1983-01-19 /80 Regular monthly meeting of the Queensbury Zoning Board of Appeals was called to order January 19, 1983 at 7:30 P.M. by Acting Chairman, Mr. Sicard. Present: Mrs. Goetz, Mr. Griffin, Mr. Turner and Mr. Sicard Absent: Mr. Cornwell, Mrs. Richardson and Mr. Prime The Acting Chairman asked for a motion to approve the minutes of the previous meeting. Mr. Turner said he had a correction on one Variance vote. On the voting for the Bruce Fence Variance he had voted No. Mrs. Goetz added that the Interpretation Number was 14. Motion by Mr. Turner, seconded by Mr. Griffin, all voting affirmatively RESOLVED that the minutes of the Meeting for December, 1982 are approved subject to corrections. approved. VARIANCE NO. 803 - David Hyman Off Route 9L - Dark Bay, Lake George, NY Mr. Hyman was represented by John Matthews, East Side Lake Goerge. Mr. Matthews stated that Mr. Hyman wants to continue construction on a house that was started in 1972. The present problem being that the lot does not have frontage on a public road as is re- quired. Mr. Turner asked Mr. Matthews about water. Mr. Matthews said they propose to get water from the lake. Mrs. Goetz asked if the building would be year round. Mr. Matthews said probably not. Mr. Griffin asked if it would be built on the same foundation that he previously started. Mr. Matthews said yes. Mrs. Gcif£ then asked if it would be bigger than this foundation. Mr. Matthews said no, just what the foundation is now. Mrs. Goetz also was concerned about fire apparatus reaching the area. Mr. Matthews said that fire trucks get to the houses in the area now, there would be no problem reaching this house. I~ Page 2 January 19, 1983 fhe question was asked -why wouldn't the owner of the adjoinging land sell a strip of it to Mr. Hyman. Mr. Matthews said he did not know why. He has been approached on several occasions by these people to solve this matter and Mr. H~ncan only purchase the whole lot. Wh~ MaetmB~swas next opened to the public. Mr. Matthews (not the Agent for Mr. Hyman) spoke about the access to a common lot with beach rights. He has property next to this lot and concerned about dock space there. Cþairman asked the agent, Mr. Matthews, if the owner was con- templating putting a dock there. Mr. Matthews said that the owner has nothing to do with the docks as it stands. Everyone in this Sub-division belongs to an association and the association maintains the docks. It was then mentioned that if the owner wanted to put in a dock, there were permits etc. he would have to get to do so. Mrs. Beverly Leary, next door neighbor to the proposed dwelling, concerned about the fact that whilè the building of the dwelling is going on her entrance to heE home will be blocked. This is a private road and ends directly in front of her house. Mr. Matthews said it is the plan to continue the drive on down to the lot. Public portion of the meeting was closed. The Planning Board recommended approval as a pråctical difficulty has been shown. Motion ~y Mrs. Goetz to approve Variance No. 803 seconded by Mr. Griffin, all voting affirmatively RESOLVED that the Queensbury Zoning Board of appeals approves Variance No. 803 based on the fact that a pråctical difficulty has been demonstrated. Approved. VARIANCE NO. 804 - Hot and Cold Food Systems, Inc. 58-60bBoulevard. Represented by Griffin Engineering - Marvin Dobert appearing. / S:( Page 3 January 19, 1983 Mr. Dobert explained the existing problems with the water line. Mr. Turner asked if parking would be adequate after expansion. Mr. Dobert said that the parking facilities as they are now seem to be adequate. Mr. Griffin asked if there would be a truck platform for the loading and unloading of the trucks. Mr. Dobert said that there is a future prov~s~on for one on the south side of the building. There is an existing door on the west side of the existing building in the front which will be used as the access to the new warehouse. The meeting was opened to the public - no one present either for or against the request for the addition. Queensbury Town Planning Board recommended approval along with the Warren County Planning Board. A letter from the Queensbury Beautification Committee was read for Mr. Dobert's benefit. This letter was discussed between the Board and Mr. Dobert with much concern regarding the trash {,- pile up to the rear of the building. Mr. Dobert was asked if . there would be any objection to Mr. Eddy of the Beautification Committee coming to the area again with no objection from Mr. Dobert. Mr. Dobert said the owners of the business are making the effort. Motion by Mr. Griffin, seconded by Mrs. Goetz, all voting affirmatively RESOLVED that the Queensbury Zoning Board of Appeals approves Variance No. 804, Hot and Cold Food Systems, Inc., to place an addition to wholesale food business with 30 ft. front setback in L lieu of the required 50 ft. A practical difficulty has been shown with the water main and current construction to the south. It is also recommended that some contact be made with the Beautification Committee by Mr. Alexy prior to their March meeting. Approved. Variance No. 80õ - Adirondack Radiant Heat, Inc. - 300 Bay Road, Glens Falls Represented by John Matthews - Mr. Matthews said that the owners want to operate a radiant heat retail sales and service store on the property. The main operation is in Diamond Point. They are only planning to have the retail sales and some minor service at this location. Public pBetinf meeting closed. The Queensbury Town Planning Board recommended approval along with the County Planning Board. VARmAM~EON NO. 806 - Withdrawn VARIANCE NO. 807 - Charles and Marion Ledford Ash Drive, Glen Lake Proposed use is to make two apartments in the building which was formerly the Glen Lake Casino. There are no exterior changes to be made to the building. Mr. Griffin asked what kind of heat would be used in the apart- ments. The representative said electric. There were no further questions from any members. Everyone was of the opinion this was a good move on the part of the Ledfords. Meeting opened to the public - no one present for or against. The Queensbury Planning Board recommended approval with the Warren County Planning Board also approving. Motion by Mr. Turner, seconded by Mr. Griffin, all voting affirmatively RESOLVED that the Queensbury Zoning Board of Ap~eals approves Variance No. 807 for the construction of two (2) apartments in a pre existing building. The hardship being the building is too large for a single family dwelling. Approved.
