Supervisor Brandt called meeting to order ... we have one resolution that's prepared, it's to transfer monies
to the Hovey Pond Fund from the contingency account ... $15,000 dollars, enough to pay for the
engineering work to be done and some monies to work on the relocation of a drainage pipe that must be
done so that the excavation can proceed. Before the design was made, a conversation took place between
neighbors and the result was, that Finch Pruyn volunteered a whole bunch of people and equipment to help
while they had some off time ... a front end loader, 2 trucks, hydraulic backhoe and a bulldozer ... I spoke
with Paul Naylor, he's going to lend us some pipe that he has on inventory, we have to install that. We're
going to hire from him some labor for moving that pipe, some of the necessary help to break a hole in
concrete and then to assemble that pipe. There will be accounting on it and that will all be part of this
$15,000 dollars.
Councilman Tucker-Questioned who will have control of this?
Supervisor Brandt-Harry and I will be overseeing it.
Attorney Dusek-Would like to note that when the resolution came up from EJ's office today, I was under
the impression that the money was going to be used strictly for design purposes. Concerned, that if your
going to do building projects with it, it may be subject to permissive referendum.
Supervisor Brandt -EJ advised me to take it out of contingency, then that wouldn't happen. If I took it out of
the Capital Reserve Account, it was subject to permissive referendum.
Attorney Dusek-It can still happen under the Town Law, there's a provision when you start building.
Councilman Monahan-We're paying the gentleman for design, what is the other part of the fund to be used
for?
Supervisor Brandt-It's to be used for relocating a drainage pipe which is in the way of the excavation.
Attorney Dusek-So you're not really building on the park?
Councilman Tucker-It's a pipe that we've got to take out because it's in the way of excavation.
Attorney Dusek-Then it's not really a park improvement, it's a drainage situation. That's another section of
law, I'm uncertain and would like to research it first.
Supervisor Brandt-Would like to recommend $5,000.00 dollars, that would take care of the engineering.
We have some money, there's $3,000.00 already in the account, which may cover what we have to do on
that drainage work.
Town Board agreed to the sum of $5,000.00 dollars and the following resolution was proposed.
RESOLUTION TO AMEND 1992 BUDGET AND TRANSFER FUNDS
RESOLUTION NO. 270, 92, Introduced by Mr. Nick Caimano who moved for it's adoption, seconded by
Mr. Michel Brandt.
WHEREAS, the Town Supervisor has requested a transfer of funds for the 1992 Budget, and
WHEREAS, said request has been approved by the Town of Queensbury Accounting Office and
the Chief Fiscal Officer,
NOW, THEREFORE, BE IT
RESOLVED, that the funds be transferred as follows, for the 1992 budget:

cash from the General Fund to the Hovey Pond Project Fund in the total amount of $5,000.00.

RESOLUTION CALLING FOR EXECUTIVE SESSION
RESOLUTION NO. 271, 92, Introduced by Mr. Nick Caimano who moved for it's adoption, seconded by
Mrs. Susan Goetz.
RESOLVED, that the Town Board of the Town of Queensbury hereby adjourns from Regular Session to
enter Executive Session to discuss Litigation.
Duly adopted this 6th day of May, 1992, by the following vote:

RESOLUTION TO RECONVENE
RESOLUTION NO. 272, 92, Introduced by Mrs. Betty Monahan who moved for it's adoption, seconded by
Mr. Pliney Tucker.
RESOLVED, that the Town Board of the Town of Queensbury hereby adjourns from Executive Session
and enter Regular Session of the Town Board.
Duly adopted this 6th day of May, 1992, by the following vote:
