1968-07-18 SP 4 1 Special Meeting July 18, 1968 Present: Gerald Solomon Supervisor Absent Lloyd Demboski Councilman Absent Theodore Turner Councilman Harold Robillard Councilman Hammond Robertson, Jr. Councilman Atty. Harold Katz. The meeting was called to order by the Supervisor at 8 :00 p.m. Supervisor Solomon greeted the following visitors: Florence McIlvaine - Reporter, The Post Star John Austin, Jr. - Radio Station WWSC Thomas K. Flaherty - Superintendent of Queensbury Water District Wendell Wilson - Interested in Zoning Variance Charles King - Visitor LeRoy Phillips - Chief of Police The minutes of the meeting of July 11, 1968 were approved. Carried unanimously. A letter stateing his resignation from the Town of Queensbury Planning Board was read and placed on file from Mr. Kenneth Karch, Councilman Robertson voiced the opinion that a note of recognition should be extended to Mr, Karch, Cummings & Co. Katz, Esq. 80 Bay Street Glens Falls, New York 12801 Re: Zayre, Glens Falls, New York Dear Mr. Katz: Thank you very much for the courtesies you extended to me during our telephone conversation today, pertaining to the Zayre signs at the above location. In accordance with your instructions, we are going to leave the signs on the premises and pay the fine of $50. 00 per week, commencing on the date of the court order. On this date, I will recheck and notify you as such. I understand we are to send the checks directly to the attention of the city clerk at the town hall. It is also my understanding that the Planning and Zoning boards are setting up a new sign regulation and that we should wait until this is completed before we reapply for a variance. Albert Myers Vice President 492 A letter of application for appointment on the Queensbury Police Department was received and placed on file. The letter was mailed to the Town Board from Mr. Casey. RESOLUTION TO FILL VACANCY ON QUEENSBURY PLANNING BOARD RESOLUTION NO. 164, introduced by Mr. Robertson, seconded by Mr. Robillard. WHEREAS, a vacancy exists on the Queensbury Planning Board due to the resignation of Kenneth M. Karch occasioned by the fact that Kenneth M. Karch is changing place of employment and also is leaving the Town of Queensbury. RESOLVED, that J. David Little, 21 Wilson Street, Town of Queens- bury, be and he is appointed a member of the planning board of the Town of Queensbury effective this date, and to serve for the remainder of the term of Kenneth M. Karch, said term to expire on September 30, 1970. Duly adopted by the following vote: Ayes - Mr. Robillard , Mr. Robertson and Mr. Solomon. Noes - None RESOLUTION NO. 165 , Introduced by Mr. Robertson, seconded by Mr. Solomon. Resolution approving Re-Zoning of U. S. Catherter and Instrument Corp. Bounded on the north by Quaker Road ; on the east by Bay Road; on the west by Glenwood Avenue; and bn the south by the R-4 line parallel to the Railroad right of way. WHEREAS, said U. S. Catherter and Instrument Corp. is the owner of property located south of Quaker Road and west of Bay Road in the Town of Queensbury; and WHEREAS, said U. S. Catherter and Instrument Corp. is desirous of erecting additional Research and other facilities on its said property; and WHEREAS, said property is presently Zoned as a C-3 District and such expansion of facilities would require a re-zoning of the area hereinbefore set forth; and WHEREAS, the Town Board after due consideration of the maps and plans filed with the petition, determined it was in the Public Interest to call a Hearing pursuant to the provisions of Section 11:00 of the zoning Ordinance of the Town of Queensbury for the Re-Zoning of said property from a C-3 District to an M-2 District, as such Districts are shown on the official Zoning Map of the Town of Queensbury and provided for in the Building Zone Ordinance; and WHEREAS, such Hearing was held pursuant to the Notice duly given at a meeting of the Town Board at the Queensbury Office Building, Bay and Haviland roads, Queensbury, New York on Thursday July 11th, 1968 at which persons desiring to be heard in favor of said Re-Zoning and also those desiring to be heard in opposition thereto were given an opportunity and were heard, and thereafter the Public Hearing was closed and decision reserved; Now therefore be it 493 RESOLVED, by the Town Board that the following property located in the Town of Queensbury and now in a C-3 District is hereby Re-Zoned to an M-2 District: that area bounded on the North by Quaker Road, on the east by Bay Road, and on the West by Glen- wood Avenue, and on the South by a line parallel to the Railroad right of way, which line marks an R-4 District, and it is further RESOLVED, that the necessary changes be made upon the departmental maps of the Town of Queensbury so as to indicate the aforement- ioned Zoning change from a C-3 District to an M-2 District, and the location of said property and the respective zones and defined and regulated pursuant to the provisions of the zoning Ordinance and map of the Town of Queensbury, as amended, and it is further RESOLVED, that the Town Clerk be and he is hereby authorized and directed to give the necessary notice of such change in zoning to the departments and agencies having jurisdiction in the matter. Duly adopted by the following vote: Ayes - Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes - None Mr. Thomas K. Flaherty, Superintendent of Queensbury Water District, reported on the construction progress by the contractor on the South Queensbury Water District. Mr. Flaherty discussed recent problems at the pumping station which resulted from a low voltage condition in the electric power supply. On Motion the meeting adjourned at 5;45 P.M. Carried unanimously. The public hearing on the application of Clifford Jarvis to locate a Mobile Home on Pinello Road was opened at this time. Proof of publication was presented by the clerk. Supervisor Solomon requested a voice from any one present in favor of or in opposition,. to the granting of the permit. There were none.
