The meeting was called to order at 8:25 with a salute to the flag.
The bids were opened on a used three wheel roller. Proof of publica-
tion was shown by the clerk. One bid was received from Gray Truck &
Equipment Sales. It was read by the clerk as follows:

WHEREAS, upon proper investigation it appears that the applicant

WHEREAS, upon proper investigation it appears that the applicant
has complied with all of the requirements of the Ordinance Regula-
tions relating to Mobile Homes in the Town of Queensbury, therefore

York, has made application to this Board for a permit to locate a
Mobile Home at property situated at north side of Sherman Avenue,
400 feet east of the Northway, Town of Queensbury, New York, and
owned by Charles Washburn Jr. and
WHEREAS, upon proper investigation it appears that the applicant
has complied with all of the requirements of the Ordinance Regula-
tions relating to Mobile Homes in the Town of Queensbury, therefore
be it
RESOLVED, that it was felt that it was not continuous with -our
zoning and would be improper to start putting trailers in this
area, therefore be it further

Dear Mr. Solomon:.
Please be advised that I represent Eugene J. Lucia and Marion E.
Lucia who reside on Bay Road in the Town of Queensbury. Mr. and
Mrs. Lucia are the owners of a certain parcel of land lying south-
erly of Bay Road and which parcel includes some 1642' more or less
on PicUe Hill Road.
I have in my possession two survey maps which indicate that the
northerly line of the Lucia parcel is located parallel to and some
distance north of Pickle Hill Road and that the parcel extends from
there in a southerly direction and contains approximately fifty (50)
acres of land more or less. It is the position of my clients that,
while the Town of Queensbury appears to have assumed the responsi-
bility for maintaining the portion of Pickle Hill Road which lies
within -the above description, title to the road area is in Mr. and
Mrs. Lucia.
The purpose of this letter is to advise you, first, that Mr. and
Mrs. Lucia claim ownership to the road area and secondly, to advise
you that they would be willing to enter into a discussion with the
Town towards a reasonable resolution of this problem.
I am aware of the fact that this matter has come to the Town' s at-
tention on prior occasions, but I would, however, feel that it would
be in the interests of all involved to attempt to solve the mutual
problem once and for all.

Supervisor Solomon turned this letter over to Attorney Harold Katz.
However, he explained that Pickle Hill Road appears as a town road
on an 1858 map that hangs in his office and that the road has been
paved and maintained by the Town for many years.

Dear Sir:
We are writing to you at the direction of the Town Board
of the Town of Queensbury with reference to the property in
said Town owned jointly by you, L. J. Grossman, Jr. , R. A.
Grossman and W. H. Rubin.
When the Town Board rezoned said property for the Zayre
Store complex, two conditions were imposed. One required the
erection of a chain link fence. This has been done. The other
condition required the planting of a wooded barrier fifty feet
in width along the southerly boundary of the subject premises.
This has not been done.
You are hereby advised that unless the planting of said
wooded barrier is commenced and completed without undue delay,
the Town Board will proceed to rezone the said property back
to its residential zone status. In fact, until the planting
is-completed as directed in the rezoning resolution, this pro-
perty is deemed to be residential in nature and cannot be used
for commercial purposes.

Gentlemen:
In response to your letter of April 29, I wish to advise you that
a contract has been entered into between this company and Meade' s
Nursery of your town for the planting of 150 Evergreen trees in
the 50' area required.
I suggested that Mr. Meade review with you the exact location of
these trees to get your approval and I understand he has already
done this. Mr. Meade advises me that the planting will be com-
pleted some time during the week starting May 10.

Supervisor Solomon said the trees have been planted and this pro-
blem is finally resolved.

The Police Department Report for the first quarter of 1971, January
1 through March 31, 1971, was read and placed on file.
The Police Department Report for the month of April 1971 was read
and placed on file.
The Highway Report for the month of April 1971 was placed on file.
The Supervisor' s Report for the month of April 1971 showing total
receipts of $84,738.83 and total disbursements of $113,901.30 was
placed on file.
Supervisor Solomon stated that he had met with Eugene Johnson re-
garding the 33 acres of land adjacent to the town landfill site on
Ridge Road which the town -had orally agreed to buy from Mr. Johnson
for $16,500. Mr. Johnson informed the Supervisor that he had con-
tracted to sell the land to another party. The Supervisor said it
was imperative for the town to acquire the property because the es-
timated life of the present landfill area is nine months to two years.
It was agreed that the Supervisor should renew the $16,500 offer in
writing to -Johnson and others as their interest may appear and em-
power Town Qense1Harold Katz to -petition for condemnation if the
offer is not accepted.
RESOLUTION No. 107, introduced by Mr. Robertson, who moved its
adoption, seconded by Mr. Robillard.
WHEREAS, by Resolution No. 35 of 1971, the Town Board of the
Town of Queensbury authorized the acquisition of land in said Town
.of Queensbury for sanitary landfill purposes and appropriated the
sum, of $16,500 therefor, and
WHEREAS, the owner of said land has now advised the Town Board
of his refusal to -convey said land as agreed, and
WHEREAS, the subject land is adjacent to an existing Town of
Queensbury sanitary landfill area, and
WHEREAS, this Town Board deems it in the best interest of the
Town of Queensbury to acquire said lands and acquisition can only
be achieved by the power of eminent domain and condemnation proceed-
ings,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Supervisor of the Town of Queensbury
be and he hereby is authorized to 'renew in writing said offer of
$16,500..00 for the purchase by said Town of a 33-acre tract of
realty on the east side of Ridge Road in said Town, bounded south-
erly and westerly by the Town of Queensbury sanitary landfill, to
Eugene Johnson, the record owner of said premises, and to any other
persons who may have an interest therein; and be it further
RESOLVED, that if such offer be not accepted, that Harold W.
Katz, as attorney for said Town be and he hereby is authorized to
petition in the name of said Town for the condemnation of said pre-
mises for use as a sanitary landfill.

Noes: None
Councilman Austin explained a new proposed ordinance regulating
motor boats. He said it would replace an existing ordinance and
extend town authority to waters bounding the town as well as in
it. The town' s authority would extend 1,500 feet out from the
shore. It would regulate anchorage, prohibiting mooring of a boat
within 100 feet of a private dock or improved property except in
emergency or at the direction of a police officer or at the invita-
tion .of an owner or le ssee of the property. Councilman Robertson
noted that the. ordinance as it applies to Lake George waters re-
quires Conservation Department approval.

RESOLUTION No. 108, introduced by Mr. Austin, who moved its
adoption, seconded by Mr. Robertson.
RESOLVED, that a public hearing be held on the following ordinance
on the 27th day of May, 1971, at 8:00 o'clock -P.M. at the Queens-
bury Town Office Building, Bay and Haviland Roads, Glens Falls, New
York, and that the Town Clerk give notice of such hearing by pub-
lication of a notice thereof in the official Town Newspapers at
least once 10 days prior to the date specified for such hearing
specifying the time when and the place where -such hearing will be
held and in general terms describing said proposed ordinance:
ORDINANCE REGULATING THE OPERATION OF MOTOR BOATS IN THE TOWN -'
OF QUEENSBURY, WARREN COUNTY, NEW YORK.
Section 1. Declaration of policy. Pursuant to the pro-
visions of Section 130, paragraph 17 of the Town Law .of the
State of New York, the Town of Queensbury hereby regulates the
operation of pleasure boats in the waters within and bounding
said Town, such regulation being necessitated by the marked
increase in pleasure boating in said waters and the proportion-
ate increase in dangers to others resulting therefrom.
Section 2. Definitions. a. The term "person" as used in
this ordinance shall include an individual, society, club, firm,
partnership, corporation or association of persons, and the
singular number shall include the plural number.
b. The term "boat" as used in this ordinance shall include
any vessel propelled on water in any other manner than by hand.
c. The term "motor" as used in this ordinance shall include
both inboard and outboard engines using gasoline or similar fuel.
d. The term "waters" as used in this ordinance shall em-
brace all waters within the Town of Queensbury and all waters
bounding said Town to a distance of 1,500 feet.
Section 3. Regulation of speed. No person shall operate
on any waters any boat having a motor installed therein or at-
tached thereto at a speed greater than five miles per hour
within one hundred feet from any shore.
Section 4. Regulation of anchorage. No person shall anchor
or moor any boat within 100 feet of any private dock or other
improved property, except in a case of emergency or at the di- .
rection of any police officer or at the invitation of the owner
or lessee of said dock or improved property.
Section 5. Penalties. Any person violating any of- the
provisions of this ordinance shall be guilty of a violation,
and any conviction thereof shall be punishable by a fine not
exceeding $100.00 or imprisonment in the Warren County Jail
for not more than fifteen (15) days.
Section 6. Saving clause. If any clause, sentence, para-
graph, section or part of this ordinance shall be adjudged by
any court of competent jurisdiction to be invalid, such judgment
shall not affect, impair or- invalidate the remainder thereof,
but shall be confined in its operation to the clause, sentence,
paragraph, section or part thereof directly involved in the con-
troversy in which such judgment shall have been rendered.
Section 7. Repealer. Town of Queensbury Ordinance Regu-
lating the Operation of Motor Boats in the Town of Queensbury,
Warren County, New York, duly adopted the 16th day of July,
1955 is hereby repealed in its entirety.
Section 8. Effective date. This ordinance shall take
effect ten (10) days after its publication and posting as re-
quired by Section 133 of the Town Law and upon the written
approval of the Conservation Commissioner as required by Section
130, paragraph 17, subdivision 2, of the Town Law.

Supervisor Solomon opened the meeting to the public. Pliney
Tucker congratulated the Board on the good news that U. S. Catheter
and Instrument Corporation was remaining in Queensbury. He criti-
cized Justice J. David Little for a "slapping of hands" penalty
in the case of a mobile home ordinance violator. He complained
of lack of action against West Side Auto junk yard which he said
is unlicensed but still operates as before. He said the yard has
been in violation for over a year and he would be glad to sign
the complaints if that was necessary. Supervisor Solomon said
the matter was being investigated. The meeting was closed to the
public.
Supervisor Solomon announced that the Board had had several meet-
ings since the public hearing last week on the Queensbury Sewer
District and that he would introduce a resolution to form the
Queensbury Sewer District and a resolution to finance the Queens-
bury Sewer District. He said the Board had been studying the
problem for over a year, and felt this was the only way to go . . .
the only way we would ever be able to come up with this amount of
state and federal aid to alleviate the growing problem of pollution.
Councilman Austin said he had some reservations about the program,
principally the matter of sealing our future with a public corpora-
tion or authority from the state level. He said he had no reserva-
tions on intermunicipal cooperation. After weighing many considera-
tions, he said he was voting for the resolution. Councilman Austin
pointed out that the voters did have an opportunity to put the
issue on the ballot if they wished to petition, to do so. Counicl-
man Demboski said he was pleased to see so many at the public hear-
ing last week and had received many favorable comments from the
public. He thanked Supervisor Solomon, as did Councilman Austin,
for the many hours of hard work he had spent on the sewer problem.
He thanked Ray Irish of Rist-Frost for the excellent explanation
of the sewer system and thanked Harold Katz for all the coopera-
tion he had given to board members -regarding this project.

RESOLUTION TO APPROVE BID FOR USED ROLLER
RESOLUTION No M. introduced by Mr. Robertson, who moved its
adoption, seconded by Mr. Austin.
WHEREAS, Mr. Carl Garb, the Superintendent of Highways of the
Town of Queensbury, did recommend the advertising for bids for
a used 3 wheel roller for the Highway Department and
WHEREAS, one bid was received on May 13, 1971, from Gray Truck
and Equipment Sales and
WHEREAS, the bid was opened and read aloud by the Clerk at 8:00
P.M. on May 13, 1971 and the price quoted was $3,500 for a used
1964 Huber Roller as per specs and
WHEREAS, the price bid met with the approval of Carl Garb , the
Town Highway Superintendent, therefore be it
RESOLVED, that the bid of $3,500 from Gray Truck and Equipment
Sales is hereby accepted and that delivery of the Roller will
be made at once.

IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK.
WHEREAS , the Town Board of the Town of Queensbury,
Warren County, New York, has duly caused a general map, plan and
report to be prepared and filed in the office of the Town Clerk
of said Town for the establishment of Queensbury Sewer District
in said Town to be bounded and described as follows :

Warren County, New York , as follows :
Section 1. The establishment of a Sewer District in the
Town of Queensbury, Warren County, New York, to. be known as Queens
bury Sewer District in said Town, and the construction of improve-
ments therein consisting of a sewage collecting system generally
serving the populated areas of the district, including acquisition
of lands and rights in land, all as more fully set forth and shown
on the map and plan aforesaid, at an estimated maximum cost of
$322962400 are hereby approved. The method of financing the cost
of said improvements shall be by the issuance of serial bonds of
said Town maturing in annual installments over a period not
exceeding forty years . The cost of said improvements shall be

assessed , levied and collected from the several lots and parcels
of land within said Queensbury Sewer District in proportion as
nearly as may be to the benefit which each such lot or parcel will
derive therefrom.
Section 2. Said District shall be bounded and described
as follows:
Beginning at the southeasterly corner of the Town
of Queensbury, the said point of beginning being in the
center of the Hudson River, running from thence in a
westerly direction in the center of the Hudson River and
following the southerly bounds of the Town of Queensbury
to the southeasterly corner of the City of Glens Falls ;
thence running northerly along the easterly bounds of
