RESOLUTION APPROVING MARY AND SHELDON EISENBERG'S
APPLICATION FOR SANITARY SEWAGE DISPOSAL VARIANCES
RESOLUTION NO.: 18,2012 BOH

WHEREAS, Mary and Sheldon Eisenberg filed an application for variances from
provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance, Chapter 136 to allow:
1. A septic tank to be located 4' from the property line in lieu of the required 10'
setback;
2. A pump tank to be located 4' from the property line in lieu of the required 10'
setback;
I A force main to be located 7' from the property line in lieu of the required 10'
setback;
4. An absorption field to be located 1' and 5' from the property line in lieu of the
required 10' setback;
5. An absorption field to be located 15' from the dwelling in lieu of the required 20'
setback; and
6. An absorption field to be located 95' from Lake George in lieu of the required 100'
setback;
on property located at 98 Rockhurst Road in the Town of Queensbury, and
WHEREAS,the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health conducted a public hearing concerning the
variance requests on Monday, August 6th,2012,and
WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners
within 500 feet of the subject property,
NOW,THEREFORE,BE IT
RESOLVED,that
1. due to the nature of the variances, the Local Board of Health determines that the
variances would not be materially detrimental to the purposes and objectives of this
Ordinance or other adjoining properties nor otherwise conflict with the purpose and
objectives of any Town plan or policy;and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and is the minimum variances which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
applicants;and
BE IT FURTHER,
RESOLVED, that the Local Board of Health hereby approves Mary and Sheldon
Eisenberg's application for variances from the Sewage Disposal Ordinance to allow:
1. A septic tank to be located 4' from the property line in lieu of the required 10'
setback;
2. A pump tank to be located 4' from the property line in lieu of the required 10'
setback;
3. A force main to be located 7' from the property line in lieu of the required 10'
setback;
4. An absorption field to be located 1' and 5' from the property line in lieu of the
required 10' setback;

RESIDENCE ON ROCKHURST ROAD IN THE TOWN OF QUEENSBURY IS 40+ YEARS IN AGE
AND OF UNCERTAIN CONDITION. THIS PLAN PROPOSES A NEW REPLACEMENT WASTEWATER
SYSTEM TO SERVE THE RESIDENCE ON THE PROPERTY. IN AN EFFORT TO PROVIDE A
MORE HIGHLY TREATED EFFLUENT FOR DISCHARGE TO THE NATIVE OVERBURDEN IT IS
PROPOSED
FLUENTODISCHARGEADD TO HTO TITHE DSPOSALMENT I FIELD. ECONDSA, PROPOSEDTREATMENT TO DOSE THE SEPTIC
TANK EFFLUENT TO A PURAFLO PEAT BIOFILTER WHERE ADVANCED TREATMENT OCCURS DUE
TO PHYSICAL, CHEMICAL, AND MICROBIAL PROCESSES THAT ARE OPTIMIZED W THE PEAT

UNDER NORMAL CONDITIONS THE PUMP ASSEMBLY
SHOULD BE INSPECTED ANNUALLY WITH REGULAR
MONITORING OF THE PUMP OPERATION THROUGH THE
CONTROL PANEL DATA DISPLAY, BASED ON
MANUFACTURERS GUIDELINES THE PEAT FIBER
MODULES SHOULD BE VISUALLY INSPECTED ON AN
ANNUAL BASIS.
THE OWNER WILL BE PROVIDED WITH MANUFACTURER'S
RECOMMENDED GUIDELINES FOR MAINTENANCE OF THE
SYSTEM COMPONENTS AND AN INFORMATIONAL
PACKET ON THE 'DO'S AND DON'TS' REGARDING THE
OPERATION OF A SEPTIC SYSTEM.
FILLGYSTFM INSTALLATION
1. WHEN PLACING FILL ON TOP OF EXISTING GRADE,
ORGANIC DEBRIS, INCLUDING LEAVES, ROOTS AND
OTHER PLANT FORMS, SHALL BE REMOVED PRIOR
TO THE PLACEMENT OF THE FILL AND THE NATURAL
SOIL PLOWED OR SCARIFIED.
2. THE SOIL USED FOR FILL SHALL BE
WELL -GRADED LOAMY SAND OR WELL- GRADED
LOAMY SANDY GRAVELS AND SHOULD CONTAIN A
MAXIMUM OF 129) OF SILTS OR CLAYS CONTAINING
NO ORGANIC DEBRIS TWELVE PERCENT (12 OR NO
SOLID OBJECT LARGER THAN THREE (3) INCHES IN
DIAMETER, AND THE FILL SHALL BE ALLOWED TO

TRENCH BOTTOM AND MAXIMUM SEASONAL

BEDROCK. THIS SEPARATION MUST BE THREE (3)
FEET WITHIN ONE THOUSAND (1,000) FEET OF LAKE

4. ONLY ABSORPTION FIELDS SHALL BE USED AS
THE LEACHING FACILITY IN FILL SYSTEMS.
5. A CHANNEL OR DIVERSION SYSTEM SHALL BE
PLACED ABOUT THE FILL SYSTEM IN THE
UP-SLOPE DIRECTION AND OF SUFFICIENT LENGTH
TO DIVERT SURFACE AND SHEET WATER RUNOFF

VOLUMETRIC CAPACITY EQUAL TO OR GREATER THAN TWO TIMES THE DAILY DESIGN FLOW.
