RESOLUTION EXPUNGING PAST DUE WATER AND SEWER CHARGES
FOR PARCEL LOCATED AT 275 BAY ROAD

WHEREAS, the Warren County Treasurer previously determined that there was no practical
method to enforce the collection of delinquent taxes against Town of Queensbury Tax Map Parcel
No.: 302.8-1-2 owned by J. David Muller and located at 275 Bay Road (Parcel) and therefore the
County issued a Certificate of Prospective Cancellation (Certificate) in accordance with New York
State Real Property Tax Law §1139(d) so that the Parcel would become exempt from taxation, and
WHEREAS, the Town's Assessor accordingly complied with the Certificate and placed the
Parcel in Roll Section 8 which is the wholly exempt portion of the assessment roll;however, the Parcel
continued to be liable for Queensbury Consolidated Sanitary Sewer and Queensbury Water District
charges, and
WHEREAS, the Warren County Director of Real Property Tax Services has advised the Town
that the Parcel is not subject to special district assessments until such time as the County revokes the
Certificate with a Certificate of Restoration so the County will not be proceeding with a tax foreclosure
proceeding, and therefore the Town should expunge any past due charges from the Parcel's records for
the years 2015, 2016, 2017 and 2018, and
WHEREAS, the Town Assessor and Town Counsel have reviewed this information and
concur with such recommendation,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the Town Assessor to
expunge past due Queensbury Consolidated Sanitary Sewer and Queensbury Water District charges
from Tax Map Parcel No.: 302.8-1-2 owned by J. David Muller and located at 275 Bay Road(Parcel)
for the years 2015, 2016, 2017 and 2018 as follows:
2015 - Qsby Consolidated $ 17.91
Qsby Water Exempt $102.53
TOTAL: $120.44
2016 - Qsby Consolidated $ 32.80
Qsby Water Exempt $ 55.05
TOTAL: $ 87.85
2017 - Qsby Consolidated $ 30.44

BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Assessor and/or
Town Clerk to forward a certified copy of this Resolution to the Warren County Director of Real
Property Tax Services and the Town Supervisor, Town Clerk and/or Town Assessor to take all other
actions needed to effectuate the terms of this Resolution.

CERTIFICATE OF PROSPECTIVE CANCELLATION
Warren County has determined that there is no practical method to enforce the
collection of delinquent taxes against Queensbury parcel 302.8-1-2. Therefore,in
accordance with Real Property Tax Law Section 1138, sub d, the enforcing office for
Warren County is issuing this certificate to the assessor for the Town of Queensbury so
that the parcel shall become exempt from taxation not withstanding any other provisions
of law.
The parcel shall remain exempt until Warren County determines that the parcel should
be restored to the taxable portion of the assessment roll, and a Certificate of Restoration
from the enforcing offer is filed with the assessor and county director of real property
services.

Queensbury Parcel 302.8-1-2, located at 275 Bay Road and owned by David Mullen
has possible environmental problems which make the property unsalable. In addition, it is
economically unfeasible for Warren County to foreclose on this property.
