Requested Action

Proiect Description
Pursuant to Chapter A-183 of the Zoning Ordinance any Modification to Applicant proposes to modify a previously
approved subdivision to eliminate the walking trail and gazebo/sitting area. Also requested modification of planting plan
to maintain current plantings and revised planting plan. Pursuant to Chapter A-183 of the Zoning Ordinance, any
modification to an approved subdivision shall be subject to Planning Board review and approval.
Staff Comments
The applicant is requesting an amendment to the subdivision for the Townhouses at the Haviland Road subdivision. They
propose to remove the requirement to develop a walking trail and gazebo sitting area on the Homeowner's Association
land. The area of the walking trail is one of three HOA land sections and is 2.12 acres. The Homeowners Association has
contacted the 38 homes within the development with only one home owner not responding and they are in agreement to
remove the trail/gazebo area.
The development is part of an approved subdivision in a Planned Unit development where changes to the subdivision plan
require review and approval by the Planning Board. The applicant has included a revised planting plan with assistance
from the Code Compliance site review the plan indicates that any items circled with no notations will not be planted.
Items that have checks have been installed, the plans also includes items planted but not the species also with checks. The
applicant has explained that additional plantings to be added behind homes 63 and 59. The HOA is also encouraging
private plantings around the homes. The submission includes photos of each of the homes in the HOA showing the front
planting arrangements.
In addition, the applicant has received a letter from the Conklin Center the neighboring property that has indicated they
have no objections to the removal of the walking trail and gazebo.
Summary
The applicant has submitted a request for the subdivision modification. This includes removal of a walking trail, a gazebo
and as built planting plan.
