The awarding of -the bid was deferred at this time for study by the
Water Superintendent.
The public hearing was opened on the consolidation of the South
Queensbury Lighting Sistrict and South Queensbury Lighting District Ext.#1,
Proof of publication was presented by the clerk.
Supervisor Solomon waqupsted any opinions from persons present at
the meeting.
Mr. Edward Waters, a resident of the South Queensbury Lighting District,
discussed the district and stated that all of the residents of the
area are pleased with the recently installeO street lights.
The public hearing closed at 8:20 p.m.
The public hearing on the adoption of an Ordinance Regulating Littering
in the Town of Queensbury -was opened at this time.
Proof of publication was presented and read aloud by the clerk.
Supervisor Solomon invited a voice of opinion from any personpresent.
Mr. Robert Eddy, a member of the Queensbury Beautification Committee
presented the following message in reference to the littering
ordinance.

Queensbury Town Board hearing on Antilittering Ordinance:-
I can not imagine anyone appearing here to oppose the antilittering
ordinance - it would be someshat like opposing motherhood or some-
thing else as sacred. But I feel I would be remiss in my responsi-
bilities, if I did not appear to support this legislation.
My presence here is not as Chairman of the Queensbury Committe for
Community Beautification, as President of the West Mountain Garden
Club or as a ,member of the Warren County Natural Beauty Commission -
those organizations do not meet until next week. But I am sure
there is no doubt in your mind as to the stand these organizations
would take on this subject. --..
_ The Queensbury Committee for Cummunity Beautification as had
several projects to clear litter from the Town or to educate the
public not to litter.
I wish to compliment Councilman Lloyd Demboski for proposing this
legislation.
I wish to support the Town Board in their consideration of this
ordinance. But I want to go further than this. I want to urge our
residents and guests to carry out not only the letter, but the intent of
this law.
I, also ask the support of our Police Department in the enforcement
of this ordinance and the Court of Justice in melting out sentences
for those found quilty of breaking this law.
It is always nice to have ordinances on the books that can be used
for flagrant violations, but this legislation should be actively
enforced.
A clean property has ---�
p p y psychological effect on owners, tenants, and
other users of the property that leads to less littering, better
maintenance and more constianious use of refuse containers.
Our local paper carried in article a while ago that indicated that
it cost our highway departments in the nation $3 billion per year
to remove litter from our highways and rights of way, let alone
the cost in life limb andproperty caused by accidents resulting from
such litter. I am sure Carl Garb, or his predecessor, Bernard Codner
could verify this so far as our Town is concerned.
I trust the Town Board will not only pass this legislation, but
give it the support it needs to make it effective in our Town.

Mr. Jerry Greenberg was granted the floor. Mr. Greenberg voiced
agreement with Mr. Eddy' s statements. Mr. Greenberg also
questioned the extent of the penalties in the propose Ordinance.
Mr. Greenberg stated that the placing of proper containers at
locations within the town would in his opinion encourage residents
to automatically eliminate littering. Mr. Greenberg suggested
the tabling of the adoption of the ordinance at this time.
Councilman Robertson, questioned the opinions of Mr. Greenberg as
to which approach would result in the greatest effect in 'all areas
of the town.

Mr. Pliny Tucker was granted the floor. Mr. Tucker discussed the
laws of the State of New York which are intended to control
littering. Mr. Tucker stated that the problem of littering is
present in many sections of the town at this time. . Mr. Tucker
suggested that the ordinance be adopted but same must be enforced.

Mr. Robertson introduced the following resolution and moved
its adoption, seconded by Mr. Austin,
WHEREAS, the South Queensbury Lighting District- was duly
established in the Town of Queensbury, Warren County, New York
by final order duly made and adopted by the Town Board of said
Town on the 11th day of April, 1968, and
WHEREAS, the South Queensbury Lighting District Extension
No. 1 was duly established in the Town of Queensbury, Warren
County, New York, by final order made and adopted by the Town
Board of said Town on the 12th day of September, 1968, and
WHEREAS, it is provided by Section 206 of the Town Law
that consolidation of special districts may be made by resolution
adopted by the Town Board after public hearing, and
WHEREAS, a public hearing on the proposed consolidation
of South Queensbury Lighting District Extension No. 1 with South
Queensbury Lighting District has been held on this 11th day of
September, 1969, and it being deemed in the public interest that
said South Queensbury Lighting District Extension No. 1 be
consolidated into the South Queensbury Lighting District and that
any existing indebtedness of South Queensbury Lighting District
Extension No. 1 be assumed by hte consolidated South Queensbury
Lighting District and that the existing funds of South Queensbury
Lighting District Extension No. 1 on the effective date of
consolidation be paid over to the consolidated South Queensbury
Lighting District, be it
.T RESOLVED, that, subject to permissive referendum, on
the 31st day of December, 1969, the South Queensbury Lighting
District Extension No. 1 and the South Queensbury Lighting
District be consolidated into one lighting district known. as
South Queensbury, Lighting District, all as provided by Section
206 of the Town Law and other statutes applicable thereto, and be
it further
RESOLVED, that apy indebtedness owed by South
Queensbury Lighting District Extension No. 1 so consolidated on
the 31st day of December, 1969, be assumed and paid by the
consolidated South Queensbury Lighting District and that all 1
funds of South Queensbury Lighting District Extension No. 1 in
the hands of the Supervisor on the 31st day of December, 1969,
be transferred to the account of the consolidated South Queensbury
Lighting District, and be it further
RESOLVED, that after such consolidation, any assessment
required to pay the costs of operation, maintenance and improvement
in such consolidated South Queensbury Lighting District be taxed
on an ad valorem basis, and be it further
RESOLVED, that the Town Clerk be and he hereby is
directed to give notice of the adoption of this resolution in the
manner provided by Section 206 of the Town Law, and be it further
RESOLVED, that the Town Clerk be and he hereby is
directed to give notice of the adoption of this resolution in the
manner provided by Section 206 of the Town Law, and be it further
RESOLVED, that this resolution shall take effect
thirty days after its adoption.

it is the public interest to enact an ordinance to regulate littering
in said Town, and
WHEREAS, a proposed ordinance was presented to the Town
Board, and after due notice, a public hearing was held thereon by
the said Town Board on the 11th day of September, 1969, and the need
for such an ordinance being upheld thereat, be it
RESOLVED, that the Town Board of the Town of Queensbury
adopted the following ordinance:
ORDINANCE REGULATING LITTERING
IN THE TOWN OF QUEENSBURY,
WARREN COUNTY, NEW YORK
Section 1. No persons shall throw, or deposit, or cause
to be thrown or deposited any dirt, filth, wastes, tin cans, containers,
bottles or any discarded substances of a solid nature in or-upon
any public place whatsoever within said Town except in such area
or areas designated by said Town for such purposes. ._..J
Section 2. A violation of this ordinance shall con-
stitute an offense punishable by a fine not exceeding $25.00 or
by imprisonment in the Warren County Jail for ten (10) days or
by both such ine or imprisonment for the first offense, and by a
fine not exceeding $50.00 or by imprisonment in the Warren County
Jail for thirty (30) days or by both such fine and imprisonment for
a second or subsequent offense.
III RESOLUTION NO. 184 - continued
Section 3. Should any section or P rovision of this
ordinance be decided b the Courts to be unconstitutional y s itutional or
invalid, such decision shall not affect the validity of the
ordinance as a whole or any part thereof other than the part
so decided to be unconstitutional or invalid.
Section 4. This ordinance shall take effect ten
(10) days after its publication and posting as required by
law.

WHEREAS, the establishment of through highways and
stop intersections, and the placement of stop signs on town
highways in the Town of Queensbury, County of Warren, State of
New York, promotes the safety of both pedestrians and motorists
using said highways; and
WHEREAS, Town of Queensbury Ordinance I, duly adopted
the sixth day of August, 1955, has been outmoded by subsequent
increase in population of said town and by subsequent increase
in the use of highways in said town; and
WHEREAS, it is provided by Section 130 (7) of the New
York Town Law that town boards may enact ordinances regulating
the use of streets and highways by motor and other vehicles; and
WHEREAS, said Section 130 of the New York Town Law
requires a public hearing on all proposed ordinances upon due
notice as provided for therein;
THEREFORE, be it RESOLVED that a public hearing be held
on the following proposed ordinance on the 25th day of September,
1969, at 8:00 p.m. in the Town Office Building, Bay and Haviland
Roads, in the said Town of Queensbury; and that the town clerk
give notice of said hearing by publication thereof in The Glens
Falls Times and The Post-Star once at least ten (10) days prior to

Section 4. Stops required.
Pursuant to Section 1172 (a) of the New York Vehicle
and Traffic Law, any person operating a vehicle on any town
highway which crosses or intersects a through highway as herein
designated, or on any town highway an intersection with which has
been herein designated a stop intersection, shall, before entering
or crossing such through highway or such stop intersection, bring
such vehicle to a complete stop unless otherwise directed by a
police officer, and shall enter upon or cross such through highway
— or such stop intersection with cautinn.
Section 5. Penalties for violations.
Pursuant to Section 1800 (b) of the New York Vehicle and
Traffic Law, any person violating any of the provisions of this
ordinance shall1for a first conviction thereof be punished by a fine
of not more than fifty follars (#50.00) or by imprisonment for not

. more than fifteen (15) days or by both such fine and im-
prisonment; for a second conviction within eighteen (18)
months thereafter such person shall be punished by a fine of not
more than one hundred dollard ($100.00) or by imprisonment for
not more than forty-five (45) days or by both such fine and
imprisonment; upon a third or subsequent conviction within eighteen
(18)- months after the first conviction such person shall be
punished by a fine of not more than two hundred fifty dollars
($250.00) or by imprisonment for ncLt more than ninety (90)
days or by both such fine and imprisonment.
Section 6. Effective date.
This ordinance shall take effect ten (10) days
after its publication and posting, pursuant to Section 133 of
the New York Town Law.
Section 7. Savings clause
If any court of competent jurisdiction shall
determine that some portion or provision of this ordinance is
invalid, such judgement shall not affect the remaining portion
or provisions of this ordinacne.
Section 8. Resission.
Town of Queensbury Ordinance I, establishing arterial
routes and authorizing stop signs in said town, duly adopted
the sixth day of August, 1955, is hereby rescinded and super-
seded.

appropriated to the Pine View Cemetery, thereby increasing the

$10,000. be transferred to the Pine View Cemetery Commission for the
Perpetual Care Fund, and
