1985-06-18 cJ, ~ &, Regular Meeting of the Town of Queensbury Planning Board held .Tune 18, 1985 at 8: 00 P .~1. Present: Mr. Dybas, Mrs. Mann, Mr. Sorlin, Mr. Noll and Mr. Macri Absent: Mr. Roberts and Mrs. Levandowski In the absence of the Chairman, Mr. Roberts, Mr. Sorlin was appointed acting chairman. The first item acted upon was the approval of the minutes of the May, 1985 meeting. Motion by Mr. Macri, seconded by Mr. Noll, all voting affirmatively it was RESOLVED THAT the minutes of the meeting held May 1985 are hereby approved. Approved. The first request before the board was from the Queensbury School Playground Committee represented by Cynthia J. Bishop. Mrs. Bishop explained the plans by the group to build a playground the eìementary school. She said they were asking for permission for an off premises signs, in fact two (2) signs for key areas of the Town. ~'!rs. Mann asked if these signs would be temporary and ~·1rs. Bishop said definitely. They would be needed from early July until the end of October Mr. ~1acri added that there is a provision in the ordinance which permits signs if they are connected with a governmental organization. The problem here is this is off premises, if they were to be on school property there would be no problem at all. ~otion by Mrs. ~ann, seconded by Mr. ~1acri, all voting affirmatively it was RESOLVED THAT the Queensbury Planning Board hereby approves off- premises signs 22A and 22B for the Queensbury School Playground Committee to be erected July thru October. Approved. SUBDIVISIONS: Bedford Close, Section 5, Sub. No. 6-84. Represented by Mr. Hccormack, - final approval. Hr. Sorlin mentioned that the problem at previous meetings was with the drainage. He then added that Mr. McCormack has 4bne an out- standing job in putting this together. The Town Engineer, Mr. Scudder, then produced a letter to the Board regarding this project. This letter is attached to these minutes as it was read into the record. The developer, insofar as possible, shall provide the Highway Superintendent a written schedule of major construction events vis-a-vis roads and drainage. The developer shall cause establishment of vertical and horizontal control to U.S.G.S. datum. The developer shall give 24 hour written notice of desired inspections incident to approvals of construction by the Highway Superintendent, and inspections will be made during normal business hours. Kings Plantation - Subdivision No. 2-85 90 lots Peggy Ann Road Tabled - no resolution Valente - South side Walker Lane Sketch Plan Review Attorney Dennis Phillips represented Mr. Valente along with attorney Daniel Smith. Mr. Phillips explained along with Mr. Smith that this is basically a townhouse development planned to be located off Bay Road south of Walker Road. Mr. Valente showed a drawing of what the proposed buildings would look like. He explained that this development is quite large and would take a lot of work. They are basically 4, 6 & 8 plex buildings. Some with 2 bedroom units and some with 3 and that the entire pro- ject would take approximately 12 to 15 years to complete. He introduced Mr. Scudder who is his consulting engineer for this project. Mr. Scudder showed the plans for approximately seventy (70) acres of land. Approximately 3.6 units per acre. There will be two entrances or exits into the project. Mrs. Mann questioned possible problems with septic system in the high area. Mr. Scudder said there were none, there have been tests taken with no problems. )).? Page 3 Planning Board June 18, 1985 Attorney Smith explained further the project adding that he has also been involved ina similar project in chestertown. He added that they were asking for conceptual approval of the project. Mr. Sorlin asked when they thought they would be looking for preliminary approval of the entire project. Attorney Phillips interjected that they would like to begin with phase one (I) beginning sometime in September. Once we have conceptual approval we will have a lot to do to get things together. Mr. Dybas asked how many units would be included in Phase One. Mr. Valente said he would like to put one (I) six (6) plex up to start phase one. Mr. Sorlin added that the land use plan for the Town of Queensbury envisioned just this type of project when we put it together. ~1rs. Mann interjected that the density here is roughly half of what is allowed. Chairman added that there will be a Public Hearing advertised on this as plans develop. Motion by Mrs. Mann, seconded by Mr. Dybas, all voting affirmatively, it was RESOLVED THAT the Queensbury Planning Board hereby gives conceptual approval on the Baybridge plan. Approved. PHEASANT WALK - Phase Two (2) Final Approval. Mr. Sorlin said that they have done everything that we asked. No further questions from the Board Motion by Mr. Dybas, seconded by Mr. Macri, all voting affirmatively, it was RESOLVED THAT the Queensbury Planning Board hereby gives final approval for the Pheasant Walk Subdivision as all requests previously made by the Board have been met by developer. Approved. OLD BUSINESS Public Hearing on Site Plan No. 10-85 still open J~~ Page 4 Planning Board June 18, 1985 Attorney Wilson Mathias, Attorney for the Town of Queensbury, presented to the Board a copy of the Proposed Local Law No. 2 which the Town is considering adopting regarding transient merchants and solicitors. Mr. Sorlin said that he would like to ask for public input at this point in the hearing. He asked for anyone in favor, there were none. Those not in favor Mr. Lombardo, resident of the area said he was not in favor. He added that this man rents from him and he will have no toilet facilities and everyone will be using his. He then added that Mr. Dawson was in violation of his lease. Attorney Desantis, owner of building immediately to the south. Mr. DeSantis sug~ested that the Board should determine if a permanent structure would be put up there. He was not in favor of a possible garage sale atmosphere. Mr. Macri questioned the sanitary facilities. Mr. Dawson said there was no reason to need any as he would not have five employees. Public Hearing closed. a motion by Mrs. Mann to disapprove site plan review 10-85 did not receive a second. After further discussion from Attorney DeSantis it was decided to table for more information. Motion by Mr. Macri, seconded by Mr. Dybas, all voting affirmatively, it was RESOLVED THAT Site Plan Review 10-85 be tabled for more in- formation. Tabled.------ The Board is confused as what has been submitted and requested a legal interpretation. NEW BUSINESS Site Plan Review No. 14-85 - Clifton F. Harriman - to construct two (2) duplex dwellings and one single family dwelling in Suburban Residential 30 Zone on property east side of Ridge Road north of Quaker Road. Page 5 23C1 Mr. Sorlin asked why this application done in this manner, it should probably be a variance. He added that there should be Zoning Board approval before this Board can act. The application should be revised to reflect requirements for SR30. The application, as presented is improper. No action taken SITE PLAN REVIEW NO. 15-85 - W. T. Desbiens - to construct a 4-unit apartment building in Urban REsidential 10 Zone on property situated Meadowbrook Road. Mr. Desbiens represented himself explaining what he proposed which would be 3 two bedroom units. He also showed a rendering of the proposal. Several neighbors present were concerned about drainage. Mr. Desbiens said that he discussed this with Mr. Woodbury who will be the contractor and that he said there would be no problem with drainage. Mrs. ~1ann mentioned that this proposal is located between two private residences and Mr. Desbiens said that was correct. Public Hearing Open Nancy Kelly, Ridge Street asked if this is the only building and Mr. Desbiens said at this time yes. Mrs. Kelly said her concern is for the traffic and septic drainage Resident of 28 Meadowbrook Road presented a petition against the request. Marilyn Tallon presented samples of surface soil from her yard. James ~ihitney 334 Ridge St. concerned about how many buildings there would be in the future. Connie Keep 35 Meadowbrook Road against request. Phil Santisaro 320 Ridge St. Against mainly concerned with water. Mr. Desbiens said he was going by the perk tests. Robert Lynch 320 Ridge st. against Larry Barker 330 Ridge asked if any other area was considered for this project and Mr. Desbiens said he liked this area. Joseph DeMeyo concerened about the traffic. Public Hearing closed. J3/ Page 6 Planning Board June 18, 1985 Mrs. Mann spoke about the fact that this is a one family area strictly residential and the character of the neighborhood would definately change and in her opinion it should remain as is. Motion by Mrs. Mann, seconded by Mr. Dybas The Queensbury Planning Board disapproves Site Plan Review 15-85 as it does not blend with the character of the existing neighbor- hood since the existing neighbors are all single family residential. The apartment building would be placed between two (2) established single family residences. Yes (to deny) Mr. Dybas, Mrs. Mann, Mr. Sorlin, Mr. Noll and Mr. Macri No - None Denied. SITE PLAN REVIEW NO. 16-85 - Tire Warehouse - to operate a tire sales store in an existing building in Highway Commercial 15 Zone property located IS Boulevard. Mr. John McCall represented the Company. Concern about general appearance of the area, Mr. McCall said that they are doing a general re-vamp of the building itself and the outside area is also being cleaned up. Warren County Planning Board approved with concern about the parking on the Boulevard side of the building. Mr. McCall answered to this that there was ample parking in the entire area. Mrs. Mann asked if they have to come to the Town for anything else that they are planning. Mr. Dean said he will need a building permit because of the change in occupancy. Motion by Mr. Dybas, seconded by Mr. Noll, all voting affirmatively, it was RESOLVED THAT Site Plan Review 16-à5 by approved as it will re- hab and put into use an old building and improve the entire neighborhood. The existing building is in a run down condition and should be an improvement to the area. Warren County Planning Board approved with concern for parking and also the Beautification Committee approved. Approved. Roberts, Chairman Queensbury Planning Board Queensbury Town Office Building Bay Road at Haviland Glens Falls, New York 12801 Re: Bedford Close, Section 5 Dear Mr. Roberts: As you know, this project has been under close scutiny for some months by Mr. Naylor, the Planning Board, and me. We have all been concerned about the drainage question, particularly as regards the potential for serious flood damage in storms of unusual intensity and duration. Mr. McCormack and Mr. Buckley, land surveyor and engineer respectively, have completed their studies and plans to the satisfaction of this office and of Mr. Naylor. We are of the opinion that care has been taken to define how water will be routed through the subdivision in a severe storm so as to minimize property damage. In that connection, a computation has been made by Mr. Buckley to quantify the amount of storm water expected to pass through the subdivision in a lO-year design storm, and his calculations are being submitted herewith. Mr. McCormack has shown on the drawings prepared in his off~e the flood routes of the stormwater. Inlets and storm sewers are provided to bring the amount of surface.travel of water within accept- able limits. , In the finished grade planning both for roads and adjacent lots, there have been a number of lots identified on the plan as requiring special grading to protect the homes from flood damage. It would seem the building inspector should take steps to ensure that the lot purchaser is made aware of this condition on the affected lots.
