1970-03-26 RESOLUTION TO APPROVE AUDIT OF BILLS
RESOLUTION No. 78, Introduced by Mr. Robertson, who moved its adoption,
seconded by Mr. Solomon.
RESOLVED, that the Audit of Bills as listed in Abstract 70-3
numbered #303 through #428 inclusive and totaling $43,417.66
is hereby approved.

Supervisor .Solomon. reported that final cost estimates on inter-
- municipal sewerage should be ready in about two months and that
he will be attending another meeting next Thursday in South Glens
Falls on this matter. He also reported that resolutions requesting
the State Department of Transportation to establish speed limits
in the Town' s populated areas will be on the March 26th agenda.
Councilman Austin commented on the large volume of court activity
in the Town and the capable administration of Justice James A.
Davidson. He also commented on the annual report of the Crandall
Library stating that the statistics point up the wisdom of inter-
community support.
Supervisor Solomon reported that Justice Meredith Bentley is a
patient in Glens Falls Hospital and wished him a speedy recovery.
Supervisor Solomon noted that the board was remaining for a 9 :00 P.M.
meeting with Assemblyman Lawrence E. Corbett to discuss several pieces
of legislation which could concern the Town of Queensbury.

The public hearing was declared opened on the zoning of property
of Ski and Shore Corporation.
Proof of publication was presented.
Attorney Harold Katz explained that the property consisting of
approximately 19 acres in the Gurney Lane area was formerly owned
by Warren County and was unzoned since municipal property is im-
mune from the zoning ordinance. He said there has been some con-
flict in the various court decisions relating to such cases. A
Massachusetts decision held that unzoned municipal property when
sold to a private owner automatically becomes a part of the sur-
rounding zone. He advised the board to follow a New York State
court decision holding that such lands do not necessarily have
to be zoned in the same manner as those of which they are a part.
It was noted that the Planning Board on February 4, 1970, had
recommended the C-3 designation. Hammond Robertson read the clause
on C-3 district.
Supervisor Solomon requested a voice of opinion from any persons
present either in favor of or in opposition to the zoning of the
property. Mr. Robert J. Nolan asked that it be noted for the
record that he was present on behalf of Ski and Shore Corporation
and offered to answer questions about proposed uses.
The public hearing was closed at 8 :08 P.M.
RESOLUTION NO. 79, Introduced by Mr. Austin, who moved its adoption,

RESOLUTION APPROVING ZONING OF
PROPERTY OF SKI AND SHORE CORPORATION
WHEREAS, application has been made by Ski and Shore ..
Corporation for the zoning of an unzoned area acquired by said
corporation from the County of Warren, and
WHEREAS, the Town Board determined it in the public
interest to call a hearing on said application pursuant to
Section 11:100 of the Zoning Ordinance of the Town of Queensbury,
and
WHEREAS, such hearing was held pursuant to notice duly
given at a meeting of the Town Board in the Town Office Building,
Bay and Haviland Roads, on Thursday, March 26, 1970 at which all
persons desiring to be heard in favor or said zoning and also
those desiring to be heard in opposition thereto were given an
opportunity to be heard, and thereafter the public hearing was
closed ,
NOW, THEREFORE, BE IT RESOLVED:
That the property owned by Ski and Shore Corporation
consisting of approximately 19 acres of land bounded on the north
by Gurney Lane , on the west by the relocated West Mountain Road,
on the east by Interstate Highway No. 87, and on the south by
lands of Brayton and others, and be and the same is hereby zoned as
a C-3 district , and it is
FURTHER RESOLVED, that the necessary changes be made
upon the zoning and departmental maps of the Town of Queensbury --�
so as to indicate the location of said property as being located
in a C-3 zone as defined and regulated pursuant to the provisions
of the Zoning Ordinance and map of the Town of Queensbury, as
amended, and it is
FURTHER RESOLVED, that the Town Clerk be and he is
hereby authorized and directed to give the necessary notice of
such change in zoning to the department and agencies having juris-
diction in the matter.

and Claudine Mabb to locate a mobile home in place of a dwelling in
Howard Street.
Proof of publication was presented.
Supervisor Solomon requested a voice of opinion from any persons
present either in favor of or in opposition to`$ie graning of the
permit in question. Hammond Robertson asked that a stipulation
be put in the resolution that the existing dwelling be removed
by July 31, 1970, because of its poor condition. Mr. Mabb ap-
peared after the resolution was passed and he was informed of
its approval and the condition to have the present dwelling re-
moved. The public hearing was closed.
RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME
RESOLUTION No. 80, Introduced by Mr. Robertson, who moved its adoption,
seconded by Mr. Robillard.
WHEREAS, George and Claudine Mabb of Howard Street, Town of
Queensbury, has made application in accordance with paragraph 2 (c)
Section 4, of an ordinance of the Town of Queensbury entitled ;
ORDINANCE FOP. THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS
IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a
mobile home outside of a duly licensed mobile home court at pro-
perty situated at Howard Street, Town of Queensbury, and
WHEREAS, this town board has conducted a public hearing in
connection with said application and has heard all persons desiring
to be heard in favor of or against said application, and
WHEREAS, it is hereby determined that the facts presented in
said application and at<• said public hearing are sufficient to
authorize the issuance of the permit requested by said application
for the following reasons : Their were no persons in appearance in
opposition to the granting of the permit. The application was ap-
proved by the Zoning Enforcement Officer.
It is a condition- of this Resolution that the existing dwelling
be removed by July 31, 1970, because of its poor condition. There-
fore be it
RESOLVED, that pursuant to the provisions of the above mentioned

WHEREAS, Superintendent of Highways, Carl A. Garb, has recommended

RESOLUTION TO SET PUBLIC HEARING
RESOLUTION No. 86, Introduced by Mr. Austin, who moved its adoption,
seconded by Mr. Robillard.
WHEREAS, the use of land for gasoline filling stations
or garages for five or more motor vehicles has nuisance
characteristics and is potentially harmful, and
WHEREAS, the Town of Queensbury has duly adopted a
Zoning Ordinance that includes provision for issuance by the
Board of Appeals of special use permits for such garages and
filling stations under certain specified conditions, and
WHEREAS, consent of a certain percentage of the
landowners within a specified distance of the site of such
proposed uses is not now a condition for issuance of such
permits, and
WHEREAS, the establishment of such consent as a condition
precedent to the issuance of such permits has been upheld by
the courts of this State, and
WHEREAS, the following proposed amendment of said
Zoning Ordinance has been presented to this board :
5.505 USES
b. Garages and Filling Stations. In a C-1. C-2
or C-3 District or in an M-1 or M-2 Manufacturing District,
plans for the erection or structural alteration of any
garage for more than five motor vehicles , or of a filling
station, may be approved by the Board of Appeals, only
when said plans are accompanied by the written consent
of sixty (60) per cent in number of the owners and mort-
gagees of all property within three hundred (300) feet of
any portion of the lot or plot on which said garage or
filling station is , or is proposed to be, located. Said
Board may require such change therein in relation to
yards, locations of pumps and buildings and construction
of buildings to minimize traffic difficulties and to
safeguard adjacent properties.

WHEREAS, said proposed amendment has been referred to
the Town of Queensbury Planning Board for consideration and study,
and
WHEREAS, said Planning Board unanimously recommends adop-
tion of said proposed amendment; and
WHEREAS, Section 265 of the Town Law and Section 11.100
of said Zoning Ordinance require that a public hearing be held
on such proposed amendment; now
THEREFORE, BE IT RESOLVED that a public hearing on said
proposed amendment of the Town Zoning Ordinance will be held

WHEREAS, Donald A. Chase, Town Clerk, under Sub-Division 18 , Section
30 of the Town Law has deemed it adviseable to name an additional deputy
to issue conservation licenses only and
WHEREAS, the Town Clerk haq. thereby named Roy A. Ball, Jr. of Corinth
Road, Town of Queensbury, as such deputy, therefore be it
RESOLVED, that Roy A. Ball, Jr. as a deputy appointed by the Town
Clerk shall have the power to issue conservation licenses as con-

Cooperative intermunicipal action to eliminate another traffic hazard
was completed with the adoption of a resolution to install a highway
light at the intersection of Hicks Road and County Line Road, the en-
trance to Warren County Airport. The site is on the Warren-Washington
County line and the cost will be shared equally by the Towns of Kings-
bury and Queensbury.
RESOLUTION No. 88 regarding the installation of a highway light at the
intersection of Hicks Road and County Line Road is not available at this
time but will be forthcoming from Attorney Harold Katz. This resolution

RESOLUTION TO REQUEST ESTABLISHMENT OF AREA SPEED RESTRICTIONS
RESOLUTION NO. 89, Introduced by Mr. Austin, who moved its adoption,
and seconded by Mr. Demboski.
WHEREAS, certain areas of the Town of Queensbury have experienced
and continue to experience an increase in both residential popula-
tion and motor vehicle traffic; and
WHEREAS, the Town Board of the Town of Queensbury, the Police
Department of said Town and the Division of Traffic Engineering
and Safety, New York State Department of Transportation, have
studied motor vehicle traffic flow throughout said Town and
J determined the need for establishment of area speed restrictions
in certain areas; therefore, be it
RESOLVED, that the Town Board of the Town of Queensbury, together
with the Warren County Superintendent of Highways, hereby request
said Department of Transportation, pursuant to Section 1622,2 of
the New York Vehicle and Traffic Law, to establish area speed
restrictions within the following areas :
1. 30 MPH within the South Queensbury area, the
boundaries of which are described as follows : Beginning at the
intersection of the northerly right-of-way line of Route 32 with
the Warren-Washington County line; thence northerly along the
Warren-Washington County line to the southerly right-of-way line
of Dix Avenue; thence westerly along the southerly right-of-way line
of Dix Avenue to the westerly right-of-way line of Highland Avenue;
thence southerly along the westerly right-of-way line of Highland
Avenue to the northerly right-of-way line of Route 32; thence
easterly along the northerly right-of-way line of Route 32 to
the point of beginning.
2. 30 MPH within the Cleverdale-Kattskill Bay area,
the boundaries of which are described as follows : Beginning at the
intersection of the northerly right-of-way line of Route 9L with the
easterly right-of-way line of CR 38; thence northerly along the
easterly right-of-way line of CR 38 to its intersection with the
Warren-Washington County line; thence northerly along the Warren-
Washington County line to its intersection with the easterly Lake
George shore line; thence southerly, northerly and southerly along
the easterly, easterly and westerly shore line of Lake George around
Cleverdale Point to its intersection with the northerly right-of-way
line of Route 91,; thence easterly along the northerly right-of-way
line of Route 9L to the point of beginning.
3. 30 MPH within the Glens Fails area, the boundaries
of which are described as follows: Beginning at the intersection
of the westerly right-of-way line of Meadowbrook Road with the
northerly Glens Falls City line; thence westerly and southerly along
the northerly and westerly Glens Falls City line to its intersection
with the northerly shore line of the Hudson River; thence westerly
along the northerly shore line of the Hudson River to a point oppo-
site Riverside Drive extended southerly; thence on a straight line

The meeting was opened to the public. Pliney Tucker commended Carl
Garb and the Highway Department for a magnificent job of •snow removal.
He also asked about the re-study of the mobile home situation. He was
told that a special committee had just completed a survey of the town
and that any changes will be enacted in conjunction with a building
and housing code for the town.

WHEREAS, the members of the Town Board were saddened by the passing
of Meredith S. Bentley and,
WHEREAS, Mr. Bentley was the Town Justice and has served the town
faithfully for many, many, years, and
TaHEREAS, Mr. - Bentley was a mumber of one of the old and respected
families in the Town of Queensbury and
WHEREAS, the Town of Queensbury has suffered a loss by his passing,
be it
RESOLVED, that the members of the Queensbury Town Board hereby
record their profound sorrow on the passing of Meredith S. Bentley,
and extend to his wife and family their sincere sympathy and be it
further
RESOLVED, that this resolution be entered- in the minutes of this
meeting and that the Town Clerk be and he hereby is directed to
transmit copies thereof to the members- of his family.

The meeting was called to order at 10:15 P.M.
This special meeting was called at the conclusion of the Queensbury
Republican Committee meeting in which they unanimously voted to submit
the name of J. David Little as their candidate to succeed Meredith S.
Bentley as Town Justice to the Town Board.
RESOLUTION N0, 92, Introduced by Mr. Austin, who moved its adoption,
seconded by Mr. Robillard.
WHEREAS, a vacancy -exists in the office of Town Justice by reason of
the death of Meredith S. Bentley, and
WHEREAS, it has been determined that J. David Little , an attorney at
law residing in the Town of Queensbury, is qualified to be appointed
to fill- such vacancy, be it
RESOLVED that, pursuant to subdivision 5 of Section 64 of the Town Law,
J. David Little, residing at 21 Wilson Street, be and he hereby is
appointed Town Justice of Queensbury to fill the vacancy caused by the
death of Meredith S. Bentley who had been elected to that office, to
hold office until his successor is elected at the general election to
be held on the -3rd day of November, 1970.
