SUPERVISOR STROUGH- Requested a moment of silence for John Webster who passed away
on July 22, 2015. Mr. Webster was a hero to those who knew him. He was a hero for three (3)
reasons. First, because he was a person that deeply cared about his family, friends, Town, and
Country; he would do anything for you as long as it was the right thing. Second, was his duty to
his Country; he received a purple heart and a cluster for his purple heart. The third reason why he
was such a hero was for his public service. Most notable was his four (4) terms as Town
Supervisor here at the Town of Queensbury. Our Town office is here today because of him. He
was very well respected.

SUPERVISOR STROUGH- Janet Westcott has a residence at 50 Rockhurst Road and she has a
cesspool system on her property that is not good for the health of the Lake; it's not good for
anything. Given the constraints of the property, she's asking to put a three thousand (3,000)
gallon holding tank, actually, two (2) holding tanks of fifteen hundred (1,500) a piece in between
her house and Rockhurst Road. So she needs two (2) variances: one (1) foot from the west
property line, in lieu of the required ten (10) foot setback and three (3) foot from a structure in
lieu of the ten (10) foot setback. Now we've had others like this and we've approved them, but
this is a public hearing on this and we'll see what the public has to say. It also involves
decommissioning the existing inadequate absorption system. That's a nice way of putting what is
currently is there. This new system reaches the goal of the owner, which is to place a system that
will be good for the Lake's environment. All right, so given that Tom, is there anything that you
would like to add?
TOM CENTER, NACE ENGINEERING-No, other than exactly what you said, two (2) fifteen
hundred (1,500) gallon holding tanks, remove the existing septic system. Also, the tanks will be
traffic rated with steel covers on all of the outlets so that we can access that for pumping out.
Since we are so close to the road, they will be traffic rated.
SUPERVISOR STROUGH- Good. That was my one (1) question, because I know that
everybody parks there. It's one (1) of the few places to park along Rockhurst, is that little eight
(8) foot margin between the road and the house, or whatever it is ten (10) foot maybe. Does the
Board have any questions for...
COUNCILMAN IRISH- I have two (2) questions. Is there a reason that you can't move the
system south so that you don't need the one (1) foot variance?
MR. CENTER- The further south we go we get further from the existing plumbing. We already
have to over excavate for the existing system to try to keep all our work in the same location. It
is a built up block foundation. All the plumbing comes out of that location. It would be very
difficult to come across ...
COUNCILMAN IRISH- The other question I had and it's more along the lines that we did
something similar over off of Ridge Road, was moving the septic field or the holding tanks
closer to the road so that they didn't need...you're still going to need the variance but is there a
reason we wouldn't go closer to the road instead of closer to the house?
MR. CENTER- Certainly we could go right on the property line or I don't know if they want us
in with the Town right of way or closer to the road.
COUNCILMAN IRISH- I know we did that over on Ridge.
MR. CENTER- ...excavation in there is going to be very tight.
SUPERVISOR STROUGH- In this case I think you're talking about the difference between one
(1) foot and two (2) foot.
MR. CENTER-We're going to be pretty close to that location anyways when we get it in there.
COUNCILMAN IRISH- Okay.
MR. CENTER-We are removing those planters that are in front of the house. We're trying to
avoid those disturbances of the steps also.

SUPERVISOR STROUGH- In reading the plans Tom, I saw, I was reading about the alarm
system. Pretty standard except that it says that when the third tank gets half full. What's, we have
the two (2)?
MR. CENTER- I'm sorry, it should be second. It's two (2)tanks.
SUPERVISOR STROUGH- Okay, no big deal.
MR. CENTER- It should be when it gets to the third level that's when the ...
SUPERVISOR STROUGH- Yeah, but it refers to three (3)tanks and that was just a carryover
from the previous job, okay.
MR. CENTER- Yeah.
SUPERVISOR STROUGH- Any other questions?
COUNCILMAN CLEMENTS- I just want to make clear that the variance is for nine (9) feet and
for seven (7) feet.
MR. CENTER- Correct, yes. Nine (9) feet is...
COUNCILMAN CLEMENTS- West property line.
MR. CENTER-West property line, yeah, and they're asking for nine (9) feet of relief or one (1)
foot from the west property line, and seven (7) feet from the structure.
COUNCILMAN IRISH- And who's the property owner on the adjacent property?
MR. CENTER- There's lands of George Young and Michael Doran and Margaret Doran.
COUNCILMAN IRISH- Have you had any conversation with them?
MR. CENTER- I believe Mr. Westcott may have taken the drawings...Mrs. Westcott's son-in-
law...
COUNCILMAN IRISH- And I've been out of town John, so I don't know if we got any, did we
get any correspondence from them?
SUPERVISOR STROUGH-No, and in the past the fellow neighbors at Rockhurst have looked
at this system favorably because we know where it is and that's the important thing.
MR. CENTER- And I did Mrs. Colacino's across the street and just of the south of her Mrs.
Demarco's also.
SUPERVISOR STROUGH- Okay.

WHEREAS, Janet M. Westcott (Applicant) filed an application for a variance from Town of
Queensbury On-Site Sewage Disposal Ordinance, Chapter 136, §136-11, which requires applicants
to obtain a variance for holding tanks, as the Applicant wishes to replace an existing wastewater
system with a new, 3,000 gallon holding tank system, and
WHEREAS, the Applicant has also applied for additional variances from Chapter 136 to
allow placement of such holding tank system:
1. 1' from the west property line in lieu of the required 10' setback; and
2. 3' from a structure in lieu of the required 10' setback;
on property located at 50 Rockhurst Road in the Town of Queensbury, and
WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health conducted a public hearing concerning the
variance requests on Monday, August 3rd, 2015, and
WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners
within 500 feet of the subject property,
NOW, THEREFORE, BE IT
RESOLVED, that
1. due to the nature of the variances, it is felt that the variances would not be materially
detrimental to the purposes and objectives of this Ordinance or other adjoining
properties nor otherwise conflict with the purpose and objectives of any Town plan or
policy; and

2.0 PUBLIC HEARING
PUBLIC HEARING TO EXTEND TEMPORARY MORATORIUM ON RESIDENTIAL
MULTIFAMILY CONSTRUCTION WITHIN BAY ROAD OFFICE DISTRICT

SUPERVISOR STROUGH- The next item is that we have a public hearing on a local law to
extend the temporary moratorium. This is very similar for the same reasons as we put in place

the moratorium before; we've had information come forward. For example, there was a study
done and the study says if you build out Bay Road and it builds out in full capability of what it's
capable of doing you'll be at a level of five hundred and sixty nine (569) gallons per minute,
which exceeds the capacity of the system even with a hundred and twenty thousand dollars
($120,000)worth of upgrades to exceed the capacity beyond four hundred and twenty five (425)
gallons per minute. Remember what I said before? Five hundred and sixty nine (569) gallons for
the total capacity worst case scenario... It would cost millions and millions of dollars. For one
thing, we would have to replace the entire line going down Cronin Road. All right, so our full
build out exceeds capacity by thirty four percent (34%). And yes, that's a worst case scenario,
but it is something in this Board's minds that we need to do something. Maybe it doesn't have to
be drastic but it needs to do something. So there's some ideas out there. Emails were floating
kind of thinking about things right now, but in order for us to try and include some of the things
we want in the Bay Road Office District and we like to package it together and this moratorium
as soon as possible. But this is to extend it for two (2) months. It does give a reason and it's the
same reason, I'm just reading the prior moratorium reasons. First of all is the engineering study,
but complimenting this consideration is the fact that residential uses typically have more demand
on sewer capacity than commercial uses. Second, there is concern over the diminishing of the
desired commercial development that the Town has historically fostered, especially along the
Bay Road Corridor. That multifamily uses overly consume properties that would otherwise be
used commercially. There exist studies that demonstrate that commercial uses bring jobs, help
reduce taxes and require less in governmental services than residential area, and so forth. So this
is offering an extension until October 9t1i but I'm sure this Board will like to get it over with in
August. That's, I think, our goal. But we gave us two (2) months just to have enough room. So
that's what this moratorium is and I'm going to allow a public hearing on it. But before we go to
public hearing is there any comments by any of the Councilman first?
COUNCILMAN CLEMENTS- I just had a couple I just want to make clear.
SUPERVISOR STROUGH- Sure, go ahead.
COUNCILMAN CLEMENTS- One of the things that we had talked about before this was
offering some scenarios from Craig Brown.
SUPERVISOR STROUGH- Yeah.
COUNCILMAN CLEMENTS- I'd like to get together and see some of those as quickly as
possible.
SUPERVISOR STROUGH- Did you see the email?
COUNCILMAN CLEMENTS- I did.
SUPERVISOR STROUGH- Okay.
COUNCILMAN CLEMENTS- The other thing, is August 16th is that our workshop date?
SUPERVISOR STROUGH- August 12u'
COUNCILMAN CLEMENTS- August 12t1i thank you. That's when we are going to go over this
some more?
SUPERVISOR STROUGH- We can put that on the agenda.
COUNCILMAN CLEMENTS- Thank you, that's all I have.
SUPERVISOR STROUGH- Okay, anything else? All right, is that any member of the public that
would like to speak to our potentially extending the moratorium? Surprised if you didn't...

DAN VALENTE- I wanted to obviously...my position this moratorium. I think we had the
opportunity to look at the concerns... the sewer on Bay Road. I continue to reiterate that this
district, which is not a district, that this extension on Bay Road is never built to accommodate
every parcel on Bay Road. We're looking at incorporating...the Town Board years ago made a
conscious decision to build the system the way it is today and circumvent doing it a proper way
in creating a sewer district. The precedent was set back then that this system was going to be a
first come first serve user system. All this money we're spending on studies, tax payer dollars,
we're looking into a crystal ball which obviously nobody has. So, we're guessing at what people
may or may not develop down the road, we may not have any more development on Bay Road
ever. So we continue to spend time and money to extend and drag this thing out when there's
absolutely no justification for it. It's more an issue of the zoning. I understand your personal
views as far as the Supervisor goes, it's clear, he doesn't want apartments on Bay Road or any
multi-family, senior housing, any of that nature, but there's really no justification. This sewer has
been used as a crutch or a lever to try to manipulate changes. There's no justification for this.
The Town has grown at the same rate as the rest of this country has; it's about one percent (1%)
annually. So you get roughly two hundred and eighty (280) and three hundred (300) new
residents a year in the Town, there's growing pains. If you have issues with your sewer system
downstream, maybe that's the area you need to focus on so that you can improve down the road
and build a system that is really appropriate for Bay Road. But you would have to build a whole
new system. We have dedicated property to the Town to build a system properly before we
ended up with what we have and the Town Board at that time, not this Board, decided to go a
different route. So, obviously, I'm adamantly against this whole thing. I really think, as I said
before, a witch hunt on multi-family and I really feel you guys, if you do make a change to this
zone, it is going to significantly put a hardship on myself and de-value my property and see that
as a taking and then... So please look at this appropriately. You can't limit somebody just
because you want to save it for somebody that you don't know is ever going to use it...first come
first serve, always. Thank you.
SUPERVISOR STROUGH- Just a couple of corrections.
MR. VALENTE-What's that?
SUPERVISOR STROUGH- One (1) is it is a district.
MR. VALENTE-Bay Road is a sewer extension.
SUPERVISOR STROUGH- If you look on the zoning map, it's called a Bay Road Office
District.
MR. VALENTE-No, I'm talking about the sewer.
SUPERVISOR STROUGH- Yeah, but you didn't make that clarification.
MR. VALENTE- Oh, I'm sorry.
SUPERVISOR STROUGH- The other thing is I'm not opposed to apartments on Bay Road
because I believe within one (1) mile we have about five hundred (500) of them, or are going to.
There's the hundred and forty eight (148)that you proposed and got approved.
MR. VALENTE- Yes.
SUPERVISOR STROUGH- And Mr. Schermerhorn bought the property and is doing that.
There's another hundred and forty two (142) over here and I believe there's another hundred
(100) or two hundred (200).
MR. VALENTE- There's a need.

SUPERVISOR STROUGH- Well, there's also a balance, okay. So, well thank you for your point
of view.
MR. VALENTE- You know we're proposing senior housing. Very good.
SUPERVISOR STROUGH- Okay. Anybody else? Yes, John.
JOHN SALVADOR- As I understand, Mr. Strough mentioned earlier that you're faced with
millions and millions of dollars in improvement costs if you try to improve the Cronin Road
sewer, and that's your real problem. So, somehow, some way what you've got to do, whatever
you do...you've got to take the pressure off the capacity of the Cronin Road sewer line. The way
to do that is to take the sewage that I suggested in your last meeting. Take the sewage on the
west side of Bay Road directly to Quaker Road through a pump station in the force main. Now
Mr. Schermerhorn put a pump station in and a force main about the same length we're talking
about here for less than two hundred thousand dollars ($200,000). That's the answer. Your
design that you're faced with now shows a new eight inch (8") line underneath Bay Road
connecting the west side with the east side to go down on Cronin Road, you'd save that money,
whatever that is. But, somehow the day is going to come when you've got to relieve the pressure
on Cronin Road. This is the time and the place to do it. If you can't take the sewage to Quaker
Road, take it all the way to the force main down Bay Road. Connect it down there. There are
solutions. What I would like to suggest is that you get some cost figures on this. You can ask this
consultant, who's presently working to put together some numbers on this alternative and it
should be a SEQRA alternative. Thank you.

WHEREAS, on or about Jul` 28th, 2015 the Warren Count` Planning Department considered the

WHEREAS, on or about January 27th 2015, the Queensbury Planning Board considered the
moratorium and adopted a Resolution whereby it would recommend careful review of projects as

the Director of Building and Codes Enforcement's (Director) engagement of the monthly lawn mowing
services of Cheap Pete's Lawn Care for certain properties in states of serious neglect,and
WHEREAS,the Director has advised the Town Board of an additional property in a similar state of
neglect located at 1 Moorwood Drive in the Town of Queensbury,and
WHEREAS, although the Town Court can impose fines, it lacks the authority to mandate ongoing
maintenance,and
WHEREAS, in accordance with Town Law §64 (5-a), the Town Board may require the owners of
land to cut, trim or remove from the land owned by them, brush, grass, rubbish or weeds or to spray
poisonous shrubs or weeds on such land, and upon default, may cause such grass, brush, rubbish or weeds to
be cut, trimmed or removed and such poisonous shrubs or weeds to be sprayed by the Town and the total
expense of such cutting, trimming, removal or spraying may be assessed by the Town Board on the real
property on which such grass, rubbish, weeds or poisonous shrubs or weeds were found and the expense so
assessed shall constitute a lien and charge on the real property on which it is levied until paid or otherwise
satisfied or discharged and shall be collected in the same manner and at the same time as other Town charges,
NOW,THEREFORE, BE IT,
RESOLVED, that the Queensbury Town Board directs that a final notice shall be sent by U.S. mail
to the Property Owner of Record as set forth above requiring that they mow the lawn on their land within 10
days and failing to do so,the Town will cause such action to be taken and the cost thereof will be assessed by

WHEREAS, in 2014 the Warren County Soil and Water Conservation District (WCSWCD) was
awarded a stormwater improvement grant funded by the New York State Department of Environmental
Conservation (NYSDEC)through its Round 11 Water Quality Improvement Program, and
WHEREAS, the Town of Queensbury was included in WCSWCD's grant application as a
prospective partner with the following Projects identified for funding:
• Assembly Point Knox intersection- bioretention or porous pavers need test pits ($3,000)
• Assembly Point Sunset intersection- two drywells ($8,000)
• Pickle Hill Tributary- three drywells ($12,000)
• Lockhart south project- Large drainage in combo with Bay Road- one drywell ($4,000)
• Lockhart north project drywells, turnouts- one drywell, check dams, stable turnouts ($4,000)
• Chestnut Road Glen Lake- one drywell and paved swale ($4,000)
and
WHEREAS, these Projects were developed from discussions with the Queensbury Highway
Department and reviewing the "Town of Oueensbrrry Stornnvater Identification Project" (March 2013),
and
WHEREAS, the dollars attached to each Project are estimates, as the Town has the ability to
spend and be reimbursed up to and including $39,000 for these improvements and the eligible
reimbursable expenses would include supplies and materials, and
WHEREAS, as with many grants, some Projects may have been completed prior to the award or
the date that reimbursement may be eligible, so if a Project on this list has been completed prior to
January 1 2015, it is not eligible for reimbursement; however, WCSWCD would work with the Town to
identify additional water quality improvement project locations that could be substituted, and
WHEREAS, the Town's contribution to the grant is an in-kind service match commitment which
would be through force labor, equipment usage and any supplies and materials that are not eligible for
reimbursement, but assist with the implementation of the Projects, and
WHEREAS, NYSDEC will withhold 10% of the grant expenditures until the grant is closed out,
and if the Town has vouchered for $39,000 in supplies and materials, the Town would receive $35,100
until the grant closeout and the remaining $3,900 would then be paid, and

WHEREAS, WCSWCD submits reports and reimbursement request quarterly, and NYSDEC has
generally been providing reimbursement within 8 weeks so that once WCSWCD receives payment, it

at grant closeout, and
WHERESA, as a result of changes in the NYS grant programs, the Town will need to enter into a
Memorandum of Understanding with the WCSWCD regarding this grant Project, and the WCSWCD
has prepared and presented such proposed MOU at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby accepts the up to $39,000 in grant
funding as delineated in the preambles of this Resolution, and
BE IT FURTHER,
RESOLVED, that the Town Board further establishes appropriations and estimated
revenues as follows:
• Increase Revenue in Home and Community Aid Account No.: 001-0000-53989
by $39,000;

Town's Purchasing Agent to publish an advertisement for bids for the Dixon Road Culvert
Replacement Project in the official newspaper for the Town of Queensbury, and
WHEREAS, on July 29t1i 2015, all received bids were opened and reviewed, and
WHEREAS, the Purchasing Agent and Chazen have recommended that the Town Board
reject the bid as only one such bid was received and by re-advertising, it is hoped that the Town

IN ELK RIDGE SUBDIVISION

WHEREAS, Foothills Builders, LLC (Developer) has offered a deed to the Town of
Queensbury to dedicate Elk Ridge Drive in the Elk Ridge Subdivision to the Town of Queensbury
as more particularly described in a survey map prepared by Bolster and Associates, Professional
Land Surveyors, dated July 14, 2015, and
WHEREAS, the Town Highway Superintendent has inspected the road and
recommended its acceptance contingent upon the Developer completing the top coat of the
black-top within two years of the date of acceptance or by August 3rd, 2017, and if applicable, all
drainage easements being in place, and
WHEREAS, the Developer has provided the Town with a $21,712 cash escrow to ensure
placement of the top coat on the road consistent with the Town Highway Superintendent's
requirements, and
WHEREAS, the Town Water Superintendent/Wastewater Director has indicated that an
inspection has been made of the water mains and appurtenances installed in the Elk Ridge
Subdivision and the installation has been made in accordance with the requirements of the Town
Water/Wastewater Department, with the Developer to be responsible for the installation's repair and
maintenance for one year from the date of Town Board approval of the road dedication or through
August 3rd, 2016, and

WHEREAS, the Town's Director of Planning, Zoning and Code Compliance and/or
Director of Building and Codes Enforcement have confirmed that they have inspected Elk Ridge
Drive and it was found to be in general compliance with the requirements of their offices except
that adequate lot numbering signage and permanent survey monuments have not yet been
installed,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby accepts and approves the dedication
of Elk Ridge Drive in the Elk Ridge Subdivision contingent upon the Town Highway
Superintendent confirming that street and/or stop signs have been installed and all documentation
related to such dedication being in form acceptable to Town Counsel, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Supervisor to execute,
sign and affix the Town seal to any and all documents necessary to complete the transaction
including the Escrow Agreement substantially in the form presented at this meeting, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Developer to record the
deed in the Warren County Clerk's Office, after which time the deed shall be properly filed and
maintained in the Queensbury Town Clerk's Office, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Clerk to add
the roads to the official inventory of Town Highways as follows:

distance of 1,064±' and .0 hundredths of a mile and ending at a cul-de-sac.

WHEREAS,the Queensbury Town Board wishes to approve an audit of bills presented as a Warrant
with a run date of July 30th,2015 and a payment date of August 4th 2015,

RESOLVED,that the Queensbury Town Board hereby approves the Warrant with a run date of July
30th 2015 and a payment date of August 4th,2015 totaling$636,038.61, and
BE IT FURTHER
RESOLVED,that the Town Board further authorizes and directs the Town Supervisor and/or Town
Budget Officer to take such other and further action as may be necessary to effectuate the terms of this
Resolution.

WHEREAS, John Strough has offered to donate $600 to the Town of Queensbury for the
construction of a sign to be erected at the Rush Pond Trail, thanking the various supporters of
construction of the Rush Pond Trail, and
WHEREAS, the Town Board is honored by this generous offer, feels that such donation will
benefit Town residents, and therefore wishes to approve and authorize such donation,

NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board, in accordance with New York State Town
Law §64(8), hereby approves and accepts the $600 donation from John Strough, and

RESOLVED, that the Town Board authorizes and directs the Town Budget Officer to
deposit the donation in such account she deems appropriate, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Clerk to send a certified
copy of this Resolution to Mr. Strough with a letter from the Town thanking him for his generosity.

JOHN SALVADOR- Spoke to the Board regarding sewer districts.
GEORGE WINTERS-
• The new Dollar Store on Main Street is a nice looking building.
• The brush needs to be cut back on Veterans Road (Sherman end) as well as on
Crownwood.
DAN VALENTE- Spoke to the Board further regarding the sewer district/extension along the
Bay Road Corridor.
7.0 TOWN BOARD DISCUSSIONS
COUNCILMAN VANNESS (WARD IV)- ABSENT
COUNCILMAN IRISH (WARD III)-
• Had the fortune of meeting some of the Town's Water Department employees. Thanked
them for a job well done. Asked that in the future, when employees go onto someone's
property, they knock on a door and let the land owner know that they are there.
• Thanked Highway Superintendent, Tom VanNess, for getting the signs up on Dixon
Road. Just a reminder, Dixon Road is thirty five miles per hour (35mph).
• Any political signs that are placed on the roundabout will be removed. They are
dangerous and distracting for people going through there.
COUNCILMAN CLEMENTS (WARD II)-Nothing to report.

COUNCILMAN METIVIER(WARD 1)-
• Contacted by a resident regarding the corner of Sunset at Pickle Hill. Site distance there
is zero. In order to remedy the problem, an agreement needs to be in place with the
affected neighbors. The Town is working on that now.
• Received a phone call from a concerned resident on Seelye Road regarding speed limit.
SUPERVISOR STROUGH-
• Received an email from a resident regarding an airplane on Sandy Bay. This resident is
concerned the plane poses a public safety issue. Made a call to the Lake George Park
Commission. They referred to the FAA laws and concluded that the airplane is a vehicle;
as long as it's going the speed limit it is allowed.
• Commented on an article he received from Ed Bartholomew entitled "The Best Places to
Start a Business in New York". It's great to see that the Glens Falls and Queensbury
areas are listed. Thanked Mr. Bartholomew for that article.
• A portable bathroom will be put back at the West End Park. Asked adults who monitor
the area to keep an eye out for vandalism.
• The Queensbury Senior Citizens released their monthly post. Reviewed some of the
activities offered. If you are not a member already and interested in joining, please call
761-8224.
• Received a thank you from the YMCA for the six thousand dollars ($6,000) contribution
towards their summer camp program. This program enables children who normally
would not be able to the ability to go to summer camp.
• The Town Board received a thank you on behalf of the musicians, staff, board volunteers
and supporters of the Glens Falls Symphony for their great support of the July 3rd concert
in the Park.
• Thanked Look TV, Max, (our new camera man who has replaced Joel Barlow), as well as
our sponsors for televising these meetings.
