The reading of the notice was dispensed with at this time. The Clerk summarized the original application as same was received. Following the public hearing the town board in its entirety voiced the opinion that the permit for Raymond and Rosemary Potter would be granted. 16S The public hearing was declared open at 7:43 p. m. , on the application of Mr. and Mrs. Theodore McClouth for a permit to locate a Mobile Home outside of a duly licensed Mobile Home Court. Proof of publication was presented by the Clerk. The reading of the notice was dispensed with at this time. The Clerk summarized the original application as same was received. Superintendent of Highways., Bernard J. Codner noted that the proposed location of the Mobile Home is not on a town highway. The following persons appeared in opposition to the granting bf the permit. None The following persons appeared in favor of granting of the permit. Mr. and Mrs. Theodore McClouth. Supervisor Webster again discussed the fact that the- town has-not accepted the highway into the Town Highway system. - The public hearing was declared closed at 7:55 p. m. The minutes of the meetings of August 19th and- 26th were approved by the Town Board at this time. Water Tap Fees Received Queensbury $100.00 West Glens Falls $50.00 Total amount of fees turned over to Supervisor $150.00 Work Completed Queensbury District Glen Street 667 Glen Street - Broken 3/4" galvanized line, caused by electrolysis. Repaired by owner. 688 Glen Street - Broken 3/4" galvanized service, line, caused by age • and electrolysis. Repaired by this department. C 675 Glen Street - At this location there were two broken 3/4" service lines. Again this was caused by age and electrolysis. Some difficulty was encountered as these lines were abandoned and there were no records of their locations. Repairs were made by this department. West Fountain Road. The old. 6" line which connects both tanks and feeds the County Infirmary wag located and staked out for the County Highway Department. Also all the gate valves were lowered to prevent damage during construction. These will be raised when a finished grade is established. Patton Drive- Investigatkdaa complaint of excessive pressure at the ,Lemery residence. This complaint was received once before and this party was advised to install a pressure reducing valve. This advise was again offered. Glenwood Ave.- The water meter at DeLongs Restaurant was found to be inoperative and repairs were made by this department. The curb box at the residence of Mr. Wescot was repaired and brought to grade. Other Work Completed. - .Service Boxes Repaired 4 Permit for tap outside district 1 West Glens Falls District. Lynda Avenue. - Installed one 6" tapping valve and sleeve and laid 126+- feet of 6'•' CZ main. Miin Street Repaired the fire hydrant at the Richardson Street intersection, which was damaged by a car several months ago. At this time heavier guard post were installed. Izerne Road Investigated the complaint of Mr. C. Lynch concerning inadequate water service and a report was made to the Board. 170 Other Work Inspected and certified two private wells. One at the Varney residence, Main Street and one at.the Faint residence, Caroline Street. Department August 31, 1965 Law To: John 0. Webster, Supervisor Re: Mobile Home Ordinance Charles J. Astrowski Yours Town Board adopted a mobile home ordinance which, among other things, provides that after the effective date of the ordinance no mobile home shall be placed in the Town of Queensbury outside of a licensed mobile home court unless the Town Board, after a public hearing, shall grant permission by reason of hard- . ship or extenuating circumstances. I know from my own observation that Mr. Astrowski had had a mobile home for several years on his property on Assembly. Point. As I understand the facts, Mr. Astrowski did not register his mobile home with ,the Town Clerk as the ordinance requires and that, at the suggestion of your Building_ Inspector, he then made. an application for a permit and, following your procedure, the .- Town Board held a public hearing on his application, Some oppo- sition was registered at the public hearing, principally by Mr. Klein, and .up to this time your Town Board has taken no action. The purpose of requiring registration-of mobile homes immediately after the adoption of the ordinance was to furnish the Town Board with an accurate record of the existing mobile homes which could not be affected by the ordinance. ,Since no registration fee was required, there could be no other purpose for registrat-im. This is borne out by the requirement for registration within thirty days. Section 133 of the Town Law requires an ordinance to bye'-._, published once in the official newspaper and posted on the Town Clerk's bulletin board. Mr. Astrowski lives in Schenectady.and: is at Assembly Point a feq weeks in the summer. According to him, he had no actual knowledge of the adoption of the .ordinance and this _ is the reason why.he failed to register his mobile home within the thirty day period. I see no reason why Mr. Astrowski or any other person in the Town of Queensbury who had no actual knowledge of the ordinance should not be permitted to register after the thirty day period. 17- (Re: Mobile Home Ordinance - Charles J. Astrowski- Continued) _:Of course, if any person who had a mocile home on his property on the effective date of the ordinance should now want to replace it with a different mobile home, under the terms of the ordinance, he would have to apply for a permit. When -the matter was first referred -to me, I thought Mr. Astrowski might be changing the mobile home, which would require a permit. I asked him if it were the same mobile home he has had on his property for years and he assures me that it is the same one. I know that if looks like the same one I have seen there for years. Under the circumstances, it is my opinion that Mr. Astrowski is entitled to maintain this same mobile home on his property without a permit. I think he should register it so you will have a record of it and be able to determine whether the mobile home on his property is the same one. If your -Town Board is satisfied that the mobile home nom on the Astrowski property is the same one which was there prior to the adoption of the ordinance, I suggest the Town Board adopt a resolution reciting the facts, approving the registration and dismissing the application for a permit. Albert E. Beswick County Attorney RESOLUTION NO. 200, Mr. Robertson introduced the following resolution and moved its adoption, seconded by Mr. Lampson. WHEREAS, this Town Board on July 23, 1964, adopted an ordinance for the regulation of mobile homes and mobile home courts in the Town of Queensbury which became effective ten days after its publication and posting, and which ordinance, among other things, required the owners of mobile homes located outside of mobile home courts on the effective date of the ordinance to register such mobile homes with the Town Clerk within thirty days and provided that the ordinance should not apply to such mobile homes, and WHEREAS, it appears that Charles J. Astrowski- has had a mobile y home on his property at Assembly Point for several years prior to the adoption of the ordinance and that such mobile home was on his property on the effective date of the ordinance..but that he failed to register his mobile home with the Town Clerk within thirty days for the reason that he- had no actual knowledge-of the ordinance and that upon being adilsed by the%Building Inspector of the ordinance, he thereupon made application for a permit under the ordinance, and WHEREAS, the purpose of the requirement for the registration of mobile homes which were located outside of mobile- home courts on the effective date of the ordinance was, to provide an accurate record of the mobile homes not affected by the ordinance and no fee was required for registration and no penalty is provided for failure to register, be it RESOLVED that it be and hereby is determined that Charles J. Astrowski had on his -property at Assembly Point on the effective date of the mobile home ordinance a mobile home which s. still on the property, and be it further RESOLVED that the Town Clerk be and he hereby is authorized and directed to accept from Charles J. Astrowski a registration of his said mobile home, and be it further 172 (Resolution No. 200 - continued) RESOLVED that it be and hereby is determined that, under the circumstances, Charles J. Astrows1i is not required to obtain a permit from the Town Board for such ,mobile home and that the application of Charles J. AstroWski for such permit now pending before this Town Board be and the same hereby is dismissed. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster. Noes - None A public hearing was declared open by Supervisor Webster on the matter of a proposed ORDINANCE TO REGULATE AND LICENSE PEDDLERS in the Town of Queensbury at 8:00 p.m. - Proof of publication was presented by the clerk. Reading of the notice was dispensed with at this time. Supervisor-Webster discussed the basis for drawing up the proposed ordinance The clerk read the .ordinance in its entirety. Supervisor Webster welcomed comments from any persons in opposition. Mrs. Marjorie Adgate spo$e orb, the possible effect on a usineas's which she conducts within the town. Councilman Lampson expressed the opinion that the fee which is being considered is excessive. Supervisor Webster welcomed comments from any persons in favor of the ordinance as follows: _ Mrs. Clyde Swift Mrs. Theodore Bauckman Mr. James Dempsey voiced am opinion that the objection of Mrs Adgate should be considered and that the registration fee should be reduced. The public hearing was declared closed at 8:55 p. m. The following representatives of the Town of Queensbury Planning_ ,; Board accompanied by the consultant on the 701 Program were greeted by the Town Board at this time. George Kushner - Chairman, Planning Board J. Arthur Norton - Secretary, Planning Board Paul Cushing - Member, Planning Board Robert Kirkpatrick - Member, Planning Board William Sorrentino - Planning. Consultant The joint meeting of the Planning Board and the Town Board took place at this time. A lengthy presentation of the activity of the Planning Board was presented by Mr. George Kushner. Mr. William Sorrentino, announced his aims to ultimately result in a presentation of a concept plan as same is prepared up to this date. A sizeable map was displayed and discussed at length at this time. F 173 Supervisor. Webster, declared the discussion at .an end at 11:10 p. m. The Town Board discussed all aspects of the concept plans which has been prepared by the Planning consultants. RESOLUTION TO REQUEST ESTABLISHMENT OF A 35 MPH SPEED ZONE RESOLUTION NO. 201, Introduced by Mr. Turner, seconded by Mr. Lampson. WHEREAS, this town board has received numerous requests from residents of the Cottage Hill Subdivision, Town of Queensbury, for the creation of a 35 MPH speed zone, and WHEREAS, the Cottage Hill Subdivision is a densely populated residential area of over 100 homes, and WHEREAS, this board considers that speed should be restricted on the streets of the subdivision, now therefore be it RESOLVED, that the Town Board of the Town of Queen-sbury does hereby request the State Traffic Commission to establish a lowed maximum speed not exceeding 35 MPH at which vehicles may proceed on the entire lengths of Cottage Hill Road, Rrospect Drive, 4nd ,Hil-lcrest Avenue, in the Cottage Hill Subdivision. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster Noes - None RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION 0. 2 2, introduced by Mr. Turner, seconded by Mr. Lampson. WEREAS, Raymond and Rosemary Potter of R.F.D. #3 Main Street, Warrensbur€ — New York, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW Y0 '.9 to locate a mobile home outside of a duly licensed mobile home court at property situated on Burch Road, 200' South from Stanley Robinson trailer, and WHEREAS, this town board -has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: There were no persons in appearance in opposition to the granting of the permit. The applicants has had a mobile home in the Town of Queensbury at another location, and that in the opinion of the town board the property values in the area would not be adversly effected, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ,T ordinance, permission is hereby given to Raymond and Rosemary Potter of R.F.D. #3 Main Street, Warrensburg, New York to locate a mobile home outside of a licensed mobile home court, at property situated at Burch Road 200' South from Stanley Robinson trailer and that the Town Clerk is hereby authorized and directed to issue such permit in accordance with the terms and conditions of said ordinance.
