WHEREAS, by Resolution No.: 223, 2017, the Queensbury Town Board authorized the
Buckbee Road Culvert Replacement Project (Project), establishment of Buckbee Road Culvert
Replacement Capital Project Fund 4218 and engagement of The Chazen Companies (Chazen) for
technical and engineering services concerning the Project, and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and award
the bid to the lowest responsible bidder meeting New York State statutory requirements and the
requirements set forth in the Town's bid documents and specifications, and
WHEREAS, by Resolution No.: 376,2017, the Town Board authorized the services of Chazen
for design and construction phase services concerning the Project, and an advertisement for bids for
the Project in the official newspaper for the Town of Queensbury, and
WHEREAS, on May 151'', 2018, the Purchasing Agent duly received and opened all bids,
and
WHEREAS, the Purchasing Agent and Chazen have reviewed the bids and recommended
that the Town Board authorize the bid award to the lowest responsible bidder, James H. Maloy,
Inc., for an amount not to exceed $186,000, and
WHEREAS, the Town Board wishes to authorize a withdrawal and expenditure in the total
estimated amount of$186,000 from Capital Reserve No. 64 toward this Capital Project, and
WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town
Board is authorized to withdraw and expend funds from Reserve 464 subject to permissive
referendum,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby awards the bid for the Buckbee
Road Culvert Replacement Project (Project) to the lowest, responsible bidder, James H. Maloy,
Inc., for an amount not to exceed $186,000, to be paid for from Capital Construction Account
No.: 218-8540-2899, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby finds that the withdrawal and expenditure for such
Project are expenditures for a specific capital project for which the Capital Reserve Fund 464 was
established, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs that funding for such Capital
Project shall be by a transfer from Capital Reserve Fund 464 in the amount of $186,000 to
transfer to Buckbee Road Culvert Replacement Capital Project Fund 4218, and
BE IT FURTHER,
RESOLVED that the Town Board authorizes and directs the Town Budget Officer to
take all actions necessary to increase such appropriations and revenues as follows:
• Revenue Acct No. —218-0000-55031 (Interfund Revenue) $186,000;
• Expense Acct. No. —218-8540-2899 (Capital Construction) $186,000; and
• Increase Appr 001-9950-9030-0064 Transfer to Cap Project $186,000;
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute any necessary documentation, including any needed Agreement between the Town and
James H. Maloy, Inc., in form acceptable to the Town Supervisor, Budget Officer and/or Town
Counsel, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Purchasing Agent, Budget Officer and/or Town Counsel to take any and all action necessary to
effectuate the terms of this Resolution including signing n License Agreement with the City of
Glens Falls in form acceptable to the Torrmn Supervisor and Torrmn Counsel, and
BE IT FURTHER,
RESOLVED, that this Resolution is subject to a permissive referendum in accordance with the
provisions of Town Law Article 7 and the Town Board hereby authorizes and directs the Town Clerk
to publish and post such notices and take such other actions as may be required by law.

The Chazen Companies(Chazen) has reviewed the submitted low bid provided by James H. Maloy, Inc. (Maloy)
for completion of Specification Sections 004113 through 004900,which represents"The Bid." Maloy submitted
the lowest base bid of $170,000, with Rock Removal Alternate #1 at $6,000 and Contingency Allowance
Alternate#2 at$10,000 for a total bid of$186,000. Please note that the prices bid for alternates#1 and#2 can
only be authorized by the Engineer and the Town, if it is determined that project conditions require additional
work.
• Chazen has completed a background verification of Maloy which included confirming the amount of the bid
bond. Chazen has previous and current projects in which Maloy was or is a prime or subcontractor.Their past
performance was satisfactory.

Maloy's bid (including Bidder's Qualification Statement, Performance Bond Information, Bid Bond and other
data) is attached and was also reviewed during the background verification. Based on the information
presented herein,Chazen, would not take exception to the Town awarding the project to James H. Maloy, Inc.
as a lump sum price contract.

2017 at the Queensbury Center, Town of Queensbury, 742 Bay Road, Queensbury, New
York,the following was adopted and is subject to permissive referendum:
RESOLUTION AUTHORIZING TECHNICAL SERVICES CHANGE
ORDER NO. 1 REGARDING CONTINUED PROFESSIONAL SERVICES

WHEREAS, by Resolution No.: 223, 2017, the Queensbury Town Board authorized the
. Buckbee Road Culvert Replacement Project (Project), establishment of Buckbee Road Culvert
Replacement Capital Project Fund #218 and engagement of The Chazen Companies (Chazen) for
technical and engineering services concerning the Project for an amount not to exceed $18,240 as
previously set forth in Chazen's July 12, 2017 proposal for professional technical and engineering
services, and
WHEREAS, Chazen has provided such design and construction phase engineering services
authorized by such Resolution, but the Town Board now wishes to publicly bid this Project for
construction rather than have the work performed by Town forces as previously anticipated, and
therefore additional engineering services will be necessary to advance the Project through
bidding and construction, and
WHEREAS, Chazen has accordingly presented the Town with a Technical Services
Change Order #1 dated November 30, 2017 in the amount of $13,320 detailing the additional
costs to add Task 004A Bid Documents, Task 004B Bid Phase Services and to modify the fee for
• Task 006 (Construction Phase Services) to include both construction administration and
additional construction observation services, and
•
WHEREAS, the Town Board wishes to authorize a withdrawal and expenditure in the total
estimated amount of$13,320 from Capital Reserve No. 64 toward this Capital Project, and
WHEREAS, in accordance with General Municipal Law §6(c), the Town Board is
authorized to withdraw and expend funds from Reserve#64 subject to permissive referendum,and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder(s) meeting New York State statutory requirements
and the requirements set forth in the Town's bidding documents,
NOW THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes The Chazen
Companies Technical Services Change Order#1 and the $13,320 increase in spending for design
and construction phase services performed by Chazen for work outside the original Scope of
Chazen's July 12, 2017 proposal as set forth in the Technical Services Change Order #1 as set
forth in the preambles of this Resolution and as presented at this meeting, bringing the new total
contract price for services to be performed by Chazen to $31,560, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby finds that the withdrawal and expenditure for
such Project are expenditures for a specific capital project for which the Capital Reserve Fund
#64 was established, and
BE IT FURTHER,
• RESOLVED, that the Town Board further authorizes and directs that funding for such
