Robert Eddy - Visitor Gilbert Schlierer - -Chief of Police George Liapes - Visitor Fred - Austin Visitor 191 The public hearing on the adoption of the ordinance entitled "ORDINANCE REGULATING ALCHOLIC BEVERAGES IN OPEN CONTAINERS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK" was declared open at this time. The clerk presented proof of publication which was read aloud. Supervisor Solomon discussed the content of the proposed ordinance and its possible effect in preventing the continued littering along the highways within the town. Mr. John Esmond questioned the Town Board as to why the County of ~- Warren and not the Town of Queensbury would be the agency to adopt such an ordinance as is being proposed by the Town of Queensbury. Attorney Katz stated that all neighboring towns have already adopted a similar; ordinance. Mr. Esmond questioned the technicalities of the ordinance as to transporting open bottles of liquor or other alcholic beverages. Mr. Robert Eddy questioned the fact as to the proposed ordinance being similar to one already adopted by neighboring towns. Mr. Eddy also stated that if the Chief of Police has requested the ordinance; it should be adopted. Mr. Eddy also stated that he is in favor of the ordinance adoption. The public hearing closed at 8:15 p.m. The public hearing on the application of Mrs. Ruth Steffen for a permit to locate a Mobile Home on Big Boom Road. Proof of publication was presented and read aloud by the clerk. Supervisor Solomon requested a voice of opinion either in favor of or in opposition to the granting of the permit. There was none. Public hearing closed at 8:18 p.m. The public hearing was opened on the application of Mrs. Pearl Carpenter for a permit to locate a Mobile Home on Luzerne Road, Queensbury. The clerk presented and read aloud the notice of publication. The Supervisor requested a voice of opinion either in favor of or in opposition to the granting of the permit. There was none. The public hearing closed at 8:20 p.m. Water May 1, 1969 Department Queensbury Town Board, Mr. Gerald B. Solomon, Supervisor Gentlemen: This department has reviewed the bids of R. D. Wood, U. S. Pipe and Shamoon Industries to furnish 6 and 12 inch cast iron pipe as per our specifications. The bids of U.S. Pipe and R.D. Wood were identical and the the lowest of the three. 192 It is my recommendation that the bid be awarded to the U. S. Pipe company for the following reasons: 1. They have a local representative who was in attendance at the meeting. 2. They have supplies us with material satis- factorly in the past. 3. They meet all requirements of the specs. RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION NO. 101, introduced by Mr. Austin, seconded by Mr. Solomon. WHEREAS, Claire A. Guimond of 9B Fulton Street, Glens Falls, N. Y. , has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated 37 Montray Road, Town of Queensbury, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on May 22, 1969, ate8:00 p.m. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Dear Jerry, This office is very seriously condidering the use of voting machines for Primary Elections. As it now appears that there will be contests for at least one-Public Office and several Party Positions in the Town of Queensbury, our final determination could possibly entail the expenses of machine custodians for the June Primary. I believe that it is advisable at this time that the Queensbury Town Board take whatever action is needed for the compensation of voting machine custodians. Dear Gerry, I know that you are aware that the property formerly known as the Glens Falls Castone Co. on the Corinth Road has been sold since the last General Election. This place for several years has been used as the Polling Place for Election District 13, of your town. As it appears that we will have a Primary Election on June 17, it is my suggestion that you ascertain if the new owners will permit the use of this building and if not, the Town Board should designate a new location. Since the Queensbury recreation program was started a few years ago I have been employed as bus driver and now work with Mr. Cederstrom in planning routes and securing other drivers when needed. Smith October 29, 1968 The Board of Supervisors Town of Queensbury Queensbury, New York Gentlemen: We the Glen Lake Association and We, the residents of Fitzgerald Road, Town of Queensbury, petition the Town to lower Fitzgerald Road which is situate on the east side of Glen Lake: FITZGERALD ROAD GLHN LAKE ASSOCIATION The petition was signed by 30 residents of the area. Mr. Esmond repeated a request for the elimination of an auto body shop on Garner Street in West Glens Falls. Supervisor Solomon stated that the Building Enforcement Officer is investigating the business operation and that he will make a report as soon as same is complete. Atty. Katz discussed the part that the Town of Queensbury can accomplish in arriving at a solution. Mr. Pliney Tucker discussed the condition of the fence at West Side Junk Yard site on Southwestern Avenue and junk cars at other locations. Mr. Tucker discussed conditions at the City of Glens Falls dump on Luzerne Road, which at present are not in a sanitary land fill basis. Supervisor Solomon stated that the Mayor of the City of Glens Falls has been notified that the dumping conditions at the dump and along the road. The Monthly Report of the Supervisor was received and placed on file. The total receipts for the month were $83,068.83, the total disbursements amounted to $126,717.73. The reports of the Building and Zoning Department and also the Highway Department were received and placed on file. RESOLUTION NO. 102, introduced by Mr. Robillard, seconded by Mr. Robertson. WHEREAS, the Town Board of the Town of Queensbury deems it in the public interest to enact an ordinance to regulate alcoholic beverages in open containers in said Town, and WHEREAS, a proposed ordinance was presented to the Town Board, and after due notice, a public hearing was held thereon by the said Town Board on the 8th day of May, 1969, and the need for such an ordinance being upheld thereat, be it RESOLVED, that the Town Board of the Town of Queensbury adop t the following ordinance: - - _ 195 ORDINANCE REGULATING ALCOHOLIC BEVERAGES IN OPEN CONTAINERS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK Section 1. No person shall have in his possession any open bottle, or container containing liquor, beer, wine or other alcoholic beverages while such person is on any public highway, public street, public sidewalks, public parking area or in any vehicle or public place excepting those premises duly licensed for sale and con- - sumption of alcoholic beverages on the premises. Section 2. An open bottle or open container in any vehicle shall be presumptive evidence that the same is in possession of all occupants thereof and in vio- lation hereof. Section 3. A violation of this ordinance shall constitute an offense punishable by a fine not exceeding $25.00 or by imprisonment fnrthheWarren County Jail for ten (10) days or by both such fine and imprisonment for the first offense, and by a fine not exceeding $50.00 or by imprisonment in the Warren County Jail for thirty (30) days or by both such fine and imprisonment for a second or subsequent offense. Section 4. Should any section or provision of this ordinance be decided by the Courts to be uncon- stitutional or invalid, such decision shall not affect the validity of the ordinance as a whole or any part thereof other than the part so decided to be unconsti- tutional. Duly adopted by the following vote: �— Ayes - Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon Noes - None RESOLUTION TO AUTHORIZE ADVERTISING FOR BIDS FOR THE PURCHASE OF VOTING MACHINES RESOLUTION NO. 106, Introduced by Mr. Austin, seconded by Mr. Soloman WHEREAS, it has become and evident fact, that with the steady growth of voters in the Town of Queensbury, it is necessary at this time to purchase additional voting machines, and WHEREAS, the Town Board of the Town of Queensbury have authorized the purchase of (4) four additional voting machines, therefore be it RESOLVED, that the Town Clerk is authorized and directed to cause to be published a "Notice To Bidders" in substantially the following dorm: NOTICE TO BIDDERS The Town Board of the Town of Queensbury, Warren County, New York, will accept bids to supply the Town of Queensbury with (4) four new voting machines equipped with device or mechanism which provides a printed, embossed, or photographic record of candidate counters immediately prior to start of voting and directly after polls close, secured in the presence of the inspectors of election at the polling place. The machines shall contain nine (9) nine rows of thirty (30) voting levers each for voting for candidates, thirty (30) devices for voting for persons not nominated and one (1) horizontal row of voting devices for voting on fifteen (15) Constitutional Amendments, propositions, or questions, or equal capacity parties, candidates and questions. Bids should be submitted in sealed opaque envelopes plainly marked "Voting Machine Bid". Each bid should be accompanied with the proper Non-Collusion Certificate in accordance with Section 103D of the General Municipal Law. RESOLUTION BY LOCAL GOVERNING BODY APPROVING PARTICIPATION BY LOCAL HOUSING OWNERS IN THE FEDERAL RENT SUPPLEMENT PROGRAM RESOLUTION NO. 107, Introduced by Mr. Demboski, seconded by Mr. Robillard. WHEREAS, under the provisions of Section 101 of the Housing and Urban Development Act of 1965, the Sectetary of Housing and Urban Development is authorized to enter into contracts to make rent supplement �-- pp payments to certain qualified housing owners on be- half of qualified low-income families who are elderly, handicapped, displaced, victims of natural disaster, or occupants of substandard housing; and WHEREAS, the provisions of said Section 101 cannot be made available to housing owners in certain localities unless the governing body of the locality has by resolution given approval for -such participa- tion in the Federal Rent Supplement Program. NOW, THEREFORE, be it resolved by the Town Board of the Town of Queensbury as follows : Approval is hereby granted for participation in the Federal Rent Supplement Program by qualified housing owners of property located . in the Town of Queensbury. Noes - None Supervisor Solomon stated that the plan to participate in the Federal Rent Supplement Program was recommended by the Queensbury Housing Authority. RESOLUTION TO APPROPRIATE FUNDS FROM THE CONTINGENT FUNb RESOLUTION NO. 108, Introduced by Mr. Robertson, seconded by Mr. Robillard. WHEREAS, the Town of Queensbury did by Resolution #207 of September 2631 1968, authorize the Supervisor of the Town to pay the necessary amount of $52600. as the town' s share of an inter-municipal sewer study, and WHEREAS, the Joint Municipal Survey Committee of the Hudson River Bend Municipalities did recommend that each participating municipality pay its equitable share of $750.00 toward advisory and engineering administrative service from the New York State Pure Waters Authority, and WHEREAS, the Town of Queensbury by Resolution #250 of November 21, 19689 did authorize the Supervisor to pay such sum, and ...-� WHEREAS, the 1969 budget has no specific appropriation for such studies, therefore be it RESOLVED, that the sum of $6,350.00 be transferred from the Contingent Fund for these studies. WHEREAS, Audit #321 and Audit #414 of Abstract 69-4 dated April 10, 1969 payable- to Arkley Tire Company now appears to be one and the same bill, and WHEREAS, Check #1204 of the General Fund for $31.23 payable to Arkley Tire Company has been returned to the Town of Queensbury, and the same has been voided, therefore be it RESOLVED, that Audit #414 in the amount of $31.23 be deleted from the abstract thereby decreasing the amount of Abstract 60-4 by the sum of $31.23.
