Description of Proposed Project:
Applicant proposes an additional 75square foot tenant wall sign located above the store front in addition to the approved 40
square foot wall sign located on the tower of the building facing State Route 9 to the south.
Relief Required:
Parcel will require an area variance as follows:
1. Relief requested from maximum number of allowable wall signs for one tenant in a business complex as per §140-
6B(3)[4][b].
Criteria for considering a Sign Variance according to Chapter 267 of Town Law:
In making a determination, the board shall consider:
1.
Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby
properties will be created by the granting of this area variance.
Minorimpacts to the neighborhood may be
anticipated.
2.
Whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue,
other than an area variance.
It appears the benefit sought by the applicant can be achieved by the placement of the
tenant’s business on the existing pylon sign fronting State Route 9.
3.
Whether the requested area variance is substantial.
The request for an additional wall sign or 100% relief from the
maximum number of allowable wall signs for one tenant in a business complex as per §140-6B(3)[4][b] may be
considered severe relative to the code.
4.
Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions
in the neighborhood or district.
Minor impacts on the physical or environmental conditions of the neighborhood may
be anticipated.
5.
Whether the alleged difficulty was self created
. The difficulty may be considered self created.

Staff comments:
The ZBA may wish to ascertain if any other tenants in the plaza will require additional wall signs. Staff has concerns that if
approved, precedent will be set for additional requests.
