The Clerk presented and read aloud the following letter to the Town Board: August 6, 1968 23 Main Street Glens Falls, N.Y. 12801 Town Board- Town of Queensbury c/o George Crannell, Town Clerk Gentlemen: It is with deep concern and alarm that I learn of your intention to establish a joint town-city dump just south of the Corinth Road. For over 60 years we fought forrelimination of the city dump in its present location. Lack of development in the Luzerne Road-Sherman Avenue sections is mute but eloq- uent testimony of the effects of that dump location. This was the result not only because of nearness to the dump, but also due to the scattering of rubbish along the entire route. property values were depressed and will probably remai so for many years. Much effort while I was on the Board failed to properly control thisnuisance. Now I learn to my dismay that you plan not only to est- ablish a town dump, but also to jointly operate it with the city. The nuisance will be compounded in several ways: 500 1, the volume to be handled will be more tkan doubled 2, access to the area will be largely concentrated over one highway, one of the busiest town arteries through thickly settled sections; and, 3. the proposed area drains directly into the Hudson witty resultant contamination problems. Gentlemen, I am not requesting relief for our area at the expense of another section of the town, but certainly there must be a better way. I consider the exhorbitant price paid for the sub-marginal land without accessR/W to be fiscally irresponsible. This money could have gone a long way towards an inceration plant, located so as to minimize effects on any one area. If you continue with present plans , I feel that you will be directly responsible for devaluation of property in the area. It is my intention through wide distribution of this letter to publicize in every way possible, the hazards of your proposed plans and to enlist support for opp- osition. I refuse to accept the philosophy that we are too far down the road to change plans and I will explore every possibility of halting those plans. Very truly yours H.C. WHEREAS, Route 9, Route 254 and CR 70 are to be reconstructed in the Town of Queensbury, Warren'County; and WHEREAS, the Bureau of Public Roads , U.S. Department of Trans- portation has approved the allocation of Federal funds for use ' in connection with the above project; and WHEREAS, the expenditure of State and Federal finds can only be jilstified if this facility provides for the safe and efficient movements of traffic; and NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of QUEENSBURY, WARREN COUNTY, does hereby approve the Traffic Control dated July 3, 1968 for the above described highway project, and does hereby agree to adopt the ordinances , rules or regulations necessary to effectuate the plan as indicated in said Traffic Control Report; and BE IT FURTHER RESOLVED, that no changes or modifications in the traffic control measures set forth in the Traffic Control Rppatt insofar as they affect traffic on the State highway(s) or within 100 feet of the State highway(s) will be made at a later date1 j without written approval of ;the State Department of Transportation. WHEREAS , proceedings were duly held by the Town Board of the Town of Queensbury, Warren County, New York, pursuant to Article 12-A of the Town Law, for the establishment of a water , district to be known as the South Queensbury Water District in said Town of Queensbury ,according to a map, plan and report , prepared by Joseph A. (Seal) Town Clerk • Supervisor Solomon discussed the future traffic plans of the State of New York Department of Transportation to do with the Re-Alignment of Aviation Road and also the widening of Route 9 from the City Line to the north. The statements of Joseph A. Kestner, Jr. , the engineer for water districts was also discussed. The re-location of a 2" water main is the topic of question at this time. A request will be submitted- to the Department of Transportation for a proper Resolution to be adopted at a later date by the Town Board. August 12, 1968 Mr. Gerald Solomon, Supervisor Queensbury Town Board Town Hall Bay Road. Dear Mr. Solomon: Enclosed find proposal of the New York State Dept. of transportation regarding the land to be acquired by them j from the front of the Pineview Cemetery property. Also _.. enclosed is a photo�-eopy of the map showing the land to be acquired, Our Cemetery Commission has discussed the offer of $40,000.00 which they make and it has been voted by us that we recommend to the Town Board that- the offer be • accepted. This being Town of Queensbury Property, the final decision will rest with the Town Board. We believe this to be a reasonable offer and we believe that the Town should accept it without delay. I As your Cemetery Commission, we ask that the usual 25% of the money received be placed in our perpetual care fund, in as much as that percentage would have been placed for perpetual care if the land had been sold as burial plots. - Also, we would like. to be allowed money enough in our 1969 budget to purchase new dump Truck replace the 1957 International which we are now using. We feel that the $995 which we paid for it as a used truck in 1961 has - paid good dividends, but now it should be replaced. We l will discuss the above items with your board at budget i time. RESOLUTION NO. 174, Introduced by Mr. Robertson, seconded by Mr. Robillard. WHEREAS, the Pineview Cemetery Commission of the Town of Queensbury, has recommended that the Town Board of the Town of Queensbury should accept the offer of the State of New York Department of Transportation for the sale of property of the Pineview Cemetery fronting on Route #254. The offer as received is in the amount of $40,000.00. WHEREAS, The Cemetery Commission has recommended further that the usual amount of retainer be transferred to the Treasury of the Pineview Cemetery Commission for Perpetual Care Fund. { WHEREAS, the Town Board of the Town of Queensbury has verbally agreed to the transaction as stated above, therefore be it RESOLVED, that the offer of the State of New York Department of Transportation be accepted and that the 25% part of the purchase price be transferred to the Pineview Cemetery Commission far the Perpetual Care Fund, and FURTHER RESOLVED, that the Supervisor of the Town of Queensbury be authorized and directed to negotiate the sale of the property and to sign all agreements to do with the sale. Noes - None August 3, 1968 PETITION 1- We, the undersigned residents of Sylvan Avenue, do hereby formally petition the Town Board of Queensbury to expedite a recommendation to the State Department of Transportation that an urgent need exists for reduction of the speed limit on Sylvan Avenue to 20 miles per hour, The existing 50 miles per hour speed limit constitutes:.a clear threat to the lives of the many young children residing on this avenue. The foregoing petition was signed by 13 residents of Sylvan Avenue. Personal letters of request were submitted from James K. Hutchinson and Charles Hutton. RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION NO. 175, introduced by Mr. Demboski, seconded by Mr.. Turner. WHEREAS, Teresa Brewster of R.F.D. #2 Lake George, New York has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home out- -- side of a duly licensed mobile home court at property situated Route 9 Lake George Road, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to Justify further consideration by this board, therefore be it f RESOLVED, that pursuant to the provisions of the above mentioned . ordinance, the town board shall conduct a public hearing on said application on September 12, 1968, at 8:00 p.m. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Y. has made application to this Board for a permit to locate a Mobile Home at property situated at Lots #11 & 12 Hartman Development, . Pinello Road and owned by Mrs. Leah Hartman, and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the Ordinance Regulations relating to Mobile Homes in the Town of Queensbury, therefore be it RESOLVED, that there was no hardship shown on the original application, therefore be it further RESOLVED, that the application of Richard W. Hermance be and is hereby disapproved and that the Town Clerk is hereby directed to notify I Richard W. Hermance of the decision of this Board. Noes - None RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY RESOLUTION NO. 177, introduced by Mr. Demboski, seconded by Mr. Turner. WHEREAS, Robert Jabaut of Hudson St. , Fort Edward, N. y. has made application to this board for a permit to locate a Mobile Home at property situated at Lots #3 & 4 Hartman Development, Pinello Road and owned by: Mrs. Leah Hartment, and WHEREAS, upon proper investigation it appears that the applicant- has complied with all of the requirements of the Ordinance Regulations relating to Mobile Homes in the Town of Queensbury, therefore be it i--h RESOLVED, that there was no hardship shown on the original application, Li therefore be it further RESOLVED, that the application of Robert Jabaut be and is hereby disapproved and that the Town Clerk is hereby directed to notify Robert Jaubaut of the decision of this Board Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Turner, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes - None Mr. Sterling Akins was granted the floor. Mr. Akins spoke in objection to the proposed location of a new Land-fill dumping operation off the Corinth Road. Mr. Akins presented the following petition which was signed by over 300 residents of the area. PETITION 8-12-68 To THE TOWN BOARD OF TOWN OF QUEENSBURY GENTLEMEN: We the undersigned residents of the area which will be adversly affected by the proposed Town-City Dump to be located South of of Corinth Rd. hereby petition the Town Board to hold a public hearing where at residents of the area may appear and present their views on the proposed dump. The grounds for this Petition are outlined in part as follows.: 1. The residents of the affected area have not been properly advised or informed in this respect. 2. The advertising of the land purchase and referendum was faulty in several ways and did not properly describe the affect area. 3. The proposed location will unfairly discriminate against residents of the affected area by devaluation of property values. It is further requested that no further proceedings of land purchase, payment there for or acceptance of deeds for proposed land site, be conducted or consumated pending the above requested public hearing. The following petition was attached and signed by 37 residents of Big Bay Road and Palmer Drive. PETITION I This is a petition of the residence of the Big Bay Road and Palmer Drive section who are against having a dump or refuse disposal off the Big Bay Road area: Councilman Robertson stated that the Petitions should be reviewed by the Town Attorney who would advance an opinion on their legality and also would make a statement on the possibility of a Public Hearing. Town Attorney Mr. Harold Katz stated that the lands which would be utilized for the land fill operation have been purchased and conveyed to the Town of Queensbury, in the proper manner. Attorney Katz also explained that the time for arranging a Public Hearing has expired. Councilman Robertson stated that due to his personal investigation of other neighboring "Refuse disposal areas", he is assured that a properly maintained Land-fill operation would be satisfactory for all residents of the Town of Queensbury. The following persons were allowed to speak in opposition to the { proposed Land-fill Refuse Disposal Area: Mrs. Arthur Thornton Mr. Pliney Tucker a Mr. James Stearns Mrs. Lyman ShaPpy Mr. Lester Baird, Sr. Mr. Lester Baird, Jr. Mr. James Richardson Mr. Sterling Akins Mrs. Marsha Aubin Mr. John Beale A lengthy discussion ensued on the subject of possible pollution of the Hudson River. Mr. H. Russell Harris stated that it would be his hopes that the City of Glens Falls will not be controlling the operation of the proposed Refuse Disposal Area. J Councilman Demboski voiced his opinion that all Mobile- Homes who wish to locate in the Town of Queensbury should be forced to locate in Mobile Home Courts. Discussion also took place on the control of the presently licensed Junk Yards within the Town. Councilman Robertson and Supervisor Solomon discussed the proposed cooperation of the City of Glens Falls with the Town of Queensbury in the Land-fill operation. Following requests from persons present an information meeting was arranged for Aufgst23rd at 7 :30 p.m. , to be held at the West Glens Falls Fire House. Mr. H. Russell Harris requested that the Highway Committee of the Town of Queensbury investigate the possibility of improving a highway known as the Mud Pond Road. The meeting recessed at 10:20 p.m. The meeting was re-called to order at 10:30 p.m. The Monthly Report of the Supervisor was received and placed on file. The total Receipts for the month were $689,125.13. The total disbursements were $129,968.40. The monthly report of the Police Department was received and placed on file. The monthly Highway report was also received and placed on file. RESOLUTION TO ESTABLISH HOURLY RATE FOR TOWN EMPLOYEES %i RESOLUTION NO. 178, Introduced by Mr. Robertson, Seconded by Mr. Robillard. RESOLVED, that the hourly rates for town employees, beginning with the first payroll period following the adoption hereof, be and hereby are fixed as follows: Shovel operators $2.35 per hour Grader operators 2.35 per 'hour Motorized Equipment operators 2.15 per hour Laborers - Class A 2.00 per hour Laborers - Class B 1.85 per hour Clerical (excepting those on fixed salary) 1.75 per hour and be it further RESOLVED, that it is hereby understood that the classi- fication "Labor Class A" is intended to include full time, regular able bodied employees, and that the classification "Labor Class B" is intended to include part time, casual, temporary or seasonal employees, the judgment of the department head determining the f proper payroll classification. Noes - None RESOLUTION NO. 179, introduced by Mr. Robillard, seconded by Mr. Solomon. WHEREAS, Petitions have been presented to the Town Board of the Town of Queensbury for an extension to the South Queensbury Lighting District on the following highways: Lower Warren Street, Green Street and Brayton Avenue. WHEREAS, the Town Board will arrange a Public Hearing on the matter of this proposed Extension, therefore be it RESOLVED, that the Town Clerk is hereby authorized and directed to have published in the Post Star. and the Glens Falls Times, a notice to read as follows: NOTICE OF PUBLIC HEARING Pursuant to the adoption of Resolution No. 179, as adopted by the Queensbury Town Board at an adjourned Regular Meeting held on August 15th, 1968; a Public Hearing will be held on September 12th, 1968 at the Queensbury Town Office Building Bay and Haviland roads at 8:00 P.M. The Public Hearing will concern the request by petition from residents of Lower Warren Street, Green Street and Brayton Avenue for an extension of the South Queensbury Lighting District.
