RESOLUTION CALLING FOR AN EXECUTIVE SESSION
RESOLUTION NO. 602.2005

RESOLVED,
that the Town Board of the Town of Queensbury hereby moves into
Executive Session to discuss Contract Negotiations Strategy for Fire Contract and the
Attorney Contract negotiation with Miller, Mannix, Schachner and Hafner.

2.1DISCUSSION Out of Sewer District Contract
Supervisor Stec-Where are we with, out of contact, sewer extension.
Councilman Boor-I am a no vote.
Supervisor Stec-You do not want them to do that at all?
Councilman Boor-No.
Supervisor Stec-You do not want him to say I am going to tie in one house without us
knowing?
Councilman Boor-No.
Councilman Brewer-Why?
Councilman Boor-I think it is our duty as Elected Officials to know where the sewer is in
the Town of Queensbury.
Councilman Turner-You can track it, you are going to put it in so you keep track of it and
you just submit a worksheet with it.
Councilman Boor-The best way to track it is to know when it happens.
Councilman Elect Richard Sanford-How many requests do you get?
Unknown-One a year.
Councilman Boor- Why is he doing this?
Supervisor Stec-Mike is asking for this.
Councilman Brewer-You do not want to create bureaucracy but you are, because you are
not extending a sewer district you are granting a contract with one user. The scenario is
Roger, sewer district ends here for what ever reason, it does not matter why it ends a
person comes in and builds a house, single family home, a small use, it would be
beneficial, I live near a wetland whatever the reason, I would like to tie into the sewer,
they go to Mike Shaw he reviews it, it is a very mundane use to affect.
Councilman Boor-Who does SEQRA
Councilman Brewer-SEQRA would not have to be done, we would not do SEQRA.
Supervisor Stec-If we do not give the authority to Mike Shaw how does it get done now?
Councilman Brewer-It comes to us.
Councilman Elect Richard Sanford-What I am hearing is you get about one a year.
Councilman Boor-So what is the issue?
Supervisor Stec-If there are very few a year then why would Mike ask for it?
Councilman Brewer-We are not talking about a subdivision.
Supervisor Stec-I do not think he is asking for a lot.

Councilman Boor-Why is he asking for it?
Supervisor Stec-He may think it is more convenient, I do not know.
Councilman Turner-It holds up the progress.
Councilman Brewer-If a person wants to build a house or whatever, he has got to go
through the process of coming to the Town Board set a public hearing, wait two weeks
have the public hearing and the outcome is going to be the same ninety nine point ninety
nine percent of the time. If there is one inkling of doubt he is going to come to us.
Supervisor Stec-Why don’t we throw out commercial all together and say we will let you
tie in one single family residential unit out of contract.
Councilman Strough-It does not come up that often lets keep it without the contract the
way it has been, it hasn’t been a problem.
Supervisor Stec-Just don’t act on the resolution and keep it the way it is.
Councilman Strough-As the year progresses and we see a need for it we can change it
then. There is nothing that is pressing us to do it right now.
Councilman Brewer-If it is one house a year the Town Board has to look at it, when we
have a department head that knows ten times more than any of us combined about sewer,
that is my point.
Councilman Boor-How are they sizing the line, are they sizing it for one house or sizing
it for additional houses, potential subdivisions?
Councilman Brewer-They are sizing it for the particular use.
Councilman Boor-So, the extension, if you could put that in writing I might ..
That would be a really bad move for him, he would never do that, because if another
house comes along he would have to put a whole new pipe in.
Councilman Elect Sanford-I think what Roger is saying the frequency is so low and the
potential for there to be ulterior motives associated with this why not just keep it the way
it is that way you do not have to run the risk.
Councilman Brewer-I think you are making an undue process necessary that does not
have to be. It puts no faith in our department heads.
Councilman Boor-Why are we elected officials.
