RESOLUTION NO. 220 Introduced by Mr. Daniel Olson who moved its

WHEREAS, earl Garb, Highway Superintendent of the Town of Queensbury
recommended that we advertise for bids for removal of designated trees
in the Town of Queensbury, and
WHEREAS, bids were advertised for and received on September 13, 1977, and
WHEREAS, two bids were received and turned over to Mr. Garb, Highway
Superintendent for his recommendation, Now, Therefore be it
RESOLVED, that upon Mr. Barb's request that Town Board of the Town of 1
Queensbury accept the bid of Richard Sears Tree Experts, Inc. and be
it further
RESOLVED, that the bid of Richard Sears Tree Experts was accepted
based on the prodf of compensation insurance which was not provided by
the low bidder as required in the specifications , and be it further
RESOLVED, that the payment for this tree removal is in the Highway
Budget.

to have personnel trained in the Mid 6f photography.
To expedite a solution to this problem, Patrolmen J. Patrick Dee and
David C. Hull are hereby authorized to attend a six session course in
"Beginning Photography" to be held at the Adirondack Community College
beginning on October 4, 1977.
The fee for this course is $24. 00 for each enrollee.

and offered a deed for a town road not less than fifty (50') feet
in width, which is described therein in Schedule "A" attached

of Queensbury has advised that he recommends that this Board
accept this land for highway purposes into the Town Highway

1. The committee urges prompt action by the Town Board on the
letter concerning "Suggested Amendments to the Queensbury
Sign Ordinance", dated May 5 , 1977.
2. As Governor Carey has recently signed into law a regulation
which permits gasoline stations to place price signs on gasoline
pumps , measuring a minimum of 1 square foot. The committee
suggests the following addition to the sign Ordinance:
Page 8, 17. Price signs required on gasoline
pumps by State of Federal laws; not to exceed
minimum requirements.
3. Non-Conforming Signs - Page 15. The committee would lkke
the Town Board to consider changing the 10 year petiod to 5
years. Many planning and Zoning Board members are finding the
10 year period unfair and therefore unworkable. These members
find it difficult to deny variances when competition has
non-conforming signs which will be legal for 10 years.
4. Page 10, 15. - There was a strong consensus not to delete,
change or add to this. section of the Sign Ordinance. The
committee would like tt to be known that it is ready to change
the intent of 15.c to- include price within the definition of
"Products and Services Available", rather than changing the wording
of this section. However, the committee wishes this to be an
unwritten understatding of such an interpretation. It was
suggested that a memo be sent to the Building Inspector,
Planning Boadds, (Town and County) , and Zoning Board, in reference to same.

1. Page 6, No. 7 - On premises directional and/or instructional
signs for the convenience of the general public, ent y Rg
pubic parking areas , loading zones , entraces and exits, self-
service .seaas and similar signs, internally illuminated or non-
illMiRat—e—d7not to exceed 4 square feet. Whaee portion
of sign is text re uirdd by law or regulation, total area may be
increased to a maximum of square fett per face. -Business names
or personal names shall e allowed, not to InETUde advertising
messages. A 6 ft. maximum height shall be allowed, except where
required for public safety and/or by order of enforcement officers,
a 10 ft. max mum e g t may be allowed.
The Committee, with input from'Mr. Bodenweiser and Mr. Liapes , 4=
felt these changes would adequately provide for and regulate signs
' necessary for gasoline stations to provide Self-Service pumps.
2. Page 15, A.4. Written consent of the owner or general lessor of
the building, etc.
It was felt by the Committee that this insertion may need to
be checked with Mr. Joseph Brennan.
3. It was the consensus of the Committee to retain item 5. , Page 16,
as written.

RESOLUTION TO SET PUBLIC HEARING ON AMENDMENT TO SIGN ORDINANCE

Councilman Barber- I noticed with some concern today the
County has endeavored to proceed with the
construction, excavation at the intersection
of route 9 and, or rather Quaker Road and
Bay Road, project. Before the installation
of a substantial traffic light system, which
has been very much of a concern, of the Board
for the last year and a half, as to who
was going to pay for it. Since we have
notified the County on several occasions ,
that our intent was not to pay for any
elaborate lighting system that would cost
somewhere in the vicinity of 35 to 40
thousand dollars. I would like to intau-
duce a resolution to officially notify
the county that we do not have the intent to
do so.
Supervisor Brandt- First of all is there a second to that motion?
I have discussed this on the County level I
am not aware of what is happening but I can
tell" you what was decided. The- County would
install while it is handling the construction,
the base concrete footings to accept the type
ad signing that Fred Austin wanted to see
there or was designed for the road. To
install a conduit system within the road
so that at a later date this could be
installed without tearing up a lot of road,
if it were decided' The cost of those items
was ret4tiveky small and the' big dollars came
if and when the elaborate system was put in.
It was felt that it would be intellegent
right now to do this and that is my informa-
1 tion.
Councilman Barber Is the conduit presently existing there?
Supervisor Brandt It is my understanding that it-was to be
installed. .
Councilman Robertson- I believe that sometime in the past we
agreed• dhat it would make sense to put the
conduit under the road for that.
Councilman Barber' - I agree that we agreed to it, but I do not
see, any. conduit. That is my concern.
Councilman Robertson- Again, you have to go back to Fred, I would
assume that' they were installed before the
paving put down.
Councilman Barber- Hopefully yes, but knowing the way things
have gone I would not necessarily agree to
that.
Councilman Robertson I- understand your concern.
Councilman Barber- I looked at it today and I did not see any
conduit. I am ,just afraid that we will see
some lights there before, and then we will
see a large bill.
Supervisor Brandt There is no action by the-,County to install
lights and to bill them to the Town. It is
well understood`by ,the County that the Town
does not intend to install the elaborate lights
that were proposed and that it is really our
problem at this point all they have to do is
establish the fixtures to accomodate them
if in the future BhWone wants to put them in.
Councilman Barber- I will rescind my motion, due to the fact thap
you have given me a rekative guarantee that
that is not going to happen and that our
conversation is verbatim in the minutes.
Councilman Robertson- Requested that the Highway Committee and
Lighting Committee to study the intersection
of Assembly Point and Route 9L . . . not lighted
at present. . .
Supervisor Brandt- The Town is working with Niagara Mohawk to
test new lighting on Bay Road and Quaker Road

September 22, 1977
-- To the Councilmembers- of the Town of Queensbury,
I, Marilyn Tallon, living at 9 Meadowbrook Road. , Queensbury am unable
to attend this meeting tonite. However, would request traffic signs
for the following reasons.
Although in Queensbury, Megdowbrook .Rda between, Ridge and Quaker Roads
and the west. side of Meadowbrook between Quaker And Cronin is in the Glens
Falls City. School Districk.
. . . Several children kAndergarten age through sixth gaade have to walk
to school without. sidewalks or signs to -warn motorists of small children.
This is an especially dangerous situation in rainy or snowy weather, not

to mention icy conditions with cars and pedestrians sharing the road.
I feel it would alleviate the situation if road signs could be placed
at these following appropriate areas :
1. ) Two "slow children" walking signs or two the type depicting
children walking -as cars enter either side of Meadowbrook Rd. off Quaker Rd.
2.) Two "school zone" sign*.
a.) one to be seen as motorists travel south on Ridge from
QIL&er possibly well before the t®wn line. Here again,
these are Queensbury residents using the city school.
b.) one to be seen as motorists travel south on Meadowbrook
towards Ridge St. This will provide the Meadowbrook road
and Ridgedale children a somewhat safer walk to school.
Perhaps if the sings cannot be placed an even better more notickable
aid would be->flakhing lights such as those used at the Junior High School
on Glen Street and at the Queensbury schools on Aviation Road.
Please remember that although this is a city school didtrict, these
children are Queensbury residents. I feel certain that Queensbury
will act for their welfare.

Arthur Turnbull- A contractor' s liability under workmen's
compensation what is the statute regarding
that?
Joseph Brennan- There are minimum standards that must be
Town Counsel met. . .in my opinion an emplyyer hiring
someone and not havd*g the coverage is
running a great risk. . . . there is nothing
that says that pyu have to have it.
Councilman Robertson- Noted that if a job is subcontracted and the
subcontractor does not have workmen's
compensation the prime contractor can be
made to cover the workmen's compensation.
This would be the Town' s situation that we
could be tagpd for the subcontractor' s
compensation.
Walter Grishkot- Reviewed the Balloon Festival for this year
Gepdbaber 30 through October 2nd. at
Adirondack Community College. . .Outlined
future plans for the Festival. . .Requested
that the Town Board consider monies in the
publicity fund for' the Balloon Festival. . .
for next year's budget. . .

Festival you brought the Balloon Festival
to be what it is,, it is a fine tribute
not only to our town and our area but it is
also a fine trubute to you sir, and I would
like to say ublicly to you that I am.

Arthur Turnbull- Is the purchase of 45 acres to expand the
landfill necessary at this time? Noted
that 1,000 dollars an acre is a prime prime
to pay. . .
_Supervisor Brandt- I did attend the negotications with Finch
Pruyh they paid higher than 1, 000 per acre
in that parcel. . .60 acres. . .we chose
a parcel in the 60 acres whibh was usable and
asked a selling price and also an option
price. . .one year. . . to further study the
landfill situation. . .as to whether we need
the extra property. . .
Frances Walter-Councilman- Noted that she was at the meeting Friday. . .
there is a one year no cost option, the Refuse
Agency was advised by counsel to pick up that
option. . .we are not sure that we will use this
property and it would be r4diculous to buIr
the ' land when we are not sure. . . We were
advised to take the one year option that
states 45, 000 a thousand for 45 acres— that
means that it will not go to anyone else for
the year.
Arthur Turnbull Questioned why a short time ago it was a
must that the purchase of land be made because
we were running out of space and now we may
not need it?
Supervisor Brandt- That was stated in the ggper that we would
run out of land . . . the man that runs the
landfill made the statement in his opinion
we would be running out of space where he
was- currently working within a month, he is
not an. engineer. . . the engineer stated that
with the lands we are now using, with&ut
raising the ground level above Ridge Road,
a plan could be developed that could last
as long as two years.
Arthur Turnbull- You are trying to tell me that you have misin-
formed the people. This statement was made
in the press. I projected it to you and you
did not dispute the fact that this was the
situation. That we had a months use of the
landfill and if we did not move fast and grab
the forty five acres from Finch Pruyn, we
were going to have a problem. Am I wrong in
this quotation, Mrs. Walters.
'Mrs. Walter- I do .not know how Mike answered you. I have
my.-own ideas as to what was said.
Mr. Turnbull Was not the month projected, we had a months
use of, the landfill?
Mrs. Walter- At one point it was projected to me that we
had a months use.
Mr. Turnbull- It was expedient that we make this purchase
from Finch Pruyn because we were going to
have to hold our garbage until the deal was
consumated. Now you are saying we have another
, two years.

Mrs. Walter I did. not say that.
Mr. Turnbull- Mike Brandt said that.
Mr. Brandt That is a report I heard--
Mr. Turnbull- I heard this report at the Queensbury School
and Mrs. Walter you heard the same report.
Then we come back here and find out that we
only have a one months use of our landfill
until its capacity was exhausted, am I correct?.
Mrs. Walter- At one point it was projected that we
have about a month. That did not originate L
from the members of the committee but that
was how it was picked up. Exactly what Mik-
said I cothld not tell you-verbatim. I am
not trying to get off the hook. I really
could not tell you exactly what he did say.
Councilman Barber- The .problem has been the right hand does not
know what the left hand has been doing. As
the result of some information that came
down, it came from what was felt was reliable
sources repeated as a one month situation, I
asked for a workshop meeting to be conducted
between the member of this Town Board, that
a ,one month situation was not in fact in my
opinion the case in hand. I asked my fellow
Councilmen to look at the situation as I have
looked at it. They made some inquiries
in depth and they found out that perhaps
there was a mihnimum of two years more space
and that was the reason for asking, on the
part of Mr. Brandt, for asking, for an option
so that the county en#ineers could come up
with a proper system so there wwouldn` t
be panic purchasing. What this Town
Board did in workshop session a week to L-,
ten days ago is comendable because they
really regrouped and took a harder look at it,
some really good independent thinking and as
a result have influenced the County Agency.
We are paying the bill or a bubstantial
portion thereof. That is the reasons why
that unfortunately some of the information
got to the press and now we have an entirely
different viewpoint. That hadnAt gotten to
the press.
Arthur Turnbull- The point of cearification is here as far
as I am concerned. I am satisfied with your
recommendation.
Joseph Daire- Questioned the recent bidding of scrap paper
by the County?
Supervisor Brandt- The practice of the County Purchasing
Agent, he was the fellow that wrote the
specs for both bids and advertised for the
bids. He authorized the sale &n the first,
instance the sale of the scrap too for the
bid that came in. First, let me say on
that bid, I am not in disagreement with .what
was done because if you look at the tvagle
that material you can put on a truck, if you
calculate the cost of trucking from here to
Albany, and if you look at the markup it is
very easy to calculate a man has a hard time
making wages at a fair rate, an3 reasonable
rate of cost tracking. In the second instant
the purchasing agent came first to the refuse
committee and recommended rebidding because
.he had a complaint from someone who said bids
should have been higher. My feeling was if

If the bid should have been higher, why didn' t
he bid, we just went through legal advertise-
ment and that is sour grapes, i voted at that
meeting to award.the bid. We did not have a
legal quorum and we had to rehold the meeting.
Then it went to the County Board and there
it was revealed by the Purchasing Agent that
he had erred in not doing sufficient advertis-
e ing through the known channels of people who
deal in scrap, he could not rectify the error
in..the first case, but in .the second case
he 'could. The only prudent thing the county
o board could ,do was to rebid it. I feel brery
badly that the negative publicity has come to
Councilman Barber who is in this business and
has bid that work and other work. I think in
the future, .for the .good of the county and the
town, he is leaving politics apparently so
there are no conflicts with his conduct of
business.
Mr. Daire- Complimented Mr. Barber on his business.

Mr. Barber- Joe, I thank you for your comments and I
thank Mike for his comments. I did not
anticipate this discussion this evenigg, I
did not want this to be the forum for this
I have let the particular corespondent from
the Post Star use me as a wTt#pping boy with-
out any debate or rebuttle. What Mike has
said is trues all of the things that transpired
were not adequately reported, in fact they
were never reported` the only thing that was
was apparently I was trying to stiff the
county. It was not my intent to do so
because the one thing that has never come
_J out was that- they wanted a guaranteed price
for one year. No one in the scrpp business
can give that kindjf guarantee. I as a
good sound budinessAbid something as low as
possible something I can live with in good
times as well as bad times. That is the
whole problem and that never name out in the
press, in fact it was very irresponsible.
Joseph Daire- Questioned the 5ft. entrance fee to the land-
fill and was there to be a transfer station
in 3o. Qsby.?
Supervisor Brandt- In making the budget is was suggested that
additional transfer stations be established,
in other locations. I think that it is the
feeling of the Agency Members that the one
transfer station on Luzerne Road is very
effective and very cost effective—since
it is a great concern to aht of us in Qsby,
to diminish the traffic going to the landfill
I think it would be in the-best interest of
the Town to establish additional transfer
stations and that is being cranked into the
budgetary process at this time.
