The Public Hearing was declared open on the applications of Robert
Coons and Mr.& Mrs. Robert Linindoll for a permit to locate Mobile
Homes on Pinello Road, Town of Queensbury.
Proof of Publication was presented by the clerk.
The clerk read the notice as published in its entirety.
Supervisor Solomon requested a voice from any persons present either
in favor of or in opposition to the granting of the permit.
There was none.
Following discussion with the Town Board, Supervisor Solomon stated
that the permit will be granted at this meeting.
The Public Hearing was closed at 8:15 p.m.

Supervisor Solomon announced the Public Hearing on the creation of
a lighting district in -South Queensbury section of the Town of
Queensbury.
Proof of- Publication was -presented by the clerk.
The clerk read the original Resolution #68 which was published in
its entirety announcing the public hearing.
Supervisor Solomon requested any comments from persons present
either in favor of or in opposition to the creation of the lighting
district. There was none.
'- Councilman Robertson spoke in favor of the installation of the street
lighting as planned.
The public hearing was closed at 8:20 p.m.
With complete Town Board approval, all minutes up to this date
were approved. Carried unanimously.

LIGHTING DISTRICT IN THE TOWN OF QUEENSBURY, to Referendum
COUNTY OF WARREN AND STATE OF NEW YORK,
PURSUANT TO ARTICLE 12-A OF THE TOWN LAW.
The. Town Board of the Town of Queensbury, in the County
of Warren and State of New York, met in regular session at the
Town Office Building on the .11th day of April, 1968 at 8:15 o'clock
P.M. , Eastern Standard Time.
The meeting was called to order by Supervisor Gerald B.
Solomon, and the following were present, namely:

The following resolution was moved, seconded and passed :
WHEREAS, an order was duly adopted by the Town Board of
the Town of Queensbury on the 28th day of March, 1968, reciting
the boundaries of the proposed lighting district and speef**iAg
the 11th day of April, 1968 at 8:15 P.M. on that day as the time
and the Town Office Building of the Town of Queensbury located in
Queensbury, New York, as the place where the Town Board would
meet to consider and hear all persons interested in the subject
thereof concerning -the same; and
WHEREAS, such order was duly published and posted as
required by law; and

WHEREAS, a hearing was duly held by said Town Board on the
11th day of April, 1968, beginning at 8:15 P.M. at the Town Office
Building of the Town of Queensbury, at Queensbury, New York, and
full discussion of the matter having been had and all persons
desiring to be heard having been duly heard; now upon the evidence
given at such hearing, it was
RESOLVED AND DETERMINED:
A. That the notice of hearing was duly published and
posted as required by law and is otherwise sufficient.
B. That all property and property owners within the
proposed district are benefited thereby.
C. That all the property and property owners benefited
are included within the limits of the proposed district.
D. That it is in the public interest to establish said
lighting district; and be it further
RESOLVED AND DETERMINED, that there be and hereby is
established a lighting district as proposed; that the service
therein mentioned be provided for upon the required funds being
made available or provided for; that such district shall be
designated and known as the South Queensbury Lighting District
of the Town of Queensbury and shall be bounded and described as
follows:
BEGINNING in the southerly bounds of lot 9 of the
first subdivision of Queensbury at the northwesterly
corner of lands of P. A. and John Sullivan and the
northeasterly corner of lands of Michael and Helen
Powhida, running from thence in a southerly direction
along the boundary line between the lands of the said
parties, crossing Quaker Road and Dix Avenue, and
southerly of Dix Avenue following the easterly bounds
of lands of Frank Bronk and still following the westerly
bounds of the said lands of Sullivan, crossing Lower
Warren Street and to the southerly bounds thereof where
the same is intersected by the northerly bounds of
Parcel #15 as shown on a map entitled "Map of Lands of
Imperial Wall Paper Company" made by Myers, Bowers and
Ashley, dated January 24, 1934, revised by Leslie W.
Coulter April 21, 1952; running from thence in a westerly
direction along the southerly bounds of Lower Warren
Street and the northerly bounds of the said Parcel #15
to the most westerly end thereof; thence running in an
easterly direction along the northerly bounds of the
Feeder Canal, being also the southerly bounds of the said
Parcel #15, to a point therein on a line which is a con-
tinuation northerly of the westerly bounds of Parcel #17
as shown on the said map; thence running in a southerly
direction, crossing the Feeder Canal, to a point on the
southerly bounds thereof at the northwesterly corner of
the said Parcel #17; thence running South 05 degrees and t._ j

bounds of the lands of Charles J. and Ruthe E. Nassivera;

to the southeasterly corner of the said lands of Nassivera;

Queensbury Avenue; also known as County Line Road; thence

Bearings given in the above description are as given
in deeds or are as shown on survey maps.
And it further appearing that since it is not proposed
or required that the cost of such improvement be financed by
bonds, notes or other evidence of indebtedness and that, there-
fore, the permission of the State Department of Audit and Control
to create such district is not required; and it is further
RESOLVED that this resolution shall be subject to a
referendum as provided in Section 209-e.

Mr. Robert Stutz spoke on the request for a change of road sign
at Ka.ttskill Bay. The road..in .question will be armed "Mayflower
Lane" instead of "Post Office Road". Mr. Stutz presented a
petition with (9) signatures affixed.
— Mr. James Griffin was granted the floor. Mr. Griffin discussed at
length the present condition of Sweet Road. Mr. Griffin stated
that property has been deeded to the Town to straighten the road
but the construction has not been completed.

A request was received and will be referred to the Zoning
Commission to do with construction of Garden Apartments on
Glenwood Avenue. The applicant is this request was Slingerland
Development Corporation.
Supervisor Solomon presented a copy of a recently adopted
resolution by the County of Warren to do with a proposal to
establish a County Sewer Agency.
The resolution was read for the benefit of the persons present.

1968 was received and placed on file.
A discussion ensued with all board members taking part, on
speed control in Residential Districts within the Town of
Queensbury.
The monthly report of the Supervisor for the month of March,1968
was received and placed on file.
The total receipts as listed were $25,986. 11, the total disbursements
were $95,692.91.
RESOLUTION TO AUTHORIZE REIMBURSEMENT OF FUNDS FROM THE AGENCY
AND TRUST ACCOUNT TO THE QUEENSBURY WATER DISTRICT ACCOUNT.
RESOLUTION NO. 72, Introduced by Mr. Robertson, who moved its
adoption, seconded by Mr. Turner.
WHEREAS, the Town Board of the Town of Queensbury did
by Resolution No. 209 dated October 5, 1967 authorize a bond
resolution in the amount of $18,000 for the purchase of equipment
for the Queensbury Water Department, such money to be deposited
in the Agency and Trust Account, and
WHEREAS, the resolution . so stated that this money was
for the purchase of a new 1968 Wain Roy back-hoe, a new 1968
Chevrolet and a used 1954 air compressor at a total cost of
$18,418. The sum of $418.00 to caome from the current budget of
Queensbury Water District, and
WHEREAS, the cost of the used air compressor in the
amount of $995 was charged to the Queensbury Water District in
full rather than the partial amount of $418, and was subsequently
paid from the Queensbury Water District Account, therefore be it
RESOLVED, that the Supervisor is hereby authorized and
directed to transfer the sum of $577 (difference between $995
and $418) from the Agency-and Trust Account to the Queensbury
Water District Account; thereby correcting this error.

RESOLUTION TO INCREASE THE WATER RATES OF THE TOWN OF QUEENSBURY
EFFECTIVE MAY 19 1968.
RESOLUTION NO. 73, Introduced by Mr. Solomon, who moved its

WHEREAS, the Town Board of the Town of Queensbury has
by Resolution adopted a schedule of Water Rates and Charges for
Service Connections, and
WHEREAS, said rates and charges are deemed inadequate
due to the increased costs incurred by the Water Department to
render efficient and adequate service, therefore be it
RESOLVED, that effective May 1, 1968, the rates for
water service and water service connections shall be as set forth
in Schedule A attached hereto and made a part hereof.

QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside
of a duly licnesed mobile home court at property situated on
Pinello Road, and
WHEREAS, this town board has conducted a public hearing in connection
with said application and has heard all persons desiring to be heard
in favor of or against said application, and

RESOLUTION BY MUNICIPALITY OR POLITICAL SUBDIVISION
TO MAINTAIN FRONTAGE, MARGINAL OR SERVICE ROADS .CON-
STRUCTED IN CONNECTION WITH CONTROLLED ACCESS HIGHWAY.
WHEREAS, Subdivision 25 of Section 10 of the New York Highway Law as
amended in 1956 provides, in part, that the Commissioner of .Trans-
portation shall "Have power in connection with the development of any
controlled access facility to plan, designat, construct, alter,
improve and vacate frontage, marginal and service roads. "and also
that "The maintenance of any highway, road or street which is affected
by this subdivision and which in the judgment of the Commissioner of
Transportation is not deemed to be a part of the state highway system
shall be maintained by the municipality or the municipalities in which
all or part thereof is located, "and
WHEREAS, the Superintendent proposes to improve Aviation .Road a
controlled access highway, and in connection therewith to construct the
following-described frontage, marginal or service roads:
School House Road, beginning at a point on existing School House
Road 220 feet north of the centerline of Aviation Road and
terminating at Carlton Drive 203 feet north of the centerline
of Aviation Road, and
WHEREAS, the said frontage, marginal or service roads are to be
located within the Town of Queensbury, and in the judgment of the
Commissioner of Transportation will not be deemed to be part of
the State highway system, no therefore:
It Is RESOLVED that, upon completion of construction of the above-
described frontage, marginal or service roads, the Town of Queensbury
will maintain such roads in accordance with the provisions of the
Highway Law.

WHEREAS, , the New York State Department of Transportation
proposes the construction of the Glens Falls-Lake George SH 417
and
WHEREAS, the State will provide for the construction of
sidewalks, as shown on the contract plans relating to the pro-
ject.
NOW, THEREFORE,
BE IT RESOLVED: That the Town of Queensbury will maintain
these sidewalks.

Attorney William Bacas, representing Mrs. Cleo Rogers, .was granted
the floor. The attorney discussed a petition being presented at

The petition of Cleo Rogers respectfully shows:
1. The undersigned resides at 374 Ridge Road in the
Town of Queensbury, County of Warren and State of New York.
2. The undersigned is the owner of real property lo-
cated in the Town of Queensbury, County of Warren and State of
New York.
3. The undersigned hereby petitions and requests a
change of zoning under the zoning ordinances of the Town of
Queensbury, Warren County, New York, with respects to premises
hereinafter described, from an R-4 District to an R-5 District
for the purpose of erecting and constructing garden apartments.
4. That it is the intention to construct said garden
apartments on the following described premises: Being about 20
acres of vacant land located on the east side of Meadowbrook Road
and on the south side of Cronin Road in the Town of Queensbury,
Warren County, New York. Submitted herewith and made a part of
this petition is a map setting forth the exact description of the
premises herein.
5. That your petitioner is the owner of a 42 acre
tract of land, which tract includes the proposed site of the gar-
den apartments. A portion of said tract or 22 acres are to be
excluded from rezoning or reclassification and are to be reserved
and used as a"buffer zone" between the proposed garden apartments
and any residential areas to the . south of the proposed site. Your
petitioner intends to erect on said 22 acres tract, single dwelling
homes.
6. That the premises or proposed site are presently
zoned as a R-4 District. The surrounding character of said pre-
mises is as follows: The area immediately to the west is zoned as
C-3; the area immediately to the south is zoned as M-1; the area
immediately to the north is zoned as R-5 and the area located
immediately to the east is zoned as R-3, which abuts on a tract
zoned as M-1. Your petitioner contends and submits that the
erection and construction of garden apartments on this site is
cnnsistent with the character of the adjoining premises and
zoning districts and would not in any way effect the character of
the area in question.
7. Your Petitioner further submits and contends that
the erection and construction of garden apartments at the proposed
site would be advantageous to the Town of Queensbury, Warren
County, New York, for the following reasons:
(1) Garden apartments would enhance the general
character of the entire area.

(2) The proposed site is naturally conducive for the
erection of garden apartments.
(3) Increased real property taxes.
(4) Creation of facilities (garden apartments) now
totally lacking in the Town of Queensbury.
(5) The proposed site is advantageously located near
shopping centers, churches, schools, colleges, golf courses,
industrial parks, major routes and highways and located on the
present school bus routes.
8. The proposed garden apartments will consist of in
excess of 150 units. The units will be composed of 1 and 2 bed-
room units with living space of approximately 1000 square feet.
Each unit will have complete kitchens composed of dishwashers,
garbage disposals and exhaust systems. All units will be carpeted.
Parking facilities to accomodate 255 cars will be erected on said
premises and will eliminate any traffic congestion and on-street
parking. Adequate recreational facilities in the nature of a
swimming pool and playgrounds will be erected on said premises.
A complete sewage, disposal and treatment system will be erected
on said premises and will conform to the requirements of all local
and state agencies and regulations. Present approval has been
obtained from the New York State Department of Health. The said
sewage, disposal and treatment system will also accomodate homes
to be erected in the buffer area immediately south of the proposed
site.
9. Your petitioner further intends to convey and turn
over to the Town of Queensbury, New York, the sewage, disposal
and treatment system after completion of the proposed site.
10. That the anticipated cost of the entire project will
be Two Million Dollars.
11. That your petitioner further states that prior to
the zoning ordinances of the Town of Queensbury, much preparation
and planning. had been done to prepare said premises for the erec-
tion of garden apartments. That much of the planning and pre-
paration was by the late Tom Rogers, husband of the petitioner.
That several maps had been drawn setting forth proposed site,
specifications and proposed construction. Test borings have been
performed. The site has been partially bulldozed and graded.
12. That the foregoing was brought to the attention of
the Town Board of the Town of Queensbury and said proposal was
warmly received. That upon the death of the late Tom Rogers and
the passage of the zoning ordinances of the Town of Queensbury,
your petitioner thereafter made application for a special use and/
or variance to use said premises for the erection and construction
of garden apartments to the zoning board of Appeals of the Town
of Queensbury. That the Zoning Board of Appeals, pursuant to its
discretion and authority, referred the entire proposal to the
Planning Board of the Town of Queensbury. That the Planning Board
v refused to take action pending a legal opinion on the zoning
board's jurisdiction in the matter of granting use variances.
That upon information and belief, no legal opinion was received
by the Planning Board or the Zoning Board of Appeals. The Zoning
Board of Appeals thereupon recommended to the petitioner that she
�T make application to the Town Board for a change in zoning.

WHEREFORE, your petitioner respectfully prays that the
Town Board of the Town of Queensbury, New York, amend and/or change
its zoning ordinances to effect a change of the proposed premises
hereinbefore described from an R-4 District to an R-5 district for
the purpose of erecting garden apartments and for such other and
further relief as to the Town Board may seem just and proper.

Regular Meeting April 25, 1968

The meeting was called to order by the Supervisor at 8:00 p.m.
Supervisor Solomon greeted the group of visitors.
A sizeable groups of residents of the Glen Lake section of the
Town of Queensbury were present in protest to the possible granting
of a permit to locate a mobile home near Birch Road.
Also present were:
Mrs. Barbara McFarlane - League of Women Voters
Mrs. Clifford Lewis - League of Women Voters
Thomas K. Flaherty - Superintendent of Queensbury Water
Supervisor Solomon announced the opening of the Public Hearing
on the application of Arthur and Dianne Mead for a permit to
locate a mobile home outside of a mobile home court.
Proof of Publication was presented by the clerk.
