QUEENSBURY EMPLOYEE HANDBOOK §607 "OVERTIME PAY AND
COMPENSATORY TIME" AND §802 "SAFETY PROCEDURES"

WHEREAS, the Queensbury Town Board previously adopted a Town of Queensbury
Employee Handbook(Handbook) delineating Town employee policies and procedures, and
WHEREAS, in order to comply with the Fair Labor Standards Act (FLSA), by Resolution
No.: 362,2016, the Town Board reclassified certain employees to overtime-eligible/non-exempt, and
WHEREAS, while conforming its policies and procedures to reflect such changes in State
and Federal law, the Town Board wishes to revise occasional language of its Handbook to clarify
and correct certain information, and
WHEREAS, the Town Board wishes to accordingly amend its Handbook at §607 entitled,
"Overtime Pay and Compensatory Time"to provide for a change in policy regarding such overtime-
eligible/non-exempt employees and overtime pay policy while remaining in compliance with
Federal and State laws, and
WHEREAS, the Town Board also wishes to amend §802 entitled, "Safety Procedures" to
correct accident reporting procedures, and
WHEREAS, such proposed amendments have been presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby adopts the amendments to its
Employee Handbook as delineated in the preambles of this Resolution and in substantially the form
presented at this meeting, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor's
Office to distribute copies of the amendments to all Town employees and elected officials and
amend the Employee Handbook accordingly.

607 Overtime Pay and Compensatory Time
It is the Town's policy to request and/or authorize overtime pay or compensatory time only
when absolutely necessary. All overtime and compensatory time must be pre-approved by
the Department Manager or the Town Supervisor.
Union Employees
Union employees who are required by their Department Manager to work in excess of eight
(8)hours in a workday or forty(40)hours in a work week are eligible to receive overtime pay.
The eligibility and calculation for overtime and compensatory time varies with respect to
holidays, vacations, emergency situations, etc. Refer to your union contract regarding the
details for overtime pay. All employees are expected to work a reasonable amount of over
time,if required.
Non-Union Employees (Non-Exempt)
Non-exempt, non-union employees are entitled to overtime when they work nos than
(S) • - e more than forty(40)hours during any work week. All paid leave
time shall be treated as time worked for the computation of overtime.
Call-in: employees shall be paid a minimum of two (2) hours of overtime pay for "call-in"
(1)at a time not contiguous with their normal workday, and(2)for call-in prior to the start of
their normal workday.
Employees have the option of payment at time plus one-half or compensatory time off at time
plus one-half. However, compensatory time off must be used in the week immediately
following the week it was earned. Unused compensatory time off will be paid as overtime at
time plus one-half at the end of the week immediately following the week it was earned.
The subsequent time sheet should have the unused time added to the weekly total and
approved by the Department Manager prior to submission of the time sheet to the Accounting
Office. Overtime to be carried over as compensatory time should be clearly marked on the
employee's time sheet. Time sheets which are not clearly marked for carryover will be paid
as overtime by the Accounting Office,with no subsequent reversal permitted.
Non-Union Employees (Exempt)
By nature of their positions and in accordance with the Fair Labor Standards Act, "exempt"
employees are not entitled to earn overtime pay or compensatory time for any hours worked
in excess of their normal work week. Employees who fail or refuse to work acceptable hours
may be disciplined up to and including discharge.
802 Safety Procedures
To be successful, a safety program must have awareness toward injury and illness prevention
on the part of all employees. It also requires cooperation in all safety and health matters. Our
objective is to reduce the number of injuries and illnesses to an absolute minimum. Our safety
program includes,but is not limited to,the following:
• Providing mechanical and physical safeguards to the maximum extent possible.
• Conducting inspections to find and eliminate unsafe working conditions or practices, to
control health hazards,and to comply with the safety and health standards for every job.
• Training all employees in good safety and health practices.
• Providing necessary personal protective equipment and instructions for its use and care.
• Developing and enforcing safety and health rules and requiring that employees cooperate
with these rules as a condition of employment.
• Promptly and thoroughly investigating every accident to find out what caused it and to
correct the problem so that it won't happen again.
• Providing First Aid kits,AED's and fire extinguishers in various locations throughout our
buildings and facilities.
Accident Plan
In the case of an accident, stop work immediately and take the following steps:
1. Evaluate the accident scene
2. Eliminate the immediate cause of the accident.
3. Provide aid to the injured person and summons assistance if you can safely do so. Call
911 if required.
3. Call your Department Manager immediately.
Accident Reporting Procedures
1. When accidents occur which results either in the loss of an employee's work time or
in the provision of medical care to an employee, the employee's Supervisor must
complete a Report of Work-Related Injury Form. This form must be submitted to the
Supervisor'sAcco:ming office within 24 hours:ix (6 :a c of the accident.
2. When an accident occurs which does not result in the loss of an employee's work time,
or in the provision of medical care to the employee, but results in damage to Town
equipment or non-employee(s). the employee's Supervisor must complete a Town of
Queensbury Incident Form. This form must be submitted to the Accounting office
and Supervisor's office within six (6) work days of the accident. The Supervisor's
office should be notified immediately.
3. A log of injury/illness will be maintained by the Supervisor's Accounting Office and
retained for five(5) years following the end of the calendar year to which it relates.
4. A copy of this log, which includes totals and information for the year, will be posted
in each department or areas where notices to employees are customarily posted.
To protect all employees, and to safeguard equipment and property, it is our policy that no
employee will perform any type of work until he/she fully understand the correct operation
