SUPERVISOR STROUGH called meeting to order… PLEDGE OF ALLEGIANCE LED BY COUNCILMAN WILLIAM VANNESS SUPERVISOR STROUGH recognized the Queensbury Boys Alpine Ski Team who won the New York State Championship; Coaches Steve Jackson and Katherine Coughlan, skier’s Alex Hohman, Mike Guido and Hunter Montgomery. STROUGH ANTHONY METIVIER BRIAN CLEMENTS __________________ _________________ DOUG IRISH WILLIAM VANNESS SUPERVISOR STROUGH recognized Warren Rosenthal, DEC Conservation Manager for the Lake George Land Conservancy. WARREN ROSENTHAL gave presentation to alert the public on the Hemlock Woolly Adelgid, an invasive, aphid-like insect that attacks North American hemlocks. It is of great concern in our community due to the fact there is a high concentration of Hemlock trees in Queensbury, Lake George and basically the entire Lake George Watershed. To give an idea of the potential devastation, this has killed about 40% (forty) percent of the Hemlocks in the Catskills. Our goal is to do an early detection and take care of it before it becomes widespread. Mr. Rosenthal shared some recommendations to the town residents and public that they can do to help and noted for anyone interested in helping can contact him at wrosenthal@lglc.org or at 518-644-9673. (Submitted informational handout) 1.0 PUBLIC HEARING PUBLIC HEARING – DRAFT AMENDMENT TO TOWN OF QUEENSBURY COMPREHENSIVE PLAN PUBLICATION DATE: APRIL 22, 2016 SUPERVISOR STROUGH reviewed proposed amendments and noted that the Town Board cannot take action; the Town Board is required to hold another public hearing which is scheduled for Monday, May 16, 2016. PUBLIC HEARING OPENED FOR PUBLIC COMMENT No one spoke. PUBLIC HEARING CLOSED SUPERVISOR STROUGH reviewed proposed resolutions. COUNCILMAN IRISH brought to the floor two additional Resolutions for the Town Board’s consideration and read them into the record. (Resolutions added as 3.14 and 3.15) 2.0 PRIVILEGE OF THE FLOOR FOR RESOLUTIONS GEORGE WINTERS, 4 John Clendon Road referred to Resolution 3.7, ‘Resolution To Amend Budget’ and questioned why it mentions Animal Control Officer? SUPERVISOR STROUGH noted that the town had to switch some funds around to meet the new outsourcing of the animal control contract. MR. WINTERS referred to Councilman Irish’s Resolution 3.14, ‘Resolution In Support Of Queensbury School Board Decision’ and questioned whether this would affect him if he puts solar on his house? COUNCILMAN IRISH noted that he would not be affected. TOWN BOARD held discussion regarding tax exemptions dealing with solar products and agreed to pull Resolution 3.14 to allow Town Counsel to research further. Regular Town Board Meeting, 05-02-2016, Mtg # 15 442 SUPERVISOR STROUGH gave brief background on the proposed Solar Farm in the City of Glens Falls on city owned property where they asked for a municipal exemption. JOHN SALVADOR referred to residential solar panels and questioned whether engaging in this activity of having someone install solar panels on their house constitute commercial activity. Recommended that the Assessor classify these residences as 283, residential with incidental commercial use and compared as a separate group. 3.0 RESOLUTIONS RESOLUTION SETTING PUBLIC HEARING ON DRAFT AMENDMENT TO TOWN OF QUEENSBURY COMPREHENSIVE PLAN RESOLUTION NO.: 165, 2016 INTRODUCED BY: Mr. William VanNess WHO MOVED ITS ADOPTION SECONDED BY: Mr. Doug Irish WHEREAS, the Comprehensive Plan for the Town of Queensbury, adopted in 2007, includes recommendations to guide land use in the Town of Queensbury, and WHEREAS, among other recommendations, the Comprehensive Plan recommends that businesses in certain areas of Town not be allowed to have “drive-through” service windows, and WHEREAS, the Town Board recognizes that in the nine years since the Comprehensive Plan was adopted, more businesses have begun using “drive-through” windows and facilities throughout the country to provide their customers with fast and convenient service in their vehicles, which can be especially important in inclement weather and for customers who have impaired mobility or other debilitating conditions or contagious illnesses, and WHEREAS, the Town Board believes that allowing drive-through windows in some areas of the Main Street zoning district under certain prescribed conditions may be appropriate, and WHEREAS, the Comprehensive Plan also contains certain recommendations to apply the Main Street Plan to Dix Avenue, which now seems unsuitable, impractical and inadvisable with respect to Dix Avenue, and WHEREAS, the Town Board is considering amending the Comprehensive Plan to remove the current recommendation against “drive through” windows and facilities in certain areas of the Town, to remove the recommendations to apply the Main Street Plan to Dix Avenue, correct a factual error, and related references, and WHEREAS, a draft of an Amendment to remove the above-referenced recommendations and references from the Comprehensive Plan was prepared and presented at the Town Board’s th meeting on April 18, 2016, and Regular Town Board Meeting, 05-02-2016, Mtg # Empire must pay all fees as required by Town Code Chapter 160; 2. Empire must submit a bond in the amount of $10,000 as required by Chapter 160; 3. and WHEREAS, it is anticipated that the Queensbury Union Free School District will accept the proposed settlement terms, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves the proposed settlement of the assessment case filed by Morgan Olde Coach, LLC for 2015 as follows: 1)The Proceeding challenging the 2015 assessment shall be discontinued without refunds; and 2)The assessed values for the 2016, 2017 and 2018 assessment years shall be set at $3,000,000; and BE IT FURTHER, RESOLVED, that approval of this Settlement Agreement is contingent upon Town Counsel’s review and approval of the Stipulation of Settlement and Order, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town Assessor, Town Clerk and/or Town Counsel to execute settlement documents and take any additional steps necessary to effectuate the proposed settlement in accordance with the terms of this Resolution. nd Duly adopted this 2 day of May, 2016, by the following vote: AYES : Mr. Metivier, Mr. Clements, Mr. Irish, Mr. VanNess, Mr. Strough NOES : None ABSENT: None RESOLUTION AUTHORIZING COMMENCEMENT OF SUPREME COURT ACTION TO ENFORCE CODE AGAINST NON-COMPLIANT PROPERTY Regular Town Board Meeting, 05-02-2016, Mtg # 15 456 RESOLUTION NO.: 176, 2016 INTRODUCED BY: Mr. William VanNess WHO MOVED ITS ADOPTION SECONDED BY: Mr. Doug Irish WHEREAS, Christiana Trust, a division of Wilmington Savings Fund Society, is believed to be the owner of property located 28 Linette Lane in the Town of Queensbury and identified as Tax Map Parcel No. 308.10-1-8 (the “Property”), which is improved with a principal dwelling and in-ground swimming pool, and WHEREAS, it is believed that the owner is a lending institution and the Property remains vacant, and WHEREAS, the Property is not being maintained in accordance with Town Code and State Property Maintenance Code requirements, and WHEREAS, two large sink holes, both being several feet in diameter and depth, have developed on the Property, causing the collapse of a portion of fencing and which undermine the integrity of the Property and pose a significant and immediate threat to public health and safety, and WHEREAS, the Property is located in a residential area where several children reside, and WHEREAS, the Town of Queensbury’s Director of Building and Codes (the “Director”) has been in contact with a property maintenance company, Safeguard Properties (“Safeguard”), which is believed to be the agent for Christiana Trust, in an attempt to have the Property owner fill the sinkholes and repair or replace the fencing and the Director has notified Safeguard that if it failed to do so, he would seek to have the Town Board authorize the necessary repair work and have the cost of such work assessed against the Property, and WHEREAS, the Director has written Christiana Trust and advised it of the sinkholes and demanded that they be remedied, and WHEREAS, despite reasonable efforts to bring about voluntary compliance, the Property remains in a condition which violates the Town Code and State Property Maintenance Code and, more significantly, poses an imminent danger to the health and safety of the public, and WHEREAS, the Town is authorized to enforce the State Code and has the authority to commence an action in Warren County Supreme Court to compel compliance with the Town and State Codes, and NOW, THEREFORE, BE IT Regular Town Board Meeting, 05-02-2016, Mtg # 15 457 RESOLVED, that the Queensbury Town Board finds that the sinkholes and collapsed fencing at the Property have created an emergency situation which poses an imminent and significant threat the health and safety of the public, and BE IT FURTHER, RESOLVED, that if the sinkholes at the Property are not filled and the collapsed fence repaired by May 7, 2016, the Town Board hereby authorizes commencement of a Supreme Court Action to compel compliance with any and all applicable Town Code and State Code provisions, which Action may seek among other things: 1.An Order for preliminary and permanent relief to compel compliance with the Town Code and State Code; and 2.Fines and penalties for the continued violation of the Town and State Codes; and 3.An award of attorney’s fees and costs associated with the Action; and 4.An Order authorizing the Town to enter the Property and repair the sinkholes and the related damaged fencing and authorizing the Town to assess all costs related to the necessary work against the Property to be collectible in the same manner as real property assessments; JOHN SALVADOR recommended correcting the town boundary for the Town of Queensbury. JOAN BOVEE, 1 Lake View Drive, spoke about a county drain near her home that is full of an invasive species called snake grass which is causing an issue on her property, spreading through her front yard and now in her back yard heading down towards the lake. 6.0 TOWN BOARD DISCUSSIONS WARD III – COUNCILMAN IRISH  SPCA Contract – it’s working well so far, we did receive a report today where they had 77 calls. We will be meeting with them again in June and I will be asking them to add some more detail to their reports. WARD II – COUNCILMAN CLEMENTS  Cost Control and StoredTech did a great job saving the town money.  Queensbury Roundtable meeting last week was very informative.  Recognized great local organizations in the area. SUPERVISOR STROUGH  Chris Harrington, Water Superintendent requested that I announce to the public to visit the town’s website and review the water quality report for 2015.  Dix Avenue Corridor Study will be posted on the town’s website tomorrow and the public hearing will be held this Thursday at 3 p.m. in the Community Room at Crandall Library  Reviewed town’s spring yard waste pick-up schedule st  Announced the two (2) scheduled Hazardous Waste collection days for May 21 at the th Warrensburg DPW building and June 18 at the Queensbury Highway Building, 9 a.m. to 2 p.m. and remember to register ahead of time on the Warren County website.
