Dear Mr. & Mrs. Defayette:
I am writing to you in response to my review of your plans depicting the proposed construction of
a 140 sf addition to your home on the property referenced above.
Upon review of the plans submitted to this office, I find that an Area. Variance will be necessary
in order for you to construct the .addition in the location you desire. Specifically, the proposed
placement of your deck addition does not meet the minimum sideline setback requirement of the
Waterfront Residential, (WR) district. Further, if your existing home is considered to be a non-
conforming structure; relief for the expansion of anon-conforming structure is needed from our
Zoning Board as well as Site Plan Review from our Planning Board. It is not clear from the
information submitted if your structure is non-conforming as the survey shows a deck in violations
of the side setback line while the Hutchins Engineering plan does not depict the. deck.
Clarification on this item is necessary so that we can identify all necessary reviews.
Please note our established submittal deadlines when compiling your application materials.

As discussed, this office is representing Dennis and Nancy Defayette in pursuit an Area Variance
to allow construction of a 140 SF addition to their residence on Reardon Road Extension.
Attached please find 15 sets of a submission package requesting an area variance for side
setback, as well as 15 sets of a submission package for Site Plan Review.
We hereby request waivers from Landscaping and Lighting Plan requirements.

Being the same premises described in a Warranty Deed from Walter Palmer
to Harold D. Harris and Rose Harris, his wife, dated July 14, 1080 and
recorded in the Warren County Clerk's Office on July 22, 1980 in Book
632 of Deeds at Page 444.
Harold D. Harris died at Glens Fa11s, New York on April 15, 2010. Rose
Harris died at Staten Island, New York on January 16, 1987.
Together with the appurtenances and also all the estate which the
said Decedent had at the time of his decease, in said premises, And also
the estate therein, which the party of the first part had or has power
to convey or dispose of, whether individually, or by virtue of said
Estate or statute or otherwise.
To have and to hold the premises herein granted unto the party of
the second part, her heirs and assigns forever.
And said party of the first part covenants that she has not done
or suffered anything whereby the said premises have been encumbered in
any way whatever.
And, that, in compliance with Sec. 13 of the Lien Law, the grantor
