1986-01-15 ¿ 7 Meeting of the Queensbury zoning Board of Appeals held ~vednesday, January 15, 1936 at 7 :30 P.M. '- present: Mr. Behr, Mr. Griffin, Mrs. Goetz, Mr. Turner, Mr. Sicard, Mr. Muller and Mr. Kelley. First item on the agenda was the approval of the minutes of the December meeting~ Motion by Mr~ Sicard, seconded by Mr. Kelley, all voting affirmatively, it was RESOLVED THAT the minutes of the meeting conducted December 18,1985 are hereby approved subject as corrected. Approved. V ar iance No. 1043 - Beverly Ann Close, 15 Queensbury Avenue - to replace existing garage with a larger garage with less than the required side yard setback in urban Residential 10 Zone. Represented by the owner, Beverly Ann Close. .,- Beverly Close explained that the size of the garage was not to be used for 4 cars but that the area in the back section of the garage was to be used for storage of garden tools, lawn mower, snow blower, etc. Warren County Planning Board approved with no additional comment. Motion by Mr~ Kelley, seconded by Mr. Sicard, all voting affirmatively, it was, RESOLVED THAT the Queensbury Zoning Board of Appeals hereby approves Variance No ~ 1048 based on the fact that it meets the two criteria needed for an Area Variance. There is a practical difficulty~ There is no room to locate a proper distance from the side line and it is not detrimental to the purpose of the Ordinance~ Approved~ Variance No. 1049 - Michael J. Stevens, west side Pilot Knob Road, 3/10 mile from Ridge Road - to construct an addition to one-family dwelling with less than the required setback ~ from Lakeshore in Lakeshore Residential 1 Acre Zone. /pI 2 Represented by the owner, Michael J. stevens. '- correspondence was read from the Lake George Association and the Adirondack Park Agency. The letter from the Lake George Association suggested that perhaps building was started before permits had been taken out. Mr~ stevens explained that the retaining wall was falling down and there was a deck there which was the only way into the house. While bringing carpeting into the house, the deck collapsed~ He did not apply for .permi t at the time repairs were being made~ He didn~t believe he needed one because he was repairing what was already there. He stopped when Mack Dean informed him he needed a permit to continue. Warren County p~anning Board approved with conditions. Motion by Mr~ Turner, seconded by Mr. Griffin, all voting affirmatively, it was RESOLVED THAT the Queensbury zoning Board of Appeals hereby approves Variance NO~ 1049 because practical difficulty has been shown~ The conditions recommended by the Warren county planning Board will be incorporated in this motion. There is no adverse effect on the neighborhood. ~. Approved. Variance No. 1050 - John DeMarco, Rockhurst Road 200' North of Seeley Road on Lake George - to replace an existing old cottage with a new dwelling on one plus acres with an existing principal structure in Lakeshore Residential 1 Acre Zone~ Represented by John DeMarco, the owner. Mr~ Behr asked if the building will be one or two stories? If the building is two stories then it would be 2400 square feet not 1200 square feet as stated~ Mr. DeMarco replied it would be two stories~ l'[r ~ Behr asked if the restaurant on the property was still used? Mr. DeMarco stated his mother was living there and had been since 1949. The restaurant has not been in operation for two years~ Mr. Kelley mentioned that the property is 1.1 acres and that the Zoning calls for one building per one acre. There is ',--- already a restaurant and other buildings there. """- Mr~ Turner asked if there were any problems with the existing septic system for the house. Mr. DeMarco stated he didn't know of any. There is now a 1500 gallon system in place~ Mr. Behr asked if Mr. DeMarco intended to run any kind of business out of this dwelling. fJIr. DeMarco stated "my own profession, I~m a writer". Mr~ Behr asked if he had anything to do with all the boats out front~ Mr. DeMarco stated yes his mother operates the boat dock, which has room for 49 boats. Many questions were brought up as to where the parking would be for all these boat owners. Some of the back end of this property is very wet~ Rear end of property must be filled in before Mr. DeMarco can build~ This request has not, as yet, been made from the applicable agency. Public Rearing Open. "-' Mr~ Edward Bunke, Rockhurst Road was not necessarily opposed to the building but questioned the parking problem, particularly on weekends. Mr~ Turner stated that, in his opinion, building a house would only compound the parking problem. Harold Kirkpatrick, land owner to the south, questioned the septic system. If house is built he thought it would require a holding tank because of the wet land there. correspondence was read from the Adirondack Park Agency and Margaret Colacino of Newark, New york. Both opposing the construction~ Public Hearing Closed~ Warren County p~anning Board approved without additional comment~ Motion by Mr~ Muller, seconded by Mr. Behr, all voting negatively, it was ~ 3 f7 10 4 RESOLVED THAT Variance No. 1050 be denied, the criteria for the practical difficulty has been somewhat met because of the dimensions of the lot, however, the variance would be '- materially detrimental to the purpose of the Ordinance because adding an additional residence to a 1.1 acre lot, which is also a preexisting, nonconforming Marina, would be too heavy a use for the property.
