1986-07-15 J1f MINUTES ,,-. ~ueensbury Town Planning Board Tuesday, July 15, 1986 8:00 p.m. Present: R. Roberts, Chairman K. Sorlin, Secretary S. Levandowski J. Dybas H. Mann V. Macri F. DeSantis B. Britton, Staff The Minutes of the May 20,1986 and June 17,1986 were approved as written. SUBDIVISIONS: Amber Shire, Section 11: - 37 lots off Pitcher Road adjoining Section 1 Amber Shire Slopey Enterprises, Developers "'--' Public Hearing. Mr. Slopey and Tom McCormack present. Application tabled from previous month for development of conceptual plan of lot and road configuration and clarification of total acreage to be included in developable portion of the project. They have eliminated the third entrance, retained the same number of lots by shrinking the green area. Mr. Roberts read letter from Planning Board project engineer, Dick Morse. Mr. Morse questioned if the intent of the zone for each lot to contain a minimum of 30,000 sq. feet. Mr. Roberts explained the clustering provision to him. Al Koechlein, DEC Warrensburg, said that any work being performed within 15 feet of the bed and bank of the brook requires an Article 15 permit. Mr. Roberts said he did not think there would be any work performed that close to brook. Mr. Koechlein said his department will be restudying the areas adjacent to or bordering the brook to determine if they are wetlands and, if so, will classify them. When complete, letters will be sent to property owners. Mr. Roberts said it is not currently classified as a wetland, feels the Board has addressed the stream corridor. Mr. Morse raised a question regarding speed limit in relation to curve radius. Mr. Roberts said they have not heard if curves meet approval with Highway Superintendent, sharper than what he usually recommends. Mr. Roberts said the green area at this stage is probably going to be a Homeowners Association. Roberts left a copy of map with Recreation Commission to see if they would be interested in land for recreational purposes instead of money per lot and he has not heard from the Commission. Mr. Slopey said it would make a good picnic area, good fishing. Mrs. Mann asked about access to areQ. Mr. Roberts said this is new town ordinance that they would be looking for guidance from Town Board and Recreation Commission as to what they want. No one spoke from public. Mr. DeSantis offered motion for Sketch Plan approval, seconded by Mr. Macr i. Motion carried unanimously. RESOL VED: Sketch Plan approval as developer has provided the Board with lot size and road changes requested to comply with all aspects of ordinance. Continued Public Hearing toward Preliminary Approval. "-- J15 Page Two July IS, 1986 '-' Discussion of road design. Board will await Highway Superintendent recommendations. This is in water district. Developer verbally offered green area to Town. Mr. DeSantis suggested that they ask developer to submit to Board a copy of any restrictive covenants being utilized for the subdivision. The covenants address the green area. Jim Winchester, Pitcher Road asked if green area would remain by his house. Mr. Roberts said he is protected by green area and buffer zone. Public Hearing closed. Mr. Macri offered motion for Preliminary Approval, seconded by Mrs. Mann. Motion carried unanimously. RESOL VED: Preliminary Aprroval granted with condition that Highway Superintendent approve roads as laid out on revised plan. Also need Health Department, Water Supt., restrictive covenants, Recreation Commission. Also noted that Mr. Slopey has offered green area to Town. If Town refuses land, Mr. Slopey will have to come up with money. Need input from Town Board and Recration Commission before final approval. Need to know who will own and be responsible for that area: The Town, Mr. Slopey, a Homeowners Association? Subdivision No. 3-86 - Hidden Hills, 155 lots Sherman Ave (Woodbury, Developers) Final Approval. Peter Fitzgerald, Esq., D. Bolster (L. Steves) present. Mr. Sorlin read Planning Board project engineer's report. Highway and Water Dept. approvals in file. Health Department approval expected next week. Field work done and sent to Niagara Mohawk. Mrs. Mann '---- offered motion for final approval, seconded by Mr. Dybas. Motion carried unanimously. RESOL VED: Final Approval granted with the following requirements: Health Dept. approval must be received before Mr. Roberts signs mylar. Subject to satisfying engineers report and recreational fees be received. Subdivision No. 9-86 - Thomas J. Farone & Son, Inc., Peggy Ann Road 10ó lots Sketch Plan. Mr. Farone and D. Bolster present (L. Steves) present. Mr. Roberts noted that this subdivision is not currently in water district. He read letter from Supervisor advising that developer should approach Town Board for agreement to receive water before being placed on Planning Board agenda. Application deleted from agenda for this meeting. OLD BUSINESS: Site Plan Review No. 14-86 - Michael Jordan, west side Upper Ridge Road Public Hearing. Mr. Jordan present. Previously tabled for more information. Mr. Jordan\ submitted changes to his original plan in writing. He will build residence concurrently with two kennel buildings. If noise becomes a problem he can erect barricades on south side next to kennels. The house will be approximately 680' from road. The Board continued with check list from previous meeting. This is lot of record, does not need AP A approval. Case Prime, Planning Board attorney response to Board questions in file. Mr. Dybas offered motion for approval, seconded by Mrs. Levandowski. Motion carried unanimously. '- J910 Page Three July 15, 1986 ( "-./ RESOL VED: The Board approve as applicant has met requirements of the ordinance and applicant has agreed to changes requested by Planning Board. Appliêant's letter of July I, 1986 is a part of motion. Site Plan Review No. 2-86 - T. J. Farone & Son, Inc. Dixon Heights, Phase II Preliminary Approval. Public Hearing already held. Frank Walter, P. E. present. Phase 11 consists of 54 dwelling units. There have been some changes from original conceptual plan. Road has been changed and will come down to existing Dixon Road. When Dixon Road is realigned, the existing Dixon Road will be used as a fronting road and those sections not used will be abandoned. Radius on curve has been changed and there will be a T intersection. Water system will be a continuation of system in Phase 1. Storm water - leaching storm sewers as in Phase l. Have had good success with these, ego Fox Hollow. Project has been discussed preliminarily with Water, Highway Depts. and Charles Scudder. In answer to a question from Mr. Roberts, Mr. Scudder said he had no problems with project. Mr. Morton asked if there is provision for maintenance of storm water drainage system. Mr. Walter said that would be responsiblity of Town when roads are dedicated, along with water and roads. Mr. Berke asked if they had final road elevation (Dixon Road)on Phase 1. Mr. Walter said they do, he did not have that information with him. Mrs. Mann offered motion for Preliminary Approval, seconded by Mr. DeSantis. Motion carried unanimously. RESOL VED: Prelmininary Approval granted - 1ßew realignment of roads and balancing of green areas (more desirable design). '- NE W BUSINESS: Site Plan Review No. 15-86 - Canterbury Woods (Edward Grahl dba Viking Enterprises To construct two additional 6 unit apartment buildings in UR5 zone on property situated on west side of Bay Road (Canterbury Woods Apartments). Tom McCormack and Mr. Scudder present. The most southerly structure will be built this summer, the second one possibly next year and maybe not for several years. There will be a continuation of public water, a slight extension of macadam driveway. The road is a private road. Mr. Scudder said there will be a new wastewater facility and additional drainage and grading. There is provision for expansion of wastewater. Drainage and sewage discussed in detail. They have provision for I parking space per unit. Standards call for more than that but experience here shows they do not need more than that and Mr. Scudder asked the Board's consideration - does not seem wise to blacktop more than is needed. They will maintain a 22 foot carriageway. Mr. Roberts said they were going to recommend to the Town Board that Ordinance be amended - they are requiring too many parking spaces for many buildings and need some latitude to work with. Mr. Ferguson, neighbor, commented on excessive development of Queensbury. Mr. Morton asked where is closet stream - 700 to 800 feet (Old Maids Brook). Mr. Scudder said there would be no harmful effect. Warren County Planning Board approved without comment. Board reviewed check list. Mr. DeSantis offered motion for approval, seconded by Mr. Macri. Motion carried unanimously. RESOL VED: Approval recommended as presented with the single addition that the applicant provide no less than eight parking spaces per 6 unit '-- c '- '- Page Four July 15, 1986 J11 building and in no event in future construct more than 12 parking spaces per 6 unit building. This specifically goes to mitigation of the perme- ability item and parking question and based on the history of this parti- cular complex apparently 8 will be sufficient. Ecëmomic forces will re- quire the applicant to increase the parking to what Town requires should he have to. In this way we are minimizing amount of blacktop and impermeable surface that is being placed on site and improving qualities such as storm water runoff and drainage. ~~ Richard Roberts, Chairman
