Supervisor Webster called the meeting to order at 5:10 P.M.
The Supervisor greeted the following visitors:
Mrs. Orson Beeman —League of Women Voters
Florence Mcllvaine - Reporter, The Post Star
Thomas K. Flaherty - Superintendent of Queensbury Water District
A letter was read by the clerk which announced the delivery date for
a Rock Crusher to be used by the Highway Department.
Letters of appreciation for effort on the part of the town in the
recent open house at Adirondack Community College were read and
placed on file.
A letter of appreciation was received and placed on file for use
of the Town Office Building from the Glens Falls Area AREC.
Supervisor Webster discussed the public hearing held recently by
the Department of Transportation of the State of New York to do
with the re-building of Aviation Road. A statement which the
Supervisor presented at the public hearing was presented as follows:

I am Supervisor John 0. Webster, of the Town mf Queensbury,
and I have a brief statement to make on behalf of our town
government and at the request of the town board.
I want to point out that this statement was prepared
prior to the hearing, based upon information we have at
hand, but wothout benefit of testimony that has been or
will be given today.
We realize that in a project of this scope and magnitude
many property owners will be effected, some will be benefited
to a greater .or lesser degree, and some will be otherwise
effected to a greater or lesser degree, but we have tried to
be objective and consider what is -in the overall interest.
As a matter of record, we wish to state our agreement with
this -proposed project and our agreement with the general details
of the project as they have been advanced to this date.
In some ways, this is our plan as .well as .yours, because
as you know the Department of Transportation has worked closely
with our town government every step of the waTi in the
development of this project.

We realize that quite a number of plans, or schemes, or ideas,
have been advanced as to the method of improving traffic flow in
the project area, and all of this has taken considerable time to
evaluate but we feel that this present plan is the crest one of
all those studied.
The Department knows, but also for -the record and for the
benefit of those attending this hearing - the Town of Queensbury
has asked for certain betterments and .conditions to be built
into this project.
1. New guard railings on the sidewalks over the
Aviation Road -Bridge over the Northway - to
protect children and pedestrian traffic. -
2. Street lighting on new metal poles - throughout
the project area.
3. Sidewalks on Aviation Road from the Northway Bridge
easterly to the Plaza Intersection, and in this
connection we cite the extreme need for sidewalks
from Greenway North to the Bridge because of
children walking to school daily.
Sidewalks on Route 9 - Upper Glen Street from the
city line to the Plaza Intersection, and in this
connection we point out that sidewalks already
exist from the city line to Lafayette Street.
4. We are requesting a new 12" water main to be
installed in the relocated Aviation Road from
approximately Carlton ,Drive easterly to the Plaza
Intersection.
We are also requesting a new 12" water main on
Upper Glen Street from the city of Glens Falls line
to -the Plaza Intersection.
We realize that in both of these water main requests
the Queensbury Water District will participate in the
cost.
5.We have asked that -conditions be built into the contract
specifications to insure a minimum of interruption of
business activity during the perios of construction.
That access be maintained at all times, that access
be paved at all times. We feel that maximum consideration
must be given to protecting the many businesses in the
shopping center complex.
On behalf of the town government, I want to thank you, Mr.
Ruddy, and the personnel of your department for the many acts
of cooperation with us in -the development of this project and
for the further cooperation I know we will receive. I want to
particularly thank Mr. Christman, Associate Design Engineer,
and his successor, Mr. Levett, for all the time spent with us
at frequent intervals in this regard.
With the conditions and the betterments I have cited, the
government of the Town of Queensbury approves this project and
will cooperate with you fully in bringing it to the construction
stage as aoew.Akspossible.

Lengthy discussion ensued on the plan to lay water and sewer mains
under theproposed construction on Aviation Road by the Town -of
Queensbury prior to the start of construction.
The Supervisor announced that many residents have offered their
services to serve on a committee to .help develop low-cost
housing for the elderly within the Town of Queensbury.
The plans for developing future water supply for the use of. the
town was discussed at this time. A letter of legal adiriee from
Attorney Albert E. Beswick was presented as follows:

Re: Proposed Queensbury Water Storage and Distribution District
We have talked in a general way about providing to the Town
of Queensbury an additional source of water supply by taking water
from Lake George for distribution and sale to existing water districts
in the town and additional districts which may hereafter be established
in the town. I assume there may be opposition from the Lake George
Association and others to the taking of water from the lake and it may
be necessary to have legislation to authorize the taking of water from
the lake for the Town of Queensbury.
Section 190 of the Town Law provides for the establishment
of a water supply district which cannot include lands within an exist-
ing water district. A water supply district generally develops a
source of water supply such as an impounding reservoir for sale to
i water districts. In this connection, Section 118 of the General Muni-
cipal Law provides for the sale of water by a water supply district
to villages and cities.
Section 190-a of the Town Law provides that a town board
may establish a water storage and distribution district for the
purpose of acquiring or developing a water supply for sale to water
and water supply districts within the water storage and distribution
district for redistribution by them. A water supply and storage
distribution district shall consist of water districts and water
supply districts which need not be.contiguous.

I assume that to do what you have in mind, there should be
a water storage and distribution district which could include the
whole town provided Water Resources Commission would approve it.
Section 190-c provides that a town board on- its own motion,
after a public hearing, may conduct a study of the advisability of
a water storage and distribution district and may cause maps and
pland to be prepared. Such maps and plans must shoe (1) the
identity and boundaries of the water districts which the town
board in its -judgment considers will be benefited by the estab-
lishment of a water storage and distribution district, (2) a
j written description of the proposed water storage and distribution
district, (3) the source of water supply and a description of the
lands, streams, water and water rights facilitielF, if any, to be
acquired therefor, the mode of construction of the proposed water
works and the location thereof, including reservoirs, water puri-
fication or treatment works, standpipes, wells, pumping stations,
aqueducts and mains, (4) estimates of the cost of construction or
acquisition of the facilities as shown on the maps and plans and
(5) the method of financing the same, including estimates of revenue
to be derived annually from the sale of water to water and water
supply districts within the water storage and distribution district

an revenues from any other source, and estimates of the eost of
aeggisaition and construction of water storage and distribution
facilities, of the cost of maintenance and operation, and of the
cost of debt service.
The first public hearing is on the general proposal and
after the hearing, the town board can retain an engineer to prepare
the maps and plans of the proposed water storage and distribution
district. The cost of preparation of such maps and plans is in the
first instance a general fund charge, but must be included in the
estimates of total cost and refunded to the general fund .if the
water storage and distribution district is subsequently established.
After the maps and plans have been completed, there must
be a second public hearing on the specific maps, plans and estimates.
Following the second public hearing, the town board adopts
a resolution determining whether all property and property owners
in the proposed district will be benefited thereby, whether all --
property and property owners benefited are included within the pro-
posed district and whether it is in the public interest to establish
the district, which resolution is subject to permissive referendum.
The next step is the application to the State Comptroller
for permission to establish the district and the application to
Water Resources Commission.
When we talk of including the entire town in the proposed
water storage and distribution district, it seems to me you might
have difficulty in making a valid determination that all of the
property and property owners in the entire town would be benefited.
You have French Mountain, Luzerne Mountain and West Mountain where
it would not seem logical to provide water service. _ I as not saying
it would be impossible but I just wonder if the State Comptroller
and Water Resources Commission would go that far. You certainly
could include your existing water districts and the inhabitable area
between the districts where municipal water service would be a
benefit even though the property owners in such areas might not
want a municipal water supply.
This is an outline of the procedure and perhaps at the
first public hearing, you can get enough reaction to decide whether
the whole town should be included.

RESOLUTION TO AUTHORIZE HIGHWAY LIGHT ON BAY ROAD AT BAYBERRY COURT
RESOLUTION NO. 220, Introduced by Mr. Robertson, seconded by Mr. Turner
WHEREAS, it is hereby determined that a dangerous condition exists
at the following intersection:
Bay Road at Bayberry Court
RESOLVED, that a 175 watt mercury corrected white highway light be
authorized for this intersection and that the Town Clerk be and he
is authorized and directed to contact the Niagara Mohawk Power
Corporation and make all necessary arrangements so that this -authorized
Highway Light may be installed.
