RESOLUTION AUTHORIZING CONTRACT WITH CSEA
RESOLUTION NO. 118 Introduced by Mr. Hammond Robertson who moved

RESOLVED, that the Town Supervisor be and he hereby is authorized to
enter into a contract with the Queensbury unit of -the Civil Service
Employees Association, which contract has been approved by J. David
Little, Counsel to the Town Board of the Town of Queensbury, and a
copy of which contract is attached hereto.

RESOLUTION REPEALING SECTION 28.1 OF THE TOWN OF QUEENSBURY FIRE CODE
WHICH PERTAINS TO BONFIRES AND OUTDOOR RUBBISH FIRES
RESOLUTION NO. 119, Introduced by Mr. Daniel Olson who moved its
adoptEon, 'seconda by Mr. Michel Brandt:
WHEREAS, Section 28.1 .of the Fire Code, adopted by the Town Board of
the Town of Queensbury has been superseded by the enactment of New York
State Enivronmental Conservation Law Sections 9-1105 and 9-1107 and
WHEREAS, the New York State Department of Environmental Conservation is
authorized by law to enforce the aforesaid provisions of law pertaining
to outdoor burning and to control the issuance of permits pertaining
thereto and
WHEREAS, it appears that Section 28.1 of the Town of .Queensbury Fire
Code is duplicative and unnecessary in view of the regulations and con-
trol of the same conduct by the State of New York and
WHEREAS, it appears that Section 28.1 of the Fire Code of the Town of

Queensbury should therefore be repealed from the Town of Queensbury Fire
Code as being unnecessary and
WHEREAS, a public hearing to consider repeal of Section 28.1 has been
held before the Town Board of the Town of Queensbury on the 11th day
of May, 1976 after the posting, publication and making of all legal
notices necessary for the holding of said public hearing, and the Town
Board having fully considered all matters being presented to it pertaining
thereto, now, therefore be it

RESOLUTION NO. 120, Introduced by Mr. Harold Robillard who moved its

WHEREAS, the Town Board deems it necessary to adopt an ordinance number
45, entitled Ordinance to Establish a No-Parking Zone on the Northern
and Southern side of Quaker Road between Lafayette Street and Bay Road, and
WHEREAS, a proposed Ordinance was presented to the Board and after due
notice a Public Hearing was hold thereon by the Town Board on the 11th day
of May, 1976 at 7: 30 P.M. at the Town Office Building, Bay and Haviland
Roads, Glens Falls, New York 12801, and that the Town Clerk gave notice
of such hearing by publication thereof in the Official Town Newspapers
at least once prior to the date specified for such hearing, specifying
the time when and the place where such hearing will be held and in general
terms describing said proposed Ordinance, and
WHEREAS, all persons were heard both in favor of and opposed to said
Ordinance. Now, Therefore be it
RESOLVED, that Ordinance Number 45, of the Town of Queensbury be as
follows:
ORDINANCE TO ESTABLISH A NO-PARKING ZONE
ON THE NORTHERN AND SOUTHERN SIDE OF QUAKER
ROAD BETWEEN LAFAYETTE STREET AND BAY ROAD
BE IT ENACTED AND ORDAINED BY THE TOWN BOARD OF THE TOWN OF QUEENSBURY,
WARREN COUNTY, NEW YORK AS FOLLOWS :
Section No. 1. For the purpose of this Ordinance the word "vehicle"
"park" and "standing" shall have the meaning defined in the Vehicle and
Traffic Law of the State of New York.
.., Section No. 2. No vehicle shall be parked or left standing on the
northern or -southern side of Quaker Road in the Town of Queensbury
r- Warren County, New York, between Lafayette Street and Bay Road, Town of
Queensbury.
Section No. 3. All ordinances or parts thereof of the Town of
Queensbury inconsistent with the provisions of this ordinance are
herbby repealed; provided, however, that such repeal shall be only
to the extent of such inconsistency and in all other respects this
ordinance shall be in addition to the other ordinances regulating
and governing the subject matter covered by this ordinance.
Section No. 4. Any person violating any provisions of Section 2
of this ordinance shall upon conviction be punishable for a first
offense by a fine not to exceed TEN DOLLARS ($10. 00) and for a second
offense by a fine not less than TEN DOLLARS ($10. 00) nor more than
TWENTY FIVE DOLLARS ($25. 00) or by imprison4ient for not less than

TWO (2) nor more than TEN (10) days. The third or any subsequent offense
within one (1) year shall be punishable by a fine not to exceed ONE
HUNDRED DOLLARS ($100. 00) or by imprisonment not to exceed THIRTY (30)
days or by both such fine and imprisonment. In addition to the aforesaid
penalties, the Town Board of the Town of Queensbury may institute any
proper action, suit or proceeding to prevent, restrain, correct or abate
any violation of this ordinance.
Section No. 5. This ordinance shall take effect immediately.

WEEKS FROM AN R-3 CLASSIFICATION TO A C-3 CLASSIFICATION

WHEREAS, George T. Weeks has presented to the Town Board of the Town of
Queensbury an application for the rezoning of his property, from an R-3
Classification to a C-3 Classification, and
WHEREAS, a public hearing was held pursuant to Section 11:100 of the
Zoning Ordinance of the Town of Queensbury for the rezoning of the
described area as such districts are shown on the official zoning map
of the Town of Queensbury and provided for in the Building Ordinance
in the Town of Queensbury, and
WHEREAS, such hearing was held pursuant to notice duly given at a
meeting of the Town Board in the Town Hall, Town `of Queensbury, Warren
County, New York, on April 27, 1976 at which time all persons desiring
to be heard in opposition to, were given the opportunity, and were
heard and the public hearing having been thereafter closed, Now, j

RESOLVED, that the following property in the Town of Queensbury as shown

Councilman Robillard-This Town Board in the past has set down a precedent
where by if a request is made to rezone land you give an idea of what is
going in. . .I do not feel that I want to be a part of rezoning for speculation.
If Mr. Weeks would come before the 'Town Board with a proposal of what might
go there, seeing that we have had so much opposition from the neighbors,
I feel that I might look favorably upon that, but just to rezone for
speculation I do not feel that I want to take part in that.
Councilman Barber-It has come to my attention that during the SRi and
Shore Rezoning Application that you were approached by past members of
this Town Board in respect to having your property also rezoned at that
time, that you were not interested at that time. And you were opposed
to the Ski and Shore application.
Mr. Weeks- I never turned down any approach to have it zoned commercially,
I never opposed Ski and Shore application for commercial zone. I did go
before the Town Board at their request and stated that my land was commercial
speculation.
Councilman Barber- Do you have any concrete plans presently for this
property?
Mr. Weeks- No.
Supervisor Brandt-It isn' t the intent of the Zoning Ordinance to vote
on a particular use of that land or particular owner and his use of the
land) but rather, I feel that it has to be looked at only as the best
use of that land in the long run for the benefit of the Town. I personally
feel that we should not consider a parcel of land purely on the basis of
proposed us% MWI�rather on the basis of its proximity in this case of the
Northway, the traffic flow, and patterns of the Town, what is the logical
development of the Town. I feel that we presently have spot zoning we
should -zone the region as it is being forced by the Northway, as commercial.
John Lemery-I just want to respond to Mr. Robillards statem%ts because I
believe the Board has a precedent in connection with zoning a parcel without
having a specific use. I was at a meeting where a parcel of land on
Quaker Road was rezoned because that land was contiguous to another parcel
which the Town Board felt in the best interest of the area should be rezoned.
Mr. Robillard-They rezoned acreage on the Big Boom Road and I was opposed
to that also. I feel if Mr. Weeks wants this rezoned, he should show us
what is going in there.
RESOLUTION PROCLAIMING FIREMEN"S WEEKEND KNOWN AS`HERITAGE DAYS"

WHEREAS, there will be a need for professional engineering services in
local areas in regard to the Warren County Sewer- District, Now, therefore

RESOLVED, that the Town Board of the Town of Queensbury authorize the Super-
visor to enter into contract with Rist Frost Associates for engineering
services as per their April 19, 1976 proposal entitled: ENGINEERING
SERVICES ON LOCAL SEWER SYSTEMS FOR THE WARREN COUNTY SEWER DISTRICT at a
cost of $17,600. 00 of which 75% is to be reimbursed by the Federal Government
and 122% by the State Government.

the former Queensbury Water District and the Queensbury Consolidated Water
District in the Town of Queensbury, Warren County, and all actions and

thereof upon the belief that said assessments were validly and legally

RESOLUTION TO AUTHORIZE CONTRACT WITH GLENS FALLS SENIOR CITIZENS CENTER
RESOLUTION NO. 127, Introduced by Mr. Robert Barber who moved its adoption,
seconded by Mr. Daniel Olson:
WHEREAS, the Town of Queensbury has heretofore contracted with the Glens
Falls Senior Citizens Center, Inc . to provide services for the elderly, and
WHEREAS the New York State aid is available for the establishment, main-
tenance and expansion of senior citizens center programs, which aid was
expanded by the provisions of chapter 1001 of the laws of New York 1974,
providing among other things that State aid will be available to pay up
to one-half of the entire amount of approved expenditures for a municipal
program, and
WHEREAS the Town of Queensbury desires to continue its support of the Glens
! Falls Senior Citizens Center, Inc. under provisions of law so as to be
eligible for state aid as a co-sponsoring municipality,
NOW, THEREFORE BE IT
RESOLVED, that the Supervisor of the Town of Queensbury be and hereby is
empowered to contract with the Glens Falls Senior Citizens Center, Inc.
for the furnithing of services to the elderly residents of the Town of
Queensbury for the year 1976 and the payment of $1900.00 is therefor
is hereby approved, and the Supervisor is hereby directed to execute the
contract on behalf of the Town and a copy of such contract, duly executed,
shall be filed with the Town Clerk.

"Be it known that the Kiwanis Club of Queensbury
celebrates their 7th year of organization on May 13th
in this Bicentennial Year 1976. Kiwanis International
earlier this year celebrated their 61st year. The
motto of Kiwanis "We Build" has had an impact on the
Town of Queensbury. One significant project, the Pole
Barn at Gurney Lane, was due to the effort of members
working on numerous fund raising projects in order to
complete a club committment and then turn it over to
the town. To give of oneself to help community or
individuals has its own reward. "

Joseph DeMeo-18 Sargent;. Street- question the board as to when something
will be done to Sargent Street in regard to drainage and-the re-
surfacing of the road. . .
Supervisor Brandt- noted that .Tuesday Night the Town Board and Mr.
Garb will be doing a survey and we will look at that.

Susan Goetz- If the sign ordinance should differ from what was presented
at the last Public Hearing will there be another hearing?
Town Counsel-Brennan- If there is a substancial change . . yes. . .

essance the proposed ordinance. . .no. . .
Gerald Hammond-16 Seward Street-noted a water problem in his area. . .
now effecting the Sewage tanks and causing a health hazard. . . . cellars
being rotted by the water. . .
Councilman Robillard- question to Mr. Martindale how far did the line
go up Seward Street?
Mr. Martindale- Just went to Seward Street. . .
Councilman Olsnn- noted that it probably would have drained it but
the residents voted it down. . .
Mr. Bob Havens- The line goes 50' beyond Seward Street. . .also complained
about the water table in the area. . . noted that the house footings
were setting in water. . .
Mr. Chuck Thor 130 Grant Avenue- what has to be done to

vote on a the drainagedisetict?
Councilman Olson-Another petition must be submitted and current prices
on the drainage-district will have to be obtained. . .
Mr. Chuck Thornequestioned if the Town and City could place a sidewalk
for the Children from Grant Avenue to Coolidge Avenue. . .protection
for the children in the Winter. . .
Supervisor Brandt- We will have to take a look at that. . .
Mr. Lundgren- noted that if the drain on Grant Ave. was opened it
would alleviate the problem of water. . .
Mr. Al Maek- 11 Seward Street- noted that the water level has been
raising for the past 10 years. . .
Unknown- gave history of the plugiUN& of the grant Avenue Drain. . .
H. Russell Harris- noted that the Drainage Project was a WPA project
and he felt that as such it did not belong to the City but to everyone
and they had no right to dump cement into the drain. . . this AevJ be
brought to Court. . .
