accordance -with paragraph 2 (b) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated East Sunnyside Road, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to authorize the issuance of the permit requested by said application, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, temporary permission is hereby given to Erwin R. Bardin of R.D. 1, Glens Falls, New York, to locate a mobile home outside of a licensed mobile home court for a period of one year at pro- perty situated at East Sunnyside Road, Town of Queensbury, and that the Town Clerk is hereby authorized and directed to issue such permit in accordance with the terms and conditions of said ordinance. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robertson and Mr. Solomon Noes: Mr. Robillard RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY RESOLUTION No. 115, introduced by Mr. Robillard, seconed by Mr. Demboski. WHEREAS, John Francis Connors of 10515 Saratoga Road, South Glens Falls, New York, has made application. to this Board for a permit to locate a Mobile Home as property situated at Lot 780 and 781 Michigan Avenue, Town of Queensbury, New York, and owned by Asunta Forte, and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the Ordinance Regula- tions relating to Mobile Homes in the Town of Queensbury, therefore be it RESOLVED, that there was not hardship shown on the original appli- cation, therefore be it further RESOLVED, that the application of John Francis Connors be and is hereby disapproved and that the Town Clerk is hereby directed to notify John Francis Connors of the decision of this Board. WHEREAS, Mrs. Patricia Lewis of Ogden Road, R.D. #2, Glens Falls, New York has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOW OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Lots 9 and 11 on Leo Street, R.D. #3, Glens Falls, New York, and 183 WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on June 10th, 1971, at 8:00 P.M. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hear- ing in accordance with the provisions of said ordinance. -- Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon. WHEREAS, Thelma Mitchell Kranzmann, Luzerne Road, Glens Falls, New York, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at pro- perty situated Luzerne Road, Town of Queensbury, New York, and WHEREAS, it is hereby detemmned that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by `i this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on June 10th, 1971, at 8:00 P.M. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said- ordinance. PA4 E 1b3 RESOLUTION No. 119 to set a public hearing on June 10, 1971 on the application of Chris Drellos to rezone from an R-3 to an M-1 property situated on the north side of Luzerne Road in order to allow him to manufacture septic tanks- is not available at this time but with be forth coming from Attorney Harold Katz. scc PA&-E !b3 In reviewing the Broughton application for rezoning on which the Planning Board recommended approval except for a 300-foot setback along Ridge Road, the application was tabled to allow for further discussion with the corporation. RESOLUTION TO ACCEPT AMENDED BID FROM BROWN BROTHERS ON SIGNAL LIGHT RESOLUTION No. 120, introduced by Mr. Robillard, who moved its adoption, seconded by Mr. Robertson. WHEREAS, the Highway Superintendent had requested bids on the in- stallation of traffic lights on the Aviation Road in front of the Firehouse and WHEREAS, the installation of the lights was put up for bid by the Town of Queensbury and WHEREAS, one bid was "received from Brown Brothers on April 29, 1971, at a cost of $3,200 and WHEREAS, this bid was amended to read $2,800 by a letter from Brown Brothers on May 24, 1971, because the signal light is already owned by the Town, therefore be it _ RESOLVED, that the Town of Queensbury enter into a contract with Brown Brothers for the installation of traffic lights on Aviation Road at a cost of $2,800. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon Noes: None RESOLUTION TO AMEND APPROPRIATION RESOLUTION No. 121, introduced by Mr. Robertson, who moved its adoption, seconded by Mr. Demboski. WHEREAS, the Highway Department received payment from the General Fund A8160 for labor and contractural expense at the refuse area in the amount of $4,778.87, and WHEREAS, the sum of $4,333.96 was for personal services and was charged as an expense out of Item IV DS5142.1, therefore be it RESOLVED, that the sum of $4,333.96 be appropriated to Item IV DS 5142.1 thereby increasing the appropriation from $48,000.00 to $52,333.96. WHEREAS, the following applicant has made application to the Town Board of the Town of Queensbury for the renewal of his junk yard license for the year 1971, and said application has been accom- panied by the proper fee of $25.00 in accordance with- the Queens- bury Junk Yard License Ordinance as adopted on June 9, 1966. NAME ADDRESS West Side Auto Supply, Inc. Corinth Road, Glens Falls, N.Y. WHEREAS, the applicant has agreed to comply with all the provisions of said ordinance, subject to certain conditions therefore be it RESOLVED, that the renewal of the Junk Yard License of the above listed applicant for the calendar year 1971, be and the same is hereby approved, and be it further RESOLVED, that the Supervisor is hereby authorized and directed to issue said renewal license and deposit the fee in the General Fund of the Town. RESOLUTION AUTHORIZING COMMUNITY PARTICIPATION IN COMPREHENSIVE PLANNING ASSISTANCE PROGRAM WHEREAS, the Town of Queensbury, in order to provide for a planning study contributing to an overall program for its future community development, desires to participate in the Federal-State Comprehen- sive Planning Assistance Program as authorized by Section 701 of the Housing Act of 1954, as amended, and Article 26 of the New York State Executive Law, and WHEREAS, the New York State Office of Planning Services, under authority of Article 26 of the New York State Executive Law, is the official State planning agency designated to administer Federal and State funds under the provisions of Section 701 of the Housing Act of 1954, as- amended, now therefore, be it RESOLVED, that the Town Board of the Town of Queensbury hereby re- quests the New York State Office of Planning Services to provide planning assistance under authority of Article 26 of the New York - State Executive Law, with such financial assistance as may be pro- vided by the United States Department of Housing and Urban Develop- ment, under authority of Section 701 of the Housing Act of 1954, as amended. Such planning assistance is more particularly described in the attached project application. RESOLVED, that if the aforesaid application is approved and accepted by both the Director of the New York State Office of Planning Services and the Department of Housing and Urban Development, the Town of Queensbury shall enter into a formal agreement with the New York State Office of Planning Services to undertake the project described in the approved application and to pay to the State of New York its share of the estimated total cost of the said project, together with such other terms and conditions as may be deemed necessary and ap- propriate to carry out the said project. RESOLVED, that the Town of Queensbury hereby agrees to have avail- able , in the year the project is to be completed, the sum of thirteen hundred & seven dollars ($1307.00) , or so much thereof ai may be necessary to contribute a sum not to exceed thirteen per centum (13%) of the total cost of said project, to be paid to the State of New York, on condition that the above- mentioned application is approved by both the Department of Housing and Urban Development and the Director of the New York State Office of Plan- ning Services. RESOLVED, that the Town of Queensbury shall assume the costs of operating and maintahing its own planning board or commission in- cluding such services as clerical personnel, office space, equip- - merit, materials, communication and travel, as such costs cannot be charged to the Comprehensive Planning Assistance Program. RESOLVED, that it is understood that current planning services may not be charged to the Comprehensive Planning Assistance Pro- gram. RESOLVED, that the Supervisor of the Town of Queensbury be and hereby is authorized and empowered to execute in the name of the Town of Queensbury all necessary applications, contracts and agree- ments to implement and carry out the purposes specified in this resolution. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes: None. The meeting was opened to the public. No one wished to speak. The meeting was closed to the public. Councilman Austin explained that letters will go out soon to Town of Queensbury residents reminding them that the town high- way right-of-way does not necessarily conincide with the edge of the pavement or roadway. The practice of maintaining lawns and sometimes of placing shrubbery or other home improvements on the right-of-way has caused problems for the highway and water departments. The intent of the letters is to prevent misunder- standings in cases where necessary snow plowing or other town operations have disturbed lawns and fences that are in fact on town property. Supervisor Solomon announced that he will meet with the Recreation Commission Tuesday evening at the Gurney Lane park to review summer plans. Councilman Robillard announced that the Town of Queensbury will observe Memorial Day Monday with a parade forming at Queensbury High School and exercises in Pine View Cemetery. The program is sponsored by Queensbury Posts of Veteransof Foreign Wars and American Legion. On motion the meeting was adjourned. Respectfully submitted, Donald A.
