RESOLUTION FOR APPOINTMENT TO FILL VACANCY
IN OFFICE OF TOWN COUNCILMAN.
WHEREAS, a vacancy exists in the office of Town
Councilman in the Town of Queensbury, County of.Warren because
of the death of Councilman Theodore Turner who was elected to
such office on the 2nd day of November, 1965, for a term of four
years from the 1st day of January, 1966; --
BE IT RESOLVED, that NOW THEREFORE, in pursuance of
the power vested in us by Section 64, (5) of the Town Law, we,
the members of the Town Board of the Town of Queensbury, do
hereby appoint JOHN D. AUSTIN, JR. of said Town to fill the .
vacancy existing in such office of Town Councilman, Such
appointment is effective immediately and the said John D. Austin
Jr. shall hold office until January 1st, 1970.
IN WITNESS WHEREOF, we have hereunto- set our hands
and seals at the Town Office Building in said Town on the 6th
day of March, 1969.

Supervisor Solomon announced the following appointment to the
Beautification Committee of the Town of Queensbury.
To the Town Board:
In addition to the previously appointed members to the Queensbury
Committee for Community Beautification for the year 1969, I wish to
appoint Mrs. Clare Noyes, 25 Sunset Drive, Glens Falls, Town of
Queensbury, New York .
RESOLUTION TO ACCEPT DEED FOR TOWN HIGHWAY
RESOLUTION NO.. 61, Introduced by Mr. Robertson, seconded by Mr. Austin.
WHEREAS, Mabel C. Ellsworth has executed ndt nn rfdD a deed for a
50 foot roadway to convey an extension o i-�r w QV Beuna Vista
Avenue as shown on the map of Section 11 of Westland, dated June 6,
1968, and
WHEREAS, Carl Garb, Superintendent of Highways and- Thomas K. Flaherty,
Superintendent of Queensbury Water District have advised this Board
that they recommend the acceptance of these extensions into the
Town Highway system, and
WHEREAS said deed has been approved by Harold W. Katz, Counsel to
the board, therefore be it
RESOLVED, that the aforementioned deed be and the same is hereby
• accepted and approved, and that the Town Clerk is hereby authorized
and directed to cause said deed to be recorded in the Warren County
Clerk' s office, after which said deed shall be properly filed in the
office of the Town Clerk, and be it further
RESOLVED, that this new road is hereby added to the official inventory
of Town Highways, and described as follows:

Attorney Harold W. Katz discussed the serving of the notice of
legal action against the Town of Queensbury, which has been
brought by Paul A. Usher and Madeline Usher. The Attorney
stated that the Town has no re-course but to defend itself in
the action.
RESOLUTION NO. 62

RESOLUTION DIRECTING DEFENSE OF LEGAL
ACTIONS AGAINST THE TOWN
WHEREAS, PAUL A. USHER and MADELINE USHER as
Plaintiffs have commenced legal action against the Town alleging
the negligent construction and maintenance of Luzerne Road, and,
WHEREAS, the question of highway construction and
maintenance is of great importance to the Town; therefore be it
RESOLVED, that the Supervisor of the Town be, and he
hereby is, authorized and empowered to retain HAROLD W. KATZ,
ESQ. , as legal counsel in the matter upon such terms as he deems
proper and advisable and he shall authorize such counsel on
behalf of the Town to take such action as may be deemed advisable
to bring about a speedy determination of the rights and
interestsof the Town with respect to said matter.

RESOLUTION NO. 63

RESOLUTION OF THE TOWN OF QUEENSBURY AUTHORIZING
THE TOWN SUPERVISOR TO ENTER INTO A CONTRACT
WITH NIAGARA MOHAWK POWER CORPORATION.
WHEREAS, the Town Board recognizes the necessity for
providing for meeting the increased demands made upon the water
supply system of said Town created by the rapid residential and
industrial growth within said Town, and
WHEREAS, after extensive study and deliberation the
Town Board has determined that it would be in the best interests
of the residents of the Town to acquire a source of water supply
capable of meeting the constantly increasing demands, and
WHEREAS, such study has established that the reservoir
maintained by the Niagara Mohawk Power Corporation at the ..
Sherman Island Hydro-Generating Station located in the Town of
Queensburycan provide a water supply to meet the present and
foreseeable needs of said Town, and
WHEREAS, said Niagara Mohawk Power Corporation has
agreed to permit said Town to withdraw water from said
reservoir and to purchase land for the construction and
maintenance of a filtration system and pumping station in an
area adjacent to said reservoir and has signified its intention
to enter into a written agreement to implement such proposal,
NOW, THEREFORE, BE IT
RESOLVED, that the -power to enter into an agreement
with Niagara Mohawk Power Corporation and to fix and determine
the -terms thereof is hereby delegated to the Supervisor, subject
to such conditions, acts and things required by the statutes of
the State of New York and the Federal Statutes to be performed
precedent to, and in furtherance of, said agreement.

numbered #226 to #228 inclusive and totaling $110.30 - is hereby
approved.
