Supervisor Webster declared the public hearing open on the repeal of
an ordinance entitled "An Ordinance Regulating Dumps, Dumpifig and
Garbage Disposal In The Town of Queensbury" as"adopted on November 30,
1953.
The clerk presented proof of publication.
The clerk read the Notice as published in the press.
Supervisor Webster requested any appearances of persons regarding
the matter of repealing the oi-dinance in question.

The public hearing was declared closed at 7:40 p.m.

The Public Hearing on the adoption of the "Ordinance Regulating
Burning of Garbage in the Town of Queensbury" was opened by the
Supervisor at this time.
Supervisor Webster requested a voice from any, persons in favor or
in opposition to the adoption of the ordinance.
Mr. Clifford Witham was granted the floor. Questions were ad-
vanced by Mr. Witham as to the use of incenerators, as mentioned
in the ordinance.
Supervisor Webster -discussed the content of the ordinance in its
entirety. J
Mr. Witham stated that he is in favor of the ordinance with -
certain qualifications which would necessitate further study-.
• The Public Hearing was declared closed by the Supervisor at 8:00 p.m.
Mr. John Hallinan was granted the floor. A request was advanced
by Mr. Hallinan, that more protection for persons walking on the
bridge over Route 87 at Aviation Road be provided by either a
watchman or railings on the road-side of the walking area.
Mr. Clifford Withman again discussed the possible appointment of
a re-placement member to the Planning Board of the Town of 'Queensbury.
The minutes of the meeting of September 15th, 1966 were approved.

Dear John-:
I refer to our recent conversation regarding my status
on the Queensbury Town Planning Board, and reluctantly tender
herewith my resignation.
The fact of the matter is that I personally am most
interested in the future of the Town of Queensbury, just as you
and the Town Board are interested in seeing that it continues to
grow as a beautiful and attractive place in which to live._-

I also understand that there is a question as to the
validity of my being on the Planning Board in view of the fact
that I have` not as yet taken out my U.S. citizenship. It had
not occurred to me that this was a requirement, since to serve
on the Planning Board did not result in any remuneration to* a
board member, but rather required his being a resident of the
town and involving a sacrifice of additional time on his part.
I can certainly understand where it would be a requirement for
a paid servant of the town to also be a U,S. citizen.
In view of the fact that my not being a citizen, and
being a member of the Planning Board could result;,in possible
complications as to the validity of the proposed *ping ordinance,
I - like you - feel that I should withdraw from the Planning Board.
May I extend my every good wish for the future success
of the Queensbury Town Planning Board and to the Queensbury Town
Board.

ORDINANCE REGULATING BURNING OF
GARBAGE IN THE TOWN .OF QUEENSBURY
Be It Resolved and Ordained by the Town Board of 'the Town
of Queensbury, Warren County, New York, on this 22nd day of
September, 1966: -
Section 1. Legislative Intent. The open burning of
garbage on the surface of the ground, in pits or in trash burners
or barrels creates an offensive smoke and adors and results in a
residue of unburned garbage which decays and causes offensive
odors and. attracts flies, rodents and vermin, and is .a menace -to
public health and should be prohibited.
Section 2. Definitions. The word "person'? as used in
this ordinance shall include an individual, ° society, club, firm,
partnership, dorporation, municipality or association of persons
and the singular number -'shall include the plural number. r
The word "garbage" as used in this ordinance
shall include was foodT, fruit, vegetables, meat, dead -antmals,
birds or fish or parts thereof, or any kind of waste material
capable of fermentation or decay.
The word "incinerator" as used in this ordi-
nance shall mean a device or equipment designated -specifically
for the burning of garbage in such manner or means as to effect
complete combustion and burning 'of garbage leaving only an ash
residue. ti
Section 3. No person shall burn, cause to be burned or
permit to be burned in the Town of Queensbury'any. garba.ge by open. _
fire, on the .ground .or. in trash burners or barrels or in pits.
Garbage shall -be disposed of in the Town of' Queensbury by deposit-
ing the same in°the_ town . dump under and in accordance with the
rules and regulations governing the use of the town dump or by
burying the same in the ground and covering the same with at least
four inches of soil .or by Eurning the same in incinerators so
made, designed, constructed and operated as to result in complete
burning with only an ash residue. j
Section 4. Penalties. A violation of any of the provisions
of this ordinance shall be,a misdemeanor and upon convistion 'thereof,
such persons shall be subject to a fine 'of not more than, $100.00 or
imprisonment for a period of not more than thirty days orboth.
Section 5. This ordinance shall take effect ten days after
its publication and posting as required by the Town Law.

Supervisor Webster reported on a meeting which he and Councilman
Beaty arranged with residents of Farm-to-Market Load in the vicinity
of the location of the proposed Transit Mobile Home Park. A
recommendation was made by the Supervisor that action should be tabled
at this time on the granting of the permit.

Councilman Robertson agreed that ,thegrantingf the permit should
be delayed until such time as town-wide zoning is ready for final
adoption.

Re: Kattskill Bay Residential Area

The Town Board held a public hearing last week on the Proposed
ordinance establishing the Kattskill Bay Residential Area and you
have tcsld me that some questions were raised atrthe hearing. .
As V recill it, one question was whether if a building used
for a non-conforming use at the time of the adoption of the ordinance
were to burn or be destroyed or razed by the owner, would -that
prevent the erection of a building to replace the former building.
The Kattskill Bay ,ordinance is the game''as the A:s'sembly'POint,
the Plum Bay and Cieve:'rdale ordinances and none of them specifically
cover this point.
This. 9rdinance, like the other ordinances, relates only to use
of property and not to a particular building. If a 'building devoted
to a non-conforming use is burned or destroyed or torn down �and `is
replaced 'within a reasonable time with a building of the same size
for ,,the .same_use? there is no question that the owner could do so as
a matter of right. If a s"mall building were destroyed''or removed,
and 'the owner wanted to build a larger building on the same -or
different site on the property, he would then have to make application
to the Town Board under Section -5 of' the ordinance. ' Also, if the owner
wanted to grange the `non=conforming use to a different one, he would
have to apply to the Town Board. j
I believe a 'question was also raised as to the° last portion of
Section 6 which provides that the Town Board may apply to a court
to restrain and enjoiii 'a` threatened violation. I believe that a
Town Board has the right to seek injunctive relief without this
provision but `this does make it clear that the Town Board has re-
served that right. " Without this provision, the Town Board would-have
to wait until the owner had completed his building and commenced a
commercial use before he could be charged with a violation. When an
owner has invested a lot of money in a new building, even though he
did it illegally sand unwiselq under the ordinance, a Court-might be
reluctant to impose a severe penalty, especially where under your
building notice ordinance you would have knowledge of the construction.
The fair thing to do is to stop a threatened' violation bytcourt
action.
These residential area ordinances will be superseded by your
general town zoning ordinance whenever they are in conflict.

1WHEREAS, the petiiion' for the 'establishment of a'residential area to
be known as the Kattskill Bay Residential Area pursuant to Article 13-C
of the General Municipal Law was approved on August 25, 1966, and a
public hearing was duly held by the Town Board on September 35,. 1966,
on the matter of the adoption of a proposed ordinance to �establish said
residential area,

Be It Enacted and Ordained by the Town Board of the Town
of. Queensbury, Warren County, New York, as follows:
Section 1. The word "person" as used in this ordinance
shall ,-include an indvivdual; society, ,club, firm, partnership,
corporation or association of persons, and the singular number
shall include the area. The words "residential area" shall have
the meaning intended and provided by Article 13-C of, the General
Municipal Law. The legislative intent in the adoption of -the
ordinance shalf be as set forth in. Section 280 of the General
Municipal Law.
Section 2. Pursuant to the provisions of Article 13-C
of the General Municipal Law, there is hereby established a
residential area in that portion of the Town of Queensbury wholly
within the Lake George Park bounded and described as follows:
"Beginning on the easterly shore of Warner Bay at
-the southwesterly corner of lands of Richard Paler;
running from thence in an easterly direction along- the
southerly bounds thereof to the center of Pilot Knob
Road; thence running southerly along the center of
Pilot KNob Road to the intersection of the same with
the center of New York State Highway number 9-L; thence
running in a southerly direction along the center of
the said State road to a point therein where
the same is intersected by the extension westerly of
the southerly bounds' of the lands of Murray Crannell;
thence running easterly to' the southwe-sterly corner
of the said lands of Murray Crannell; thence running
easterly along the southerly bounds of the landsbf
Murray Crannell to the southeasterly corner thereof
and continuing the same course easterly to .the Warren-
Washington County line;` thence running northerly along
the said county 1ine. until it reaches the shore of
Lake George; thence running southerly along the shore
of Lake George to the- point and place of beginning."
Section 3. On and after the effective date of this
ordinance, no person shall use any real property or the buildings
and structures thereon `within the boundaries of the aforesaid
residential area for any industrial or commercial purpose except
that any residence within the said residential area may be leased
or rented for singki ,private family residential purposes, but
this ordinance shall not apply nor prohibit a non-conforming use
in existence at the time of the effective date of this ordinance.
Section 4. If the Town Board of the Town of Queensbury
shall hereafter adopt and enact a general zoning ordinance for the
entire Town of Queensbury and any provisions of such general zoning
ordinance relating to the use of real property in the said resi-
dential area established by this ordinance shall conflict with or
be inconsibtetit with any provision of such general zoning ordinance,
�--' the provisions of such general zoning ordinance shall supersede the
provisions of this ordinance and shall govern the use of such
property.

Section 5. The Town Board of the Town of -Queensbury
shall have the power to grant a proper and appropriate variance
from this ordinance to authorize or permit a necessary or desirable use
of land or prevent unnecessary hardships in an individual or parti-
cular instance. Such variance shall be by resolution adopted by
an affirmative vote of a majority of the total membership of the
Town $oard and a variance shall be granted only after a public
hearing. Notice of such public hearing shall be published once
in the official newspaper and posted on the bulletin board of the
Town Clem. Such notice shall contain the name of the owner of
the property for. which a variance has been reguested, •a sufficient
description to indentify the particular property for which .a
variance has been requested and a concise statement of the parti-
cular proposed use for which the variance has been requested.
The application by. an owner to the Town Board shall -be by written
petition which shall contain the foregoing information.
Section 6. A violation of this ordinance shall be an
offence punishable upon conviction by a fire not to exceed One
Hundred Dollars or imprisonment for not to exceed sixty days, or
both, and each cendar week' s continued violation shall consti-
tute a separate additional violation. In addition to the fore-
going penalties provided for a violation of this ordinance, the
Town Board of the Town of Queensbury shall have the right to
apply to any court of competent jurisdiction for an order to
restrain and enjoin any proposed or threatened violation of this
ordinance.

WHEREAS, as required by Section 237 of the Town Law, the Town Board
has completed and filed with the Town Clerk the benefit assessment
rolls for the Queensbury Drainage District, the Reservoir Park
Sewer District and the Pershing-Ashley-Coolidge Sewer District and
extensions covering the expenses of those special districts in the
Town of Queensbury for the 1967 fiscal year, be it
RESOLVED that the Town �Board of the Town of Queensbury hold a
public hearing on said assessment rolls at the Queensbury Junior
High School on the 6th day of October, 1966, at .8:00 o'clock, at
which time the owners of real property in any of said districts
'may make objections to their respective assessments, and be it

directed to give notice of the filing of said special district
assessment rolls once in the Post Star and Glens Falls Times at
least ten days and not more than twenty days prior to the date

T. Hay and the Gity' of Glens Falls to convey lands to.the- Town of
Queensbury for a roadway to be known as Thunderbird Drive, conditioned
upon a payment held in escrow from Lewis Parsons to guarantee the
completion of"certain work remaining on the right-of-Vay,

RESOLUTION N0. 236, Introduced by Mr.- Robertson,, seconded by Mr. Turner
WHEREAS, Oliver A. Laalsso, of 2 Buena Vista Ave. , Town of Queensbury
and Nils Klykken, 13 Garrison Road, Town of Queensbury, have
' executed and offered three deeds to convey to.nhtheo0ld Orchardssuby
to convey a portion of the streets and roads a�
division, as shown on the map of 'the subdivision dated July 1965
and approved by the Town Planning Board on August b, 1965, said
roads being all of the extension of Wincrest Drive., all of the
extension of Oakwood Drive, all of Apple Lane., and a portion of
Orchard Drive, and
WHEREAS, this subdivision has been approved by the Town Planning Board,
and
WHEREAS, Bernard J. Codner, Superintendent of Highways, has advised
this board that he recommends the acceptance of these streets into
the Town Highway system, and
WHEREAS, Thomas K. Flaherty, Superintendent of the Queensbury Water
District, has advised this board that the estr mains the have
installed completely with hydrants, acceptable
RESOLVED, that subject to the approval of County Attorney, Albert E.
Beswick, the deeds, as above described, be and the same are hereby
accepted and approved and that the Town Clerk is hereby authorized
and directed to cause said deeds to be recorded in the Warren County
`— Clerk' s Office and then filed in the office of the Town Clerk,
and be it further
