Solomon - Supervisor Lloyd Demboski - Councilman John Austin, Jr. - Councilman Harold Robillard - Councilman Hammond Robertson, Jr. - Councilman Attorney Harold W. Katz was also present. The meeting was called to order at 8:00 p.m. The following visitors were greeted by the Supervisor: Sterling Akins - Visitor Pliney Tucker - Visitor Claire Ojimond - Visitor Martin W. Flaherty - Superintendent of Queensbury Water Dist. The opening of bids to supply the Queensbury Water District with cast iron pipe for the year 1969 was announced at this time. Proof of Publication was presented and read aloud by the clerk. The clerk proceeded to open and read aloud the following bids. Gray Truckin, Ed.Gray 150.00 for International Dump Truck Councilman Robertson moved that the bid of Morgan Keith Combs be accepted. 183 RESOLUTION NO. 89, Introduced by Mr. Robertson, seconded by Mr. Solomon. WHEREAS, Carl A. Garb, Superintendent of Highways for the Town of Queensbury has recommended that bids be accepted for the purchase of certain obsolete material in the Highway Department, and WHEREAS four (4) Bids were received and read aloud at a regular Town Board meetigg held on April 24, 1969, and WHEREAS, it appears that Morgan Keith Combs of VanDusen Road, Town of Queensbury is the highest bidder for the materials as advertised, therefore be it RESOLVED that, the bid of Morgan Keith Combs is hereby accepted and that upon receipt of the payment for the material and the remeval of same, the Queensbury Highway Department will be rid of the obsolete materials. Carpenter RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION NO. 909 Introduced by Mr. Austin, seconded by Mr. Robillard. WHEREAS, Pearl J. Carpenter of R.F.D. #3 Luzerne Road, Town of Queens- bury has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of'Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated R.F.D. #3 Luzerne Road, Town of Queensbury, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on May 8, 1969 at 8:00 p.m. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Aiken of Gansvoort, New York has made application to this Board for a permit to locate a Mobile Home at property situated at Lot #111 Junction New Hampshire & Central Avenues, Town of Queensbury, and owned by William Welch, and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the Ordinance Reg- ulations relating to Mobile Homes in the Town of Queensbury, therefore be it RESOLVED, that there was no hardship shown on the original application, therefore be it further RESOLVED, that the application of Roland V. Aiken be and is hereby disapproved and that the Town Clerk is hereby directed to notify Roland V. Aiken of the decision of this Board. Noes - None 185 RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY RESOLUTION NO. 93, introduced by Mr. Robertson, seconded by Mr. Demboski. WHEREAS, Earl G. Underhill of 105 Palsun Drive, Schenectady, N. Y. , has made application to this Board for a permit to locate a Mobile Home at property situated at Lake Sunnyside and owned by Earl Underhill, and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the Ordinance Regulations -- relating to Mobile Homes in the Town of Queensbury, therefore be it RESOLVED, that there was no hardship shown an the original Application, therefore be it further RESOLVED, that the application of Earl G. Underhill be and is hereby disapproved and that the Town Clerk is hereby directed to notify Earl G. Underhill of the decision of this Board. The Supervisor Stated that the cut would amount to $4,000.00 per year but in his opinion the over all result would be in favor of the tax payers of the Town of Queensbury. 187 (Page 186 omitted in error.) A quotation was read by the Supervisor to do with the purchase of _. one Bennett Gasoline Pump. This quotation was presented by Carl A.Ggrb, Superintendent of Highways. RESOLUTION NO. 94, Introduced by Mr. Robertson, seconded by Mr. Soloman. WHEREAS, Mr. Carl A. Garb, Superintendent of Highways has recommended the purchase of one (1) #3789 D Fleetmaster Key-op Gasoline Pump at an installed price of $997.75, and WHEREAS, with this purchase, bein g over the amount of cost which is -- to be purchased by the Superintendent of Highways without Town Board approval, therefore be it RESOLVED that, Mr. Carl A. Garb, Superintendent of Highways is permitted and instructed to have this #3789 Fleetmaster Ley-op Gasoline Pump installed at the location of the Queensbury Highway Department on Aviation Road, Town of Queensbury. Noes - None RESOLUTION OF SORROW RESOLUTION NO. 95, Introduced by Mr. Demboski, seconded by Mr. Robertson. WHEREAS, the members of the Town Board were saddened by the passing of Charles K. Denny, and WHEREAS, Mr. Denny served on the Town of Queensbury Cemetery Commission for many yeard, and WHEREAS, the Town of Queensbury has suffered a loss by his passing, therefore be it RESOLVED that the members of the Queensbury Town Board hereby record their profound sorrow on the passing of Charles K. Denny, and extend to his family their sincere sympathy and be it further RESOLVED, that this resolution be entered in the minutes of this meeting and that the Town Clerk be and he hereby is directed to transmit copies thereof to the members of his family. Noes - None This resolution was adopted by a special and separate mote and each member of the Town Board stood for a moment of silent paayer when the resolution was adopted. RESOLUTION NO. 96 INTRODUCED BY MR. Robillard, who moved its adoption. SECONDED BY MR. Robertson. WHEREAS, the Town Board of the Town of Queensbury deems it in the public interest to enact the following ordinance to regulate alcoholic beverages in open containers in said Town and to hold a public hearing thereon as required by law, O BE IT RESOLVED that a public hearing on the following proposed Ordinance be held on May 8th, 1969 at 8 :00 o'clock P.M. D.S.T. at the Town Office Building, Bay and Haviland Roads, Town of Queensbury, Warren County, New York and that due notice thereof be published in the official newspaper of the Town of Queensbury as required by law. ORD INA NON REGULATING ALCOHOLIC BEVERAGES IN OPEN CONTAINERS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK Section 1. No person shall have in his possession any open bottle, or container containing liquor, beer, wine or other alcoholic beverage while. such person is on any public highway, public street, public sidewalks, public parking area or in any vehicle or public place excepting those premises duly licensed for sale and consumption of alcoholic beverages on the premises. Section 2. An open bottle or open container in any vehicle shall be presumptive evidence that the same is in possession of all occupants thereof and in violation hereof. Section 3. A violation of this ordinance shall consti- tute an offense punishable by a fine not exceedingr $25.00 or by imprisonment in the Warren County Jail for ten(10) days or by both such fine and imprisonment for the first offense, and by a fine not exceeding $50.00 or by imprison- mestL in the Warren County Jail for thirty (30) days or by both such fine and imprisonment for a second or subsequent offense. Section 4. Should any section or provision of this ordinance be decided by the Courts to be unconstitut1onal or invalid, such decision shall not affect the validity of the ordinance as a whole or any part thereof other than the part so decided to be unconstitutional. Section 5. This ordinance shall take effect ten (10) days after its publication and posting as required by law. Noes - None RESOLUTION TO INCREASE APPROPRIATION OF THE PINEVIEW CEMETERY RESOLUTION NO. 97, Introduced by Mr. Austin, seconded by Mr. Robillard. WHEREAS, the Town of Queensbury Cemetery Commission has asked that surplus funds from the sale of logs and pulpwood cut at the Pine View Cemetery be applied to Cost of Improvements for the cemetery and 189 WHEREAS, the Supervisor has received the dum of $414.86 from Frank , Cowles, treasurer of the Cemetery Commission, therefore be it RESOLVED, that the sum of $414.86 be appropriated to Improvements to Pine View Cemetery thereby increasing the appropriation from #3,900.00 to $4,314.86. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes - None RESOLUTION TO MAKE APPLICATION TO THE NEW YORK STATE DIVISION FOR YOUTH FOR APPROVAL OF RECREATION PROJECT RESOLUTION NO. 98, Introduced by Mr. Demboski, seconded by Mr. Solomon. WHEREAS, the 1969 Town Budget has made provision for a continuation of the Town Recreation Program, and WHEREAS, it is believed that the town is eligible to receive State Aid under the State of New York Division of Youth, therefore be it RESOLVED, that application to the New York State Division for Youth for approval of the Recreation Project is hereby authorized, and that the Supervisor of the Town is hereby authorized and directed to execute such application on behalf of the Town of Queensbury. Noes - None Councilman Robillard moved that the Junk Yard of Leon Dean on the Corinth Road and Nelson Harrington on Pasco Avenue, Town of Queensbury be investigated by the Queensbury Police Department.
