PUBLIC HEARING-Re: Amending Ordinance #28 NOTICE SHOWN SUPERVISOR WALTER-Noted that the proposed amendment to Ordinance #28 is to add a stop intersection at Garrison Road and North Road. The stop sign shall be erected on the Garrison Road entrance from east and west on North Road at its entrance from north and south and the amendment will take affect after its publication. Asked for public comment? CHARLES EISENHART-I live on Bay Road but use Garrison Road a great deal, and I don't see any reason for this stop sign. JOHN CAFFRY-My grandmother who couldn't be here has lived on Garrison Road almost forty years now and she would like very much to see a sign on that corner. COUNCILMAN MONTESI-1 received comments from the neighbors regarding Garrison Road saying that this road was going through a change where younger people are _. moving into the neighborhood with young children...Garrison Road is part of the Glens Falls School District and as such the children must walk to school...and to have a stop sign at North Road would provide some safety margin for children, at least they would have a corner to cross at with cars stopping. COUNCILMAN BORGOS-The other concern is the speed condition and if people know there is a stop sign maybe they will start slowing down earlier and that will tend to reduce speed, we have heard from a lot of people about this. SUPERVISOR WALTER-At the February llth, meeting of the Warren County Traffic Safety Board it was pointed out that a four-way stop sign at this particular intersection was deemed to be inappropriate as per the New York State Manual of Uniform Traffic Control Devices...the sheriff has written a letter to one of the residents who lives on Garrison Road and has indicated to him that there were several attempts to resolve the problem but didn't seem to think the four-way stop was in order. COUNCILMAN MONTESI-Stated that when the sheriff has gone on Garrison Road for radar check in a half hour to an hours' time he can pick up seven or eight speeders and the last time four of them were residents of the road. SUPERVISOR WALTER-Asked for further comment hearing none the Public Hearing was closed 8:50 P.M. I OPEN FORUM DR.CHARLES EISENHART-Bay Road,Town Historian-Reported his progress to the Town Board regarding the inventory of Town Cemeteries, noted that there are twenty two cemeteries in the Town and it will take longer than anticipated to complete the inventory. COUNCILMAN MONTESI-Asked about the PDX Cemeteries where people went to die is that part of the twenty-two? CHARLES EISENHART-1 don't know...I will check into that. Z86 COUNCILMAN MONAHAN-Can you copy down some of the neat inscriptions on some of the old ones? CHARLES EISENHART-No, it becomes too much just to get the names down and the dates, as best I can...that makes quite a collection data on it. COUNCILMAN BORG OS-Suggested to speed up the whole process, a very simple computer program...just get the names and dates, type it in once...it can then be sorted, alphabetically, in order of date of birth, death, whatever you want. CHARLES EISENHART-In the end I hope to have a complete list, about five thousand names and alphabetizing a single cemetery take a while.I am chairman on the bicentennial j and I have a very good committee and we will have our first event on Sunday, September 20, on the campus I have a reservation at Dearlove Hall and over in the Lecture Hall for that Sunday night. Then we have tentatively set up a date in October in which we will be involving the school activities, principally Queensbury Central but in the meantime we've got Dr. Norman M. Horning as principal speaker...he is an authority on the constitution and an excellent speaker. I will be sending you some minor cost for it but it won't be anything very great. I hope the town will be getting into some enthusiasm perhaps about the 200 anniversary of the establishment of the constitution. COUNCILMAN MONAHAN-Asked if Lake George School would be involved? CHARLES EISENHART-We have not worked out whether we are going to try to seclude it to the Queensbury Central or open it up to the whole area. COUNCILMAN BORGOS-Asked if anything had been heard regarding the exits 19 and 20 from DOT. SUPERVISOR WALTER-No new news-They had added exit 18 not exit 20 as far as placement of the traffic signal and I have had a running correspondence with the people down there at DOT as far as their planning...Dan Cane and myself and I think Mack has been a part of it to, in getting the entry way to Queensbury Plaza moved further south to line up with the egress on the Grand Union side, by closing off one...then the addition to a second turning lane going left if you are going north on Rte. 9 to alleviate some of the traffic. All of those things are in the design stage and they are not any further along then that. Yes, the DOT is addressing both of those intersections at the exits on the Northway and also that particular problem where we have a ,. lot of congestion on Rte. 9 and Quaker Road. COUNCILMAN KUROSAKA-Noted that because of the concern of the people at the last meeting regarding Sandy Bay, the county has said they would look into it and hopefully do something...asked if there was anything new on it. SUPERVISOR WALTER-I brought it up at the county and I think it was the Sheriff's committee, and I mentioned to him we had a lot of discussion and I had talked with other supervisors, namely Supervisor Tessier, Lake George and Supervisor Bolton, from Hague who had indicated that they were having problems with groups also, not to the extent we experienced them in Sandy Bay but they had seen an increase and at open discussion of the whole committee it was the general consensus that if a town should pass any kind of legislation that, that would just remove the problem from that town but that it would go somewhere else and the best way to address it would be a county wide piece of legislation. We left it that the sheriff was going to be discussing it with the county attorney and that they would be reporting back at the next sheriff's committee. OPEN FORUM CLOSED. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mr. Borgos, Mr. Montesi, Mrs. Monahan, Mrs. Walter Noes: None Absent: None RESOLUTION TO SET PUBLIC HEARING ON PROPOSED REGULATIONS AND INTERIM STANDARDS FOR SEWER LINES AND APPURTENANCES WITHIN THE TOWN OF QUEENSBURY RESOLUTION NO. 242, Introduced by Mr. Stephen Borgos who moved for its adoption seconded by Mr. Ronald Montesi WHEREAS, the Town Board of the Town of Queensubyr has determined to consider the adoption of regulations and interim standards for sewer lines, mains, and appurtenances proposed to be connected with any existing or proposed sewer district within the Town of Queensbury, and WHEREAS, the Town Board recognizes the need to regulate the installation of sewer lines and appurtenances and to set uniform standards for the materials to be used for such lines and appurtenances within existing and proposed sewer districts, and WHEREAS, the Town Board intends to avoid accepting sewer lines and appurtenances which have been improperly installed or which utilized materials which are inadequate, and WHEREAS, the proposed regulations and interim standards have been prepared, a copy of which is annexed hereto, and WHEREAS, the proposed regulations and interim standards are worthy of consideration for legislative action, NOW, THEREFORE, BE IT RESOLVED, that a public hearing be held concerning the proposed adoption of said local law and that said public hearing be held at 7:30 P.M. in the meeting room of the Town of Queensbury Office Building, Bay & Haviland Roads in the Town of Queensbury, Warren County, New York on the 25th day of August 1987, at which time all persons interested in the subject thereof will be heard, and be it further RESOLVED, that the Town Clerk be hereby directed and authorized to publish and provide notice of said public hearing as may be required by law. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mr. Borgos, Mr. Montesi, Mrs. Monahan, Mrs. Walter Noes: None Absent: None SEWER DISTRICT INTERIM STANDARDS AND REGULATIONS The following standards and regulations regarding sewage facilities proposed to be connected with existing or proposed municipal sewer districts shall apply. 1. 3 sets of completed engineering drawings stamped by a licensed engineer shall be submitted to the Town of Queensbury. Such drawings shall set forth the following. a) Specifications for all proposed materials and the method of installation thereof; b) flow calculations on all facilities to be served; c) all sewer lines shall be represented with scaled sewer profiles; 2. All facilities shall be designed in accordance with the 1987 Edition of GLUMRB - Recommended Standards for Sewage Works (10 State Standards). 3. All sanitary sewers shall be installed utilizing a laser instrument, thus, �es g thus, assuring proper grade and alignment. 4. All sanitary sewers shall be installed in a dry trench. The groundwater table shall be lowered below the excavation limit prior to excavation. 5. All sanitary sewers shall be installed in the public or developer's right of-way to allow easy accessibility for repair. 6. Approval by Town Engineer of the plans and specifications required at Paragraph 1 hereof. 7. Payment of the Town Engineer's fee for review of the plans and specifications. 8. Certification by a licensed engineer to the Town of flueensbury that the materials used and the installation of sewer line was made in accordance with the plans and specifications submitted to the Town for its review. 9. Satisfactory low pressure air test to be witnessed by an authorized Town employee or representative. 10. Approval by Town Counsel of the form of sewer easement if the line maintained by the Town. 11. Payment to the Town of Qlueensbury of the sum of $200.00 plus $20.00 per unit of residential housing and or $200.00 plus $20.00 a thousand square foot for commercial and or industrial for the implementation and administration of these interim standards and regulations. 12. All materials used shall be in accordance with the plans and specifications for the Quaker Road Sewer District as prepared by Kestner Engineers, P.C. DISCUSSION HELD BEFORE VOTE SUPERVISOR WALTER-The town intends to avoid accepting sewer lines and appertence which have been improperly installed or which utilized materials which are inadequate, and I believe the Board is going to be firm on anyone who is getting the jump on putting sewer mains in at this time. We are concerned with those smaller sewer lines that are going to be connecting to our sewer and we don't want to have any system infiltrating storm or whatever into our sewers because we do have a limited capacity. Hopefully by setting some firm standards we will be able to handle whatever may occur between this time, the public hearing and the acceptance of those standards, when we get a permanent set. COUNCILMAN MONTESI-Noted that around town the sewer district is being built and one of the problems is the immense dewatering process in order to lay the pipes... We need to inspect the lines prior to the developer covering them up to ensure that we are getting the kind of quality we want therefore we need these interim standards. SUPERVISOR WALTER-Stated that the fee was open to discussion this evening for the inspector to go out and look at these sewer lines. COUNCILMAN BORGOS-Based on our experience with the last contract with the engineers for somebody to observe the actual placement of sewer, making sure the seems are tight and the stone is there and the gravel is there, that fee could be very high for our own sewer district work...I think the fee in this case should be reasonable but also reasonably high to ensure that we get the proper kind of inspection that we want and proper kind of administration. COUNCILMAN MONTESI-There are three kinds of inspection that we are dealing with...one is that the developer has an engineer to design a sewer line, and part of the cost of that engineers job will be to design it and also to see that it is built to those design specifications, our responsibility will be to have our engineer, to review those plans and see that those plans and those materials used fit our guidelines and lastly Tom Flaherty, our Water Superintendent, or one of his designated inspectors goes out and checks the water lines...I think that is what we are referring to. COUNCILMAN KUROSAKA-This is a different kind of inspection. COUNCILMAN BORGOS-We will be increasing the value of these properties significantly by putting sewers in...Perhaps $200.00 per residential unit as an initial fee until tig9 we get the fee set. COUNCILMAN MONTESI-Asked George if he would expect that it would take a long time out at the site to do this? COUNCILMAN BORGOS-I think someone ought to look at it while they are putting it in so as to see if the method is proper...you don't need somebody out there all the time...suggest then when everything is in do a lantern type check to make sure you can see the hole that is the old method...there is a more modern way now. COUNCILMAN MONTESI-Stated that Kestner Engineers prefers the laser especially when you are dealing with a grade because you can't do it with a transit unless you've got the computer print out. COUNCILMAN BORGOS-Stated $200.00 plus $20.00 per unit for residential housing or $200 plus $20.00 per thousand square feet for commercial and or industrial. RESOLUTION TO APPROVE ELECTRICAL INSPECTORS RESOLUTION NO.243, Introduced by George Kurosaka who moved for its adoption seconded by Mr. Stephen Borgos. WHEREAS, the Town Board of Queensbury has adopted a Local Law (Number 4-87), the "Electrical Law of the Town of Queensbury" and WHEREAS, the Local Law sets forth certain criteria for businesses and/or individuals to perform electrical inspections in the Town, and WHEREAS, the Town Board has determined that the following firms have met the criteria: Middle Department Inspection Agency, Inc. New York Board of Fire Underwriters NOW, THEREFORE BE IT RESOLVED, that the Middle Department Inspection Agency, Inc., and the New York Board of Fire Underwriters are hereby authorized to make electrical inspections within the Town of Queensbury, and be it further RESOLVED, that no other individual/firms may conduct electrical inspections within Town of Queensbury limits after this date unless approved by resolution of the Queensbury Town Board. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mr. Borgos, Mr. Montesi, Mrs. Monahan, Mrs. Walter Noes: None Absent: None DISC USSION:Stated that the Building and Code Enforcement Officer has provided procedures for the Inspection Agencies to adhere to as far as doing electrical inspections in the town. Suggested that the Inspection Agencies check with the Building & Code Enforcement Officer. Stated that there were two new agencies now in the town and noted that they should have their resumes on file with the Town Clerk. RESOLUTION FOR STATE AID FOR ASSISTANCE IN DEVELOPING A LOCAL LAND USE PROGRAM RESOLUTION NO.244, Introduced by Mrs. Betty Monhan who moved for its adoption seconded by Mr. Ronald Montesi. WHEREAS, Chapter 53 of the Laws of New York of 1986 authorizes State financial assistance to Adirondack Park towns and villages for the implementation of local land use programs developed pursuant to Article 27 of the Executive Law, and WHEREAS, development of a local land use program typically includes the following general elements tailored to a community's needs community survey, natural resource studies, socio-economic studies, community issues and goals, land use plan and regulatory 290 devices, NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby designates the Senior Planner and the Code Enforcement Officer as the development administrators and zoning officers for the purpose of performing the following specific planning tasks: 1) assistance in the development of an updated Comprehensive Land Use Plan. 2) referrals of variances and other actions, 3) review of code requirements with prospective applicants, 4) assistance to planning and zoning boards, and 5) record keeping at a state share cost of $12,000. RESOLVED, that the Town shall enter into negotiations for an agreement with the development administration staff to undertake the administration of a local land use program, and it is further RESOLVED, that Frances J. Walter, as Supervisor is authorized and empowered to negotiate such agreement on behalf of the Town, and it is further RESOLVED, that the Town Board shall review and approve any memorandum of agreement or contract which results from the aforesaid negotiations. RESOLUTION TO ACCEPT DEED TO TOWN OF QUEENSBURY FOR PREMISES FOR EXTENSION OF TOWN HIGHWAY KNOWN AS HONEY HOLLOW ROAD RESOLUTION NO.245, Introduced by Mr. Stephen Borgos who moved for its adoption seconded by Mr. George Kurosaka. WHEREAS, Northern Homes, Inc. has executed and offered a deed for the extension of a town roadway running south/easterly from the current terminus of Honey Hollow Road to the intersection of Brookshire Trace and an easement agreement for drainage purposes which are more particularly described in the map heretofore filed with the Town Board, and WHEREAS, Paul H. Naylor, Superintendent of Highways of the Town of Queensbury, has advised that he has made the necessary inspection of the right of way clearing, sub-base preparation, drainage implementation, roadway surface and finds that such work has been performed in accordance with the standards and requirements of the Town of Queensbury, and he recommends that this Board accept this land for highway purposes into the Town Highway System, and WHEREAS, Thomas K. Flaherty, Superintendent of Water of the Town of Queensbury, has advised that he has made the necessary inspection of Water Line Installation and finds that said installation has been made in accordance with the standards and requirements of the Town of Queensbury and that he recommends that this Board accept this land insofar as the water installation is concerned, and WHEREAS, the form of the deed, drainage easement and title to the roadway has been approved by Wilson S. RESOLUTION TO ADOPT AN AMENDMENT TO ORDINANCE NO. 28 ENTITLED ORDINANCE ESTABLISHING THROUGH HIGHWAYS AND STOP INTERSECTIONS IN THE TOWN OF QUEENSBURY, COUNTY OF WARREN, STATE OF NEW YORK RESOLUTION 249, Introduced by Mr. George Kurosaka, who moved for its adoption seconded by Mr. Stephen Borgos. WHEREAS, the Town Board deems it necessary to adopt an amendment to Ordinance Number 28 entitled ORDINANCE ESTABLISHING THROUGH HIGHWAY AND STOP INTERSECTIONS IN THE TOWN OF QUEENSBURY, COUNTY OF WARREN, STATE OF NEW YORK, and WHEREAS, the Queensbury Town Board set a public hearing on August 11, 1987 at 7:30 P.M. on the proposed amendment to the Queensbury Ordinance 28, and WHEREAS, the public hearing was held at the specified time and place and all interested parties were heard on the proposed amendment to Ordinance No. 28, NOW THEREFORE BE IT RESOLVED, that the following amendment be added to the Queensbury Ordinance Number 28: ORDINANCE NUMBER 28 (Amendment) Section 1. Delete Garrison Road from Route 9 to Bay Road as a through highway. Section 2. Add as a stop intersection the intersection of Garrison Road and North Road is hereby designated a stop intersection and stop signs shall be erected on Garrison Road at its entrance to said intersection from the east and west and on North Road at its entrance to said intersection from the north and south. Section 3. This Amendment shall take effect 10 days after its publication, posting and compliance with Section 1683 (a) of the Vehicle and Traffic Law. COUNCILMAN BORGOS-Said he agreed with the county's response of creating legislation for the entire lake. COUNCILMAN MONAHAN-Agreed with Mr. Borgos in theory but said that the only thing was by the time they got the entire lake done, we would be another year down the pipes. RESOLUTION TO ADOPT AN AMENDMENT TO ORDINANCE NO. 34 ENTITLED ORDINANCE REGULATING SPEED OF MECHANICALLY PROPELLED VESSELS IN THE AREAS OF SANDY BAY, WARNER BAY, ASSEMBLY POINT AND HARRIS BAY. RESOLUTION NO. 250,Introduced by Mrs. Betty Monahan who moved for its adoption, seconded by Mr. George Kurosaka. WHEREAS, the Town Board deems it necessary to adopt an amendment to Ordinance NO. 34 ENTITLED ORDINANCE REGULATING SPEED OF MECHANICALLY PROPELLED VESSELS IN THE AREAS OF SANDY BAY, WARNER BAY, ASSEMBLY POINT AND HARRIS BAY, and WHEREAS, the Queensbury Town Board set a public hearing on August 11, 1987 at 7:30 P.M. on the proposed amendment to the Queensbury Ordinance No. 34, and WHEREAS, the public hearing was held at the specified time and place and all interested parties were heard on the proposed amendment to Ordinance No. 34 NOW, THEREFORE BE IT RESOLVED, that the following amendment be added to the Rueensbury Ordinance Number 34: AMENDMENT TO ORDINANCE NO. 34 SECTION 1-a Sandy Bay. Bounded northerly by a line 1800 feet north of the southerly shore of Lake George in Sandy Bay, east by Rockhurst, south by the state land at Sandy Bay and westerly by Cleverdale. Bodenweiser, Fire Marshal did recommend that we advertise for bids for one new vehicle 1987 or 1988 Model 2 Door Hatch Back, and WHEREAS, three bids were submitted and received and opened at the specified time and place by the Director of Purchasing/Town Clerk Darleen M. TOTAL BID Rotondo/Carlegen Attached $420, 000.00 Walden, New York RESOLUTION TO ACCEPT BID RESOLUTION NO.253, Introduced by Mrs. Betty Monahan who moved for its adoption seconded by Mr. Ronald Montesi. { WHEREAS, Kestner Engineers, P.C, Troy, New York did recommend that we advertise for bids for a factory-built, concrete, preassembled, pretested sewage station and wet well complete with all equipment and appurtenances and WHEREAS, one bid was submitted and received and opened at the specified time and place by the Director of Purchasing/Town Clerk Darleen Dougher and WHEREAS, Mr. Kestner, has recommended the bid be awarded to Rotondo/Carlegen, Walden, New York, NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby accepts the bid of Rotondo/Carlegen, of Walden, New York in the amount of $420,000.00 and be it further RESOLVED, that the financing for such work will be financed through bonds. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mr. Borgos, Mr. Montesi, Mrs. Monahan, Mrs. Walter Noes: None Absent: None DISCUSSION: COUNCILMAN MONTESI-Noted that he wanted to clarify the fact that Hiland Park is a fact of life and their fair share of the pump station is a fact of life but I am not quite sure that the Town Board should be relying on Earltown paying their fair share, they have not been approved yet...so the cost to the town is $420,000.00 plus and part of that cost will be borne by Hiland...this is the only one we can rely on. SUPERVISOR WALTER-The point of the matter is the pump station will be sized so that it will handle the Hiland Park...it could handle Earltown also...on the other hand what we have indicated is that we can use that pump station for our extensions on sewer districts where we don't have to rely on either or developer because we can utilize that pump station for enough flows by extending the districts. Noted that the Town was now striving to meet a commitment to our large industry in the town, C.R. Bard, to get them sewer service and we have predicted that it will be the fall of this year and specifically before the first of the year. COUNCILMAN BORGOS-Asked if this was a package plan? RESOLUTION TO CONDUCT FIREWORKS RESOLUTION NO.254, Introduced by Mr. Stephen Borgos who moved for its adoption, seconded by Mr. George Kurosaka. WHEREAS, Charles R. Wood Enterprises of Queensbury, New York has requested permission to conduct a fireworks display as follows: SPONSOR: Charles R. Wood Enterprises PLACE: The Great Escape DATE: August 18, 1987 NOW, THEREFORE BE IT RESOLVED, that the Town Clerk is hereby authorized and directed to issue a permit to the aforesaid sponsor subject to the following conditions: A. Receipt of proof of Insurance 1. The Town of Queensbury must be named as an additional insured. B. Inspections and approval must be made by the Queensbury Fire Marshal Chief of Queensbury Central Fire Dept. _ C. There must be adequate parking and access for emergency vehicles D. Cleanup of the area must be completed by 10:00 A.M. the following day, all debris must be cleaned up including all unexploded shells. Noted that Cool Insurance said this company was a very good company and always paid their claims with no problem.
