A RESOLUTION AUTHORIZING THE CONSTRUCTION OF IMPROVEMENTS
TO SERVE THE BAY ROAD WATER DISTRICT IN THE TOWN OF QUEENSBURY,
WARREN COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF
$3122000, AND SUTHORIZING THE ISSUANCE OF NOT EXCEEDING
$296,000 SERIAL BONDS OF SAID TOWN TO PAY A PART OF THE
COST THEREOF.

WHEREAS, the Town Board of the Town of ,Queensbury, Warren .
County, New York, by proceedings duly had and taken p4rsuant to
Article 12-A of the Town Law, has duly established the Bay Road
Water District in said Town; and
WHEREAS, it is now desired to provide for the financing of
the construction of improvements in said Water District; NOW THEREFORE,
BE IT
RESOLVED, by the Town Board of the Town of Queensbury, Warren
County, New York, as follows:
Section 1. The construction of improvements to serve the
Bay Road Water District in the Town of Queensbury, Warren County, *
New York, is hereby authorized at a maximum estimated cost of
#312,000. Such improvements shall consist of the construction
and installation of mains to be connected to the water supply of
the existing Queensbury Water District, the installation of pipies,
hydrants, valves and other appurtenances and equipment, substantially
in accordance with the map, plan and report prepared by Joseph A.
Kestner, Jr. , a licensed engineer.
Section 2. The plan for the financing of such maximum estimated
cost is by the issuance and sale of not exceeding $296,000 serial
bonds of said Town, hereby authorized to be issued- therefor pursuant
to the Local Finance Law, and the balance thereof from available
current funds.
Section 3. Subject to the provisions of the Local Finance Law,
the power to authorize the issuance of and to sill bond anticipation
notes in anticipation of the issuance and sale of the serial bonds
herein authorized, including renewals of such notes, is hereby
delegated to the Supervisor of said Town, the chief fiscal officer.
Such notes shall be of such terms, form -and contents, end shall be
sold in such manner, as may be prescribed by said Supervisor,
consistent with the provisions of the Local Finance Law.
Section 4. It is hereby determined that the period of probable
usefulness of the aforesaid. object or purpose is forty years, pursuant
to subdivision 1 of paragrapb.a of Section 11.00 of the Local Finance
Law, provided, however, that such bonds shall mature over a period
not in excess of thirty years. It is hereby further determined that
such bonds will mature over a period in excess of five years.
Section 5. It is hereby further determined that no down payment
is required in connection with the aforesaid object or purpose,
pursuant to the provisions of Section 107.00 of the Local Finance Law.
Section 6. The faith and credit of said Town of Queensbury,
Warren County, New York', are hereby irrevocably pledged for the payment
of the principal of and interest on such bonds as the same become due
and payable. There shall annually be assessed upon all the taxable
real property in said Water District at the same time and in the same
manner as other Town charges, an amount sufficient to pay said
principal and interest as the same become due and payable, but if not
paid from such source, all the taxableCreal proPerty within said
Town shall be subject to the levy of ad valorem taxes without
limitation as to rate or amount sufficient to pay the principal of and
interest on said bonds.

Section 7. The validity of such bonds may be contested only if:
1. Such bonds are suthorized for an object or pu-f'pose for which
said Town is not authorized to _expend money, or
2. The provisions of law which should be complied with at the
date of publication of this 'resolution are not substantially
complied, with,
and an action, suit or proceeding contesting such validity is commenced
within twenty days after the date of such publication, or
3. Such bonds are authorized in violation of the provisions of
the Constitution. °
Section^8. This resolution, which takes effect immediately, shall
be published in 'full in Post Star and Glens Falls Times, together with
a Clerk' s certificate in substantial conformity with Section 81.00 of
the Local Finance Law.
The question of the adoption of the foregoing resolution was duly
put to a vote on roll call, which resulted as follows:

Corporate* Headquarters, located near Philadelphia. The new position is
permanent, and has caused me to change my permanent residence to
Wallingford, Pa.
I've enjoyed knowing you and the Town Board. The Town has
a wonderful future. I believe the Board' s action in authorizing
participation in the "701" Master Plan program was wise. The benefit
of an organized study-of the Town's present and future will become
l very evident in the next 10 years.

It has been a distinct pleasure to have been one of the original
appointees to" the Recreation Commission and to have served as the first
chairman. It was a fruitful experience to be able to work with the
many talented and civic-minded individuals who serve on the Recreation
Commission.
However, I have been extremely interested in the future of our

material spreader, and
WHEREAS, it appears that the bid of State Equipment Company, Albany,
New York, to supply the Town of Queensbury with a new Swenson,
Model EVP-1002 is the lowest responsible bid, therefore be it

be and the same is hereby accepted and approved and that the
Supervisor is hereby authorized and directed to pay the amount of
$2,491.00 to the State Equipment Company upon delivery of the

RESOLVED, that the Tom of Queensbury solicit sealed bids- for highway
salt and that the following notice be published once in the Glens Falls ,
Times and the Post Star on or before November 1, 1965.
NOTICE TO BIDDERS
-- Bernard J. Codner, Superintendent of Highways, Town of Queensbury,

is asking for sealed bids for approximately one hundred tons (100 tons)
moreor less, of grade CC salt, delivered to the Town Storehouse,
Aviation Road, Glens Falls, New York, in 100 lb. bags or in bulk, as
determined by the Superintendent of Highways.
Quality to meet New York Division of Standards and Purchase
requirements.
Bids must include price per ton in 100 lb. bags and price per ton
in bulk and bidder must specify nearest distribution facility from
which shipment to the town will be made.
Bids must be submitted in sealed opaque envelopes plainly marked
".Salt Bid", and there shall be included in such bid the certificate
as to Non collusion required by Section 103d of the General Municipal
Law as the act and deed of such corporation.

RESOLUTION TO AUTHORIZE APPLICATION FOR STATE ASSISTANCE FOR
1' 66 YES ;PROGRAM
RESOLUTION NO. 249, introduced by Mr. Robertson, seconded by

RESOLVED that Supervisor Webster be authorized to apply for State
assistance for matching funds for the YES program, subject to
similar applications being made by ,South Glens Falls and the
City of Glens Falls.

RESOLUTION NO. 250, introduced by Mr. Turner, seconded by Mr. f
Lampson. `
WHEREAS, Robert A. Reid and Margaret F. Reid, his wife, conveyed
to Town of Queensbury a`parcel of land 50 feet in width' for-a
town highway known as Stonewall Drive together'with two additional
small parcels to provide a turn around at the end of Stonewall
Drive as described in said deed dated November 12, 1963, and
recorded in the office of the Warren County Clerk on January 14,
1964, in Book 437 of Deeds at page 433, and
WHEREAS, said Robert A. Reid and Margaret F. Reid, his wife, have
executed a deed, dated October 18, 1965, which conveys to the
Town of Queensbury for highway purposes three parcels which in-
clude an extension of Stonewall Drive beyond the present turn
around, a new road to be known as Reids Lane, and an extension of
Lyndon Drive to connect with Reids Lane, and have tendered said
deed upon condition that the Town of Queensbury convey back to
, tliem_ the two parcels which constitute the present turn around, and —
WHEREAS, it appears to be desirable to complete the loop and
eliminate the dead end and the Planning Board has approved the
acceptance of the highways conveyed by the deed dated October 18,
1965, and the Town Superintendent of Highways has approved the
acceptance of the new highways and the elimination of the turn
around, be it
RESOLVED that the Town of Queensbury accept the said deed from
Robert A. Reid and Margaret F. Reid, his wife, to the Town of
Queensbury as approved by the County Attorney and that the
Town of Queensbury release and convey to Robert A. Reid and
Margaret F. Reid, his wife, the two parcels which are now owned
by the Town of Queensbury for the turn around to be abandoned, and
that the Supervisor be and he hereby is authorized toy execute such
deed on behalf of the Town of Queensbury in form approved by the
County Attorney.

RESOLUTION NO. 251, introduced by Mr. Robertson, seconded by
Mr. Lampson.
WHEREAS, William H. Barber and Celia B. Barber, his wife, by deed
dated July 26, 1946, and recorded in the office of the Warren County
Clerk on the 26th day of November , 1946, in Book 245 of Deeds at
page 176, conveyed to the Town of Queensbury a parcel of land 50 feet
in width for a proposed town highway to be known as Ames Place between
Sherman Avenue and Grant Avenue Extension as shown on.. a map designated
as "Glendale” prepared by Leslie W. Coulter, surveyor, dated
September 1, -1946, and
WHEREAS, Ames Place," as described. in said deed and as shown on said
map, was never laid or used as a town highway, and
WHEREAS, Griffin Lumber Company has acquired title to the lands
between Sherman Avenue and Grant Avenue Extension westerly of
Ames Place as described in said deed and shown on said map and has
prepared a new subdivision map of Glendale whrh provides for the
• relocation of Ames Place as shown on a map prepared by John K. Bright,
Licensed Professional Engineer, entitled "Map of Ames Place", dated
August- 25, 1965, and Griffin Lumber Company proposes to convey to the
Town of Queensbury the parcel of land 50 feet in width from Sherman
Avenue to Grant Avenue Extension as shown on the Map of Ames Place
upon condition that the Town of: Queensbury abandon Ames Place as
conveyed to the Town. by .Barber and convey that parcel to Griffin
Lumber Company, and
WHEREAS, the proposed subdivision to be known as Ames Place and as
shown on the Bright map has been approved by the State Department of
Health and by the Planning Board of the Town of Queensbury, and
WHEREAS, it appears that Ames Place as described in the deed from
-- Barber to the Town of Queensbury is not satisfactory and that the
acceptance of the new location of Ames Place will open up a new area
for development and that it is in the best interests of the Town of
Queensbury to abandon the old right of way for Ames Place aria accept
a deed to relocate Ames Place, be it
RESOLVED that the Town of Queensbury accept from Griffin Lumber Company
a deed, in form approved by the County Attorney, conveying to the
Town of Queensbury the 50 foot parcel from Sherman Avenue to Grant
Avenue Extension in the location shown on the map of Ames Place pre-
pared by John K. Bright, Licensed Professional Engineer, and according
to the description thereof prepared by Coulter & McCormack, surveyors,
as a town highway known as Ames Place, and be it .further
RESOLVED that upon receipt from Griffin Lumber Company of a deed
conveying the aforesaid parcel to the Town of Queensbury, the
Tom Board of the Town of Queensbury, with the approval of the
County Superintendent of Highways and the Town Superintendent of
Highways, abandon as a town highway the parcel conveyed by William H.
Barber and Celia B. Barber, his wife, to the Town of-Queensbury by
said deed dated July 26, 1946, and recorded in the office of the
Warren County Clerk on November 26, 1946, in Book 245 of Deeds at
page 176, and that the Town of Queensbury convey tQ Griffin Lumber
Company the right of way for Ames Place as so conveyed but never laid
out or used, and that the Supervisor be and he hereby is authorized to
execute such deed on behalf of the Town of Queensbury, and be it further

RESOLVED that, prior to the abandonment of the unused right of way
for Ames Place and the conveyance thereof to Griffin Lumber Company
and prior, to the acceptance.of the deed from Griffin Lumber Company
for the right of way for the relocated Ames Place, that Griffin
Lumber Company shall at its expense open up and put to a width and
grade approved by the Town Superintendent of Highways the right of
way for the relocation of Ames Place and that thereafter Ames Place,
as relocated, shall be a town highway and be improved and maintained-
by the Town of Queensbury.
