RESOLUTION AUTHORIZING MEMORANDUM OF AGREEMENT
BETWEEN TOWN OF QUEENSBURY AND TOWN OF QUEENSBURY
UNIT OF CIVIL SERVICE EMPLOYEES ASSOCIATION, INC. (CSEA)

WHEREAS, the Town of Queensbury (Town) previously entered into an Agreement with the
Town of Queensbury Unit of the Civil Service Employees Association, Inc. (CSEA) regarding
employment of the Town's CSEA members, and
WHEREAS, the Agreement terminated as of December 31St, 2015, and
WHEREAS, the Town and the CSEA negotiated terms and have come to an agreement
concerning a new Collective Bargaining Agreement to be executed between the parties, and
WHEREAS, a January 4th, 2016 Memorandum of Agreement, agreed to by majority vote of
the membership on or about January 6th, 2016, has been presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves, affirms and ratifies the
January 4th, 2016 Memorandum of Agreement between the Town of Queensbury and Town of
Queensbury Unit of the Civil Service Employees Association, Inc. presented at this meeting, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to
execute a new Collective Bargaining Agreement for the years 2016 through 2019, such new Collective
Bargaining Agreement to incorporate the January 0, 2016 Memorandum of Agreement terms, and
BE IT FURTHER,
RESOLVED, that to the extent that the terms of the Collective Bargaining Agreement are
being amended by such Memorandum of Agreement and are different than as set forth in previous
Resolutions of the Town Board, this Resolution shall supersede the Town Board's earlier actions with
regard to employees covered by the Collective Bargaining Agreement, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor and/or
Town Budget Officer to take such other and further action necessary to effectuate the terms of this
Resolution.

• MEMORANDUM OF AGREEMENT
The Town of Queensbury("Town")and the CSEA,Local 1000 AFSCME,AFL-CIO,Town of
Queensbury Unit #9007,Warren County Local 857("CSEA")hereby agree to the following
changes to the collective bargaining agreement("Agreement")between the Town and CSEA
which expires December 31,2015.The terms of this Memorandum of Agreement supersedes
all prior collective bargaining agreements and understandings.Any articles,sections or
portions of the prior agreement not discussed herein shall continue unchanged and be
incorporated into the successor collective bargaining agreement.Any agreements reached
between the parties placed into the form of a memorandum of agreement shall not be
effective unless and until they are approved by the governing board of the Town and ratified
by the Association.
1. Term-The parties agree to a four year agreement effective January 1,2016 through
December 31,2019.
2. Artide Ill,Compensation,Section 1 and Schedule A,CSEA Wage
Schedule will be changed to reflect the following increases:
• • 2016-$.40/hour
• 2017-$.45/hour
• 2018-$.50/hour
• 2019-$.55/hour
3. Artide III,Compensation,Section 2 and Schedule B,CSEA Longevity Schedule will
be amended to reflect the following amounts:
2 Years of Service $100
3 Years of Service $200
4 Years of Service $300
5-9 Years of Service $600
10-14 Years of Service $1,400
15-19 Years of Service $1,700
20-24 Years of Service $2,000
25-29 Years of Service $2,300
30+ Years of Service $2,600
• AND appropriate corresponding Per Hour amounts.
*all compensation increases will be effective January 4,2016
• 4. Artide XIV(3)(b)shall be amended as follows:
For one person driving a snowplow truck alone between December 1 and March 31
(one person plow)shall be$.75/hour,instead of the current$.50/hour.
5. Add to Article XIV,Section 14(b)and(c)based on below,the hourly rates for
water Maintenance Foreman and Water Maintenance 1:
b.Shall be paid an additional$.50/hour effective January 4,2016
c.Shall be paid an additional$.50/hour(for a total of$1.00/hour)effective January
4, 2016 if such persons in such positions have valid CDL Class A licenses and
demonstrate proficiency of operating a Water Department tandem dump truck as
determined by and certified by the Water Superintendent where such certification
shall be placed in the employee's town personnel file,with a copy delivered to such
person.
6. Article IV Section 1 shall be amended to indude the following:
Work hours for Wastewater Maintenance shall be 7:00 a.m.—3:00 p.m., no lunch
and Water Meter Service Workers shall be 7:00 a.m.—3:30 p.m.,with a 30 minute
unpaid lunch. Work hours for Building Maintenance Workers in the Water
Department shall be 5:00 a.m.—1:00 p.m.,no lunch.
7. Article XIV will add Section 19 that will read as follows:
The Town Board may,in its absolute discretion,determine by Resolution to offer an
incentive program for retirement and/or incentive program for early separation.
The Town Board would have to determine that such an incentive program is in the
Town's financial interest. The terms of any incentive program must be mutually
agreed upon by both the Town and the CSEA.
8. Article IV(9)shall be modified to provide the following:
Notwithstanding anything herein to the contrary, all employees in the Highway
Department shall be expected to work overtime. A no answer (e.g., no one
answered the phone, including, without limitation, if it goes to voice mail), a no
show,or a refusal shall each be considered to be unavailable. After five(5)times of
being unavailable when called or communicated with, the employee may be
subject to discipline. It will be the Highway Department's responsibility to inform
the employee when they have been unavailable three (3) times. The Highway
Department shall keep records of each of its employees and their unavailability.
This section shall take precedence over other sections as to overtime and the need
to work overtime and will apply to each December 1 — March 31 period. If a
Highway Department employee is on approved vacation, personal time, or
floating holidays, a written excuse by the Highway Superintendent or Deputy
Highway Superintendent may be granted. In addition, a Highway Department
• employee may, upon two (2) weeks written notice to the Highway
Superintendent,request a weekend off from being called for overtime.
• 9. Article IV Section 11 paragraph 2 shall be amended to read as follows:
Water Treatment Plant Operators and Lab Operators shall be considered one
combined dass for overtime coverage and opportunities. In the event that no
Operator(Water Treatment Plant or Lab)is available,the shift must be covered by
the operator on duty, unless the on-duty operator shall have already worked two
(2) shifts (16 hours), in which case the least senior operator available shall be
obligated to cover the shift.
10. Article VI Section 1 add(f)as follows:
Water Treatment Plant Operator or Lab Operator shall be eligible each year to cash
in up to 24 hours of sick time earned but not used during a calendar year. Each
such employee shall be eligible to cash in such unused sick time by making a
written request delivered to both the Water Superintendent and the Town Budget
Officer,during the period of December 1—January 31.
11. Article IV Section 9 add(c)to read as follows:
Continuous Work Overtime: Notwithstanding anything herein to the contrary, if a
Highway Department crew or a Water or Wastewater Department crew is working
on a project or activity which is not completed by the end of the crew's normal
shift, the Department Manager can require such crew to continue and stay until
• the job is complete (not to exceed three (3) hours). This will allow the crew that
began the project to complete it. Each such employee shall receive overtime pay
for all overtime worked. There will be no need for the Department Manager to
break up the existing crew and call others from an overtime list in such
circumstances.
12. Article XVI will now read as follows:
All new labor class and non-competitive employees shall be deemed probationary
employees for up to 26 week of continuous employment with the Town. (The rest
of the language in this article will be eliminated)
