1971-01-07 ORG RESOLUTION TO APPROVE SALT BIDS
RESOLUTION No. 282, introduced by Mr. Robertson, seconded by
Mr. Robillard.
WHEREAS, Mr. Carl Garb, the Superintendent of Highways of the
Town of Queensbury, did recommend the advertising for bids to
supply Highway Salt to the Highway Department for the winter
of 1970-1971, and
WHEREAS, bids were received on December 30, 1970 and there were
two bids received, and
WHEREAS, the bidsof Morton Salt Company and International Salt
Company were opened and read aloud by the Town Clerk and the
quoted price per ton was $19. 90 per ton from both bidders, and
WHEREAS, in the opinion of Mr. Carl Garb, Morton Salt Company
was the better offer because of their price being firm through
December 31, 1971, therefore be it
RESOLVED, that the Morton Salt Company is hereby awarded the
contract to supply the Highway Salt and delivery will be made
to the Highway Storehouse on Aviation Road as needed by the
Superintendent.

RESOLUTION TO RETAIN THE TOWN SURVEYOR
RESOLUTION No. 6 , introduced by Mr. Robillard, who moved its adoption,
seconded by Mr. Robertson.
RESOLVED, that John B. VanDusen of the Town of Queensbury, be retained
as Town Surveyor of the Town of Queensbury for the fiscal year of 1971
at an annual compensation of $3 ,400- and that the Supervisor be and he
hereby is authorized to execute on behalf of the Town a contract with
John B. VanDusen for such services, and be it further
RESOLVED, THAT IN ADDITION TO THE SERVICES PROVIDED by such contract,
the Town Board employ said John B. VanDusen to perform other services
as may be required which will involve the employment by him of persons
to assist in compiling data, drafting and similar work, and that the
Town reimburse John B. VanDusen for such additional work and expenses
in connection therewith during the fiscal year of 1971 but not to
exceed in the aggregate the sum of $1,000. which reimbursement shall
be made only upon itemized and certified vouchers therefore audited
by the Town Board.

RESOLUTION AUTHORIZING HIGHWAY SUPT. TO PURCHASE SUPPLIES

RESOLVED, that purchase of materials, supplies and tools for the
Highway Department may be made by the Town Superintendent of Highways
without the prior approval of the Town Board where the cost thereof
does not exceed an aggregate of $500.00 during the fiscal year.

We have been informed that the board of assessors in your
town consists of three appointed members and that each year one
of the members is designated chairman for a one, year term by
resolution of the town board. We have been advised that you would
like our opinion as to the "term" which should be set forth in the
1971 resolution.
Section 6 of Chapter 957 of the Laws of 1970 provides, in
part, that the ". . .terms of office of all assessors. . . . in
office in all. . . towns. . . whether elected or appointed. . . .
whose term would extend beyond September thirtieth, nineteen
hundred seventy-one, shall terminate on September thirtieth,
nineteen hundred seventy-one. . ."
Therefore, the 1971 resolution should designate a chairman
for a term ending on September 30, 1971.

HOLIDAYS
All employees shall be entitled to the following holidays.:

ARTICLE TWO
VACATION, SICK LEAVE
Section 1 - Vacation Leave
a. Subject to the limitations set forth herein, all Town
employees shall be entitled, after one year of continuous service,
to a vacation, with pay, as follows:

More than ten years but
less than twenty years Fifteen working days.
More than twenty years- Twenty working days.
b. The period of employment referred to above shall be a period
of continuous service in the Town of Queensbury employment. A new employee
commencing employment on or after the first day of July shall be credited
with one year of service on January 1st of the following year for the
purpose of computing vacation credit, but said vacation cannot be taken
until completion of one year of continuous service.
c. A day of vacation shall be a working day.
d. Vacation credits shall be computed on a calendar year basis.
e. All vactions shall be scheduled in advance by the Department
Head under whom each employee works.
f. All vacations shall be taken in the calendar year during which
the employee becomes entitled thereto, and no part of such vacation shall
be carried over from one year to another, or used in part or in whole in
any year except the year in which it is earned. Provided, however, that
vacation leave earned and not taken through no fault of the employee, may
be accumulated up to a maximum of thirty days and paid, in cash, to the
employee only at the time of his termination of employment either by
death or retirement, and shall not be paid, taken, used or credited at any
other time or in any other manner.
Section 2 - Sick Leave
a. Absence from duty by an employee be reason of sickness or
disability of himself or herself shall be considered "sick leave".
b. No employee shall receive any part of his compensation while absent
from duty because of sickness or disability except as..,iherein provided.
c. A full-time employee who is paid on an annual basis shall
be entitled to sick leave with pay on the basis of one working day per
month and not more than twelve working days in each year. Such sick

leave with pay shall be granzed to the employee by the Department
Head. The Department Head may require a physician's statement for
any absence of more than three consecutive days.
d. The twelve working days per year allowed to an employee
for such leave with pay may be kept to his or her credit for future
sick leave with pay.
e. In the event that any employee utilizes the sick leave
benefits provided by this section while not actually sick, such
employee will be subject to disciplinary proceedings.
f. In the event an employee has not used all of his accumulated
sick leave at the time of his retirement, _he shall be paid, in cash,
at the hourly rate t1l n in effect, for one-half of the accumulated
sick leave to his credit.
Section 3 - Military Leave
Town employees who are members of military reserve units and
are required to go on active duty for training purposes shall be
entitled to leave, without loss of pay for such time as is necessary
to fulfill such military training obligations, but not exceeding
thirty work days per calendar year: Payment shall not be made to
such employee unless a copy of the military orders are submitted to
the Department Head.
ARTICLE THREE
HEALTH INSURANCE PLAN
Section 1 - Health Insurance
All permanent employees of the Town of Queensbury shall be
eligible for membership in the Town Health Insurance Plan. This
provides that the Town shall pay the entire cost for the employee
and one-half of the cost for the coverage of an employees's family.

"Labor Class A" is intended to mean full time, regular able bodied
employees, and "Labor Class B" is intended to mean part-time,
casual, temporary, or seasonal employees, the judgement of the
department head determining the' proper payroll classification.
Section 3 - Longevity
All employees not excluded in Article Four, Section 1, shall
be entitled to additional compensation on the basis of longevity
incentive as follows:

copy of the annual financial report to the Comptroller with the Town
Clerk on or before March 1, 1971, in lieu of filing a separate financial

RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE A MOBILE
HOME IN THE TOWN OF QUEENSBURY
RESOLUTION No. 28 introduced by Mr. Austin, seconded by Mr. Robertson.
WHEREAS, Harold L. Hermance of 8 Minnesota Avenue, Town of Queensbury,
has made application to this Board for a permit to locate a Mobile
Home at property situated at Burch Road, Town 'of Queensbury, and owned
by Una Burch, and
WHEREAS, upon proper investigation it appears that the applicant has
complied with all of the requirements of the Ordinance Regulations
relating to Mobile Homes in the Town of Queensbury, therefore be it
RESOLVED, that investigation showed that the mobile home in question
�j was in fact an 8 by 32-foot travel trailer and was found already
located on the property and being lived in which was in violation
-- of the ordinance, therefore be it further
RESOLVED, that the application of Harold L. Hermance be and is hereby
disapproved and that the Town Cleik is hereby directed to notify
Harold L. Hermance of the decision of this Board.

The above violation will be turned over to the Queensbury Police
Department.

The meeting was opened to the public. Felix Burch of Burch Road
asked why the town could not keep the road open even though it is
not a town road. He charged that the highway department was plowing
private driveways. Asked by the Supervisor whether he could name
any private roads that were being plowed, he said: "I can' t tell
you the names of them, but I can show you where they are." Council-
man Robertson pointed out that the practice is illegal and said we
must stop abuses of the law and not continue to abuse it. He said,
"I don' t want to risk anyone' s life but all the people in this
particular area were informed and, in fact, there was some question
of permitting them to locate there. Supervisor Solomon said to his
knowledge there are no private roads in the town being plowed but he
would be glad to look into it. He pointed out that in addition to
roads formally accepted into the town highway system there are about
28 miles of roads for which the town has legal responsibility because
of long usage. Mr. Francis Fish of 23 Wintergreen Road , who had
appeared previously, wanted an answer regarding the highway employment
of non-residents. He was told the matter had been referred to the
Highway Superintendent. Mr. Fish also charged that some roads in one
section of the tows were being sanded and others were not. He also
said the town was not enforcing laws relating to open trucks. Mr.
Pliny Tucker of Division Road asked about persistent rumors that U. S.
Catheter and Instrument Corporation were moving from Queen. sbury.
Supervisor Solomon said the board could not answer that question but
that the board had been working diligently with U. S. Catheter to
find a suitable site. The meeting was closed to the public.
The December 1970 Building & Zoning Department report was read and
placed on file.

Queensbury, has recommended that the Town Board advertise for bids for
the purchase of a used four wheel drive front end loader, therefore be

RESOLVED, that the Town of Queensbury solicit sealed bids for a used
four wheel drive front end loader and that the following notice be
published once in the Glens Falls Times and Post Star to read in the
following form:
NOTICE TO BIDDERS
Sealed bids will be received by the Town Clerk of the Town of
Queensbury at the Town Office Building, Bay and Haviland Roads
up until 5 :00 P.M. on January 28, 1971 for a USED FOUR WHEEL
DRIVE FRONT END LOADER, bucket capacity one cubic yard, minimum
horsepower 54, hydraulic brakes, gas engine, optional equipment,
enclosed cab with windshield wiper, one set of forks.

WHEREAS, the Town Board of the Town of Queensbury has by Resolution
adopted a schedule of water rates, and
WHEREAS, said rates are deemed inadequate due to the increased costs
incurred by the Water Department to render efficient and adequate
