WHEREAS, the Town of Queensbury (Town) wishes to enter into an agreement with the
Glens Falls City School District (School) regarding expansion of the School's bus garage facility that
currently exists at 31 Glenwood Avenue in the Town of Queensbury, and
WHEREAS, the Town and the School have negotiated specific details and come to agreement
concerning an expansion of the facility to include an approximately 20,000 square feet project site on
the adjacent parcel at 35 Glenwood Avenue in the Town, and
WHEREAS, a proposed Memorandum of Agreement between the Town and City is presented
at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves and authorizes the
Memorandum of Agreement between the Town of Queensbury and the Glens Falls City School
District regarding expansion of the School's bus garage facility located at 31 and 35 Glenwood Avenue
in the Town of Queensbury, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to
execute such Memorandum of Agreement substantially in the form presented at this meeting and any
other needed documentation, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Director of Planning, Zoning and Code Compliance and/or Town Budget Officer to take such other
and further action necessary to effectuate the terms of this Resolution.

MEMORANDUM OF AGREEMENT
between the
TOWN OF QUEENSBURY
and the
GLENS FALLS CITY SCHOOL DISTRICT
Purpose.
The purpose of this Memorandum of Agreement (MOA) is to advance the bus storage facility
project currently proposed by the Glens Falls City School District (School) and, at the same
time Town of Queensbury (Town) wishes to preserve and protect the neighborhood character
and provide adequate environmental protections.
Background
The School wishes to expand their existing bus garage facility at 31 Glenwood Avenue in the
Town of Queensbury to include development of an approximately 20,000 square feet area on
the adjacent property at 35 Glenwood Avenue in an effort to create a more functional facility
from which to operate their bus services.
The School has conducted research, and obtained determinations that there are no impacted
New York State Department of Environmental Conservation (DEC) wetlands and that the New
York State Office of Parks, Recreation and Historic Preservation, (SHPO) has no concerns
regarding the planned parking area.
The Town has reviewed the proposal presented by the School and finds the same to be
compatible with the objectives of preservation and protection of the neighborhood character.
The purpose of this MOA, then, is to codify the relationship so that future interactions are
enabled successfully.
Responsibilities.
The Town acknowledges that the proposal to expand the bus garage facility onto the property
at 35 Glenwood is an acceptable use, and finds that an exemption from a full Planning Board
Site Plan Review is warranted for this project, however, the Town reserves its rights to review
future projects on this property subject to any and all applicable Town of Queensbury Zoning
Code requirements.
The School agrees to provide detailed plans for the Stormwater Control improvements for the
development of the bus garage facility for compliance confirmation by the Town prior to any
site work. The School agrees to install and maintain the stormwater control devices in
compliance with all applicable Town of Queensbury and DEC requirements for the same.
The School further agrees to install and maintain the landscaping/screening shown on the
sketch dated , 2018 and entitled: XXX XXX XXX generally describing the
proposal and received by the Town from the School's legal counsel on , 2018
and more specifically described as 8-10 arborvitae trees a minimum of 4-6ft tall planted
approximately 4-6 ft apart. A copy of the sketch is attached as part of this MOA as Exhibit A.
The School agrees that both of these items will be maintained for the duration of their use of
the property. The School agrees that this project does not include the use or demolition of any
of the buildings on the property. If the School intends to use or demolish the "ice house
building"or any other buildings on the site the School will seek all necessary review and
approval from the Town prior to proceeding with any occupancy, use, construction or
demolition of said building(s).

The Town Point-of-Contact is the Town Supervisor, currently John F. Strough.
The School Point-of-Contact is the Superintendent of Schools, currently Paul Jenkins.

Duration ofAgreement.
This Memorandum of Agreement will be in effect for the duration of the School use of the
property. The Agreement may be terminated at any time upon written mutual agreement of
both parties.
