RESOLUTION REAPPOINTING ANDREW GARNER, M.D. AS
2016 TOWN HEALTH OFFICER AND AUTHORIZING
HEALTH OFFICER AGREEMENT

WHEREAS, the term of the Town of Queensbury's Health Officer, Andrew Garner, M.D.,
will expire as of December 31St, 2015, and
WHEREAS, the Town Board wishes to reappoint Dr. Garner as Town Health Officer for
2016 and enter into an agreement with Dr. Garner to serve as the Town's Health Officer, and
WHEREAS, a proposed agreement is presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board appoints Andrew Garner, M.D. as the Town's
2016 Health Officer, and
BE IT FURTHER,
RESOLVED, that the annual salary for Dr. Garner shall be $2,000, plus $100 per hour for any
case work the Town assigns to him, to be paid for from the appropriate account as determined by the
Town Budget Officer, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to
execute the Agreement substantially in the form presented at this meeting and the Town Supervisor
and/or Town Budget Officer to take such other and further action as may be necessary to effectuate the
terms of this Resolution.

HEALTH OFFICER SERVICE AGREEMENT BY AND BETWEEN
DR. ANDREW GARNER AND TOWN OF QUEENSBURY
WHEREAS, by Resolution, the Town of Queensbury (Town) has appointed Dr. Andrew
Garner (Dr. Garner) to serve as Town Health Officer in accordance with Public Health Law
§324; and
WHEREAS,Dr. Garner has accepted this appointment;
The parties hereby agree as follows:
1. Dr. Garner shall serve as Health Officer for the Town as of January 1St, 2016 and
continuing through December 31St, 2016.
2. The Town Health Officer may be removed from office for cause as set forth at
Public Health Law §322.
3. The Town Health Officer shall make an annual sanitary survey and maintain
sanitary supervision over the Town.
4. The Town Health Officer shall make a sanitary inspection periodically of all
places of public assemblage and shall report thereon to those responsible for the maintenance of
such places of public assemblage.
5. The Town Health Officer shall promote the spread of information as to the cause,
nature and prevention of prevalent diseases and the preservation and improvement of health.

6. The Town Health Officer shall take steps as may be necessary to secure prompt
and full reports by physicians of reportable diseases and prompt and complete registration of
births and deaths.
7. The Town Health Officer shall enforce within the Town the provisions of Public
Health Law and the Sanitary Code.
8. The Town Health Officer shall attend conferences called by the Commissioner of
the Department of Health or his authorized representatives.
9 The Town Health Officer shall file such reports as may be required under the
Sanitary Code or otherwise required by the Department of Health.
10. The Town Health Officer shall perform such other duties as may be required by
the Town and advise the Town Local Board of Health in matters that continue to come to the
Board's attention including, but not limited to, issues concerning outdoor furnaces and variances
from the Town's On-Site Sewage Disposal Ordinance.
11. The Town Health Officer shall receive an annual payment from the Town of
$2,000.00 payable January 1st of each calendar year during the term of office. In addition, the
Town shall pay the Town Health Officer $100.00 per hour for any case work assigned to the
Town Health Officer by the Town.
12. The Town Health Officer shall provide certification of insurance (including
professional liability) acceptable to the Town and naming the Town as an additional insured.
