We do have a variety of letters, all of which, I think are in support. One from Carol Hunt. One from Lorraine and Bob Carbognin. One from Pete Sherman and Sharon Adamo. You want to tell us a little bit about it. DENNIS MACELROY, ENVIRONMENTAL DESIGNS-I am representing Scott and Jane Dubin the owners of the property of 11 Sunset Lane. As explained, it is a request for a replacement wastewater system that would involve a variance for the field. The absorption field area that is situated in the back area of the property it would be two feet from the property line. We looked at a number of different locations for the potential field. This is in combination with the use of the Clarus Enhance Treatment Unit replacing the septic tank. We have an enhanced treatment going to a new raised field area. This is sort of a natural area adjacent to the REGULAR TOWN BOARD MEETING 09-24-2018, MTG#37 197 neighbor's property that has a retaining wall so this is just simply built out from that and sloped down to the native grade. It seemed like a good solution for a replacement, which is oftentimes the most challenging part of these variances or redesigns is finding the place for the absorption field to go so that we are away from the lake or neighboring wells. In this case, the lake does not come into play. There are neighboring wells and their own well that allows us to stay more than a hundred feet in this particular location. SUPERVISOR STROUGH-Town Board questions for Mr. MacElroy. COUNCILMAN ATHERDEN-I just have one question out of curiosity. Is there normally when you do the Clarus System is there normally like a UV light that is attached? MR. MACELROY-I wouldn't say normally. It is something that you can do. I know that they have used in some instances in the Dunham's Bay properties. In those cases not ones that I have been involved with, but in most cases they are not going to a new field. They are tying into whatever exists in place now. I think that was done sometimes. It is just a little more assurance that there is additional treatment. In this case, I don't feel that it is necessary. SUPERVISOR STROUGH-Anybody from the public like to speak to this variance request. PUBLIC HEARING OPENED DEPUTY CLERK O'BRIEN-Read the following letters into the record. Dear Sir or Ma'am, I am in complete agreement with the variance necessary for the Dubin sewage disposal. I have every confidence that Scott Dubin has made every effort to ensure an absorption field that will take care of their wastewater and not harm the lake. Scott Dubin and I have worked together for many years on lakefront plantings to absorb storm water runoff to limit runoff from entering the lake. He is very aware of the importance of proper wastewater disposal. His family has been neighbors of ours for almost 60 years. They have been very actively involved in a variety of ways to keep Lake George water clean and healthy. Again, I support the variance necessary for their new wastewater system. Our back property line abuts the Dubin property line, adjacent to the proposed site of their new septic field. We understand that the Dubin's require a side yard setback variance from 10 feet down to 2 feet, to enable optimal location for their system. We trust that the town engineer has done his diligence to ensure that this project would have no negative impact on our existing septic system and existing leach field, which his 10 feet from this property line. We take no issue with this project and encourage the board to approve it, as the ultimate goal for all is to protect the environment and our lakefront. An absorption field more than fifty feet from the lake. It is a Clams Fusion 800. It is a five bedroom. They are asking for one variance. An absorption field with a new system be four feet from the property in lieu of the ten foot required setback on 20 Bean Road. We have a public hearing tonight on this. Mr. MacElroy is there anything that you wish to elaborate. DENNIS MACELROY, ENVIRONMENTAL DESIGN-This is a case where the owners feel they want to upgrade and replace an old system to serve the five bedroom primary house on the property. We looked again in several locations did test pits and whatnot to try to find something that was more suitable than the existing area. Tucked up in the upper corner of the property is an area with some soil. The limiting condition is rock that is one of the reasons we are proposing the Clams system enhance treatment. The new field area will be raised so we will import some additional better soil on top of the native soil. Then have enhance treatment effluent going to that field. It is two hundred and thirty feet from the lake. It is much further away from the lake. It is much further away from the lake it is a much better situation than currently exists. It does require a setback variance to the property line. It is four feet verses the ten feet that is required. We have had discussion with the nearby neighbor. I think you will see a letter from them in support of the project. I feel good about this solution for the replacement system. We have reviewed the plans with both Scott Severance and his engineer, Dennis MacElroy, and have no issues with the proposed variance requesting a minimum of 4' versus 10' setback from our property line as it is currently proposed location. I am going to apologize; I just need you to explain a few things to me.I retired from municipal government so I worked for people like you. I was Superintendent of Recreational Parks. We had a lake under my jurisdiction. It was opened to the public. I am under the impression that Glen Lake is opened to the public. SUPERVISOR STROUGH-Yes. We have public access there for canoe and kayak use. MS.PETERSON-So why is it that the people who live around the lake have to pay for it when everybody gets to use it? SUPERVISOR STROUGH-The Town Board puts in a fair amount. REGULAR TOWN BOARD MEETING 09-24-2018, MTG#37 209 MS.PETERSON-I understand that. Why isn't it spread the whole bill spread amongst the whole Town? We didn't make certain people pay that lived around the lake. We made everybody in the whole Town of Clarkstown pay for the aquatic work that we had done. It was done between the DEC and the Recreation and Parks Department. Then when we went onto different companies, we worked directly with them. Our Town was much bigger. It was eighty five thousand people. I am not sure how big Queensbury is. I am just a little confused. You know you are used to doing it one way. We are used to doing it a different way. I just wanted a clarification. SUPERVISOR STROUGH-First of all it is a district. A regional management entity that has to have a defined number of entities that are in it. We use units. They divide these units differently for these different districts. If you live on the lake, it might be one unit. If you live off the lake, but have lake rights it might be a half a unit. The Town of Queensbury owns several properties on there. I was looking real quick,but I didn't expect this question. I think we are the largest contributor. Paul Derby are we the largest contributor here? PAUL DERBY-Yes. SUPERVISOR STROUGH-So we are the largest contributor. MS.PETERSON-What about the Great Escape? A lot of water comes in through the Great Escape and that is where we have a lot of problems. I was under the impression they are not part of the special district. I do not understand why. SUPERVISOR STROUGH-When they set up the district years ago, they were not included for whatever reason. MS.PETERSON-Can that be changed? Just because a mistake might have been made, do you think we could look into correcting it? SUPERVISOR STROUGH-It can be. MS.PETERSON-And... SUPERVISOR STROUGH-You have an Advisory Board. Have you been part of that? MS.PETERSON-Yes I have.I have gone to the meetings. SUPERVISOR STROUGH-Has the Advisory Board not as an individual, but has the Advisory Group made any recommendations to add that entity? MS.PETERSON-They said they would ask. I do not see why the Great Escape would volunteer to be part of a tax district if they are not already paying.I would think that would have to come from the Town. SUPERVISOR STROUGH-Right. I think the original definition was that those who are on the shoreline or benefit from the lake by having a deeded access to the lake were the ones that were the targets. That did not include the Great Escape by that definition. MS.PETERSON-The water does flow under the trail into the lake. SUPERVISOR STROUGH-And it flows from Rush Pond. It flows from the mountain. You can make the argument that all those people should be... MS.PETERSON-The Great Escape does have a large water situation going on over there. A discharge. I am just looking at it from a fresh set of eyes that's all. SUPERVISOR STROUGH-That is all right.It is appreciated. MS.PETERSON-I feel like I am back at work. Thank you very much. SUPERVISOR STROUGH-Thank you. That is something the Advisory Committee can take up, right Paul. Anybody else like to speak to this? MIKE MASHUTA,41 BIRCH ROAD-I have lived there for more than fifty years now.I noticed that this past year that the aquatic invasive plants both pondweed and milfoil are far worse than they have ever been. All of the treatment was done at the beginning of the year. They completely eradicated the milfoil. The milfoil is completely back and a second invasive is in there the pondweed. It has actually choked out several pieces of property already. It might be directly related to sewage difficulty. Some of the places that are really old have the worse pondweed. I don't know if there is a direct link, but we have the largest problem on our hands in fifty years with the decreased volume flowing in through the inlet. Just the total number of invasive plants volume metrically. We went from being the cleanest clearest lake two or three years ago.It is something that is really on the borderline of devastating for some homeowners at this point. I just want to advise the Board of that condition. REGULAR TOWN BOARD MEETING 09-24-2018, MTG#37 210 SUPERVISOR STROUGH-Well I am probably as familiar with that lake as you are maybe more so. MR.MASHUTA-I am on the lake every day. SUPERVISOR STROUGH-Well I kayak it almost every weekend. MR.MASHUTA-Good. SUPERVISOR STROUGH-I am usually up early when not too many people are out. I caught Paul one day. I caught Jim Underwood last week. In overall, it is much better than it was ten years ago. I did see the pondweed more so than I have in previous years. Especially at the mouth of the inlet,the milfoil was stronger than I would like to see it. Let me tell you that we do a survey of our actions that we did this spring. We try and determine the effectiveness for management plans. Maybe you don't know, but Paul Derby, Paul McPhillips and I worked with the DEC and we will probably be starting this in January,February. We sit down with Solitude who is your management company at least for chemical applications. Paul works with others as well. I don't work with them directly.We work out a management plan. This summer it was unusually hot so we saw the growth of these invasives to a greater degree than we like to see. Keep in mind we are never going to get rid of the invasives. As a matter of fact, there is one member of the DEC that we work with on the management team who believes that invasives are here to stay. What we are going to do is try and manage them. You want some of the invasives because they are plants and do provide a kind of environment for the fish and the other animal life that depends on a variety of vegetation. We did even plant some native vegetation this time around.We will see how that works,too.That will be part of our team. When we sit down in January and February, I am sure that Paul Derby or Paul McPhillips would enjoy having you come along with us. If you want to speak to the management program, we try and deal with the DEC. The DEC is trying to down play chemical use, which is a powerful way of controlling some of these invasive species. They would rather see us use mechanical means. We have been trying to wean ourselves off the chemicals and go to the mechanicals to assess what we are doing. Every year we assess what we did the previous spring and during the summer with the mechanical harvesting, the suction harvesting and see what was effective. The management program goes on and I am sure Paul will invite you to be part of that if you are interested Mr. Mashuta. MR.MASHUTA-I appreciate that John. I have been involved for the past three years. SUPERVISOR STROUGH-Very good. MR.MASHUTA-Things are going very slowly. I think January,February is far too late to plan for next year. I think the kayak view of the late is limited. That is why it took Solitude, and Paul, and everyone else to go around on a pontoon boat and New York State to look at the areas. It really has never been... Thank you. SUPERVISOR STROUGH-Any other member of the public like to speak to the Glen Lake Aquatic Plant Control District Benefit Tax Roll. PAUL DERBY, Chair of the Advisory Committee-Just to clarify a couple points. Of course,you know John you and I have sat at those meetings of the DEC. It is always a balancing act. We put out a management plan and then they will let us do this or that. What happen with the... pondweed that came back this year is that someone at the DEC wanted to see more of those plants there. We used an herbicide that had no effect on the pondweed so we did see a very big rebound this year. It was eleven years ago we had to do a whole day treatment because the milfoil and pondweed was very bad. I am fearful depending on what we are able to do next year how we might be in that situation again. We will go to the DEC and take folks with us. We will do the best we can to manage. We had seven weeks of hand harvesting this year for milfoil. We also did spot treatments in the inlet,the outlet and some other areas. They had some control,but that inlet has been annually pesky. We are going to have to keep managing that to keep it under control. SUPERVISOR STROUGH-Anyone else? KATHERINE BRASS-9 MERRY LANE,LAKE GEORGE ON GLEN LAKE-We lived there fourteen years this year. This is one of the more significant years that we have had in terms of the pondweed.... We have had other years where it has been quite significant. We hand harvest in our area to keep swim area clear for our grandchildren. We have a pontoon boat. We are out every day on the boat...we take a look around. It is not just in the inlets this year.It is pretty much through the body of the lake. I know we have a taxing district. I support the taking district. We support the chemical treatment. Hand harvesting if it works. I am sure they worked really hard at doing that this year. We would tell you it didn't look very effective. I had harvested, I did it five times almost every couple of weeks. You cannot keep up with the pondweed. You cannot keep up with the milfoil. I don't think that the mechanical means are particularly effective with the proliferation that we have. I would like to see them at least consider as part of the process I know that Paul Derby will probably take care of that. I would just like to make sure that people are noting and trying something more than just the mechanical means that is not always effective. REGULAR TOWN BOARD MEETING 09-24-2018, MTG#37 211 SUPERVISOR STROUGH-Katherine I understand and we will. MS. BRASS-From a taxing district I think that it is good in getting everybody to participate. I think the chemicals work better. I am all for hand harvesting in a limited way, but I don't think you can hand harvest Glen Lake. SUPERVISOR STROUGH-We will make that argument as we always do to the DEC. MS.BRASS-I know.I just feel maybe it helps if we put it on record it will make next year better. SUPERVISOR STROUGH-It does. Any member of the public wish to speak to this. PUBLIC HEARING OPENED BOB HUNTZ, SUNNYSIDE LAKE-I live on Sunnyside Lake. I am the President of the Lake Sunnyside Protective Association. We really are happy with our tax district. That we have it, that we have the funds available to be able to keep the lake in good shape. Some of you may remember four or five years ago, you could see islands in Lake Sunnyside that were milfoil. That grew to the surface and they covered probably twenty five percent maybe a little more than that of the entire lake.Now you don't see that. The lake is clear. We did a chemical treatment a number of years ago that was before we had the tax district. We decided that we would not use any chemicals again. We didn't want to anyway and we haven't. We have gone to harvesting the invasive plants that are in the lake. Harvesting, of course,is more expensive than chemicals,but certainly, it is safer. We do have a management plan; of course,you never know what the future holds. We have plenty of money in our tax district now. It has been raised over the past five years. A bit of it has been expended. In fact,next week there will be harvesters on Lake Sunnyside. They were here in the spring. They are back now to clean up any milfoil plants that may have sprouted up over the summer so that we can keep that under control. The future threats...who knows what the future holds. There are a lot of concerns around New York State about hydraulic, which has been an invasive plant in Florida for many years. It has inundated the lakes in Florida and now they are finding it in New York State to some degree. We hope that doesn't arrive at Sunnyside Lake. Of course, I hope it doesn't get to Glen Lake, also. Other kinds of threats are algae blooms. You hear a lot about harmful algae blooms around the State. You need to take steps to try to prevent that. There is also curly leaf pondweed,which Glen Lake is concerned with. We have some of that in Sunnyside. We did harvest some of it this spring. It can only be harvested in the spring because in the fall that pondweed dies down. We also have another weed in Lake Sunnyside.It is called broad leaf pondweed,which almost looks like a cabbage plant. That is a native weed. It is not invasive species. If it gets beyond control then you need to harvest that as well. We have taken a look at our finances and feel that we are in excellent shape. We had a meeting of the Lake Sunnyside Association and a meeting of the Advisory Committee for the tax district. The Advisory Committee was unanimous in deciding to cut our tax rate in half for next year since we do have a surplus. The Association we discussed the same thing a vote was taken and all of the members present, which there were probably close to thirty people present. All but two voted for cutting the taxes in half. One of the two people who voted against that motion said she voted against it because she thought we should keep it at the present rate and not reduce it. The other vote was to reduce the tax rate, completely eliminate it. We think we are in good shape for the future. We will have when we pay our bills for this year it will probably be close to sixty thousand dollars in our account. All of our bills have been paid. We paid back the Town for the help they gave us when we set up the district. The harvesting is starting next week. It will take a week or two. We will be able to pay that. With the funds that will be raised with the half fifty percent taxes for next year will probably get us up to seventy, seven five thousand dollars. Why that number. That is the number we have because of five years ago when we were inundated with milfoil. We had someone come in and do an estimate of what it would take to harvest the whole lake when it was so full of milfoil. That figure was seventy five thousand dollars. We do not want to be caught short and not be able to do the things that need to be done to keep the lake clear. We feel we want to keep that amount there. Of course, next year we can consider our taxes again. If we need to lower them further or raise them depending on what happens over the next year. We thank the Town for allowing us to have a tax district. The people who work for the Town that we deal with in getting bills paid are excellent,very cooperative with us.It is a good operation. SUPERVISOR STROUGH-I think it is Bob. Thanks to your leadership,it has been a very successful program Lake Sunnyside better than ever. Anybody else like to speak to the Lake Sunnyside Aquatic Plant Growth District Benefit Tax Roll. GENE CASELLA-LAKE SUNNYSIDE-The only reason that I am talking Bob just mentioned that two people did not agree. One wanted taxes to go up. One wanted no taxes. I am the one that wanted no taxes. The REGULAR TOWN BOARD MEETING 09-24-2018, MTG#37 213 reason why is because we have seventy thousand dollars in the kitty as he just mentioned. Our bills this year for the lake weed pulling and that sort of thing was around eighteen thousand dollars. We have about seventy thousand dollars left. I just think that right now my concern is we just want through a major reassessment in the Town. SUPERVISOR STROUGH-We constantly do.We stay at one hundred percent. MR.CASELLA-Mine went up fourteen percent. I am very concerned about taxes right now. The fact that my taxes are going up as much as they are. I just got my school tax. We have the lake that we have to be taxed for, too. I just thought and I agree with Bob by the way. If that is what everybody around the lake wants,just half of the past last tax bill then that is fine. I was hoping that we would have nothing for this year get a break for one year. It really is annoying that you have thirty people as Bob mentioned around the lake.Thirty residents that make the meetings if we make that many;really,it is around twenty that come to thirty people. There are eighty homeowners or property owners around the lake. There are only thirty people coming all the time. The thirty people that come are the people that are very happy with everything. I am the one voice crying wolf that is saying let's try to keep our taxes down. Anyway, I am not complaining about anything. All I was hoping was is I thought,I might ask you a question of Bob and I did not get a chance to talk to him. Years ago...used to pay for our lake and it wasn't very much. I should not say it was not very much. It was a nice amount of money that you paid. I just thought that in the light of the reassessment and the new taxes that we are all being charged. All we are going to be taxed is about half of what we have been taxed this past January. We are only talking about twelve or thirteen thousand dollars. How about forgiving us for one year that is my question. I really did not want to come up and ask you that. Since he said there is one person who is against paying the taxes. I am not happy with paying any more taxes to clean the lake especially when there is seventy thousand dollars in the till and it is only costing us twenty thousand dollars a year. ERIC SAGE, 140 SUNNYSIDE NORTH-I appreciate very much what Gene Casella had to say. I have a lot of respect for him. He has been a dedicated member for PALS for many years. He has done a lot of efforts to help us out. I will say I am an Environmental Scientist. I have been studying the Lake Sunnyside ecology for many years especially with the invasive species. When we decided on presenting the next year's tax district of about fifty percent. The reason why we are looking at sustaining roughly seventy thousand in the budget is because there is so much uncertainty with the different types of species that we are facing. It is very possible we could get blasted with a thirty or forty thousand-dollar bill next year. At the meeting what we did we explained all the circumstances that we are facing. We presented this to as many people that possibly attend the meeting. This way they were able to make the most informed decision about what is the best solution what should we set for a tax district. So we decided to go with fifty percent. The vast majority of people understood why we made that decision. SUPERVISOR STROUGH-Yes Eric you and I talked before now I remember. It is a great family event. It always helps raise money for a lot of the local not-for-profits. COUNCILMAN GEORGE FERONE(WARD III) • On Friday,September 28,2018,the Ben Osborn Golf Tournament will be held at the Top of the World Golf Course this is to support the Ben Osborn Memorial Fund. COUNCILWOMAN ATHERDEN(WARD II) • It is climate week in New York State. There is much everyone can do to reduce their carbon footprint. You can visit dec.ny.gov and find out all sorts of information. Southern Adirondack Solar Campaign there are two more events.One is in Chestertown tomorrow at the Ice Cream Parlor from five to seven. COUNCILMAN METIVIER(WARD I) • Spoke regarding a resident who approached him before the meeting tonight regarding not having responded to an inquiry regarding crosswalks, noting he did not know how to respond to it. I feel crosswalks invite ignorance of people who feel they have the right-of-way.They will step out in front of cars even when cars are speeding at them.It creates a very dangerous situation. Spoke to the Board regarding the number one complaint in the Town,which is speeding.This is a problem in any area that you live in. If anyone that is listening tonight can come up with an idea that actually would work to slow people down we are all about it. SUPERVISOR STROUGH • Spoke regarding an article in the Post Star regarding changes to propose local law rejected,noting it is not true.
