SUPERVISOR STROUGH- I will open the public hearing. Anybody like to speak to any of
these proposed zoning changes? Yes, Ma'am.
VICTORIA BOSSONIS- I have a couple of questions and a couple of comments.
SUPERVISOR STROUGH- Alright, I didn't catch your last name, Victoria.
MS. BOSSONIS- Bossonis. B as in boy, o-s-s-o-n-i-s.
SUPERVISOR STROUGH- Okay, Victoria.
MS. BOSSONIS- Okay. So first I'd like to know about the area near the Aviation Mall. I would
like to know who the developer or builder is.
SUPERVISOR STROUGH- I'm not allowed to divulge who the developer was that came to me.
MS. BOSSONIS- That's okay. I have another question.
SUPERVISOR STROUGH- But, it was the developer as well as representatives from the
Aviation Mall came to talk to me about this because I had a concern that the Mall live up to its
obligation that when it goes to further develop the property behind Ambrosia Restaurant, which
used to be the old Holiday Inn, not Holiday in...
COUNCILMAN VANNESS- Howard Johnsons.
SUPERVISOR STROUGH- Howard Johnsons. That they create a connection that will connect
the upper parcel to the signalized intersection and they assured me that that would happen. I told
them that would have to happen before any development be allowed up there because let's say
you put a hotel up there and the buses, you know there are certain AM or PM...they are not
going to get back on the interstate unless they went to a signalized intersection. So this is just a
common sense thing. So maybe that might be helpful knowing that that's got to happen before
any development up there happens. There's also an allocation for a right hand turning lane in
front of Ambrosia so that traffic entering this area shouldn't be at levels that would impede the

normal traffic flow on Aviation Road; and I'm talking about the eastward bound traffic flow.
That the right hand turning lane would have to be constructed. It's already shown on the plans
for the Ambrosia Restaurant. If those two things help.
MS. BOSSONIS- Okay, I have a couple more questions and a couple comments.
SUPERVISOR STROUGH- Sure.
MS. BOSSONIS- Can I continue? Okay, so the other question is part of the property that you're
talking about does that butt up against Coles Woods?
COUNCILMAN IRISH- Not, it butts up against the water tower.
SUPERVISOR STROUGH- Yeah.
MS. BOSSONIS- Because I know when you're in Coles Woods and you're walking around, you
see part of the Mall.
SUPERVISOR STROUGH- Yeah, but this is up further. This is where the Howard Johnsons
used to be up there.
MS. BOSSONIS- I know where it is.
COUNCILMAN IRISH- If you look right behind the restaurant, it's all the vacant property right
behind the restaurant.
MS. BOSSONIS- And then you mentioned that it was to be a motel but to me 70 feet is a hotel,
not a motel.
SUPERVISOR STROUGH- Yeah, well it's the same in our definition, hotels, motels are treated
the same in our definition.
MS. BOSSONIS- And regarding the multi-use area it sounded something like an arena of some
sort where you would have events and so forth. From my knowledge the Civic Center can barely
make any money on the events that they hold, I don't see how we can support that.
SUPERVISOR STROUGH- Well, it would be a private developer if one was to be put in. And a
sports arena or permanent facility structure or combination of structures offering at least ten
thousand square feet of space dedicated to a meeting space and designed to support as its
principal uses, receptions, banquets, entertainment events, community events, school and use
events, religious events, conferences, trades, storage, arts, craft shows, exhibits, expos, animal
shows or consumer shows, annual conventions, corporate conferences, educational meetings,
garage sales, sales incentive meetings as secondary uses any such facility may provide food
service or may sell items related to the events in progress. That's the definition. Now we would
not be building it. It would be a private developer and, I'm assuming, would be in conjunction
with a hotel. You know, like Fort William Henry has a conference center.
COUNCILMAN VANNESS- I think that's been one of our biggest complaints, Victoria with the
hotels that are coming in off the exit corridor and off exit 19 are the convention spaces to be able
to hold, bring a convention in to have a display area. As I'm sure you've been to them yourself
where you're going into the vendors. We really don't have that in the immediate area to have a
hotel and a vendor spot where they can go into them. So that's something we're trying to cover
to try to get them to bring vendors and have an area that vendors can set up in.
SUPERVISOR STROUGH- Okay?
MS. BOSSONIS- Yes, thank you.
SUPERVISOR STROUGH- And the definition of motel is a facility offering transient lounging
accommodations for a daily rate to the general public in which no provision is made for cooking
in any individual room or suite except that such facility may be provided and facilities

designated as housekeeping units, housekeeping cabins or other similar terminology. A motel
may provide additional services such as restaurants, conference and recreational facilities.
Motels may include outdoor athletic courts and facilities and swimming pools for the definition
for the term of"hotel" and "bed-and-breakfast"with more than 10 rooms is included. So...
MS. BOSSONIS- Okay, thank you for the information.
SUPERVISOR STROUGH- Alright, thank you. Yes, John.
JOHN SALVADOR- With respect to the last resolution, the zoning, I don't think we should
forget that the Adirondack Northway is classified as a scenic bi-way, and there are restrictions on
what you can build within certain distances of the road. They are not too often recognized but
they do exist and I think you should check.
SUPERVISOR STROUGH- Yes, well we do have, you're not allowed to go to the 70 foot unless
you have 100 foot setback or greater.
MR. SALVADOR- That's part of the SEQRA?
SUPERVISOR STROUGH- Yeah, that's part of it, yeah, I didn't throw that in but I did now.
MR. SALVADOR- Only 100 feet?
SUPERVISOR STROUGH- Yeah.
MR. SALVADOR- Okay. With respect to the changes to the zoning map, I don't see that there's
an effort to correct the Town boundaries as they are presently mapped...qualified for a special
use permit, which was approved by the Planning Board. On my map, my site plan map, I mapped
the Town boundaries as I understand it and as the County has mapped it, and it was approved.
SUPERVISOR STROUGH- Well, John, our boundary is as it has been established...
MR. SALVADOR- Incorrectly for many years.
SUPERVISOR STROUGH- No, for a couple of hundred years now. It's shown on all of the
maps and there hasn't been any legislative change in that boundary. But, now that you speak of
it...
MR. SALVADOR- Yes.
SUPERVISOR STROUGH- Speaker Heck is in the Town and I don't know if we zone that, so
thank you, John.
MR. SALVADOR- No.
SUPERVISOR STROUGH- Another loose end I'll pick up, okay.
MR. SALVADOR- In any case, I have brought up the subject many, many times. As I tell you
that I correctly mapped that boundary and it was incumbent upon the Town to notify the Town of
Bolton that they were issuing special use permit and property that bordered their Town.
SUPERVISOR STROUGH- Well, the border is actually quite a distance from your piece of
property.
COUNCILMAN IRISH- Are you asking us to revoke your permit, John?
MR. SALVADOR- No I'm not.
COUNCILMAN IRISH- It sounds like that's what you're asking.
MR. SALVADOR- No, I'm asking you to correct the Town boundary.

SUPERVISOR STROUGH- Well, the Town boundary is as it's been for 200 years, John. We're
not going to change it to accommodate you.
MR. SALVADOR- Steak dinner, remember.
SUPERVISOR STROUGH- Alright.
COUNCILMAN IRISH- He's still waiting for one from me too so...
MR. SALVADOR- Okay, the other thing in the write up on the zoning changes, section six is a
repealer clause. All local laws or ordinances or parts of local laws or ordinances in conflict with
any of this local law are hereby repealed. Now I've got to tell you, it's very difficult to sort out
what's revised and not revised in the Code. Now here in this text that he presented to us, you
have italics and cross outs. That doesn't appear in the Code. That doesn't get there. Now I had to,
for this special use permit I speak of, the Zoning Administrator required me to conform to the
special use permit criteria that was adopted in the year of 2002 on April I", okay. Now I had to
go out, I had to search like hell to find out the criteria for that special use permit at that time,
okay. Now it's extremely important when you get a permit based on a code, you have rights. You
have rights in that permit and if they get eradicated through a replealer clause, you don't know
about it. You do understand that the way the Town Code is written, the avenue to get any kind of
a permit requires a conference with the staff, okay. In that conference if you're not careful, your
staff is legislating. The first thing you got to do is prepare your application on forms that the
Town supplies. Read those forms carefully, they are legislating. Why not put that requirement in
the Code so everybody can see it, okay. So that's...
SUPERVISOR STROUGH- John, I'm going to disagree with you, they're not legislating. They
may be interpreting, there may be administrative judgement. Well, for example, on the Bay Road
Professional Office Zone and the 600 foot setback, it was clearly understood by the Board that
that 600 foot setback was set aside from everything else, shouldn't be used as it might by some
developers to determine densities of residential units behind the 600 foot so that they get more,
and then use up any potential commercial use of that 600 foot. That was not the intent of the law.
So sometimes administrators have to say, listen, because it's vague, here's my judgement, here's
what I think the Town Board meant. Sometimes that's the zoning administrators call. That's not
legislating necessarily.
MR. SALVADOR- The requirement of need was to produce a valid, a permit valid that had been
issued by an involved agency before April 1", 2002.
SUPERVISOR STROUGH- When did you submit your application for your marina?
MR. SALVADOR- The first one was in 2003.
SUPERVISOR STROUGH- And what special use permit analysis applied then?
MR. SALVADOR- Um...
SUPERVISOR STROUGH- Is that what you had to do?
MR. SALVADOR- ...But it's been changed three times.
SUPERVISOR STROUGH- Alright, well the special use permit analysis that we have now
would apply to these zoning changes that we're supposed to be talking about now.
MR. SALVADOR- I was required to produce something that pre-dated April 1", 2002.
SUPERVISOR STROUGH- We're not going to use that special use permit on this. We're going
to use the new one that was produced in 2007. Alright, thank you, John.
SUPERVISOR STROUGH- Anybody else? You okay, Steph?

ROMAN JAROSH- I'd like to know more about the indoor storage facility. Do we have any
other facilities like that in the Town?
SUPERVISOR STROUGH- No we don't and that's one reason why we were asked to do it.
Zoning in itself is a fluid program. We want to update it with anticipation, or as new things come
forward we never anticipated, and allow those uses if they seem appropriate. Now in this case, it
was Sokols Market. Sokols Market is sitting there vacant, as it has there for a long time, and that
is in the neighborhood commercial zone. Now...
MR. JAROSH- Where were the other storage facilities located? Are they...
SUPERVISOR STROUGH- There are exterior storage facilities, and those are the ones that you
see in a row.
MR. JAROSH- Right, but are they neighborhood commercial zones?
SUPERVISOR STROUGH- No, this would be the only one that we know of right now.
MR. JAROSH- So, what kind of safety precautions do we have as to what people store...
SUPERVISOR STROUGH- First of all, it's got to be an existing building, and you can't change
the exterior.
MR. JAROSH- I understand that. What safety precautions do we have as to what people store in
there since it's in a neighborhood commercial zone?
SUPERVISOR STROUGH- Oh, you mean like not combustibles and things like that?
MR. JAROSH- Yeah.
SUPERVISOR STROUGH- Yeah.
MR. JAROSH- And explosives.
SUPERVISOR STROUGH- Well, that's a good...

SUPERVISOR STROUGH- They are in commercial zones, yes, this is not a commercial zone.
COUNCILMAN CLEMENTS- I'm assuming that would be under the Fire Marshal's discretion
on things like that, wouldn't it?
SUPERVISOR STROUGH- Yeah, well the other thing too is that is goes through what we call
SUP (special use permit). Another words, when somebody brings their proposed use, and let's
say it's an interior storage facility, they go through the SUP process, which Mr. Salvador was
referring to. It is more stringent than a site plan review where the Planning Board takes extra
concern to make sure that it fits where it's being proposed to.
MR. JAROSH- So I have a bunch of chemicals in my cellar and I don't want to keep them there
and I put them in a storage unit, who's controlling that?

those types of products from being included in that zone, but how would you monitor that?
COUNCILMAN METIVIER- But the fact that you just said that I'm storing them in my
basement, what's the difference between storing these chemicals in the basement versus a
storage facility? There's no difference. We can't monitor what you put in your basement so how
would we restrict...
MR. JAROSH- Well, it's a single house so if something does happen, it's not going to go
through the whole neighborhood.

SUPERVISOR STROUGH- This may be, you know, like I said, it can't be a warehouse. What it
does say is, I didn't read you every single word, I highlighted it. You bring up a good question.
But, it does say this that it has to be for storage of items of personal property. I could say this
ammunition is my personal property I suppose, you could say, right. So there's still no protection
there.

point. Again, our relationship with our Planning and our Zoning sometimes isn't so where we
like what they're doing and they don't like what we're doing either. But, I think this is going to,
especially under and SUP, which is a much stricter policy to get the permit to put it there. I
would hope and I would think that, and Bob, correct me if I'm wrong, you know how many
times I talk about of Zoning and Planning, but isn't that a criteria that they would set on it as far
as what can be stored in it or is that something...
TOWN COUNSEL, HAFNER- I don't know what they will consider as part of their process. But
I have the same concern that Doug has, how are you going to enforce it?
COUNCILMAN VANNESS- I guess my suggestion to you would be to go to the Planning
Board when they go for this SUP and voice these same concerns.
SUPERVISOR STROUGH- They can condition any approval.
COUNCILMAN VANNESS- They have a little more authority than we do, to be honest with
you, as far as what can go in there, what can be in there, and what doesn't. I understand and I
don't necessarily agree with it and I've said this several times. I understand why the Zoning and
Planning is a separate entity from the Town Board even though appoint them, they are a separate
entity. So our discussions with them are very limited as to what we can discuss with them, but I
would by all means, make a recommendation that you do attend that, I mean, it's a valid point.

exit 18. They are going to be smaller units. I think the intent is really more toward a
professional...I could be mistaken.

WHEREAS, by Resolution 163, 2014, the Town of Queensbury allocated a HOME grant
match up to $6,250 per project as required, as a deferred loan from the Town of Queensbury
Revolving Loan Fund (RLF), and
WHEREAS, a single family property Case File 47120 has been determined to be eligible
for rehabilitation grant assistance and the owner of the property has requested such assistance,
and
WHEREAS, general construction specifications were provided to all qualified contractors
for bid, and
WHEREAS, four general contractors turned in bids at the specified date and time, and
WHEREAS, all contractors submitting bids were notified of the low bid amount, and
WHEREAS, Shelter Planning & Development, Inc. has reviewed the bids, and verified
all work to be completed, and determined that the total cost is reasonable and necessary for the
work required, and
WHEREAS, Shelter Planning & Development, Inc. has overseen the grant process and
has verified that it has been followed in this case and recommends approving the grant, and
WHEREAS, in connection with this grant award, the owner or owners will be required to

RESOLVED, that the Queensbury Town Board hereby authorizes the engagement of PENFLEX,
INC. to provide administration and support services during 2016/2017 and the 2016 standard year end
administration services for the Town of Queensbury's Volunteer Firefighter Service Award Program for a
total estimated cost of $12,745, to be paid from the appropriate account as determined by the Town
Supervisor and/or Town Budget Officer, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to execute the
agreement with PENFLEX, INC. substantially in the form presented at this meeting and the Town Supervisor
and/or Town Budget Officer to take any other actions necessary to effectuate the terms of this Resolution.

WHEREAS, the Town of Queensbury previously entered into a Lease Agreement dated April
16'h, 1990 with the New York State Police to lease an office building constructed on Town property on
Aviation Road, Queensbury and by Resolution No.:173,2000, authorized an extension to such Lease
Agreement, and
WHEREAS, the Town Board wishes to authorize a renewal of such Lease Agreement with
provisions similar to those in the original Lease Agreement and extension,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves and authorizes a renewal of the
Lease Agreement with the New York State Police on substantially similar terms as the prior Lease
Agreement, such form to be acceptable to the Town Supervisor, Town Facilities Manager and/or Town
Counsel, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute
such renewal of Lease Agreement and take such other and further action as may be necessary to effectuate

auditing services of Bollam, Sheedy, Torani & Co., LLP, CPA's (now known as SaxBST) to
provide cash receipts and disbursement auditing services to the Town of Queensbury for the years
ending December 31, 2011, 2012, 2013, 2014 and 2015, and
WHEREAS, the New York State Uniform Justice Court Act §2019-a and Town Law §123
set forth annual reporting, accounting and audit requirements for Town Courts, and
WHEREAS, in accordance with such laws, the Town Board reviewed the audit reports
pertaining to the Queensbury Town Court for the year ended December 31, 2015 and the Town

COUNCILMAN VANNESS (WARD IV)- Nothing to report.
COUNCILMAN IRISH (WARD III)- In the Boos and Bravos section of today's Post Star, The
Town Board received a bravo for establishing the taxing districts for Glen Lake, Lake George
and Lake Sunnyside. Although it was nice to get recognized, the residents get the credit for
making that happen.
COUNCILMAN CLEMENTS (WARD II)-
• Thanked the Highway Department for all their hard work, they are doing a great job.
• Spoke regarding an upcoming Resolution on term limits.

SUPERVISOR STROUGH-
• Thanked the Highway Department for their work at the access of the historic Blind Rock.
• Received a letter from Christy Sabo from the Office of the Aging thanking the Town
(Parks & Recreation and Building and Grounds) for assistance with their annual senior
picnic.
• Congratulations to our Assessor, Teri Ross, who was just named President of the New
York State Assessor's Association.
• The State Comptroller has assessed our fiscal situation and we received one of the best
ratings they give any local municipality.
• Thanked Look TV and our sponsors for televising these meetings.
