Moeller, Stenographer Mr. Roberts called the meeting to order 8s00 p.m. OLD BUSIJŒSS SI'l'B PLAN NO. 12-88 R & M Woodbury partnership The Site Plan is for Office space on the west Glenwood Avenue, HC-lS. information. the construction of 30,000 sq. ft. of Commercial side of Bay Road, north of the intersection with The application was tabled in May 1988 for more Mr. Theodore Bigelow represented the project and reviewed the two major concerns from the last meetings 1) 50 foot buffer zone around the property, 2) and the layout of the building. The revised proposal is for one, two-story building, previously there were two buildings of one story and 1 1/2 stories, there is a 50-foot buffer zone between the commercial and residential uses. The 6/17/88 letter from Charles Scudder, Consulting Engineer, states approval of the project (Exhibit A). The applicant feels that the required parking by the Ordinance is excessive, and is asking that the east parking lot not be built until there is a need for it, it will be left as a green area. Ms. York expressed her concern about how an agreement is made with a present owner or future owner that, when addi- tional parking is needed, the green area originally intended for parking is to be paved. Mrs. Mann felt it was advantageous to the owner to abide by the original agreement, she did not want to see another building built on that land. Mr. Desantis requested that the parking spaces be put on the plat and that it be filed in the County Clerk's office, this was agreed by the Board. Mr. Cartier expressed concern with parking spaces being 9 x 18 ft. 1 -- and the handicap spaces as 8 ft. wide. Mr. Ivan Zdrahal, Civil Engineer, explained that the handicapped requirements by standards are 8 feet in width, with a 5 foot island in between, making 21 feet for two spaces, however, it was pointed out that the Town Zoning supercedes any standards. There was considerable discussion regarding professional versus commercial offices and what the parking requirements would be for each situation. Zoning requires 1/100 sq. ft. of professional office space, or 5.5/1000 sq. ft. using the commercial aspect. Mr. Bigelow stated that at the last Board meeting, 5.4/1000 sq. ft. was permitted. In summary, parking for 128 vehicles (20 held in abeyance), driving lane 25 feet wide, parking spaces 10 ft. x 18 ft., two spaces for handicapped vehicles, total 24 ft. including island, only portion of the northeastern most lot will be used, 100 ft. towards the street will be left off. Note. Original plans called for 162 parking spaces, however, 34 were removed. Present plans present the building to be the same basic concept as before (wood-sided), two stories and it will blend with the Westwood Homes. However, Mr. Bigelow was not lOOt positive of the final architec- tural plans. P\1))lic Rearia, Op...d. Betty Monahan. Town Council, 1st Ward. Ms. Monahan questioned whether the re-zoning for the area stipulated that there was to be a paved road between the professional offices and the residential Westwood area. Her concern is that emergency vehicles may not be able to enter the residential area from the professional parking lot at all times of the year, because of a green area dividing the two sites. Mr. Macri said there was an actual deeded plat for emergency access, but not a paved road. The reason a paved road was not favored was concern of too much traffic, with people cutting through from Glenwood Avenue and Bay Road. Mr. Roberts pointed out that there are fire hydrants and the hoses would reach from the professional area. David Kenny. Day's Inn, Route 9. Mr. Kenny asked if the Planning Board was setting a precedent that the parking allotment for professional offices is 5.5/1000 sq. ft. or 1/100 sq. ft. floor area. Mr. Roberts answered no, just for this case. He questioned if the Planning Board has a right to make the change, if so, then the code should be changed. Arbitrary changing should be prohibited, however, he has no problem with 5.5/1000 sq. ft.. Lee York, Sr. Planner, affirmed that Zoning Ordinance Section 7.071 stated that the planning Board does have the right to waive certain park- ing requirements, provided green space is left, and that what is stated in the Ordinance are minimum stated requirements. 2 ---' Paul Dusek, Council, agreed to research and see what flexibility the Planning Board has in regard to parking requirements. Mr. Macri pointed out Section 7.072 j) which allows 1/100 sq. ft. floor area devoted to such ~ (not stairways, corridors, etc.) and the reason for that is becaus;-õf home occupations. Under commercial buildings, it does say gross floor area. Mr. Bigelow was not able to breakdown the specific numbers at this meeting. Quentin Kestner, Consulting Engineer, suggested that the point of the home occupation/professional offices addresses the fact that many profes- sional offices might operate out of the home. He feels that in the Ordin- ance the intent was to differentiate between the residential use and that portion of an attached building that might be used as an office. He did not think it would make sense to subtract stairways, corridors, etc. Mr. Bigelow requested direction on the code and was informed to come closer to code, which would require 300 parking spots, 10 ft. x 20 ft. He was informed that any tabling would be on the basis of legal interpreta- tion of what the Board can do under the parking regulations. Mr. Bigelow agreed to table the application. At that time, he requested the courtesy of a special meeting, because of the circumstances involved. Mr. Roberts said if a Special Meeting did come up, his request would be considered. Mrs. Mann moved to ship, until the next applicant. Counsel has requirements. Passed V...i....ly SVBDIVISIOR .0. 3-86 Hidden Hills The application is presented in order to discuss problems with the construction of the roads on Oak Tree Circle, SFR-10. There are problems with the design grades. Mr. Leon Steves, Surveyor, represented the project and reviewed the original request for the westerly road to have extensive fill, which included several lots across the middle of the subdivision. When road construction was started, Paul Naylor, the applicant and Mr. Steves saw the extent of the fill. The current proposal is to lower the grade of the road (Oak Tree Circle) at the westerly site and put in a culvert across 3 ---' the road and ditch it. However, after discussions, the dry well perfor- ated pipe condition was thought to be the better approach. The reason the application is before the Board is because the plan was not desirable from the viewpoint of the developer or the Town, because the fill itself created havoc with the aesthetics of the site. The entire area would have to be raised, including vegetation (pine, wild growth, etc.). Mr. Nick Sciartelli, Morse Engineering, discussed his letter (Exhibit B). Raymond Buckley was identified as the person who produced the original design. Mr. Macri recalled specific concerns from the neighbors regarding water flowing on their property, the original plan has not been presented, and stated that the person responsible for the changes should present them to the Board. Mr. Steves said that Mr. Buckley was consulted on the changes. This subdivision is adjacent to Queen Victoria and Queensbury Forrest developments, and the soil has very good percolation. In those subdivisions, contractors have gone to a dry well and perforated system with crushed stone around the pipe, in order to dissipate the storm drain- age, in addition to retention basins. The system was approved by the developer and Paul Naylor, in order to lower the profile because of a problem with raised profiles higher than the adjoining properties. Woodbury Development Group initiated the re-design, however, Mr. Bigelow stated that the plan worked on paper, but not at the site. The design is to have positive drainage to the plug mill at the reservoir. Mr. Steves explained that existing contour is the proposed contour, the finished grade is at 380. Mr. Sciartelli confirmed that the proposed system is a good one and will work, it will eliminate the backwater effect onto the adjoining properties. The lots will be higher than the road, the road will handle the storm water drainage, so that it will not run into adjoining properties. The six feet of road will be taken down, although there will be fill in some lots. Quentin Kestner, Consulting Engineer, suggested that the original engineer get re-involved. To discuss something that the original licensed engineer did is too casual and causing assumptions. Mr. Steves took excep- tion to that as he is licensed and feels that what is being presented he is qualified to handle. However, Mr. Kestner still felt that Mr. Buckley should be present. To try to re-design at a public meeting is not a good procedure to follow. Mr. Sciartelli affirmed that Mr. Naylor, Highway Superintendent, approved the proposal. Mrs. Mann moved APPROVAL of Subdivision No. 3-86, Hidden Hills, that the changes to the road profile have been carried out, as recommended by the Project Engineer, Nick Sciartelli It has been verbally approved by the Highway Superintendent through the Project Engineer. Mr. Leon Steves spoke on behalf of the original Project Engineer, Ray Buckley. Seconded by Mrs. Levandowski. 4 -../ Defeated 3 Yes (Levandowski, Mann, ROberts) 4 No (Dybas, Cartier, DeSantis, Macri) MIIIOR SUBDIVISIOR HO. 3-88 Donald and Mary Pensel This is for the division of four lots, zero feet of new road, LR-IA. Mr. Donald Pensel represented the project and said that the deeds have been drawn up for the lots. Mr. Roberts read a letter from APA, which stated that it will not approve the project until the Town of Queensbury has made its decision. Quentin Kestner discussed his review of the site (Exhibit C). He stated that DOT has visited the site and would allow the present road cut, which precludes what he saw. Regarding the Environmental Review, Swamp land when divided, it will change the character of the neighborhood. Percolation is tough, a hole 30· deep cannot be dug, Due to clearance of trees and construction of homes, the good view will be obstructed, it will detract from the value of the property. Site distance on the road, Mr. Klein did not feel there was 250 ft. Topographical map - was incomplete. 5 No drainage and landscaping plans. No setback indications, especially around the septic areas. If the property is under one ownership, one residence should be torn down. Commercial activities are taking place on the property, this was denied. In contrast to Mr. Klein's statements, Mr. Kestner had a letter from Raymond Buckley, who indicated a percolation test was done. He indicated a rate of 10 min./inch, the soil was fine sand with some clay and, in his opinion, the area was good for a raised sewage disposal system. Addi- tional testing should be done, preferably with backup, to find the best location for a system. Mr. Kestner feels that any future lot (homesite) should be substantiated as such, which means that a home should be shown, location of the septic system, necessary percolation tests and locations, location of adjacent wells and all necessary information necessary for a good judgement on whether or not each lot is acceptable. Isabelle Muneff: neighbor across Route 9L. Ms. Munoff feels that percolation tests on the sites should be fol- lowed. What is being stipulated as a garage, is not a garage, it is where -boat refurbishing- is taking place. Mrs. Munoff requested clarification that Mr. Pensel had to go before a Board to get a Variance to erect the building. Therefore, there is an extra building is on the property and it should be taken into consideration when dividing up the acreage. Mr. Pensel said he had to get APA approval for the building, no variance was needed. Mrs. Munoff requested that the Board consider the one house that both she and Mr. Klein feel is illegal. Regarding the road site, she does not feel there is adequate site distance for the traffic involved. George pensel: son of applicant The house in question was built with a building permit from the Town of Queensbury. Regarding the road access, Mr. Pensel feels that there is adequate vision, and DOT has already given approval. Mrs. Mann stated she would not vote for the application, she is very opposed to houses being in a backyard because they were not planned and have a little right-of-way off the main street. This is indicative of a poor concept. Mr. Pensel disagreed in that the layout was in accordance with the Town of Queensbury Ordinance and the lots are very large. Public Rearing Closed Regarding test holes that were dug, Mr. pensel said that there was one on Mr. Klein's property, which was satisfactory, there was on dug on the property to the south. The holes were three feet, they were not taken off all the lots. Mr. Dybas is concerned about the test holes, because the land differs from place to place. 6 Mr. DeSantis moved APPROVAL of Minor Subdivision No. 3-88, Donald and Mary Pensel, based upon the Engineer's Report, the fact that the Board has a memo from Staff advising of a telephone conversation with the N. Y. State DOT regarding sight distances and road cuts, and that the permit has been forwarded. As a condition of the approval and before Building Per- mits can be issued on new Lots 2 and 3, satisfactory percolation informa- tion, as well as sewerage disposal design, must be submitted on new Lots 2 and 3. Refer to Mr. Quentin Kestner's letter of June 16, 1988. Seconded by Mr. Macri. Passed 5 Yes (Levandowski, Roberts, Cartier, DeSantis Macri) 2 No (Dybas, Mann) MINOR SUBDIVISION NO 4-88 David Eastwood This application is an amendment to the Cresthaven Subdivision on Zenas Drive, for two lots, zero feet of new road, UR-10. Sharon Reynolds represented the project and stated that Mr. Eastwood is in the process of trying to purchase the property from Mr. Shoemaker, Mr. Eastwood owns the property directly to the north, on which he owns a building, he has also purchased the property to the east formerly owned by Alexander and Marilyn Potenza, and is attempting to purchase the property on the northwest owned by John and Donna Dennent. Mr. DeSantis asked to see the deed to Lot 36, because it is a filed subdivision which frequently prohibits further subdivisions. Ms. Reynolds did not produce the deed. Public Hearing Opened. Joseph DuFour, 61 Zenas Drive Mr. DeFour congestion of the setback. stated that he is opposed to the application because of the houses and the effect on the value of his property and Donna Rothstein. 63 Zenas Drive Mrs. Rothstein is opposed because of the effect on the value of the property, the house will obstruct the Rothstein's view, as the property runs directly across the front of the proposed property. Mrs. Reynolds said that Mr. Eastwood has a deposit on the property. She also said that placing a house on the property is not a definite right now, it would be a substandard lot. Mrs. Rothstein vehemently disagreed, 7 ---- noting Mr. Eastwood's statements from a previous meeting that he would build on the property. Mrs. Reynolds said that it is Mr. Eastwood's intentions to beautify the area. The Board suggested that Mr. Eastwood combine the lots and construct a home. Mr. Dybas moved DISAPPROVAL of Minor Subdivision No. 4-88, David Eastwood, as it does not meet the requirements of a substandard lot of an existing subdivision. Seconded by Mrs. Levandowski. Passed Unaat.o..ly SITE PLAB RO. 22-88 Story town U.S.A., Inc. Charles R. Wood Enterprises Bavarian Palace The application is for the review of the new construction of the Bavarian Palace (Restaurant), on the northerly side of Round Pond Road, approximately 1,000 feet east of Route 9, RC-15. (Exhibit D). Wayne Judge, Esq., represented the project and stated that, for the first time in Story town's history, a charter group of 6,500 people was accommodated. Mr. Wood credited that success to a highly professional Food Service Department. In order to employ the professional food service persons full-time, Mr. Wood planned to build a banquet facility that would be opened year round to cater weddings, banquets and special events. That was the genesis of the Bavarian pavilion, before it was purchased in Vancouver, Canada in the Fall of 1986. After the purchase and in the Spring of 1987, a Story town engineer went to the Building Department, explained the plans and called for a building foundation inspection. part of the application shows that a representative from the Town inspected and approved the foundation on May 6, 1987. The original building permit was applied for and granted by the Town of Queensbury Building Department on May 12, 1987. Another Building Department inspection was made on November 11, 1987, and later that month an application was made to the Town Building Department for an addition of a kitchen and additional bathrooms to the building, and a Supplementary Building Permit was issued to Story town on November 25, 1987. Subsequent to that time, the owners of the building called for and received a Fire Inspection from the Town of Queensbury Fire Marshal on May 6, 1988. After 5/6/88, the owners called for the approval of its sewage system from the New York State Departments of Health and Conservation, the approval was granted. Application was made to the Town Building Department for 8 ',-- -- approval of the septic and sewage system; and on May 20, 1988 the owner received approval. Since the building fronted on a County highway, plans for the access to Round Pond Road were submitted to the Deputy Highway Superintendent of Warren County; on May 20, 1988 permission was granted to construct two, 24 ft. wide driveway entrances, 100 feet apart for the Bavarian Palace for access onto Round Pond Road, with some conditions (Exhibit F). Mr. Judge emphasized that the project was entered into in good faith, every request and every regulation that was pointed out to the applicant was complied with, every permit required was granted. He appeared before the Warren County Planning Board and requested to know its concerns; Mr. Judge stated the Board refused to do that. The Board did say that there was not enough parking (Exhibit G). He continued that Story town consists of 150 acres, and more parking can be provided with more blacktop. A plan was construed without more blacktop visible from Round Pond Road. Using the same parcel of property, more parking can be provided at the top of the bank leading into the Great Escape Camping Resort. There are 80 addi- tional parking spaces not being used and not visible from Round Pond Road; therefore, making 158 spaces available. The Beautification Commission said they would only require 98 spaces; this is more than required by the statute (Exhibit H). Mr. Judge expressed his dismay in the way the Town has handled the Story town matter; iel non-communication, giving short preparation time for a presentation. He had hoped to be able to have a ·candid· meeting, where problems would be discussed openly. Mr. Judge feels that, legally, what has been presented to the Board complies with all applicable rules and regulations of the Town of Queensbury. Perhaps mistakes were made by the applicant; perhaps mistakes were made by the Town (Exhibit I). He stated that Story town is willing to go more than half way to do its part to make everyone satisfied with the project. Story town has always been a good citizen to the Town of Queensbury, and wishes to continue in that manner. Mr. Judge feels that the application should be approved at this meeting; however, there is a CO which expires on July 23rd. The Bavarian Palace has been booked for the entire summer. Mr. Judge requested the following. 1) the application for Site Plan Review be granted. However, if this is not done, 2) then he requests that the temporary CO be extended to September. During that time, the Town Planning Staff work together with Story town experts and try to deal with the existing concerns. Present at the meeting are Charles Wood, owner, and Frank Hardick, P.E. for Story town. Ms. York explained that when the planning Board was requested by the Town Board to put this submission on the Planning Board Agenda, they also requested that Mr. Wood be given an extension to submit all paperwork applicable for Site Plan review. He was informed as to time and what was required, and Ms. York felt the allowed time was sufficient. 9 -' To answer Mr. Dybas, the people who park on top of the hill by the Campsite would use a trolley or tram, as was done at a recent graduation party held at the Bavarian Palace. The reason the campsite parking could be used for the Bavarian Palace is because there is enough parking within the R. V. Park. Mrs. Mann asked about busing people down from the Warren County facil- ities, when there were 6500 guests from Vermont. Answers Warren County allocated 51 spaces in the Municipal Center parking lot to supplement the parking. Mr. Judge said he made a -handshake deal- with the Building Department that, if a temporary building permit was received until July 23rd, the parking at Bavarian Palace would not be used; if the new parking area had been available, Warren County would not have been necessary. Mr. Wood stated that Great Escape has never had the attendance as was exper- ienced last Sunday; the 6500 guests from Rutland paid admission, paid to be fed and Great Escape did not know if the present parking would accom- modate that amount of people plus the record attendance. Mr. Judge said he was familiar with the map that was submitted with the Site Plan, with the original permit, that had a fence along Round Pond Road and the Bavarian Palace. This occurred for the first time at the Warren County Planning meeting; he asked Mr. McCormack to explain why one entrance was shown onto Round Pond Road. Mr. McCormack told Mr. Judge that Mr. Wood asked hi~ to plot out the amount of parking that would be possible to be placed on-site, and he pulled out the easiest map that he had, which was a topographical map. He said it was not intended for Site Plan Review, it was intended to show 100 spaces. However, Mrs. Mann pointed out it was presented with the Building Permit. She added that the permit said a -Bavarian Pavilion within the Amusement park,- and that no where is a restaurant mentioned. Mr. Wood explained that the topograph- ical map was drawn a long time ago, before the earth was moved in the winter of 1986 after the building was bought at the World's Fair in Vancouver. All of the hill, except the berm along Round Pond Road, was taken down; the berm was taken down after the telephone company retrenched the cables. Mrs. Mann pointed out that the amusement park has a fence around it, people go through the fence, they pay to go through the fence, and that is the way it has always been. The Bavarian Pavilion is a tot- ally different use and, even though Mr. Wood states in a letter that it is a restaurant, the application does not state such. Regarding the CO for the Bavarian Palace (Exhibit J), Mr. Judge said that there are no leach fields under the blacktop; there are dry wells under the blacktop; dry wells belong under the blacktop, according to the engineer and the State. They are there to take care of the sewage. The 3000-gallon septic tanks are not covered under the blacktop. They empty into dry wells that are under blacktop, which is acceptable. Dry wells come with 8- concrete tops. The Town inspected the system, when it was wide open. Quentin Kestner, Consulting Engineer, referred to the Town of Queensbury Sanitary Sewage Disposal Ordinance Section 3.020 B. and letter from Quentin Kestner (Exhibit K), which indicate that no component of a leaching field shall be located under parking areas. 10 -' "-- Mr. Judge informed the Board that, prior to the Amendment of the Statute, a ride was not considered to be a structure but an amusement device. The new Statute specifically states that a ride is a structure, iea today a Building Permit would be necessary to build a roller coaster. Most of the buildings on the property never had Building Permit because, under the law, applications were not necessary. The Bavarian Pavilion (in/out of the park), the Johnny Appleseed Restaurant and Camping Resort are outside of the fence. Mrs. Mann reminded that the camping facility was 95' built, when a Stop Work Order was issued before it was reviewed. When the review was made and Site Plan was approved, the restaurant was not in it. Now the restaurant is in existence, which makes it in violation of the Site Plan. Mr. Dybas asked if a traffic survey had been made with the DOT. Answer a Reliance was on the Access Permit granted by Warren County. Mr. Dybas noted that the permit referred not to actual traffic count, but to the driveway entrances. Mr. Judge stated that Great Escape has not con- ducted a traffic survey, Mr. Wood said they were not told that a traffic survey was necessary and, if the applicant is permitted to park 150 cars at the site, there would be no traffic jam. Frank Hardick, Engineer for Story town, advised that the capacity of the building is 495 persons inside the restaurant seated in the spaces being served. Mr. Hardick was not aware of the number of persons in the kitchen, parking lot, etc. The num- ber outside of the building on the decks is unlimited, the only restric- tions are inside the building. Mr. Wood advised that there are fences in the R. V. Park, down to the Bavarian Palace, and to the back of Wachita Motel. Use of the building would be either from within the park, that way the four terraces would hold may 60 to 70 people, the site would be used from Round pond Road, and people would not be seated there during the winter months. During the summer, the pavilion would be used for picnics in the park, unless there is a wedding reception. Mr. Macri summarized the total persons to be 495 within the pavilion, possibly 60 to 70 on the decks, plus employees. Mr. Dybas said that the reason for asking about the traffic survey was from a safety standpoint, and emphasized that DOT should be made aware of the situation now, before the traffic problem becomes worse than it is. Mr. Wood advised that the signals on Route 9 were purchased by Story town, but are controlled by New York State. The lights used to be too close together, when Route 9 was changed, DOT required the signals to be moved, with an off-shoot into the parking lot towards the Northway. Since that time, there has never been a backup of traffic due to the signals or Great Escape. The DOT takes a traffic count every year and checks on the sig- nals. When the amusement park closes at 6aOO p.m., there may be a problem for about 20 minutes or so, but it is not continuous. Mr. Roberts returned to the subject of attendance at the Bavarian Palace, in order to determine the number of parking spaces required. Dan Hatin, Building/Codes Director, said the total number of people served is 555, not 495, that includes the mezzanine which did not appear on the 11 ,~... original permit. The delivery area did not appear on the original permit. When the septic system was approved, there was no way the Build- ing Inspector would have known that the delivery area would have been built in front of the septic tank, which is where the loading trucks would enter. Mr. Wood commented that the delivery area and all the other areas submitted for approval were on the print, which was applied to the State and stamped. The town has a copy in the file. Concerning the attendance in the Bavarian Palace and on the mezzanine, Mr. Hardick pointed out that the mezzanine was never built. It came as part of the building, and had to be included in the computation for pos- sible future use. It legally could be built. Mr. Judge asked if parking was being based on capacity or on square footage. Mr. Kestner advised that it can be on one space for each four seats or square footage, whichever is greater. Taking into consideration seating capacity within the present structure, a possible mezzanine, there would be a count of 667 seats. Mr. DeSantis noted that the documents referred to the Bavarian Palace as a restaurant, yet at this meeting it is being termed as a catering facility. He asked how the applicant would like the review to be treated. His concern is I 1) if it is a catering facility, what is the need of access from Round Pond, 2) if it is a restaurant, (even though it may not be used as a restaurant now in the sense that it is presently intended for large groups only, but there is no reason in the future why an actual restaurant cannot be created), he is concerned as to why there is the confusion about why the facility is in the park or out of the park, 3) where did confusion initiate. Mr. Wood answered. There are now over 500 employees and constantly builds over the years. The catering business now serves over 60,000 people during the summer, independent of the guests of the park. Trying to keep a food organization together for the last 30+ years, there has been one person year-round on food. How it is necessary to carry four or five people. The pavilion was built for a purposel once the park closes, then he can cater to weddings, receptions and banquets, hoping to justify the expense of full-time employees. That is why it is fenced in, half is fenced in to the park, half on the outside. The reason for the access to Round Pond is because when one goes to the park, parking is on Route 9 and one would walk through the entire park (1 1/2 miles) to get to the Pavi- lion. When the season is over and the park is closed, then the parking is needed for the Bavarian Palace. Mr. Wood emphasized that there are not many banquet areas in Queensbury that could accommodate over 200 people. Mr. DeSantis pointed out that the Board has to look at the proposal as though it will be in use seven days a week, however, Mr. Wood says he has no idea what the potential is. Mrs. Mann asked why an internal shuttle system could not be worked out, with guests parking on Route 9. Answer I There is physically no way that a person can drive from the front gate to the Bavarian Palace. Ron Montesi, Town Council 2nd Ward, stated that a traffic study has to 12 ~ be done. At the time the R. V. Park was developed, thought had been given to a traffic light at the intersection of Round Pond Road and Route 9. Now that the impact on the road has been increased (pending approval), a light is something that has to be addressed. Mr. Cartier approach the subject of the timing of the septic system approval and the parking lot paving. The septic system was approved in the Spring of 1987, and the parking lot was paved in the last 90 days. David Hatin said that when the septic system was inspected, there was no blacktop. The inspector has no way of knowing what is going on top, other than dirtl there was no indication of blacktopping. Mr. Kestner said he has no way of verifying if the inspector looked at the Site Plan. Mr. Judge emphasized that, if there was a problem with the septic system or the number of parking spaces or any other matter, the applicants should not have been delayed three weeks because of the Building Dep~rt- ment's reluctance to discuss the matters openly. Mrs. Mann felt that the problem was that the prom was booked in the pavilion and the Town Board's concern, which was overriding, was trying to make that safe. If there had not been a prom booked, none of the permits would have been issued May 20th. There were 360 children going into the building with no CO or any permits. Mr. Judge felt that it is a ridiculous way to run a Building Department. Mr. Roberts felt the problem was being overstated, and that the Building Department was not going to design the project. Mr. Judge disagreed and said that he asked for a list of all the concerns, but this was refused. Mr. Hatin denied and reminded Mr. Judge that the first time he (Hatin) had contact was last Thursday. Paul Dusek, Counsel, stated that one of the reasons why the issues were not discussed with Wayne Judge is that it is felt that these were issues that were in the discretion and the powers of the Planning Board. Tonight we are here to air this matter before the Planning Board, and let the Planning Board conduct its Site Plan Review, and he recommended that the review proceed. Mr. Robert Eddy confirmed that the Beautification Committee approved only the beautification of the site. Other points were brought up, but those areas are to be decided on by the Board. Mr. Macri expressed his view that the Site Plan should not be reviewed at this meeting because there is not enough information. He suggested to Mr. Judge that the Zoning Ordinance be studied, as it contains the information needed for a complete Site Plan Review. Mr. DeSantis asked for clarification of the site (in-the-park, out-of- the park). Mr. Wood answered. During the season, Great Escape Park can be accessed from the Pavilion, but only by a catered affair. Anybody just attending the park must go through the front entrance on Route 9. People using the park can get to the facility, but only for a catered affair. There is a fence that goes through the building to separate it. 13 ---- Mrs. Mann requested that the Board consider two items. 1) The applica- tion states -Restaurant.- Unless that site is checked, that is what is going to be there. 2) Consider a change of use of what has been accepted in that area and what was applied for. Is this an acceptable change of use? The land across the street is zoned residential and there should be a 50 foot buffer, which has been removed. She feels that a precedent is being set on Round Pond Road and it is not going to end. Some type of transportation can be devised within the park so that Round Pond Road does not have to be used. Round Pond Road should be restored to its original concept. Mr. Wood responded. He expressed that he appreciated the feelings of the Board, but felt he was too old for the -nonsense.- He has tried to comply with everything that was asked. He stated he is going to hold a press conference in a week to ten days, he is closing the Great Escape, moving the rides out, bulldozing the buildings down, and International Village can stay there as a shopping mall. Last year over $500,000 was paid to Warren County in sales tax, over $100,000 in real estate taxes, $1,750,000 was donated to local benefits. He tried to help, tried to be a good citizen, tried to comply with everyone of these things, but he does not need it anymore. Thank you. Mr. Roberts expressed to Mr. Wood that it has to be recognized that Mrs. Mann is only one person on the Board. After find out taken. Messrs. Wood and Judge left, Mr. Hardick remained to attempt to from the Board what its concerns are and what steps have to be Mr. DeSantis requested to see the Site Plan that was submitted with the Building Permit. Mr. Hardick felt there was no Site Plan at that time, and to his knowledge the only map that was submitted was the one presented to the Board for this meeting. Mr. Roberts agreed that it is necessary to determine the use, it is a change. He is not sure that the Planning Board has the authority to extend a temporary permit, David Hatin informed him that, as of this date, there is no temporary co. He was approached by Wayne Judge last week about what conditions would be placed on a temporary CO, and Mr. Judge was informed that he would not be allowed to use the parking lot, in addition to one other stipulation. There will be a problem if they use the build- ing. The temporary co is Mr. Ratin's authority and was to expire July 23rd, five days after the Planning Board Meeting, so that it can be deter- mined if the Bavarian Palace is in compliance. This is on legal counsel's opinion. Mr. Road, etc. can do Montesi felt that, if the site did not access onto Round Pond there would be no problem about it being a restaurant, amusement, If that is the concept that is desired, then that is the best you with it. Mrs. Mann felt there is no hardship, the Board is not 14 '--- ---' requesting that the building be torn down. What the Board is saying is to access from Route 9 and not from Round Pond Road. Mr. Hardick confirmed that there is no way to drive from the front gate to the Bavarian Palace. Mr. Roberts expressed his concern that the Site Plan was presented to the Board after the fact. It is legitimately a Site Plan Review. Mr. Montesi felt that the property is zoned recreation, the problem is con- ceptually a restaurant opening on Round Pond Road. If it is a problem, then access can be only through the park. Board members made suggestions to Mr. Hardick, who had assumed repre- sentation of the applicationz General traffic study, including Route 9 and Round Pond Road. How patrons of the park access the place, how access is made from Johnny Appleseed. Are there any alternatives which are proposed, other than the entrance off of Route 9 or Round Pond Road. Completion of the application. Review Article V of the Zoning Ordinance and bring everything in compliance. After completion of the information, the applicant must take the ini- tial step to make an appointment with David Hatin and discuss the Site Plan. Address how the applicant will comply with items, which are not in compliance. Mr. Hardick asked Mr. Hatin for his list of technical reasons which would deter a CO from being issued. In the technical review of the drawings we have considered the following elements: · interior traffic flow · parking requirements · curbs and paving · soils and groundwater · grading and drainage · stormwater management · sanitary sewerage · water supply - domestic service and fire flows · lighting · landscaping It has been suggested by Mr. Bigelow that it might be generally advantageous to hold in abeyance the construction of the parking spaces to the east of the proposed building (19 and 15) until the necessity for those parking spaces is actually demonstrated. This would allow more green space and more absorption area. We find the new plans for the Offices at WestMJOd a great improvement over those proposed earlier, and the technical aspects of the plans are satisfactory in our opinion. Review of Profile Revision for Oak Tree' Circle , at Hidden Hills Subdivision between Stations 16+.50 and Station 27+50 FROM: RE: In accordance with your letter of June 2, 1988, we have reviewed the profile of Oak Tree Circle between the limits of change, visited. the site with the developer and discussed the proposed changes with the ,designer, Leon Steves, and Paul Naylor, Queensbury Town Highway Superintendent. . , Our major concern is the stormwater drainage design which' is' proposed between lot nos. 140, 141, 148 and 149, and between lot nos. 111 and 112, ånd in effect requires the roådway profile to be raised..· , The following is a summary of our review: 1. Existing Conditions: . There is an existing catch .basin on the west side of the Oak Tree;( Circle/Summit Way intersection, adjacent to the property line between lot nos. 148 and 149. This catch basin has an invert elevation of 379.57. There is also a 20 foot wide drainage easement between lot nos. 140, 141, 148 and 149. . ". /""-""1' ". :" ~ 2. Proposed Stormwater Drainage Design: a. Connecting to the existing catch basin and extending 'westerly between lot nos. 148 and 149 is 100 lineal feet of 18" C.M.P. with a headwall at the inlet end. The 18" pipe is proposed at a 0% grade. b. Across Oak Tree Cirle at Station 21+55+ is a proposed 3' wide by 2' high culvert having an earth invert at a 0% grade. 3. Results of Review: a. Since no stormwater computations were received, the review assumed the 18" CoM.P. and 3'wide by 2'high culvert ai-eof suffiCient size to handle the expected storm water flows. . Condition III - in order for the proposed drainage system (culvert and/or 18" C.M.P. connection) to function with a 0% grade, the water surface would be required to attain a height of 2 feet or higher for the stormwater to flow into the existing system. The two foot height would reach a surface elevation of 382.00 and considering the adjacent lots are not being graded to a higher elevation, would cause a ponding area 200+ feet wide and 4.50+ feet in length (affecting lot nos. 111, 112, 139, 146; 141, 149, 1.50 andl.51) and extending onto the adjoining subdivision to the west. Condition 112 - If lot nos. 111, 112, 139, 140, 141, 149, 1.50 and 1.51 were hlled in to a minimum elevation of 382 and a ditch formed to the proposed culvert and C.M.P. extension, the ponding created would extend westerly into the adjoining subdivisions. Condition #3 - At the existing catch basin, the proposed 18" CoM.P. extension which is connected at the existing invert and proposed at a 0% grade would evidence a backwater from flows entering the catch basin and flowing easterly, whereby this backwater would affect flows entering from the west. 4. Conclusions and Recommendations: In order not to have lot nos. 111, 112, 113, 139, 140, 141 and 142 as depressed lots or affected by the possibility of backwater conditions from the proposed storm water drainage system, and since adjacent areas were found to have good soil percolation, the following is recommended: a.· Install dry wells and connecting perforated pipe systems from the west side of Oak Tree Circle at Station 21+.5.5+ and extending easterly to the existing catch basin a sufficient length tõ dissipate the expected runoff for a 10 year frequency storm. Instàll a smaller pipe extension to the west from the existing catch basin at a higher elevation to discharge the runoff from storms greater than a 10 year frequency. Provide whatever easements are necessary for maintenance purposes. b. The above recommendation would allow the roadway profile to be lowered and eliminate the 3' wide by 2' high culvert and 18" CoM.P. extension and be replaced by a' perforated system installed below the average frost depth. Each of the two lots is certainly large enough to support a well and sewage disposal system even if a raised or fill type of system is required. 2. The proposed driveway enters the east side of State Route 9L. Because the lots are downgrade from the road surface, the site distance to a motorist coming out onto Route 9L from the driveway appears limited; and I would suggest that the Regional Department of Transportation Engineer inspect the road cut for proper site distance. I would suggest for future subdivisions, irrespective of size, that a percolation test be required at the proposed location of each sewage disposal system drain field and that the location of all adjacent water wells be indicated as well as any available information concerning well capacity. Please keep in mind that the Warren County Planning Board recommended denial of application at that meeting and that I am not a member of the Warren County Planning Board,'but a Planning Department staff planner working with the Board. The issues presented herein are only a highlight of the discussion that took place. The main issues that were discussed were: the change of the use of a pavillion within the amusement park to a use that could stand alone without the park. as was originally the assumed use of the building; the dramatic change to a banquet/ reception facility fronting on Round Pond; the removal of the earthen embankment and chain link fence that prevented all but service vehicles access to Round Pond Road to and from the amusement park; the introduction of a proposed use that would dramatically increase traffic and congestion not only at a curved section of Round Pond Road but would also create problems at an already poor intersection with Route 9; the inadequacy of parking, not only for patrons, but also employees, that would utilize ,the building as proposed. In conclusion, it would seem that the use of the building, as proposed, within the confines of the amusement park and having access from the park's existing main entrance on Route 9, was not that unreasonable a request. The fact that there was exposure on Round Pond Road, with such a substantial use, made the negative .impacts of that use appear to be overriding. Attorney Wayne Judge informed the committee that the building contains 9,600 sq. ft. The nearest use of this building, since food will be served, seems to be restaurant. Section 7.072 of the zoning ordinance requires a minimum of one parking space for each 100 sq. ft. of gross floor area. It would seem, therefore, that 96 spaces should be provided. Our count indicates that 77 spaces are contemplated. 2. It is difficult to determine the percentage of permeability that applies to this building, but it appears it should be at least 20%. Should the driveway and parking area be paved, the percent of permeable might ~ot be adequate. 3. The Committee is not sure under which definition extensive excavation at this site applies. It could be #24, #67 or #88, but it would seem that a mining permit should have obtained. the #36, been 4 . The to be stabilized established. 5. The suggestion of use of a chain link fence with plastic slats was made to screen the dumpster, which is to be placed at the southwest corner of the building. ' 6. Maple trees are to be planted on either side of the south entrance to the building. 7. The Committee did not find the blueprint clear, but it would seem that there are three south entrances designated by four interior cubby-holes. It is in front of these sections that flower boxes or p1antings are to be placed. It was suggested that cluster plantings be placed at these four locations. Cluster planting could consist of a taller evergreen, such as pyramidal or columnar arborvitae with two smaller plants, such as spreading yews or burning bush, be used. This same treatment could be used on the north side of the building, but since that can only be seen from the fun-park, this would be optional. 8. It would seem reasonable to install curbing to stop cars from entering directly on to Round Pond Road and to plant low growing evergreens or shrubs in front of this curbing. 9. No mention was made of mUlching the plantings. It is suggested that fiber-glass mat be placed on open ground covered with shredded bark, pine needles or some other mulch material, for appearance. slope on either side of this area seems too great until the grass and crown vetch becomes (~/. The purpose of the Palace is that it will be used as an additional picnic pavilion. It will also be used for weùàing recep- ' tions, bowling banquets, church groups or any groups that will be booked as a group. In no way will it be used as an off-the-street- restaurant facility. We will not have any set-up for retail sales, gift shops or separate sale of food, other than the menu booked for a specific group. Should we have an October Fest in the Fall, I would think that we might be selling t-shirts, beer mugs and souvenirs, but I am not sure that these items would be sold within the buiiding. It may be more practical to sell these items in a separate structure within the park, but did want to mention the possibility of some type of sales of this sort. The proposed facility's seepage pits are located under the parking area off of Round Pond Road. The present Queensbury Sanitary Sewage Disposal Ordinance does not allow installation of a leaching facility under parking areas. 2. The area is served by the Queensbury Water Storage and Distribution District, and therefore, potable water is available. I would think it advisable to have more than one hydrant in the vicinity of such a facility to afford more reliable fire protection, and additionally; I would also consider the installation of a sprinkler system as an additional fire protection measure. 3. The design calculations dated March 1988 indicate a capacity of 557 persons. The indicated parking on the site plan map shows only 86 spaces with a note that additional parking is available at the adjacent RV Park. In any event the available parking is far less than required for the maximum capacity indicated.
