Harwood Beaty Councilman Theodore Turner Councilman Curtis Lampson Councilman Hammond Robertson, Jr. Councilman The Public Hearing was called to order at 8:00 p.m. Supervisor Webster greeted the group of over 100 persons present; all residents of the Lake George Park and vicinity. _ The following town officials and persons taking part in the public hearing were present: Attorney Albert E. Solomon - Supervisor - Elect James Keller - Secretary Zoning Board of Appeals Proof of publication was presented by the clerk. i The clerk read aloud the notice as published. 7 Supervisor Webster discussed at length the plans of the Town of Queens- bury to do with the development of the proposed Water Storage System. The Supervisor also discussed the recently enacted _eoning within the Lake George Park. Elaboration was made on the fact that an ordinance was recently adopted which would control sanitation within the Lake George Park which is intended to protect the purity of the waters of Lake George. Supervisor Webster invited any statements of persons present on any engineering information -which could be of assistance -to the ,Town Board in making decisions either Pro or Con on the problem of obtaining additional supply of water for use in the Town of Queens- bury. Attorney Albert E. Beswick was granted the floor. Mr. Beswick dis- cussed the legal aspects to do with the establishment of a Water Distribution District. - The attorney stated that the provisions of the Town Law authorize the public hearing which is being conducted at this time, this hearing is of a Preliminary nature which could determine the fact as to whether or not the Town Board should proceed with further preparation of maps, plans and costs of es- tablishing the proposed district. If the decision is to be, the total costs would be established and another public hearing would be called which would enable the Town Board to proceed with the final establishment of a water storage and distribution district. 8`# Mr. Joseph A. Kestner, Jr. , the engineer for the Town of Queensbury was granted the floor. Mr. Kestner discussed the present source of supply of water shich is developed from four (4) different wells. Mr. Kestner elaborated on the quality of the water at present as to its hardness and iron content. The engineer stated that a water softening system is not possible due to the fact that there is not available location for the discharge of the waste. The series of test borings which have been made by the contractors hired by the town were discussed by the engineer. The result of these borings has been to no avail without a proper supply being discovered. Mr. Kestner discussed the actual supply which would be available from Lake George for a municipal supply system for the Town of Queensbury. The cost estimate as made by Mr. Kestner for the development of this system was $2,600.00.-- This cost was compared to a mush larger cost estimate of the Inter-Municipal Water study as recently established by the engineers. Mr. George H. Engeman questioned the use of home water softener plants and also the rights of individuals to make use of runpoff water out of Lake George. Mr. Cyrus Woodbury elaborated on the fact that a sizeable amount of the water use of the town would be 'in the Hudson Falls area. Dr. Richard Hughes spoke on the results of the inter-municipal water study. Dr. Hughes stated that he is of the opinion that the Hudson River is the proper source of supply for the Town of Queensbury. Mr. Dean Howland voiced agreement with Dr. Hughes opinions. Supervisor Webster elaborated -on the fact that the comparison should not be made of the Queensbury Water System problems with the results of the inter-municipal water system as recently presented. Mr. Gerald B.H. Solomon, Supervisor Elect greeted any statements from persons present on legal or engineering data available at this time. Mr. Lysle Morton, president of Lake George Association presented a certified copy of a resolution as adopted by the Lake George Association. Same was placed on fike by the clerk. A lengthy statement was read by Mr. Morton from the Lake George Association. Copy of same was placed on file by the clerk. Mr. Ralph Soeul, Senior Engineer, Camp,Dresser & McKee endorsed the statements as presented by Mr. Lysle Morton, Mr. Soeul stated that water supply should be developed on a regional basis. A lengthy report was read by Mr. Soeul at this time. . Mr. William Busch stated that the members of the Lake George Park Association are vitally concerned as to taking the waters of Lake George for a municipal water supply system for the Town of Queensbury. Mr. Frank Adam@ presented a certified copy of a resolution of the Assembly Point Association which was placed on file. Mr. Cyrus Woodbury presented a resolution of the Lake George Chamber of Commerce which was placed on file. Mr. Orson C. Beaman read a letter from the Pilot Knob Association, which has been forwarded to the Town of Queensbury at a recent date. 04$ Miss. Alice Sinnott spoke on behalf of Mr. John Sinnott to voice the opposition of the Kaatskill Bay Association. Mr. James Schmindinger of Assembly Point stated that he is aware of the needs of the Town of Queensbury for water supply. Mr. Schmindinger voiced an opinion that he would like to be made aware of the exact amount of run-off water at Lake George at present. Mr. H. Russell Harris discussed the fact that only the residents within the proposed water supply extensions will be taxed for ? the costs of the proposed system. Mr. Fred Austin discussed the over-all details of creating the proposed water supply system. Mr. Duffy, Lake George, N. Y. , stated that he is in agreement with Mr. Schmindinger as to the gauging of run-off water from Lake George. Mr. Vonic, Pilot Kno Feel questioned the Town Board as to the amount of time which would taken in creating the water supply district. Mr. Mike Barodi discussed the availibity of extensions of services which would be available if the plan as proposed is developed. John Ahearn of South Bay Association spoke in opposition to the proposed water supply system. Mr. George Kushner spoke to the representative of Camp, Dresser & McKee to question his opinion of the estimates as prepared and presented by Mr. Joseph A. Kestner, Jr. , Engineer for the Town of Queensbury. Mr. Soeul was not in a position to make comparisons in costs at this time. Mr. Davis, Pilot Knob, questioned as to whether other communities would make a similar request for water supply should the Town of Queensburybe granted same. Resolutions and letters from the following were received in opposition to the Town of Queensbury being granted the permit to obtain water supply from Lake George. All Messages were placed on file. Darring - Telegram Supervisor Webster expressed respect for the report as prepared hpd presented by Camp, Dresser and McKee on the Inter Municipal Water study. Mr. Gerald B.H. Solomon Supervisor elect presented the following letter on the matter of the use of the waters from Lake George. 349 December 14, 1967 To The Queensbury Town Board, After hearing the statements of those present I must ask the Queensbury Town Board to postpone any action on plans to use Lake George water until after the new administration takes office on Jan. 1st, of this year for the following reasons: 1. The new administration has not been approached on the matter and since three of the five mem- bers will not be on the new board it is in fact a "Lame Duck Board." 2. Additional time is needed to seek a legal opinion from the state of New York on whether a precedent would be set allowing other areas even as far as New York City to use the water. 3. Additional time is needed for the new administra- tion to study the Camp, Dresser & McKee report as a group. In sumation I would like to impress the Town Board with the fact that thousands & thousands of Queensbury tax payer' s money is at stake and you cannot afford to make a mistake on such an important decision; therefore I must again ask that you postpone any action on this matter until after the new board takes office on Jan. 1st. Sincerely Gerald Solomon, Supervisor elect Mr. Alger Mason stated that the Lake George Park Commission has enjoyed full cooperation from the Town Board of the Town of Queensbury for many years. The public hearing closed for recess at 10:40 p.m. The Regular Meeting of the Town Board was re-called to order at 10:55 p.m. Supervisor Webster announced the first meeting has been held on December 13th, by the group selected to investigate low-cost housing within the town. The following persons are taking part in this group; Chairman - Michael O'Connor Member = Edgar Grant Member - Mrs. Fannie Wakeley A resolution has been adopted by the group to develop a building and housing code at a later date. RESOLUTION TO APPROPRIATE SURPLUS FUNDS IN THE HIGHWAY FUND ACCOUNT RESOLUTION NO. 260, Introduced by Mr. Robertson, seconded by Mr. Beaty. RESOLVED, that surplus funds of the Highway Fund -be appropriated as follows: 1. $1,152.86 to Item #3 Machinery Repair, thereby increasing appropriation from $12,106. 77 to $13,259.63 2. Transfer surplus funds in Item #4 as follows: Weeds & Brush $964.50 transfer to Item #4 Snow Removal, thereby increasing appropriation from #36,443.90 to #37,408.40. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster Noes - None 850 RESOLUTION OF THE TOWN BOARD REQUESTING LEGISLATION TO ESTABLISH A LOCAL HOUSING AUTHORITY RESOLUTION NO. 261, Introduced by Mr. Turner, seconded by Mr, Beaty. WHEREAS, the Legislature of the State of New York has enacted chapter- eight hundred and eight of the laws of nineteen hundred thirty-mine, known as the " Public Housing Law" and pursuant to Article 13 thereof, which provides for the establishment, organization, operation and dissolution of municipal housing authorities, and WHEREAS, it appears that the establishment of a municipal housing authority for the Town ** of Queensbury in the County of Warren would be in the public interest, now therefore be it RESOLVED, that the Town Board of the Town of Queensbury in the County of Warren, request the Legislature of the State of New York to create and establish for the Town of Queensbury in the County of Warren a municipal housing authority for the accomplisht of any and all of the purposes specified in Article eighteen of the Constitution of the State of New York, Duly adopted by the following votes Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster. Noes - None December 11, 1967 TOWN BOARD OF THE TOWN OF QUEENSBURY I hereby submit my application for the position of assessor for the Town of Queensbury for a term of two years, from January 1, 1968 to December 31, 1969. I have served the town in this capacity since January 1, 1960, with more than half of these years spent as chairman of the board. I have had experience in both real estate sales and appraisal -work in addition to almost eight years experience as an assessor. I have participated in nearly every training program offered by the New York State Department of Equalization and Assessments and the New York Assessors Association. I attended the most recent training program at Cornell University in July of 1967 sponsored jointly by the :University and the New York State Institute of Assessing Officers and successfully passed their examinations. If appointed, I intend to keep informed of current informa- tion regarding updated assessment practices, and to continue to discharge the duties of the office in a manner creditable to the Town of Queensbury. WHEREAS, the following applicant has made application to the Town Board of the Town of Queensbury for the renewal of their Junk Yard License for the year 1968, and said application has been accompanied by the proper license fee of $25.00 in accordance with the Queensbury Junk Yard Ordinance as adopted on June 9th, 1966: 1 NAME ADDRESS APPLICATION DATE — West Side Auto Parts Broad Street _ December 11, 1967 Glens Falls, N.Y. WHEREAS, the applicant has agreed to comply with all of the provisions of said Ordinance, therefore be it RESOLVED, that the Renewal of the Junk Yard License of the above listed applicant for the year 1968, be and the same is hereby approved, and be it further resolved that the Supervisor is hereby authorized and directed to issue said renewal license and deposit the fee in the General Town Fund. RESOLUTION NO. 263, Introduced by Mr. Turner, seconded by Mr. Robertson RESOLVED THAT, the Audit of Claims as listed in Abstract #67-12A numbered #11268 through #1331 and totaling $25,142.13 is hereby approved.
