Kestner, Jr. The Supervisor announced the public hearing on the application of Orbin & Catherine Harrington for a permit to locate a Mobile Home on Pinello Road. Proof of publication was presented and read aloud by the clerk. Supervisor Solomon requested a voice from any person present ,either in fe"r of or in opposition to the granting of the permit. Mrs. Harrington stated the necessity of the granting of the permit to do with her family needs. Donald Hazelton spoke in favor of the granting of the permit as �-- also Mr. Donald Ladd voiced the same opinion. The hearing was closed at 8:05 p.m. The public hearing was opened on the application of Eva Hamblin for a permit to locate a mobile home on Burch Road. Proof of publication was presented and read aloud by the clerk. 456 Supervisor Solomon requested a statement from any person present in favor of or in opposition to the granting of the permit. Mr. Raymond Potter spoke in favor of granting the permit. The Public Hearing closed at 8:08 p.m. The public hearing was opened on the application of Jason Sweet for a permit to locate a mobile home on Bay Road. Proof of publication was presented and read aloud by the clerk. With no persons in attendance in favor of or in opposition the Public Hearing was closed at 8:10 p.m. The Supervisor announced the opening of "Bids" on the contract to construct the equipment for the South Queensbury Water District at 8:15 p.m. Proof of Publication was presented and read aloud by the clerk., The clerk proceeded to open the following bids: Bidder Total Bid Items 1 through 55 Onontario Corporation $595,959.00 Howard LaRose Construction Co. 5499030.75 John Kubricky &. Sons Inc. 46011857.00 The bids by units were read by Mr. Jospeh A. Kestner, Jr. , the engineer for the Water district. The Board recessed at this time. The Town Board returned to session at 8:45 p.m. The following resolutions ,_] were adopted at this time. Y. , has made application in accordance with paragraph 7($) Section 4, of the Town of Queensbury entitled ; ORDINANCE FOR THE REGULATION OF MOBILE MOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile kome outside of a duly licensed mobile 'home court at property situated Block #1, Project #2 BL&M Hartman Development, and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, -for the following reasons: There were no persons in appearance in opposition to the granting of the permit. Y. , has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensburyentitled; ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Bay Road, Lake George, New York, and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: There were no persons in appearance in opposition to the granting of the permit. This application was approved by the Building Inspector do to the fact that by locating the Mobile Home at this location, the applicants could be of assistance to the father-in-law do to his health condition. It is understood that a home will be built on the location, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned f ordinance, permission is hereby given to Jason Sweet of 166 Broad St, 4 Glens Falls, N. F.D. #3 Burch Road, W. Glens Falls, N. Y. , and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the .following reasons: There were no persons in appearance in opposition to the granting of the permit. Noes - None Supervisor Solomon announced that as a result of a report as sub- mitted by LeRoy Phillips, Chief of Police, the application of Nelson Harrington for renewal of his Junk Yard License will be denied at this time. Mr. Donald Hazelton questioned the Town Board as to the need for a public hearing on his application for a mobile home permit. Supervisor Solomon explained that this rule is the result of the adoption of the Mobile Home Ordinance. The reports of the Police Department and the Highway Department were received and placed on file. The Monthly report of the Supervisor was aW received and placed. The total. receipts as listed were $78,853.76. The total disbursements in the report were $93,395.02. Councilman Demboski reported that the Queensbury Housing Authority has been established as result of action by the Seante and Legislature in Albany. RESOLUTION NO. 125, Introduced by Mr. Robillard, seconded by Mr.Robertson RESOLVED, that permission is hereby granted to conduct a Circus as follows: Sponsor - Veterans of Foreign Wars Circus - Sells - Gray Circus Place - Fireman*s Field, West Glens Falls, N. Y. Date - Friday, June 14th, 1968 and be it further RESOLVED, that the Town Clerk is hereby authorized and directed to issue a permit to the aforesaid sponsor upon receipt of proof of Liability Insurance in the amount not less than $100,000/$300,000 Bodily injury Liability and $25,000 property damage liability coverage. Noes - None 462 RESOLUTION TO AUTHORIZE TRANSFER OF FUNDS RESOLUTION NO. 127, Introduced by Mr. Solomon, seconded by Mr.Robillard. WHEREAS, the 1968 budget did not allow for compensation of employees in the office of the Assessors and WHEREAS, due to the increased work load in the office it is deemed necessary to employ some part-time clerical help, therefore be it RESOLVED, that the sum of $200. be transferred from the Assessor' s Office and Other Expense to Compensation of Employees. Noes - None RESOLUTION TO NAME MEMBER TO THE BOARD OF CEMETERY COMMISSION RESOLUTION NO. 128, Introduced by Mr. Robertson, seconded by Mr. Solomon WHEREAS, Chapter 814, of the laws of 1948 provides that there shall be a Board of Cemetery Commissions of the Town of Queensbury to consist of three members appointed by the Town Board for three year terms to expire on June 30th of each year, and WHEREAS, it appears from the records of the Town Clerk that Frank L. Cowles was last appointed by the Town Board for a term which expires on June 30, 1968, therefore be it RESOLVED, that Frank L. Cowles be and he hereby is reappointed a member of the Board of Cemetery Commissions of the Town of Queensbury for a term commencing as of July 1, 1968 and to expire on June 30, 1971. Noes - None RESOLUTION TO MAKE APPLICATION TO THE NEW YORK STATE DIVISION FOR YOUTH, FOR APPROVAL OF HOMETOWN BEAUTIFICATION PROJECT RESOLUTION NO. 129, Introduced by Mr. Demboski, seconded by Mr. Robillard. WHEREAS, the 1968 Town Budget has made provisions for a continuation of the Town Beautification Program, and WHEREAS, it is believed that the Town is eligible to receive state aid under the State of New York Divisionfor Youth, therefore be it RESOLVED, that application to the New York State Division for Youth for approval of the Hometown Beautification Project is hereby authorized, and that the Supervisor of the town is hereby authorized and directed to execute such application on behalf of the Town of Queensbury. Duly adopted by the following vote: Ayes Mr. Demboski, Mr. Robillard, Mr. Robertson and Mr. Solomon Noes - None Attorney Katz reported on the hearing in Supreme Court on the request for the granting of a permit for George Maksail on Route 9L to locatd a Mobile Home will be heard on June 14, 1968 at the Warren County Municipal Center. Councilman Robertson moved and same was seconded by Mr. Solomon, that the Attorney should appear in the behalf of the Town of Queensbury at this hearing. 468 RESOLUTION NO. 130, Introduced by Mr. Solomon, seconded by Mr. Robertson. RESOLUTION ESTABLISHING PETTY CASH FUND. WHEREAS, Town Law Section 64 (la) provides that the Town Board may establish a petty cash fund for any town officer or head of a department or office, and WHEREAS, the Town Board deems it advisable to establish such a petty cash fund for the use of the Town Justices of the Peace, NOW, THEREFORE, BE IT RESOLVED, that each of the Town Justices of the Peace, if he shall so request, shall be provided with a petty cash fund in an amount not to exceed Twenty-five Dollars ($25.00) , and be it further RESOLVED, that siad Justice or Justices shall account for said fund as provided for in the aforementioned section of the Town Law. WHEREAS, application has been made by John Hughes for the rezoning of the area bounded on the east by Bay Road; on -the south by the north line of Walker Lane; on the west by R-.3 district; and on the north by an R-5 district, from an R-4 to an R-5 district, and WHEREAS, the Zoning Ordinance of the Town of Queensbury, Section 11. 100 and Sections 264 and 265, Art. 16, Chapter 62 of the Consolidated Laws of the State of New York provide that any proposed amendment or change in the Zoning Ordinance be referred to the Planning Board for a report, thereon and a public hearing thereon, now therefore be it RESOLVED, that said application be referred to the Planning Board for a report thereon, and be it further RESOLVED, that upon the receipt of the report -of the Planning Board a public hearing on such application be held by publishing notice thereof at least ten (10) days in advance of such hearing in the official town newspapers. RESOLUTION N0. 132, Introduced by Mr. Robertson, seconded by Mr. Robillard WHEREAS, application has been made by Robert C. Baker, Loomis J. Grossman, Jr. , Richard A. Grossman and Walter H. Rubin for the rezoning of the easterly portion of their property to the southerly boundary thereof and the unimproved westerly portion of their said property to a C-3 and R-5 district respectively, as set forth in the petition and map filed with this Board, and '464 WHEREAS, the Zoning Ordinance of the Town of Queensbury, Section 11.100 and Sections 264 and 265, Art. 16, Chapter 62 of the Consolidated Laws of the State of New York provide that any proposed amendment or change in the Zoning Ordinance be referred to the Planning Board for a report thereon and a public hearing thereon, now therefore be it RESOLVED, that said application be referred to the Planning Board for a report thereon, and be it further RESOLVED, that upon the receipt of the report of the Planning Board a public hearing on such application be held by publishing notice thereof at least ten (10) days in advance of such hearing in the official town newspapers. WHEREAS, by Resolution No. 21 of this Board the hourly rates of pay for town clerical employees was fixed at $1.70 per hour, and WHEREAS, Mrs. Patricia Flaherty has been employed as a clerk in the Town Water Department, and WHEREAS, through a mathematical error said Mrs. Flaherty received -- compensation at the rate of $1. 75 per hour and has received an excess payment of $5.90, now therefore be it RESOLVED, that Mrs. Flaherty shall reimburse said Town Water Department the amount of said over payment, namely, $5.90. Kestner, Jr. , reported to the Town Board that all computations on the bids as received for construction of the South Queensbury Water District, were in order. On the recommendation of Mr. Kestner the following resolution was adopted. RESOLUTION NO. 135, Introduced by Mr. Solomon, seconded by Mr. Robertson. WHEREAS, the Town Board advertised for sealed bids for installation of water mains and other improvements in South Queens- bury Water District according to plans and specifications prepared by Joseph A. Kestner, Jr. , professional engineer, and approved by the Town Board, and WHEREAS, it has been determined by the Town Board that the bid of John Kubricky & Son Inc. , of Star Route Ridge Road in Glens Falls, N. Y. , in the amount of $460,857.00 was the lowest of the several bids received by the Town Board -and John Kubricky & Son, Inc. , having executed and filed the non-collusion certidicatesc �: required by Section 103-d of the General Municipal Law as amended, be it RESOLVED that the Town Board of the Town of Queensbury, acting for and in behalf of South Queensbury Water District, accept the bid of John Kubricky & Son Inc. in the amount of $4601857.00 and that the Supervisor be and he hereby is authorized to execute a contract on behalf of the Town Board of the Town of Queensbury with John Kubricky & Son, Inc. , for the performance of the work and the construction of the improvement in accordance with said plans, specifications and bid, and be it further RESOLVED that the cost of such improvement in the South Queens- bury Water District be financed pursuant to the provisions of the Local Finance Law by the issuance of serial bonds and capital notes of the Town of Queensbury in the total amount of $650,000.00, and that the proceeds of the sale of such serial bonds and capital notes when issued be appropriated to pay the cost of said improvement. That your petitioner is Nicholas Clemens of 318 Ridge Street, Glens Falls, New York. 466 That your petitioner is the owner of certain real property . located in said Town of Queensbury, County of Warren, State of New York which property is located at the junction of Meadowbrook Road and Ridge Street and is bounded as follows: Being a triangular parcel of land bounded on the west by Meadowbrook; on the east by Ridge Street; that said parcel is identifiable on the'map of Town of Queensbury Zoning Map by the red outline thereof as a copy of said map is filed herewith. 2. That your petitioner' s property consists of an apartment 1~ house, real estate office and liquor store all contained in one building. To the rear of said premises is a large parking lot and thereis a parking area on the east side. Immediately to the north is an accountant' s office. The area within which petitioner' s property is now zoned as an R-4 district. It is approximately 1600 feet from petitioner' s property north to an M-1 district which extends along Quaker Road. 3. It is petitioner' s desire to use his property in a manner in which the best possible use could be derived therefrom. Petiti- oner plans to erect a n attractive frame building approximately 50' x 100' for expansion of the present business use of the property. Petitioner presently liege the liquor store to a tenant who has indicated that he will seek another site for a liquor store location because thereis no adequate storage space in the above location. It is possible that the new location would be outside the Town of Queensbury. If the said tenant re-locates it-will be a hardship on your petitioner because of difficulty in re-letting said property. Petitioner is retired and is the recipient of social security and depends on rentals as a source of income to supplement his social security. 4. Your petitioner has been informed that to construct such a building would not be possible in an R-4 residential district and that it would be necessary to re-zone to a C-1 commercial district. 5. Your petitioner represents to the Town Board that in the event re-zoning is approved, he will keep his property in the same attractive motif as he has heretofore done in the past. Said property has been commercial in nature for a considerable number of years, and the proposed re-zoning will not present any drastic change in the neighborhood. WHEREFORE, your petitioner respectfully requests that petition- er' s property as outlined on said map attached hereto be re-design- ated and re-zoned as a C-1 District and the Zoning Ordinance of the Town of Queensbury, and the rules and regulations thereunder and the Zoning Map be amended, supplemented, changed or extended accordingly.
