In response to the decision and order by Justice John Dier (8/25/87) ,
in the matter of your petition to the Supreme Court pursuant to Article
78 of the CPLR, the Town of Queensbury is hereby reinstating your Building
Permit #86-590 to construct a single family dwelling on property located
at Rockhurst Road.
Please be advised that said permit shall expire in about three (3)
months, however, you may request an additional six (6) month extension
at no additional fee, as provided in Article 12 Section 12.072 of the
Queensbury Zoning Ordinance.

RE: DeMarco/Hall property Rockhurst/S.W.O.
As per condition of Stop Work Order, Mr. DeMarco, at his own
option and risk, is permitted to enclose the building to protect
it from the elements. This would include openings such as windows,
doors, exterior walls and roof. In addition to construction, some
type of acceptable covering should be placed over roof sheathing,
_ such as heavy duty poly-plastic (8 mil or better) . No windows or
doors will be installed.
As of Monday, December 8, the roof sheathing was completed
on the main house. Gable ends of exterior walls yet to be
sheathed. No waterproof covering has yet been applied to any
roof area.
Rough grading of the immediate area around foundation was
completed a day or two prior to issuance of the S.W.O. No finish
grading will be done.
The Zoning and Building Codes Department will be closely
monitoring all work done while S.W.O. is in effect or until such
time as final determination of this case is resolved.
