1966-05-26 R Regular Meeting May 26, 1966 Present: John 0. Webster Supervisor N. Harwood Beaty Councilman Theodore Turner Councilman Curtis Lampson (absent) Councilman Hammond Robertson, Jr. Councilman The meeting was called to order at 7:30 p.m. by the Supervisor. Supervisor Webster greeted the following visitors: Mr. & Mrs. Albert Palmer - Visitor Mrs. Calista Conley - Visitor Mr. James Dempsey - Visitor Mr. Robert Sanders - Visitor Mr. Charles Sanders - Visitor Mr o Floyd Bombard - Visitor Mr. Gordon Stockman - Visitor Mr. Donald Stockman - Visitor Thomas K. Flaherty- Superintendent of Queensbury Water District Bernard J. Codner - Superintendent of Highways Mrs. Albert Palmer was granted the floor. Mrs. Palmer questioned the Town Board as to the plans of the Town of Queensbury to control the -expansion of Junk Yards within the town. The depositing of obsolete cars, trucks and applicances on Rhode Island Avenue was the nature of the complaint as presented. Supervisor Webster stated that at a later time this meeting there will be a -public hearing on the proposed ordinance which will ultimatly control the operation of all types of junk yards. Mrs. Florence Mcllvaine reporter for the Post Star visited the meeting at this time. The Public Hearing on the proposed revised "Junk Yard Ordinance" was declared open by Supervisor Webster at 7:35 p.m. The clerk presented proof of publication of the notice. The reading of the notice was dispensed with at this time. Upon the request of the Supervisor, the clerk read the ordinance which has been prepared up to this date. Mr. James Dempsey questioned the Town Board on the fact as to whether the junk yards in operation at present will be controlled by the by the proposed ordinance. Mrs. Calista Conley inquired as to what action will be taken against yunk yard operators who are operating at present. A letter7of comment from Attorney Glen A. Caffrywas read by the clerk. The nature of the letter was to suggest changes in the wording of the ordinance as to distance from buildings, color of paint to be used on the fence, offense for failure to comply and restrictions on burning within the junk yards. Mr. Robert Sanders was granted the floor. Mr. Sanders discussed the control of burning at junk yards. A statement was advanced that the ordinance should spell out when burning should take place. Mr. LeRoy Phillips, Chief of Police visited the meeting at this time. 436 Supervisor Webster discussed the necessary changes within the Town of Queensbury which result from the expansion of residential areas as the years progress. The Supervisor stated that du e to the extensive growth within the town; the residents must care for the up keep of their property to comply with the natural growth of the Town of Queensbury. Members of the Town Board advanced the question as to the height of the proposed fence to enclose junk yards. Opinions were advanced, that the height. of & feet would not hide stacked cars within a junk yard. Mr. Donald Stockman questioned the color -of paint to be used on fences for junk yards. A statement was advanced by members of the Town Board that a proper color will be arrived at to conform with surroundings of the junk yards. Mrs. Calista Conley questioned the Town Board as to what possibility a junk yard operator would have in the neighborhood of a residence to secure a junk yard license under the proposed new junk yard ordinance. The Public Hearing was declared closed by Supervisor Webster at 8:30 p.m. Supervisor Webster summed up the results of the public hearing. Mr. Webster stated that all questions and suggestions of the visitors will be considered when the final ordinance `is readied for adoption. The minutes of the meeting of May 19, 1966 were approved. Carried ,unanimou sly. Supervisor Webster reported that an agreement has been reached by Mr. Fred Alexy and Mr. Donald Pensel on the question of relocating the highway at Dunhams Bay. The clerk read ,the following resolution as received by him. Whereas: It has come to the attention of the Warren County Pomona Grange that the individual rights of the property owners and citizens of the Town of Queensbury are in jeopardy and likely to be violated by the proposed zoning ordinance now in the process of being studied and prepared ,by a committee on zoning for adoption by the Honorable Town Board of the Town of Queensbury: Now, therefore, be it resolved that Warren County Pomona Grange meeting in regular session this 20th day^of May, 1966; do support the announced purposes of the North Queensbury Council against extremism in zoning for the Town of Queensbury; Furthermore, we know that sections of the zoning ordinance or law such as the requirement of two acre plots for home owners, the prohibition against rebuilding in certain instances, the probition against commercial and, light industry in certain areas where it appears to be restricted under plans; are now, and will in future be to the detriment of the town and it' s citizens; We, therefore, urge the committee on zoning to hold many public hearings and request the Town Board of Queensbury to hold up the adoption° of any zoning ordinance or law until they are sure that it is understood by the citizens of the Town and acceptable to the majority of the residents. Russell Harris George Smyth Curtis Harris A letter was read by the clerk which explained pertinent facts to do with the application of Joyce Baker Perry to locate a mobile home in the Town of Queensbury. Councilman Robertson reported on the activity at present of the Inter-municipal Joint Public Water Survey up to this date. Superintendent of Highways, Bernard J. Codner recommended the acceptance of the highways within the Twicwood Subdivision pending the receipt of the proof that Montray Place is a town ,highway. Mr. Codner also recommended the acceptance of an easement for a turn-around on John Clendon Road. - Thomas K. Flaherty, Superintendent of Queensbury Water also approved the acceptance of Twicwood and Clendon Road from the standpoint of water service. RESOLUTION -TO AMEND AUDIT OF CLAIMS RESOLUTION NO. 124, Introduced by Mr. Turner, seconded by Mr. Beaty. WHEREAS, Audit #483 as approved under abstract # 66-5 dated May 12, 1966 in the amount of $40.37 appears to be a duplicate of an item already paid under audit # 378 dated April 14, 1966, and therefore should not be allowed, RESOLVED, that payment of Audit # 483 is not allowed, and that the total amount of abstract # 66-5 is hereby reduced by the amount of $40.37. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Robertson and Mr. Webster Noes = None Supervisor Webster discussed the purchase of a poloroid camera for use of the several departments within the town. Following a report of the quotation of the cost of the item, the town board members agreed that the purchase should be made. A discussion to do with the purchase of a postage meter for use in the new town office building took place at this time. M Supervisor Webster advised the Town Board that the application as received to locate a mobile home on Bay Road has been cancelled. Mr. William Stephenson was the applicant of record.
