Beswick, County Attorney; made a statement respecting the purpose of the hearing. Frank Hurley, City Attorney, appeared for and representing the City of Glens Falls. The Hon. J. Ward Russell, mayor of the City of Glens Falls, was also present andmade a general statement respecting the application. Frank Hurley, City Attorney, spoke in reference to the application and also read the application. The following people expressed an -opinion respecting the matter, the granting of the application, ad respecting the -area concerned. Gentlemen: The executive committee and the members of Mohican Grange have been happy for many years to cooperate in the program _of elections for the Town of Queensbury. During these years many changes have come about. The old wood fire has given way to automatic oil heat and the voting booth has given way to the voting machine. Several years ago when ,the first five voting machines were stored and. cared for by Mohican Grange the rate for storage was $6.00 per year for each machine, when two more were added, the rate of $10.00 for each machine was established. Now three more machines have been added without extra charge for this year. It is our wish that you consider allowing our grange $10.00 each or total of $100.00 for storage and care of the voting machines annually. Webster, Supervisor Chestnut Ridge Road Glens Falls, New York Dear John: - You asked men to prepare the necessary papers to complete the abandonment of the old town road which used to go across the Glens Falls Country Club parking lot and up through the property of Elizabeth Mannis Swan. Your situation with respect to this road seems to be completely covered by Section 212-2 of the HiEhway Law which provides that when you change the location of a town road and a property owner- gives you land for the relocation, you may by resolution abandon the old road to the abutting owners provided the resolution is approved by the County Superintendent of Highways. I have drafted and enclose the original and copy of resolution which I believe conforms fully with Section 212-a. I suggest that your Town Board adopt this resolution and send. the copy up to !,b% Osborne and ask him to write his approval on the face of the cony and return it to -you. I am sure it would be equally satisfactory if you simply had him write you a letter approving such abandonment. - Bernard Codner spoke to me the ether day about the abandonment of two streets in West Glens Falls where the state has appropriated part of the street in connection with the Northway. The abandonment under u these conditions cannot, I believe, be done under 212-a but probably wi1..1 have to be done under 205 or 207 of the Hihway Law. If it is done under Section 207 then we will have to have the written consent Of the owners of land on both sides of the streets to be abandoned. If one person owned all the land on both sides of the street to be abandoned, then it would be simple, but if there are several owners , we could have a cgmplication. If someone can find out for me just who the owners are I will proceed with the papers for the abandonment of those streets. Yours very truly, Albert E. Resolution No. 131 Mr. Akins introduced Resolution No. 133. and moved its adoption, seconded by Mr. Lampson_ - WHEREAS, the County of Warren has relocated and rebuilt a portion of the county road, sometimes known as the Country Club Road, running from Route 9 easterly to Bay Road, and - WHER EAS , there_ has existed a town highway which left the so-called former Country Club P.cad at the entrance to the Glens Falls Country. Club, passed through the parkin-; area of the Glens Falls Country Club and through lands of Elizabeth Mannis Swan to Glen Lake, and WHEREAS, the Glens Falls Country Club, Inc. and. Elizabeth Mannis Swan conveyed to the Town of Queensbury the necessary lands for the re- location of said former town highway from the relocated county road northerly to the Mannis Road, tihd the former town h.i� twat'— through the F i 4,1 g Country Club parking area is no longer needed. and the ':Town Superinten- dent of Highways has recommended to the Town Board that the same be abandoned, and VFHER.EAS, it is provided by Section 212-a of the Highway Law that where land is given to a town for the relccation of a -toina highway the Town Board may, with the consent of the County Superintendent of High- ways , abandon to the abutting owners such sections of the old road as it existed before the improvements which are of no further use for highway purposes, and that the adoption of a resolution by the Town Board shall be an immediate abandonment without any further or other proceedings, and I V11EP.EAS , Herrick Osborne, County Superintendent of Highways , has consented to the abandonment of said old road, be it i?LSOLVLD that, pursuant to Section 212-a of the Highway Law, the Town of Queensbury abandon as a town highway that portion of the road beginning at the entrance to the Glens Falls Country Club and running through the parking area to and through the lands of Elizabeth Mannis Swan to the joint where said road intersects the town highway known as the Mannis Road , and that the portion of said former town highway runs through the lands of Glens Falls Country Club, Inc. be and the same is hereby abandoned and releaadd to Glens Falls Country Club, Inc. , and that the remainder of said former town highway which runs through the lands of Elizabeth Mannis Swan be and the sane hereby is abandoned and released to Elizabeth Mannis Swan , and that the Supervisor be and he hereby is authorized to execute and deliver to Glens Falls Country Club, Inc.and to Elizabeth Mannis Swan quit claim deeds which will release and convey to them as abutting owners the portions of said former town highway hereby abandoned. FURTHER RESOLVED that the abandonment of town road set forth above shall become effective upon the consent o£ the County Superintendent of Highways to such abandonment. Duly adopted by the following vote: Ayes - Mr. Miller, Mr. Bentley, Mr. Lampson, Mr. Akins and Mr. Webster Noes - none The Town Board generally discussed the proposed abandonment of California Avenue. The Supervisor read a letter from the New York State Employees ' Retirement System relating to retirement and social security. The Supervisor retained the letter, and was to get additional information for the next meeting. The Board generally discussed the adoption of a proposed ordinance relating to notice to be given to the assessors relating to new construction and alteration to present buildings. The proposed ordinance reads as follows: Ordinance Relating to Filing of Reports of New Construction. Be It Enacted and Ordained by the Town Board of the Town of Queens- bury in the County of Warren and State of New York, as follows: Section 1. Declaration of policy. In lieu of the adoption of a complete building code which would require the establishing of standards of construction, the filing of plans and the issuance of a permit for construction of new buildings and structures and the construction of additions to existing buildings and structures , it is the intent of the Town Board by the adoption of this ordinance to require all persons who intend to construct new buildings or structures in the Town of Queensbury to file a report of such intended construction with the Supervisor for the purpose, among other things, of enabling the Town Board and other proper town officials to determine whether such proposed construction will be within the limits of any town 120 hi ay r e or. h in�i of n es bl 'she set back lines a two en �'e tie �oM go�r� o p `an ar�c� rovtt e or zany changes in e is n�, or planned town highways or the extension of water and other facilities where the same are available. Section 2. Definitions The word "person" as used in this ordinance shall include a natural person, a corporation, a club or association `of persons and any firm or partnership and the singular shall include the plural. The words "construct" or "construction" as used in this ordinance shall mean the erection on the site by fabrication from raw materials of any building or structure, the erection of a building on -- ,g a site from prefabricated or preassembled parts , or the erection on 1 the `site of a complete building moved from the place where it was constructed or from another site. The words "building" or "structure" `as used in this ordinance shall mean and include dwellings, hotels , motels, cabins , garages , barns, sheds , trailers , frames, towers, and like improvements. The word "addition" as used in this ordinance means the enlargement of an existing building or structure, and 'the replacement or repair of an existing building or structure shall not be deemed an addition.` The word "owner" as used in this ordinance shall include the holder of the legal title to the land on which such building or structure, or addition to an existing building or structure, is to be built and shall also include a lessee of such land and any person who shall have some right or interest in the land which shall entitle such person to construct a building, structure or addition" thereon. Section 3. Regulation. Any person, who shall intend to construct a building or structure on any land in the Town. of Queensbury or who shall intend to construct an addition to any existing building or structure in the Town of Queensbury, shall file in the office of the Supervisor prior to the commencing of such construction a written notice which shall state the name of the owner of the land on which such construction is to be done, the location of the property by reference to street or highway, the intended use of the building or addition, the distance between puch building and the nearest town highway and whether, t he owner intends to apply to the Tpwn Board of the Town of Queensbury for any change in the location of a town highway or the extension of existing water mains or other town facilities. The Supervisor shall procure and have available at the office of the Supervisor during usual business hours a form of notice for use in complying with the requirements of this ordinance but the Supervisor shall receive and file such notice in the form of a letter or other written statement provided the information required by this ordinance shall be set forth therein. No fee shall be required for the filing of such notice and no permit for such construction shall be required. The preparation and. filing of such notice by a contractor , agent or attorney, acting for the owner shall h a sufficient compliance. Section 4. penalties and enforcement. The construction of a building or structure, or the construction of an addition to an existing building or structure, in the Town of Queensbury without the filing in the office of the Supervisor of the notice required by this ordinance by the owner shall constitute an offense and upon conviction of a violation of this ordinance shall be punishable by a fine not exceeding Twenty-five Dollars for each such offense. The Town Board shall also have the power to apply to a court for an injunction to restrain the owner from violating this ordinance and to compel compliance with this ordinance as provided by,the Town Law. Section 5, Effective Date. This ordinance shall take effect immediately. Resolution for Public Hearing on proposed Ordinance Mr. Akins introduced Resolution No. 132 and moved its adoption, seconded - __ i by Mr. Miller WHEREAS, there has been introduced before the Town Board of the Tovm of Queensbury a proposed ordinance entitled "Ordinance Relating to Filing of Reports of New Construction" which requires notice to the Town Board of the construction of any building or structure or the construction of an addition to any existing building or structure in the Town of Queensbury, be it RESOLVED that the Town Board of the Town of Queensbury hold a public hearing on the proposal of the adoption of said ordinance at the office of the Town Clerk on the 17th day of November, 1960, at 7:30 p.m. o'clock, at which time allpersons interested in the subject matter of said ordinance will. be heard concerning the same, and be it further RESOLVED that the Town Clerk give due notice of such public hearing by publishing such notice in the Glens Falls Times , published. at-- Glens Falls , New York, ' at least ten' days before the date of such hearing.
