In a telephone conversation with Mr. Albert Smith on
June 13 , 1980 , Mr . Smith stated the following facts :
. 1 . That Mr . Smith owns 100 acres of land on the west
side of Tuthill Road and 32 acres on the east side of
Tuthill Road in the Town of Queensbury , Warren County , NY.
2. That the subject of this letter is the 32 acres
on the east side. of. Tuthill Road.
3 . That Mr. Smith sold a 9+ acre parcel containing a
single family dwelling to a Mr . Inglee in 1977 .
11 That there remains a 13+ vacant parcel , remaining
from the 32 acre parcel originally owned by Mr . Smith .
5 . That you propose to purchase this 13 acre parcel

An Agency wetlands expert has indicated that there are
no "wetlands" sitaute on the property , that is , any land which
is annually subject to periodic or continual inundation by
water and commonly referred to as a bog , swamp or marsh.
Based on the above information ; I can state that the property
involved in your proposal is located in a aural Use area as
delineated on the Official Adirondack Park Land Use and Develop-
ment Plan Man and does not involve a "critical environmental
area" as defined by §810 (1) (d) (1) of the Adirondack Park Agency
Act, and that the project as set forth above is no: subject to
the review jurisdiction of the Adirondack Park Agency and will
not require a permit or approval from this Agency provided that
any new on-site sewage disposal is located at least 100
feet from the mean high-water mark of any permanent or inter-
mittent stream; and provided that any proposed structure is not
in excess of 40 feet in height.

This determination is grounded on the fact that the sub-
division of land in a Rural Use area, not involving shoreline,
where less than 5 lots , parcels or sites are to be created or
retained, and where each lot, parcel or site to be created
or retained is at least 320 ,000 square feet in size is
not a Class A or Class B regional project subject to Agency review.
I should point out to you that this letter is based on
information supplied by you and recited herein. Should the facts
differ from those recited, our nonjurisdictional determination could
vary accordingly. Furthermore , this letter cannot serve to
exempt your proposal from approval or permit requirements of other
state or local governmental bodies .
Finally, this letter does not change the fact that other
state and local agencies may require that permits be issued before
you commence the project. And while an Adirondack Park Agency
permit is not necessary for your proposal , you should check with
authorities of the Town of Queensbury and with other state
agencies as to whether they will require such permits .
If you have any further questions , please do not hesitate
