Noes - None October 16, 1969 Mr. Gerald Solomon, Supervisor Queensbury Office Building Town of Queensbury, New York Dear Gerry: It is with regret that I must request that the Town Board not reappoint me to the Town Planning Board. As you know, I have been recently elected to the school Board of the Lake George Central School. For this and other business reasons, I can no longer give sufficient time to the duties as a member of the Town Planning Board. It has been a privilege and a source of personal accomplishment to have served on the Planning Board. However, leaving before certain basic points have been resolved is unfortunate for me. I am referring to the adoption of the State Building Code, revision of Sign Ordinance Sections and a set of Subdivision regulations. These three (3) items I consider very important for the efficiency of the Town Building Department and the orderly a growth of the town in general. I hope in the near future, that I may once again be able to serve my community in whatever sphere may be available. Sincerely yours, Paul .E. RESOLVEDC that the Supervisor is hereby authorized and directed to transfer the sum of $2,000,00 from the Highway Fund to the Queensbury Water District, said amount to be repaid to the Highway Fund as soon as such money is needed, and in any event prior to December 31, 1969. DEMBOSKI WHO MOVED ITS ADOPTION SECONDED BY MR. ROBILLARD. WHEREAS, the Town of Queensbury has maintained and used a certain roadway known as Eisenhower Avenue for some years last past, and WHEREAS, said Eisenhower Avenue is in an area acquired by Queensbury Better Homes- Volunteers, Inc. , a membership corporation, as a gift from Ralph A. Elmore and Geneva K. Elmore, and WHEREAS, said membership corporation requires said Eisenhower Avenue to be a public highway leading from Sherman Avenue to the area it desires to develop for low tental housing, and WHEREAS, said Queensbury Better Homes Volunteers, Inc. , has by its President, Byron E. Howe, Jr. executed and delivered a deed for a roadway, including that portion known as Eisenhower Avenue, to said Town of Queensbury and said deed has been approved by order of the Supreme Court duly made and entered in the Warren County Clerk's Office, and 306 WHEREAS, Carl Garb, Superintendent of Highways, has advised this Board that he recommends the acceptance of slid roadway into the Town Highway System, and WHEREAS, the said deed has been approved by Harold W. Dr. Howe congratulated the persons who have been active in developing the Low Rental Homes. Supervisor Solomon and Councilman Demboski both discussed the efforts of Dr. Howe and his group. Councilman Robertson arrived at the meeting at this time. A letter was read by the Supervisor to do with the maintenance of the lot which houses the Zayer Shopping Complex. The cleaning from this time on will be done by contract. The required fence will be installed in the near future by local contractors. Supervisor Solomon discussed the fact that the recently purchased Merritt - Carey property has been d6signated by the Planning Board as a possible recreation area. Any work in this direction would take two years to complete. Supervisor Solomon stated that there is a possibility that the Queensbury Highway Department offices and garage magbe located on the Merritt - Carey property. Mr. Sterling Akins was granted the floor. Mr. Akins stated that the residents of the area of the Merritt - Carey property are pleased that the town is considering use of the property for a Recreation area. Section 4. Stops required. Pursuant to Section 1172 (a) of the New York Vehicle and Traffic Law, any person operating a vehicle on any town highway which crosses or intersects, a through highway as herein designated, or on any town highway an intersection with which has been herein designated a stop intersection, shall, before entering or crossing such through highway or such stop intersection, bring such vehicle to a complete stop unless otherwise directed by a police officer, and shall enter upon or cross such through highway or such stop intersection with caution. Section 5. Penalties for violations. Pursuant to Section 1800 (b) of the New York Vehicle and Traffic Lae, any person violating any of the provisions of this ordinance shall for a first conviction thereof be punished by a fine of not more than fifty dollars ($50.00) or by imprisonment for not more than fifteen (15) days or by both such fine and imprisonment; for a second conviction within eighteen (18) months thereafter such person shall be punished by a fine of not more than one hundred dollars ($100.00) or by imprisonment for not more than forty-five (45) days or by both such fine and imprisonment; upon a third or subsequent conviction within eighteen (18) months after the first conviction such person shall be punished by a fine of not more than two hundred fifty dollars ($250.00) or by imprisonment for not more than ninety (90) days or by both such fine: and Imprison- ment . Section 6. Effective date. This ordinance shall take effect on December 1, 1969. Section 7. Savings clause If any court of competent jurisdiction shall determine that some portion or provision of this ordinance is invalid, such judgement shall not affect the remaining pootion or provisions of this ordinance. Section 6. Rescission Town of Queensbury Ordinance I, establishing arterial routes and authorizing stop signs in said town, duly adopted the sixth day of August, 1955, is hereby recinded and superseded.
