Katz Town Attorney The meeting was called to order at 8 :00 p.m. Supervisor Solomon greeted the following visitors: Mr. & Mrs. M. VanDusen - Visitor Mr. Eugene Lucia - Visitor Mr. & Mrs. Gerald Harrington - Visitor Mr. & Mrs. Sterling Akins - Visitor John Beaudette - Visitor James Drexel - Visitor Pliney Tucker - Visitor William Richardson - Visitor John Austin, Jr. - Radio Station WWSC Herbert -Corlew - Deputy Highway Superintendent Florenca Mcllvaine - Reporter, The Post Star Juliette Ellingsworth - League of Women Voters Edward Waters - Visitor Allen Dufour - Visitor Harold Rathbun - Visitor The public hearing was declared open by Supervisor Solomon on the application of Mary E. Hill for a permit to locate a Mobile Home on Twin Channel Road, Town of Queensbury. Proof of publication was presented and read aloud by -the clerk. Supervisor Solomon requested a voice from any person present in favor of or in opposition to the granting of the permit. . Mr. Mel. VanDusen was granted the floor. Mr. VanDusen stated that the proposed location of the mobile home in question would be to near to his home on Twin Channel Road. Mr. VanDusen stated that the size of the lot where mobile home would be located was mis- represented on the application as received. With no further testimony being made the public hearing was closed at 8:08 p.m. Mrs. Mary E. Hill visited the meeting at this time. Following a request from the Supervisor, that Mrs. Hill be allowed to speak on the mobile home application, she didnot want to do so. Harder 23 NOTICE OF PUBLIC HEARING Please take notice that the Hudson River Valley Commission, pursuant to the authority vested in it by Chapter 345 of the Laws of 1966, will hold a public hearing at 8P.M, on September 30, 1968 in the Queensbury Town Office Building, Bay at Haviland Road, Town of Queensbury, New York, on the proposed project of the Town of Queensbury concerning partial use of a sixty-eight acre lot as a sanitary landfill operation in the Town of Queensbury, Warren County, on the northerly bank of the Hudson River. Y. Attention: Queensbury Town Board Dear Sirs: Since the peace and tranquility known to this community was recently disrupted and has become rather "heated" with the placement of another Mobile Home on the Bay Road; I, therefore, at the request of some of my long standing neighbors, and as a Community Service, instigated and circulated the accompanying petition to find out the feelings and desires of the families actually residing in the area within the boundaries of the accompying petition, that the Board may be advised of the feelings of the residents. First, let it be known that in the circulation of this petition, it was mentioned a number of times that the Mobile Homes (3) that were placed previous to Zoning restrictions in the area, that either the property owners or the Mobile Home Resident, did make an effort to place the Mobile Home as unobtrusively as possible and not one of the petitioners seemed to object to these particular Mobile Homes. The latest Mobile Home, however, has been placed without consideration of the design of the Mobile Home nor of the surrounding terrain. It is large and of high design, placed out in the open, on a higher elevation - than the road and with no effort of shielding from view. Secondly, let it be known that Non-Resident property Owners (4) in this particular area were not contacted nor are their views known. Thirdly, let it be known that since it has been stated in the news media that Bay Road, being near the center of the town, is expected to become the main Highway of the Town, also taking into consideration, the said area in the petition is beginning to develop mainly as a residential ,area, and especially since the Zoning Ordinance now in effect in said Area, makes no provisions for Mobile Homes, it is the petitioners belief and desires tilat toe best Laterest of both the Community and 2 the Town as a whole, that now is the time to guard against the influx of more Mobile Homes in said Area. I therefore, wish to present this letter with the accompanying petition as a whole before the Board for due consideration, keeping in mind the desires of the majority of the residents within the said area of the petition and respectfully request, effective this date, September 26, 1968, no further permits be issued for the in- stallation or placement of any more Mobile Homes in said area. _ Respectfully yours, Eugene J. Lucia PETITION August 13, 1968 TO: QUEENSBURY TOWN BOARD Queensbury Office Bldg. Bay Road, Glens Falls, N. Y. We the undersigned, property owners of the Town of Queensbury, residing on the Bay Road within the area from the Farm-To-Market Road North to Dunham' s Bay and on the Pickle Hill Road between the said Bay Road and Ridge Road in the said Town, do hereby petition the Queensbury Town Board as follows: That whereas the Zoning Code adopted for the Town of Queensbury did restrict the afore said area without provision for the in- stallation of a Mobile Home or Homes, and That whereas there has recently been one. or more Mobile Homes installed in the afore said area. Now, therefore; your petitioners do hereby respectfully request the afore said Queensbury Town Board to refuse to grant any further permits for Mobile Home Locations and/or Mobile Home, Trailer Park, a Trailer Court or Sites within the afore said area. The Petition was signed by 30 residents of the area on Bay Road. WARREN COUNTY AIRPORT RD #1 Glens Falls, New York John 0. Webster, Manager September 26, 1968 Queensbury Town Board Town Office Building, R.F.D. #1 Glens Falls, New York Gentlemen: Just a brief note to express our appreciation here at Warren County Airport for the numerous acts of municipal cooperation extended to us by the several departments of the Town of Queensbury. Without going into specifics, the Queensbury Highway, Water, and Police Departments have all been most cooperative on several occasions, and in several different ways. I want you to know that this assistance has been most appreciated. And may I particularly mention the marigold plantings provided by the town under the auspices of the Queensbury Committee for Community Beautification. Dick VanDusen did an excellent job with these and they have been blooming all summer and are still going strong. We have received many favorable comments about the appearance of the airport this year and Queensbury' s contribution r has played an important part in this effort. Very truly yours John 0. Webster Manager 25 Supervisor Solomon announced that the maps as proposed by the New York State Department of Transportation to do with the widening and re-aligning of Rout #9 and Aviation Road are on file in his office. Any interested resident was invited .to view the maps at any time during office hours. The Zoning and Building Inspector' s report for the month was received and placed on file. The soil conservation study as proposed by the Federal Agency was presented at this time. RESOLUTION NO. 200, Introduced by Mr. Robertson, seconded by Mr. Robillard WHEREAS their has been submitted a "Memorandum of Understanding" to do with the finding of the Warren County Soil and Water Conservation District, and WHEREAS THE Queensbury Town Board has discussed this memorandum in private session, therefore be it RESOLVED, that the "Memorandum of Understanding" of the Warren County Soil and Water Conservation District is hereby accepted and it is agreed and understood that the Town of Queensbury will observe the principles of sound soil and water conservation as presented by the District. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Turner, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes - None RESOLUTION TO AUTHORIZE TRANSFER OF FUNDS RESOLUTION NO. 201, Introduced by Mr. Turner, seconded by Mr. Dombroski. RESOLVED, that the Supervisor is hereby authorized and directed to transfer the sum of $10,000. from the Queensbury Water District Account to the General Fund, said amount to be re"-'paid to the Queensbury Water District as soon as such money is needed, and in any event prior to December 31, 1968. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Turner, Mr. Robillard, Mr. Robertson and Mr. Soloman. Noes - None RESOLUTION TO NAME ELECTION INSPECTOR RESOLUTION NO. 202, Introduced by Mr. Robertson, seconded by Mr. Demboski WHEREAS, Mr. John L. Bowman, Chairman of the Queensbury Republican Committee, did appoint Charlotte Codner as election inspector for District #9 of the Town of Queensbury, and WHEREAS, Charlotte Codner will not be able to serve at the Registration Days, October 3,4, and 5th, thereofre be it RESOLVED, that Mrs. Elizabeth Doner, West Mountain Road, Town of Queensbury, New York be appointed as election inspector for District#9 to serve for the Registration Days of October 3,4, and 5th. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Turner, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes - None 28 RESOLUTION NO. 203 INTRODUCED BY MR. Robillard, who moved its adoption SECONDED BY MR. Turner. RESOLUTION DIRECTING PROSECUTION OF ACTION ON BEHALF OF TOWN WHEREAS, it appears that the signs erected on the stores occupied by the Zayre Department Store and Saveway Markets are in violation of the provisions of the Zoning Ordinance of the Town of Queensbury, and WHEREAS, it is the desire of the Town Board to obtain compliance with said ordinance and to seek an abatement of the aforesaid violations, it is RESOLVED, that the Supervisor of the Town be and he hereby is authorized and empowered to retain counsel in the matter upon such terms as he deems proper and advisable and he shall authorize such counsel on behalf of such Town to take such action as may be deemed advisable to bring about a speedy abatement of said violations of the Zoning Ordinance. Duly adopted this 26th day of September, 1968 by the following vote: AYES: Mr. Demboski, Mr. Turner, Mr. Robillard, Mr. Robertson and Mr. Solomon. NOES: None i 1 Mr. Sterling Akins was granted the floor. Mr. Akins questioned the fact that the Public Hearing of the Hudson River -Valley Commission to be held on September 30, 1968, was arranged to be held at the Town Office Building, rather than larger quarters. Supervisor Solomon stated that Mr. Harder of the Hudson River Valley Commission requested that the meeting be held at the Queensbury Town Office Building. Mr. Pliney Tucker was granted the floor. Mr. Tucker questioned the fact, that if the proposed landfill operation on the .Corinth Road is objected toby the Hudson River Valley Commission, would the proposed road layed out to reach the landfill, be opened for all traffic. Mr. All DuFour, Chief of South Queensbury Fire Company requested a re-location of a fire hydrant on Green Street. Mr. DuFour also discussed the repaving of Queensbury Avenue. RESOLUTION NO. 204, Introduced by Mr. Robertson, seconded by Mr. Turner. WHEREAS, the Town Board has been advised by the Highway Superintendent of the need for (5) tailgate hydraulic spreaders used by said department due to the age and condition of the presnet units, now therefore be it RESOLVED, that the Town Board invite sealed proposals for the furnishing of said spreaders and that such sealed proposals shall be received and considered publicly at a meeting of the Town Board to be held at the Town Hall in said Town on the 10th day of October, 1968 at 8,:00 o'clock in the evening of that day and that notice of such invitation for bids shall be duly published by the Town Clerk as required by law, and it is further RESOLVED, that the specifications shall be publicly exhibited in the office of the Town Clerk and Highway Superintendent on Aviation Road between the date of the first publication of the notice and the date herein specified for the feceiving of such sealed proposals. Duly adopted this 26th day of September, 1968, by the following vote: Ayes - Mr. Demboski, Mr. Turner, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes - None RESOLUTION NO. 205, Introduced by Mr. Solomon, seconded by Mr. Robillard. WHEREAS, the Town Board has been advised by the Highway Superintendent of the need for certain tools and equipment to maintain the equipment used by his department and that said department does not now have such tools and equipment, note therefore be it RESOLVED, that the Town Board invite sealed proposals for the furnishing of said tools and equipment and that such sealed proposals shallbe received and considered publicly at a meeting of the Town Board to be held at the Town Hall in said Town on the 10th day of October, 1968 at 8:00 o'clock in the evening of that day and that notice of such invitation for bids shall be duly published by the Town Clerk as required by law, and it is further RESOLVED, that the specifications for such tools and equipment shall be publicly exhibited in the office of the Town Clerk kn&Highway Superintendent- on Aviation-'Road "between the date of the first publication of the notice and the date herein specified for the receiving of such sealed proposals. S, the Town Board has been advised by the Highway Superintendent a need for the replacement of 3 Motor Trucks used by said department due to the age and condition of the present trucks, now therefore be it RESOLVED, that the Town Board invite sealed proposals for the furnishing of said trucks and that such sealed proposals shall be received at a meeting of the Town Board to be held at the Town Hall in said Town on the 10th day of October, 1968 at 8:00 o'clock in the evening of that day and that notice of such invitation for bids shall be duly published by the Town Clerk as required by law, and it is further RESOLVED, that the specifications shall be publicly exhibited in the office of the Town Clerk and the Highway Superintendent, Aviation Road between the date of the first publication of the notice and the date herein specified for the receiving of such sealed proposals. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Turner, Mr. Robillard, Mr. Robertson and Mr. Solomon Noes - None 28 Councilman Robertn discussed the proposed inter-municipal sewer study being conducted by (7) local municipalities . The total cost of the study was discussed. Councilman Robertson has made an agreement that the Town of Queensbury will pay 30% of total cost. RESOLUTION NO. 207, Introduced by Mr. Robertson, seconded by Mr. Turner. WHEREAS, Councilman Hammond Robertson, Jr. , has been in attendance with the group who are making an agreement with the engineers being hired by the Hudson River Bend Area, and WHEREAS the firm of Metcalf and Eddy have been designated to conduct this study, and WHEREAS the Town Board of the Town of Queensbury have agreed to the assessment of 30% of the cost of the study, therefore be it RESOLVED that, the Supervisor of the Town of Queensbury be directed to pay the necessary amount of $5,600.00 to the proper representative as the Town of Queensbury share of the total costs.
