conversat ions between you and Laura Moore of my office.
Upon my review I find that your proposal will require an Area Variance and Subdivision approval. A
Variance is required as your plan offers the relocation of a property line which results in a setback
violation on your parcel and the creation of a substandard lot adjacent to your home lot_ Subdivision
approval is needed for the creation of the additional parcel.

Area Variances and a Preliminal-y Stage Subdivision Application_ My clients would like your
approvai of'the Area Variances for purposes of subdividing their land at 45 Ogden Road. There
is no site plan for the possible new parcel, so my clients therefore also seek waivers with respect
to any requirements associated with building plans for the possible new parcel.

to be able to sell a parcel and to conform to the prevalent lot sixes on Ogden Road, This
area variance is necessary regardless of the lines and acreage of the parcels of the
subdivision as it is impossible to divide 1.37 acres into two 2.0 acre lots in order to
satisfy the minimum acreage density requirements for moderate density residential
zones.

o The req uested area variance is a 54 percent variance. Although mathematically the
variance may be considered "substantial", the totality of the circumstances must be
considered. In I ight of the substandard lots throughout the neighborhood, it could be
reasona bly stated that this varia nce, based on the tota lity of the circurnstances and riot
just the mathematics, is not 5ubstantiaL

subdivision as itis impossible to divide 1.37 acres into two 2.0 acre lots in order to
satisfy the minimum acreage density requirements for moderate density residential
zones.

o The requested area variance is a 77 percent variance. Although mathematically the
variance may be considered "substantial",the totality of the circumstances must be
considered. In light of the substandard lots throughout the neighborhood, it could be
reasonably stated that this variance, based on the totality of the circumstances and not
just the mathematics, is not substantial.
* Whether the proposed variance will have an adverse effect or impact on the physical or

o The proposed variance will not have an adverse effect or impact on the physical or
