4.9 SERVICES\Request for Proposals—ACCEPT—Dog Control Services—Upstate SPCA—3-5-18 RESOLUTION AUTHORIZING ENGAGEMENT OF SPCA OF UPSTATE NEW YORK, INC. FOR PROVISION OF DOG CONTROL SERVICES WITHIN THE TOWN OF QUEENSBURY RESOLUTION NO.: ,2018 INTRODUCED BY: WHO MOVED ITS SECONDED BY: WHEREAS, the Town of Queensbury needs dog control services including enforcement as set forth under New York State Agriculture and Markets Law Article 7 and the Queensbury Town Code, and WHEREAS, the Queensbury Town Board authorized the Town's Purchasing Agent to request proposals for the provision of such dog control services (Services), and WHEREAS, the Purchasing Agent received and reviewed two (2) proposals and duly submitted such proposals to the Town Board for review, and WHEREAS, the Town Board reviewed the two (2) received proposals and at a Special Town Board Workshop held on February 15th, 2018, interviewed the two (2) agencies who submitted such proposals, and WHERAS, after due deliberation, the Town Board wishes to authorize engagement of SPCA of Upstate New York, Inc., for such Services for the annual amount of$65,000 as delineated in SPCA of Upstate New York, Inc.'s proposal presented at this meeting, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of SPCA of Upstate New York, Inc., for dog control services (Services) for the Town of Queensbury for the annual amount of $65,000 as set forth in SPCA of Upstate New York, Inc's proposal as presented at this meeting, such Services to be paid for from such account(s) as may be deemed appropriate by the Town Budget Officer, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute an Agreement between the Town and SPCA of Upstate New York, Inc., for such Services in form acceptable to the Town Supervisor, Town Clerk, Town Budget Officer and/or Town Counsel, as well as any other needed documentation, and the Town Supervisor, Town Clerk, Town Budget Officer, Purchasing Agent and/or Town Counsel to take such other and further actions as may be necessary to effectuate the terms of this Resolution. The Agreement will expire at 11:59 p.m.,on March 31,2019. The Town shall have the option to renew this Agreement for four(4) additional terms by providing written notice of its intention to do so to the Agency at least sixty(60) days prior to the expiration of the preceding term. Either party may terminate this Agreement at any time by providing at least ninety(90)days advance written notice to the other party. FULL PERFORMANCE KNOWLEDGE, SKILLS,ABILITIES AND PERSONAL CHARACTERISTICS: The background of the Society for the Prevention of Cruelty to Animals of Upstate New York, Inc., (hereafter referred to as SPCA of Upstate New York,Inc.),is our Executive Director, Cathy Cloutier,has been employed by shelter for 20 years. She has dealt with many cruelty,neglect cases that call for professionalism,courtesy and knowledge of animal handling. She has dealt with New York State Department of Agriculture and Markets with the necessary paperwork and vehicle equipment. She was also the Training Director for the Glens Falls Kennel Club with over ten(10)years in that position holding obedience classes consisting of puppy,beginner and advance beginner. These classes she did with Debra Stemp,her Executive Assistant. Our Executive Assistant,Debra Stemp,brings with her 19 years experience in dog handling and educational ways to correct issues. Debra is meticulous in handling all facets of paper work for this organization and any follow ups required to rectify issues. Our Office Manager,Heather Carlton,brings with her experience in dealing with dogs,cruelty situation removals and various situations and has the capability to handle those. Susan Parker is one of our Animal Control Officers that deals with dogs and all the aspects of Article 7 of Ag&Markets law along with Town codes. Susan has been with us for over seven years and is experienced in dog handling and cruelty situations Theresa Mandigo is our vet assistant and has over 16 years knowledge and experience in dog handling, medical and dealing with stressful emergency animal. Patricia Rabine has been with the organization for over three(3)years dealing with every animal that comes into our building. Mykayla Mandigo has been with us full time for over two (2)years and brings with her the same animal experience. SPCA OF UPSTATE NEW YORK, INC. - PROPOSAL Page 2 Austin Manigo has been with us for over a year in a part time capacity as an animal care giver, but will become full time in June. As dog control officer we follow New York State Agriculture and Markets Law,Article 7 and Queensbury Town Code, Chapter 73. Dog Control is not an emergency service and does not investigate or process animal abuse/neglect cases. These are criminal charges and need to be handled by Law Enforcement under New York State Agriculture&Markets law Article 26. Every case involving a dangerous dog or possible dangerous dog requires our officer's to follow up as to the incident,obtain a deposition from both parties involved and bring said paperwork to the Court of jurisdiction for the judge's decision whether he will hear the case or not. Our main priority is to protect the town that we work for from being maliciously sued. The Warren County Health Department is notified of any bite that we are made aware of and Susan Parker and Cathy Cloutier are Warren County Health Services,Animal Control Officers who follow up when the ten(10)day quarantine has expired. Any dog that is seized will be brought to the Town's contractual holding facility. Any identified dog will be instructed to pay their dog's impoundment/housing fees to the Town Clerk at the Town Office,742 Bay Road, Queensbury,NY. All insurance stated will be provided at enforcement time of contract. Every employee of the SPCA of Upstate New York,Inc.,is qualified to handling dogs in the proper way depending upon each situation. We house over 1,200 animals a year that need to be cared for daily, all sizes,shapes and breeds. We do NOT carry or use firearms. Contract Would Cover: Answering calls/complaints during hours of operation. Response within operational hours of 8:30 a.m.to 5:00 p.m.by emergency priority. Enforcement of Article 7 and Local Town Code 73. Process court documents and tickets when necessary. Serving court paperwork and site visits to ensure court compliance. Maintain required paperwork and equipment to Agriculture&Markets standards. SPCA OF UPSTATE NEW YORK, INC. - PROPOSAL Page 3 Conduct annual Agriculture&Markets inspection of paperwork/equipment with inspector. Provide monthly report of service to Town Clerk and required back up forms. Assist Law Enforcement with criminal cases involving Dogs and if requested,Law Enforcement would be the lead and(DCO would only act as consultant). Notify the Warren County Public Health Department of any bite that we are aware of and provide them with all the required information for their follow up. The SPCA of Upstate New York,Inc. has two Public Health Animal Control Officers. When we are dispatched for a call and a dog is picked up to be transported to the appropriate housing facility a DL-18 (seizure and disposition report)will be completed with DCO signature, and the housing facility employee signature. A number is assigned by the housing facility and a copy is left there. The DCO and the Town will receive their copy. This report is inspected yearly by Agriculture&Markets along with the holding facilities copy. Of which,we have had continuous satisfactory audits. The Town will have the option for DCO hours of Coverage: Option 1: 8:30 a.m. -5:00 p.m.,Monday through Friday,No Holidays Option 2: 9:00 a.m. -5:00 p.m.,Monday through Friday,No Holidays Calls after normal business hours will be addressed at the opening of business the following day. If there is an emergency after hours that poses a threat to a human or companion animal and requires a DCO officer,one will be dispatched an emergency number will be supplied. We will dedicate one of our lines for the DCO Queensbury Calls and advertise on website. We have also included in our proposal copies of"A Guide to Dog Owner Responsibilities and ways to Protect Your Pocketbook,Dog Seizure and Disposition Report,Dog License Warning Notice,Door Hanger,Appearance Ticket and log sheet(per call and date order)forms that we would like to use if we are awarded this contract with your permission. All after normal hours emergency's will be handled in the most timely manner. A fee of$100.00 plus mileage will be accessed to each emergency call. The SPCA of Upstate New York,Inc. shall have the staff available to respond to all calls that require addressing. SPCA OF UPSTATE NEW YORK, INC. - PROPOSAL Page 4 The Town of Queensbury will give authorization as to immediate actions or warnings on Town Code violations. Some Towns prefer giving someone a chance to license their dog other towns my want to proceed with appearance tickets. We do have options that we feel will be a suitable alternative to ensure code ordinance and licensing are taken care of in a timely manner if the town so chooses and maintain a professional response however the Town's wishes. The SPCA of Upstate New York,Inc.,would like to offer two options: Option 1: Use of the Queensbury Animal Control Van with equipment Option 2: The SPCA of Upstate New York,Inc.,would use their van documenting mileage for each call and town reimbursement of the standard mileage rate of 54.5 cents. The yearly fee for this contract will be$60,000.00. Payments are to be distributed at$5,000.00 per month.
